ADJOURN Meeting guidelines on reverse side. City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4 -minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. III. APPROVAL OF MINUTES: Mr. Laden made a MOTION to approve the May 10, 2017 Meeting Minutes. Motion was supported by Mr. Masonick. Mr. Stimpson abstained. Motion carried 5 - 0. IV. OPEN MIKE Chair Tralle declared Open Mike at 6:31 p.m. There was no one present for Open Mike. Mr. Root made a MOTION to close Open Mike at 6:31p.m. Motion was supported by Mr. Laden. Motion carried 6 - 0. V. ACTION ITEMS A. Lake Amelia Vistas Comprehensive Plan Amendments Katie Larsen, City Planner, presented the staff report. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 2 The applicant submitted a land use application for PUD Concept Plan and Comprehensive Plan Amendment. The proposed development is a master planned residential community located along CSAH 54/20th Avenue just east of Amelia Lake. The site contains 2 parcels totaling approximately 40 gross acres. The 40 acre site is currently vacant, natural open space. The mix of residential buildings (8 market rate apartments, 10 twin homes buildings and 2 senior assisted living apartments) are located throughout the site. A clubhouse and pool are also proposed. Pedestrian connectivity is provided throughout the development via sidewalks. A linear public park and trail are proposed adjacent to the lake. The development appears to make a conscientious effort to preserve the natural resources by minimizing wetland impacts, providing wetland buffers, protecting significant trees and maintaining the shoreland setback. Application has been withdrawn by the applicant in a letter dated June 12, 2017. Board members had no questions. Chair Tralle opened the floor for informal resident comments at 6:37 p.m. Jim Gondak, 6391 Centerville Road, stated that the Planning Commission has done a wonderful job and thanked the Board. Gary Pinkley, 6351 20th Avenue, stated that he is glad they withdrew the application. When Mr. Pinkley moved to Twin Cities, he was looking for rural feel and spent many years with houses in his backyard and parties next door. The whole reason for coming to Lino Lakes was for the rural feel. Ok with some units, as it wouldn't change the character, but not what was proposed. The proposal would not have fit the character and the feel of the area. Tom Fraser, 6468 20th Avenue, expressed concern regarding the engineering plan about making 20th Avenue to a 4 lane divided road and with 200 unit development in Centerville, traffic has become insane. Mr. Frazier said he has to go north to Centerville to make a left turn. Road is rough and has no shoulders. Street is a weak link. Amy Donlin, 6100 Centerville Road, was crestfallen and worried sick when she heard about this project. Ms. Donlin credits the city for staying with the comprehensive plan and really grateful about the strength of the Comp Plan. A lot of the neighbors are held to the 1 unit per 10 acre. No variances because it is a unique, rural, and beautiful entry into the city. Ms. Donlin stated that she never wants to see it that dense and to keep it consistent with those already there. Ms. Donlin thanked and complimented the Planning and Zoning Board and wants Lino Lakes to keep it as rural as possible for as long as you can. No motion made by the Board. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 3 B. Houle Addition Preliminary Plat Ms. Larsen presented the staff report. The applicant, Guy Houle with GRH Contracting, has submitted a land use application for a preliminary plat. The proposed development is a 1 lot and 1 outlot single family residential subdivision located at the north end of Ruffed Grouse Road. The development contains one 30.72 gross acre parcel and is called Houle Addition. The 30 acre site is a vacant rural parcel containing wetlands, short grasses and woodlands. This parcel has been through several land use proposals. In 2008, Ed Vaughan received preliminary plat (Resolution No. 08-22) and final plat (Resolution No. 08-44) approval for 1 lot and 1 outlot. The final plat was never recorded; therefore, the preliminary plat and final plat are void. In 2004, Mr. Vaughan received PUD Development Stage Plan/Preliminary Plat approval but a PUD Final Plan/Final Plat was never submitted; therefore the PUD Development Stage Plan/Preliminary Plat is void. Staff recommended approval of Preliminary Plat for Houle Addition. Staff addressed questions of the Board. Mr. Root talked about how the cul-de-sac looks now. Mr. Root asked if it is a legal or temporary cul-de-sac now. Ms. Larsen stated that there will be no changes to the cul-de- sac as it is today. Cul-de-sac bulb is within the 60 foot right of way, so no concerns. Emergency services have no concern and have been operating on that road in the past with no problems. Mr. Root asked if the outlot is developable. Ms. Larsen stated that most of the lot is not developable aside from one corner. It would have to go through the full approval process to prove it could be a buildable area. Mr. Root stated that it looks like the road was designed to continue and we are now cutting it off. Ms. Larsen stated that Mr. Vaughn had hoped to extend the road to the island, but it did not happen. Mr. Stoesz asked what happens in terms of insurance on large outlots. Ms. Larsen stated that it is the property they own. Mr. Stoesz asked if outlots pay taxes. Ms. Larsen stated that outlots pay taxes but have a lower assessed value than lots. Mr. Laden asked about making this a conservation easement today. Ms. Larsen stated it is at discretion of the watershed district, not the city's requirement. Easement is done at the request of Rice Creek Watershed District. If Rice Creek requires it then city does as well. Guy Houle, 4417 Channel Lane, approached the Board. Chair Tralle asked Mr. Houle if everything has gone smoothly. Mr. Houle stated it has. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 4 Ron Alwin, Project Engineer, stated the entire project is an outlot, splitting it into a lot and an outlot is going to increase tax revenue of the current outlot. Chair Tralle declared the Public Hearing open at 7:00 p.m. There was no one present to speak. Mr. Laden made a MOTION to close the Public Hearing at 7:00 p.m. Motion was supported by Mr. Stoesz. Motion carried 6 - 0. Mr. Stoesz made a MOTION to recommend approval of Houle addition. Motion was supported by Mr. Stimpson. Motion carried 6 - 0. C. Golden Acre Variance, Preliminary Plat and Final Plat Ms. Larsen presented the staff report. The applicant, Tim Anderson, submitted a land use application for variances, preliminary plat and final plat. The proposed development is a 4 lot single family residential subdivision located at 547 Lois Lane which is legally described as Lot 4, Block 1, Mar Don Acres. The development contains one (1) gross acre parcel and is called Golden Acre. Mar Don Acres was originally platted in 1978. As part of that plat, eight (8) lots were created north of Lois Lane with each lot being 294.00 feet in depth and approximately 165 feet in width for lot sizes of 48,510 sq. ft. Houses were purposely located on the lots in a manner so that the lot could further subdivided when public water and sewer become available. Two other residential subdivisions similar to the proposed Golden Acre have since been approved from these 8 lots, Hailey Manor and Isabell Estates. The 1 acre site is a residential parcel containing a single family house and attached garage. Other than trees and shrubs, there are no significant natural resources on site. The Certificate of Survey indicates a split rail fence along the west side of the property. Staff recommended approval of the Variance, Preliminary Plat and Final Plat for Golden Acre. Staff addressed questions of the Board. Mr. Stimpson asked about the distance from the east side of the property to the lot line. Mr. Stimpson also asked if the lot would be too narrow if it gets parceled out in the future. Ms. Larsen stated that the garage side would only require 5 feet and it should be greater than the required 5 feet. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 5 Mr. Stoesz asked if Lot 1 would be able to put a fence on the left hand side. Ms. Larsen confirmed that they would be able to and that there is no separation requirement between a fence and a house. Tim Anderson (applicant), 547 Lois Lane, confirmed the distance shows 17 feet on the east side of the property. Mr. Laden expressed concerns with the setback. Mr. Anderson said the intent is to have the driveway on the east side to save as many trees as possible and to look aesthetically better. Mr. Laden stated that it is going to put your living space closer to the garage than what the city normally allows. Mr. Anderson stated that they will place the pad as far as possible from the lot line. Mr. Laden asked if the city would want to consider a greater setback, be it a house or garage on lot 2. Mr. Anderson stated that all garages are set on the east so they would not be a concern. Ms. Larsen stated that staff has no concerns with setbacks or garage placement. Ms. Larsen questioned if the Board was suggesting a mandatory 10 foot setback regardless of a house or garage. Mr. Laden stated if it's a garage, it would only have to be 5 feet. Mr. Stimpson supported Mr. Laden's point by saying all homes in Haley Manor have adjacent driveways, this development would be opposite of that. Mr. Anderson stated his driveway is on the east side, as well as the others. Mr. Root clarified that 565, 571, 583 all have different garages to support Mr. Laden's point. Mr. Laden thought that would be more desirable and to maximize the space between the two since we are coming up short. Mr. Anderson stated his intent is to direct the home builder to construct the garage on the east side. Mr. Laden suggested the house be on the east side for greater separation. Ms. Larsen stated we could require 10 feet on lot 2 regardless of if it's a garage or house. Chair Tralle stated that the person who builds the house can decide if it is on the right or left. Chair Tralle declared the Public Hearing open at 7:21 p.m. There was no one present to speak. Mr. Masonick made a MOTION to close the Public Hearing at 7:22 p.m. Motion was supported by Mr. Stoesz. Motion carried 6 - 0. Mr. Evenson made a MOTION to recommend approval of Golden Acre. Motion was supported by Mr. Stoesz. Motion carried 6 - 0. D. Chavez Preserve Variances and Final Plat Ms. Larsen presented the staff report. The applicant, Marcel Eibensteiner with Royal Oaks Realty, Inc., submitted a land use application for two (2) variances and final plat for Chavez Preserve. The proposed development is a 6 lot single family residential subdivision. It contains 1 existing parcel (177 White Pine Road) that is approximately 2.18 gross acres. The variances are for reduced right-of-way and reduced front setbacks. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 6 Staff recommended approval of Variances and Final Plat of Chavez Preserve. Staff addressed questions of the Board. Mr. Stoesz asked why there was a fine for removal of a tree if the tree is going to be replaced. Ms. Larsen stated the ordinance requires a penalty and a replacement. Mr. Evenson asked if the tree removal was done before or after the tree mitigation plan was submitted. Ms. Larsen said yes because it was part of a plan. Mr. Evenson asked when White Pine Road was designed to be a collector road. Ms. Larsen was unsure and that it is included in the 2030 Comprehensive Plan. Mr. Evenson stated it should not be. Ms. Larsen stated that it is a link between east and west but does not have the volume that would require future expansion. Mr. Evenson asked if there is a 30 foot set back because of the variance for the houses on the south. Ms. Larsen stated that the street might not have been designed collector at the time or it was possibly overlooked. Marcel Eibensteiner, applicant, stated that staff did a great job, he is pleased, but the process took a while and was complicated. Mr. Eibensteiner stated that sheds will be down by July 10 and grading will start on July 15. He is, overall, happy with the project. Mr. Laden made a MOTION to recommend approval of Chavez Preserve. Motion was supported by Mr. Evenson. Motion carried 6 - 0. E. NorthPointe 6th Addition Final Plat Ms. Larsen presented the staff report. NorthPointe is a PUD residential subdivision located northeast of the intersection of Birch Street and 20th Avenue South/CSAH 54. The preliminary plat is 94.09 gross acres and consists of a residential density mix of single family lots and an 88 unit senior multi- family residence. The following is a breakdown of unit development: 216 Single Family Units (215 new lots + 1 existing home) 11 Future Single Family Units (future development of existing home) 88 unit multi -family 315 TOTAL UNITS The applicant, Eternity Homes LLC, has submitted a land use application for final plat of NorthPointe 6th Addition. Eternity Homes LLC is purchasing from Tony Emmerich Construction, Inc. Outlot D, NorthPointe 5th Addition and is constructing 15 single family homes on the 50 foot wide lots. Staff recommended approval of the Final Plat of NorthPointe 6th Addition. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 7 Board members had no questions. Mr. Root made a MOTION to recommend approval of NorthPointe 6th Addition. Motion was supported by Mr. Stoesz. Motion carried 6 - 0. VI. DISCUSSION ITEMS A. 2040 Comprehensive Plan Kendra Lindahl, from Landform Professional Services, presented the staff report. Minn. Stat. 473.145 requires the Metropolitan Council (Met Council) to adopt a comprehensive development guide for the metropolitan area. Minn. Stat. 473.175 requires the Met Council to review local government comprehensive plans to determine compatibility with this regional development guide. These plans are developed and updated every 10 years. Our 2040 Comprehensive Plan Update process kicked off at a joint Council/board meeting on May 15, 2017. Representatives from Landform, the City's planning consultant, will be present at the meeting to review the work session results and discuss big picture issues for the update. A public open house is scheduled for Thursday, June 22, 2017. Staff addressed questions of the Board. Mr. Stoesz stated that he was surpised that the City of Shoreview was being listed as a threat. He explained that it is not appropriate to propogate this — neighboring cities are partners, not a threat. Mr. Stoesz requested to take off this comment off the results. Ms. Lindahl stated the point was that other cities are compeititon, not threats but acknowledged that Mr. Stoesz had a fair point. Mr. Stoesz stated the Comprehensive Plan is a PDF and should be more interactive and less cumbersome. Mr. Laden stated that 300 responses does not seem like a lot. Mr. Laden asked what the response rate was to a mail questionnaire last time. Ms. Lindahl stated that last time the survey was done it was by a survey firm. This survey required residents and business owners to take action on their own. Ms. Larsen stated that with SurveyMonkey, multiple people within one house hold could answer the survey. Mr. Laden asked if the City could keep the survey open longer. Ms. Lindahl stated the survey information was included in the postcard and newsletter. More surveys will come up throughout the process. MySidewalk is a tool within the webpage and more of a interactive dialogue. So far only 1 resident has engaged. It is a blog type form and will continue to be ongoing. DRAFT MINUTES Planning & Zoning Board June 14, 2017 Page 8 Chair Tralle asked how we can relay the message to residents that there is a blog available. Staff stated that all the information is located on the City of Lino Lakes website. Chair Tralle asked if there was another way to get the word out and suggested the Quad. Mr. Stoesz suggested the water bill. Ms. Hankee stated that the City did consider the water bill but it does not go to everyone. Mr. Laden asked how big is the Comprehenisve Plan presence on the City's website. Ms. Larsen stated it was significant. Mr. Stoesz asked if it has made the digitial board. Ms. Larsen stated it has not but that is a good idea. Mr. Root asked what comments from the joint Board and Council meeting get put into the Comprehensive Plan. Ms. Lindahl stated a record of the comments and the concepts will be in the plan. Mr. Root stated there were comments against the charter commision and City Council that are devisive and should not refereance specific people. Ms. Lindahl stated they are foundational information to form the plan. But is part of the public record, what are the important issues, but hear you and a reasonable comment. We want this to build a vision and not create angst. Mr. Laden commented on the first general goal of the city and how lengthy it is. Mr. Laden stated that shorter could be too general so he would be ok with the goal being longer. Ms. Lindahl stated that we will go back to that later in the process. Mr. Stoesz asked if other cities have used a better term than 2040 Comprehensive Plan. Ms. Lindahl stated that we can work as a team to make a more broad term for the plan. Ms. Lindahl stated Development Framework is another term that has been used in the past. Ms. Larsen stated that other cities have more of a marketing work play and thought about a tagline. Chair Tralle ask if there was anyway to make changing the plan easier. Ms. Lindahl stated that the process is outlined in the statues and do not have the ability to change that as a city. The City can adopt policies serparte from the Comprehensive Plan and ordiancies that are easier to amend. Chair Tralle commented that the process is tedious. Mr. Evenson asked if notes have been kept over the past 10 years of updating Comprehensive Plans. Ms. Larsen stated that she does not because new scenarios come up. Mr. Evenson asked if there is a list of issues that staff want to address. Ms. Larsen stated that the Comprehensive Plan is too much verbage and staff have some things they would like to see in the plan. Mr. Laden asked if we need to keep moving toward adding more graphics and visuals to the plan. Ms. Larsen stated that pictures and visuals are always nice. Ms. Lindahl stated a story should be told with more visuals with descriptive language and remove repetition and to actively link parts of the plan to avoid those interal conflicts. Mr. Stoesz noted the key should be to have ownership of the roads and to make it more clear for the residents. Mr. Stimpson commented that Lino Lakes has a lot of county roads that are out of control of the city but could be a threat. The county wants to make a road bigger but the city does not want that. Chair Tralle stated that the county roads are in better shape than the city streets. Chair Tralle asked if surveys could be present at the open house. Ms. Lindahl confirmed that there would be surveys available. Mr. Stoesz asked if there was a plan to present to the charter commission. Ms. Larsen stated that it is unknown at this time. B. Project Updates Eagle Liquors retail site, the last building of the Market Place development is under construction. United Properties project is currently being painted. VII. The family owned and operated business has been serving Lino Lakes and surrounding communities since 1996. The business includes retail, office and shop facilities for small engine repair and maintenance. A small concrete ready -mix station is located in the northeast corner. The business currently operates out of 2 buildings with rental equipment and vehicles stored outdoors on site. The vacant commercial parcel to the south is 1.29 acres and legally described as Lot 1, Block 1, Pine Glen. It was platted in 2006 and is currently addressed 7928 Lake Drive. There is an existing stormwater retention pond on the east side. There is a 15 foot trail easement along Lake Drive. The site is relatively flat with no trees, wetlands or other unique features. In addition to purchasing the vacant commercial parcel, the Carlson's obtained a small remnant triangular parcel abutting Lake Drive. The existing parcel, the vacant commercial parcel and the remnant parcel will be combined into one parcel. 2 A residential lot exists immediately to the east (823 Kelly Street) and a new house is currently under construction. Zoning and Land Use The front half of the existing parcel is zoned GB, General Business. The rear half is zoned R -X, Rural Executive. In review of historic zoning maps, since the 1950's, a 300 foot wide corridor along the east side of Lake Drive was zoned commercial. It appears in 1988 with Ordinance No. 01-88, the City revised the zoning map and the rear half of the existing parcel was rezoned to R -X, Rural Executive. Staff is not exactly sure why, but the proposed rezoning will clear up any zoning confusion. The vacant commercial and remnant parcel are zoned GB, General Business. The R -X, Rural Executive portion shall be rezoned to GB, General Business. The applicant has indicated there will be no permanent outside services or sales area. Items that are displayed outside will be brought inside daily. Comments: 1. Outside display items or equipment may only be displayed during business hours on the sidewalks along the west and south side of the building. 2. All items shall be brought inside on a daily basis. The existing two buildings will be demolished. The current access off Lake Drive will be relocated to the north approximately 25 feet. It will be gated and used only for deliveries approximately 2-3 times per month. Two driveways will ingress/egress from Kelly Street. A 1,040 s.f. storage building will be located on the north end of the parcel. The existing concrete ready -mix operation will remain in the northeast corner of the site. The existing stormwater pond on the east side will be expanded and a new infiltration pond will be constructed on the west side along Lake Drive. Seven foot high security and screen fencing are proposed around the site. The parking lot will have curb and gutter and will be bituminous paved. A 15 foot trail easement exists along Lake Drive. This will remain in place but no trail improvements are required with this project. The Site Plan Review Worksheet (attached) provides additional detail related to setbacks and performance standards. The parcel is a corner lot. The front lot line is along Lake Drive. The rear lot line is opposite the front lot line and is the east lot line. The north and south boundary lines are the side lot lines. The total lot size is 95,330 s.f. (2.19 acres) which exceeds the required minimum lot size of 20,000 s.f. In general, the development meets required setbacks, lighting and landscaping except as noted below. Comments: 1. A minimum 6 foot high landscape screen is required along the east property line abutting the residential property. The proposed 7 foot high screen fence needs to be offset from the property line and have plantings on the residential side per Section 1007.043(17)(f). a. Staff suggests the screen fence proposed on the east side of the stormwater pond be removed and the proposed 7 foot security fence on the west side of the stormwater pond be a screen fence. b. The screen fence along the east property line cannot extend closer than 30 feet to the property line along Kelly Street. 2. Security fencing with barb wire must be 8 feet in height. 3. Security fencing with barb wire is not allowed in the front yard (Lake Drive) or along a property line abutting a residential use. 4. The applicant shall evaluate the need for security fencing if there is no longer going to be outdoor storage of rental equipment etc. 5. No additional accessory structures (permanent or temporary) shall be allowed without an amendment to the conditional use permit. 4 6. All driveways and parking lot areas shall be paved. This includes the north portion of the development near the accessory storage building. 7. A minimum 5 foot wide sidewalk shall be installed along the west and south elevations of the building. 8. Trash enclosure shall be located on the north side of the main building as far from the residential property as possible. 9. Gate on trash enclosure cannot be chain link and shall be a minimum of 80% opaqueness. 10. Sheet A1.1 shows the accessory storage building as 40 ft x 25 ft (1,000 s.f.) but the detailed specifications indicate 40 ft x 26 ft (1,040 s.f.). Plans shall be revised accordingly. Architectural Plans and Exterior Building Materials The main building is approximately 24 feet in height. The 7,700 s.f. lower level consists of a display area, shop area and warehouse. The 1,440 s.f. upper level has offices, conference rooms and a breakroom. Exterior materials include brick, pre -colored concrete block, precast concrete stone, EFIS and glass. The materials and percentages meet performance standards. The accessory storage building is 26 feet wide x 40 feet long (1,040 s.f.) and 17 feet in height. The accessory structure exceeds the allowed 400 s.f. for commercial properties; however, the Planned Unit Development allows for multiple buildings without restrictions to size. The accessory structure has a gable trussed roof and residential steel siding. Exterior material colors are beige siding with bronze trim. A 40 inch wainscot steel siding is proposed. Section 1007.043(2)(d)2 states that exterior wall surfaces may be a combination of materials including brick, stucco, EFIS (exterior finish insulation system), textured, colored or decoratively finished pre -cast or poured -in-place concrete panel, textured concrete masonry units, natural stone, manufactured stone, transparent, tinted or low - reflective glass, or decorative metal cladding. The proposed lap residential steel siding on the accessory storage building is allowed through the flexibility of the Planned Unit Development. The base of the building shall be brick to match the main building. Comments: 1. Sheet A2.1 shall include the square footage of each area on the plan sheet. 2. Sheet A3.1: a. Exterior material square footage and percent shall be included on plan sheet. b. Height of building and accessory storage building and measurements shall be included on plan sheet. c. Mechanical equipment location and screening details shall be provided. d. The east and west elevations shall be properly labeled. 3. Accessory Storage Building: 5 a. The 40 inch wainscot base shall be brick to match the main building. 4. A color and material palette for both the principal and accessory storage building shall be provided. Grading Plan and Stormwater Management The existing retention pond on the east side of the site was constructed in 2005 with the Pine Glen development. This pond is being expanded to accommodate the new development. A new infiltration pond is also being constructed on the west side of the site. Comments: 1. Sheet CO Site, Grading and Drainage Plan: a. Trail easement along Lake Drive shall be shown to provide adequate room for a future trail. b. Plan shall clearly show all parking lot areas, driveways and drive aisles as paved bituminous or concrete surface. Public Utilities The existing building at 7932 Lake Drive is on private well and septic system. The utility plan notes services to be abandoned at property line. The new facility will be municipally served by an 8" PVC sanitary sewer and a 12" DIP watermain located along Kelly Street. Comments: 1. The private well shall be properly sealed unless it is going to be used for irrigation. 2. The septic system shall be property abandoned. Landscaping and Tree Preservation Plan Canopy cover calculations have been provided indicating 17 large trees are required. The landscape plan shows 16 large trees and 5 medium trees that satisfy the requirements. However, it does not appear the Vehicle Hardscape area includes the drive lanes on the north portion of the property that are required to be paved. The canopy cover calculations shall be revised. Foundation plantings are shown on Plan Sheet LS 1.2. The calculations provided indicate 8 trees and 24 shrubs are required; however, only the linear feet of the facades facing Lake Drive and Kelly Street shall be calculated. The foundation landscape calculations shall be revised. Open area calculations indicate 9,140 s.f. of open area; however, it is not clear what area is being calculated. 6 Section 1007.043 (17)(f) requires a minimum 6 foot landscape screen and/or fence between any development and any less intense residential land use. A minimum 7 foot high screen fence is required along the east property line including shrub and tree cover for 50% of the wall or fence on the exterior side. Due to the existing stormwater pond on the east side, if a fence and required landscaping cannot fit along the property line, it may be possible to put the fence and landscaping on the west side of the pond. Section 1007.043 (17)(f) also requires landscape screening between a parking lot and public right of way. This shall be required along both Lake Drive and Kelly Street. The plan sheet only indicates a berm along Kelly Street. Comments: 1. Sheet LS1.1 and LS1.2 Landscape Plan: a. All calculations shall be shown on the plan set. b. Canopy Coverage: i. The chart from Section 1007.043(17)(c)3 shall be completed and shown on plan sheet. ii. Vehicle Hardscape area shall include required paved drive lanes on north portion of property. c. Foundation Landscape: i. The chart from Site Plan Worksheet shall be completed and shown Plan Sheet LS1.2. ii. Size (small, medium, large) of each tree and shrub shall be indicated. d. Open Area Standards: 1. Sheet LS1.1 shall clearly indicate the area being calculated as open area and the trees and shrubs counted towards compliance. e. Buffer and Screen Standards: i. Plan Sheet A1.1 and LS1.1 shall be revised to include a fence and landscaping in compliance with Section 1007.043(17)(f). ii. A landscape buffer shall be provided along the parking lots along both Lake Drive and Kelly Street. 2. Irrigation is required for all grass and landscaped areas. 3. Details and cross sections are required for all proposed landscape berms. 4. Seed mix details are required for stormwater ponds. Signage A separate Sign Permit Application shall be required for all walls signs and monument signs. Impervious Surface Coverage 7 The allowed impervious surface coverage is 75% for GB, General Business. The proposed 64% is compliant. Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by the construction of stormwater management BMP's such as curb, gutter and retention and infiltration basins. Land Use Plan The Comprehensive Plan guides this property for commercial use. The proposed All Seasons Rental is a retail rental equipment business and is consistent with commercial land use. Housing Plan The goals and policies of Housing Plan are not negatively impacted by All Seasons Rental development. Landscape buffers and screens will be required adjacent to the residential development to the east. Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible and to reduce unnecessary traffic. All Seasons Rental does not change the level of service along CSAH 23/Lake Drive or Kelly Street. Delivery vehicles will egress/ingress onto CSAH 23/Lake Drive. Customer traffic will egress/ingress onto Kelly Street then immediately onto CSAH 23/Lake Drive. CSAH 23/Lake Drive is an "A" minor reliever road and has capacity to handle existing traffic volumes created by the development. Sanitary Sewer and Water Supply Plan The existing building at 7932 Lake Drive is on private well and septic system. The new facility will be served by an 8" PVC sanitary sewer and a 12" DIP watermain located along Kelly Street. Sanitary Sewer and Water Supply Plan The existing building at 7932 Lake Drive is on private well and septic system. The new facility will be served by an 8" PVC sanitary sewer and a 12" DIP watermain located along Kelly Street. The existing sanitary sewer and water supply system have capacity for the new development. 8 Subdivision Ordinance The development is a combination of 3 parcels. The existing north parcel is unplatted and has a metes and bounds legal description. The vacant south parcel is platted and legally described as Lot 1, Block 1, Pine Glen. The third parcel is a remnant parcel along Lake Drive. The parcels will be combined via plat to provide clear title and dedicate required easements. The name of the plat is SS Properties Addition. Conformity with the Comprehensive Plan and Zoning Code The preliminary plat is consistent with the comprehensive plan for commercial development and zoning code requirements for GB, General Business as discussed above. Blocks and Lots The proposed preliminary plat contains Lot 1, Block 1, SS Properties Addition. There are no outlots. Streets and Alleys The front lot line is along CSAH 23/Lake Drive. The south lot line is along Kelly Street. No street improvements are required. Easements Standard drainage and utility easements at least 10 feet wide have been provided along all lot lines. Easements are also provided over both stormwater management facilities. A 15 foot trail easement exists along CSAH 23/Lake Drive. This will remain in place although no trail improvements are required at this time. There are existing drainage and utility easements along the lot lines of Lot 1, Block 1, Pine Glen. These easements will be vacated and dedicated on the final plat of SS Properties Addition. The easement vacation will be processed with the final plat application. Public Land Dedication Commercial park dedication fees for Lot 1, Block 1, Pine Glen were paid in 2005 with that development. No additional park dedication fees are required. Wetlands There are no wetlands on site. 9 Floodplain There are no floodplains located on site. Anoka County Highway Department Staff has distributed materials to Anoka County Highway Department and is waiting their comments. Environmental Board The Environmental Board will review and comment on the development at their July 28, 2017 meeting. The Environmental Coordinator notes that the owner will submit design plans for the concrete mix devices to collect concrete mix spillage and a washout collection area. Stormwater Maintenance Agreement A Stormwater Maintenance Agreement is required. Development Agreement A Development Agreement is required. Conditional Use Permits Per Section 1007.112(8) of the GB, General Business District, two (2) conditional use permits are required for this project: (j) Planned unit development — commercial including shopping centers regulated by § 1007.024 of this Ordinance. The development proposes a 7,740 s.f. principal commercial building and a 1,040 s.f. accessory storage building. Commercially zoned districts are only allowed one (1) 400 s.f. accessory structure. A Conditional Use Permit for a commercial Planned Unit Development would allow for the larger 1,040 s.f. accessory storage building to securely store rental equipment and eliminate the need for excess outdoor storage. (m) Small engine and boat repair. All Seasons Rental provides small engine repair services for lawn mowers, snow blowers, tune ups, etc. The conditional use permit requirements are further detailed under Findings of Fact. 10 Findings of Fact Rezoning The front half of the existing parcel is zoned GB, General Business. The rear half is zoned R -X, Rural Executive. This rear half portion shall be rezoned to GB, General Business. Per Section 1007.015(5), the Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgement shall be based upon, but not limited to, the following factors: (a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. All Seasons Rental is consistent with the official City Comprehensive Plan. The parcels are guided commercial and the retail rental business is consistent with that land use. The development is also consistent with the goals and policies of the comprehensive plan in regards to resource management, transportation, utilities and local water management plan. (b) The proposed use is or will be compatible with present and future land uses of the area. All Seasons Rental is compatible with present and future land uses of the area. Land uses surrounding the subject site are guided for commercial development, mixed use and residential. (c) The proposed use conforms with all performance standards contained herein. All Seasons Rental conforms with all performance standards with some minor revisions as detailed in this staff report. (d) The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. All Seasons Rental can be accommodated with existing public services. The new facility will be served by an 8" PVC sanitary sewer and a 12" DIP watermain located along Kelly Street. The proposed commercial building will not overburden the City's service capacity for either water or sanitary sewer. (e) Traffic generation by the proposed use is within capabilities of streets serving the property. 11 Traffic generated by All Seasons Rental is within capabilities of the streets serving the property. CSAH 23/Lake Drive is a minor arterial reliever street. Kelly Street is a local street. Preliminary Plat Per Section 1001.013, Premature Subdivision: (1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to the following criteria shall be denied by the City Council. (2) Conditions for establishing a premature subdivision. A subdivision may be deemed premature should any of the following conditions not be met. (a) Consistency with the Comprehensive Plan. Including any of the following: 1. Land use plan; 2. Transportation plan; 3. Utility (sewer and water) plans; 4. Local water management plan; 5. Capital improvement plan; and 6. Growth management policies, including MUSA allocation criteria. All Seasons Rental is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and utilities. The development is also consistent with the local water management plan, capital improvement plans and growth management policies. (b) Consistency with infill policies. A proposed urban subdivision shall meet the city's infill policies: 1. The urban subdivision must be located within the Metropolitan Urban Service Area (MUSA) or the staged growth area as established by the city's Comprehensive Plan; 2. The cost of utilities and street extensions must be covered by one or more of the following: a. An immediate assessment to the proposed subdivision; b. One hundred percent of the street and utility costs are privately financed by the developer; c. The cost of regional and/or oversized trunk utility lines can be financed with available city trunk funds; and d. The cost and timing of the expenditure of city funds are consistent with the city's capital improvement plan. 3. The cost, operation and maintenance of the utility system are consistent with the normal costs as projected by the water and sewer rate study; and 4. The developer payments will offset additional costs of utility installation or future operation and maintenance. 12 All Seasons Rental is consistent with infill policies. The development is within the current Utility Staging Area 1A=2008-2015. No new utility or street extensions are required. The cost, operation and maintenance of the utility system is consistent with the normal costs projected by the water and sanitary system plans. No future utility costs are proposed. (c) Roads or highways to serve the subdivision. A proposed subdivision shall meet the following requirements for level of service (LOS), as defined by the Highway Capacity Manual: 1. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade; 2. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C; 3. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D; 4. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better; 5. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies; 6. The traffic generated from a proposed subdivision shall not require city street improvements that are inconsistent with the Lino Lakes capital improvement plan. However, the city may, at its discretion, consider developer -financed improvements to correct any street deficiencies; 7. The LOS requirements in divisions (2)(c)1. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At city discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Department of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange; and 8. The city does not relinquish any rights of local determination. All Seasons Rental meets the requirements for level of service (LOS). Traffic generated by All Seasons Rental is within capabilities of the streets serving the property. CSAH 23/Lake Drive is a minor arterial reliever street. Kelly Street is a local street. The existing roads and intersections providing access to the development have structural capacity to accommodate the projected traffic from one new single family home. No street improvements are proposed that are inconsistent with the City's capital improvement plan. The city does not relinquish any rights of local determination. 13 (d) Water supply. A proposed subdivision shall be deemed to have an adequate water supply when: 1. The city water system has adequate wells, storage or pipe capacity to serve the subdivision; 2. The water utility extension is consistent with the Lino Lakes water plan and offers the opportunity for water main looping to serve the urban subdivision; 3. The extension of water mains will provide adequate water pressure for personal use and fire protection; and 4. The rural subdivision can demonstrate that each of the proposed lots can be provided with a potable water supply. All Seasons Rental will have an adequate water supply. A 12" DIP watermain along Kelly Street will serve the development. The City's water system has capacity to accommodate the commercial development. (e) Waste disposal systems. A proposed subdivision shall be served with adequate waste disposal systems when: 1. The urban sewered subdivision is located inside the city's MUSA or is consistent with the MUSA allocation criteria; 2. The city has sufficient MUSA and pipe capacity to serve the subdivision if developed to its maximum density; 3. The subdivision will result in a sewer extension consistent with Lino Lakes sewer plan and capital improvement plan; 4. A rural subdivision can demonstrate that each lot can be served by an adequate sanitary sewer disposal system; and 5. A rural subdivision with a proposed communal sanitary sewer or water system has an effective long range management and maintenance program with proper financing. All Seasons Rental will be served with an adequate waste disposal system. The development is within the current Utility Staging Area 1A=2008-2015 and will be served by an 8" PVC sewer main along Kelly Street. The sanitary sewer system has capacity to accommodate the commercial development. Conditional Use Permits The property is zoned GB, General Business and allows for multiple buildings and small engine repair with two (2) conditional use permits. The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: 1. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: 14 a. Land Use Plan. b. Transportation Plan. c. Utility (Sewer and Water) Plans. d. Local Water Management Plan. e. Capital Improvement Plan. f. Policy Plan. g. Natural Environment Plan. All Seasons Rental is consistent with the official City Comprehensive Plan. The parcels are guided commercial and the retail rental business is consistent with that land use. The development is also consistent with the goals and policies of the comprehensive plan in regards to resource management, transportation, utilities and local water management plan. 2. The proposed development application is compatible with present and future land uses of the area. All Seasons Rental is compatible with present and future land uses of the area. Land uses surrounding the subject site are guided for commercial development, mixed use and residential. 3. The proposed development application conforms to performance standards herein and other applicable City Codes. All Seasons Rental conforms will all performance standards as detailed in this staff report. 4. Traffic generated by a proposed development application is within the capabilities of the City when: a. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. b. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. c. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. 15 d. All Seasons Rental will have an adequate water supply. A 12" DIP watermain along Kelly Street will serve the development. The City's water system has capacity to accommodate the commercial development. 6. The proposed development shall be served with an adequate and safe sanitary sewer system. All Seasons Rental will be served with an adequate waste disposal system. The development is within the current Utility Staging Area 1A=2008-2015 and will be served by an 8" PVC sewer main along Kelly Street. The sanitary sewer system has capacity to accommodate the commercial development. 16 7. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. No City funds are being expended on this project. 8. The proposed development will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. All Seasons Rental is an allowed use within the GB, General Business District with an approved conditional use permit. The project will not generate excessive traffic, noise, smoke, fumes, glare or odors. 9. The proposed development will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. There are no natural, scenic or historic features on the existing site. Specific Conditional Use Permit (CUP) Requirements In addition to the administrative requirements of a conditional use permit, the following specific performance standards must also be met: (j) Planned unit development — commercial including shopping centers regulated by § 1007.024 of this Ordinance Per Section 1007.024(5) Commercial or Industrial Planned Unit Development, CUP Requirements. (a) Purpose. It is the intent of this section to further the directives of § 1007.001 and establish special requirements for the granting of a conditional use permit to allow flexibility from the strict provisions of this Ordinance in regard to multiple buildings, shared access/ parking, parking supply reductions, internal setbacks, etc. The development proposes a 7,740 sf. principal commercial building and a 1,040 sf. accessory storage building. Commercially zoned districts are only allowed one (1) 400 s accessory structure. A Conditional Use Permit for a commercial Planned Unit Development would allow for the larger 1,040 s accessory storage building to securely store rental equipment and eliminate the need for excess outdoor storage. (b) Standards. 1. Open Space. 17 a. The PUD design will result in greater landscaped pervious area than the base zoning district standard. The GB, General Business District allows for 75% impervious surface coverage. The new development proposes only 64% impervious surface coverage. The open space is landscaped with sod, trees and/or shrubs. b. The PUD design will result in the protection of important natural features (e.g., wetlands, significant trees, water courses, slopes over twelve (12) percent). There are no important natural features on site. c. The PUD design will include extensive landscaping with an emphasis on streetscape, site entrances, and the perimeter of the building. The landscape plan provides canopy cover, open space and foundation plantings along Lake Drive, Kelly Street and around the perimeter of the building. 2. Architectural Guidelines. Commercial and industrial buildings shall comply with design standards of § 1007.043 (2)(d) of this Ordinance. As detailed in the staff report and Site Plan Review Worksheet, the main commercial building complies with the design standards. The accessory storage building will be allowed to have lap residential steel siding with a defined brick base per Planned Unit Development flexibility. (m) Small engine and boat repair provided that: 1. The lighting shall be accomplished in such a way as to have no direct source of light visible from adjacent land in residential use or from the public right-of- way and shall be in compliance with § 1007.043 (6) of this Ordinance. A photometric plan has been submitted but revisions are required to verify compliance. 2. At the boundaries of a residential district, a strip of not less than five (5) feet shall be landscaped and screened in compliance with §1007.043 (17) of this Ordinance. A 30-40 foot landscape strip and buffer are provided along the east property line abutting the residential district. 3. Vehicular access points shall create a minimum of conflict with through traffic movement and shall comply with § 1007.044 of this Ordinance and shall be subject to the approval of the City Engineer. 18 All Seasons Rental does not change the level of service along CSAH 23/Lake Drive or Kelly Street. Delivery vehicles will egress/ingress onto CSAH 23/Lake Drive. Customer traffic will egress/ingress onto Kelly Street then immediately onto CSAH 23/Lake Drive. CSAH 23/Lake Drive is an "A" minor reliever road and has capacity to handle existing traffic volumes created by the development. 4. Provisions are made to control and reduce noise. A 30-40 foot landscape strip and buffer are provided along the east property line abutting the residential district. 5. No outside storage, repair or sales except in compliance with §1007.112 (7)(f) or §1007.112 (8)(i) of this Ordinance shall be allowed. There will be no permanent outside storage, repair or sales. Outside display items or equipment may only be displayed during business hours on the sidewalks along the west and south side of the building. All items shall be brought inside on a daily basis. 6. All conditions pertaining to a specific site are subject to change when the Council, upon investigation in relation to a formal request, finds that the general welfare and public betterment can be served as well or better by modifying the conditions. An amendment to the conditional use permit shall be required for modifications to the site and development plans. RECOMMENDATION Staff recommends approval of the preliminary plat, rezoning and conditional use permits for All Seasons Rental with the following conditions: 1. All comments from the City Engineer letter dated July 6, 2017 shall be addressed. 2. All comments from the July 26, 2017 Environmental Board meeting shall be addressed. 3. A Drainage and Utility Easement Vacation Exhibit with legal description shall be submitted with the final plat application. 4. Merchandise and/or equipment may only be displayed outside during business hours on the sidewalks along the west and south side of the building. 5. All merchandise and/or equipment shall be brought inside on a daily basis. 6. Sheet A1.1 Site Development Plan: a. A minimum 6 foot high landscape screen is required along the east property line abutting the residential property. The proposed 7 foot high screen fence needs to be offset from the property line and have plantings on the residential side per Section 1007.043(17)(f). i. Staff suggests the screen fence proposed on the east side of the stormwater pond be removed and the proposed 7 foot security fence on the west side of the stormwater pond be a screen fence. 19 ii. The screen fence along the east property line cannot extend closer than 30 feet to the property line along Kelly Street. b. Security fencing with barb wire must be 8 feet in height. c. Security fencing with barb wire is not allowed in the front yard (Lake Drive) or along a property line abutting a residential use. d. The applicant shall evaluate the need for security fencing if there is no longer going to be outdoor storage of rental equipment etc. e. No additional accessory structures (permanent or temporary) shall be allowed without an amendment to the conditional use permit. f. All driveways and parking lot areas shall be paved. This includes the north portion of the development near the accessory storage building. g. A minimum 5 foot wide sidewalk shall be installed along the west and south elevations of the building. a. Trash enclosure shall be located on the north side of the main building as far from the residential property as possible. h. Gate on trash enclosure cannot be chain link and shall be a minimum of 80% opaqueness. i. Details for gates along Lake Drive and along sides of building shall be provided. j. Plan sheet shows the accessory storage building as 40 ft x 25 ft (1,000 s.f.) but the detailed specifications indicate 40 ft x 26 ft (1,040 s.f.). Plans shall be revised accordingly. 7. Sheet A2.1 Floor Plan: a. Plan sheet shall include the square footage of each area on the plan sheet. 8. Sheet A3.1 Elevations: a. Exterior material square footage and percent shall be included on plan sheet. b. Height of building and accessory storage building and measurements shall be included on plan sheet. c. Mechanical equipment location and screening details shall be provided. d. The east and west elevations shall be properly labeled. 9. Accessory Storage Building: a. The 40 inch wainscot base shall be brick to match the main building. 10. A color and material palette for both the principal and accessory structure shall be provided. 11. Sheet CO Site, Grading and Drainage Plan: a. Trail easement along Lake Drive shall be shown to provide adequate room for a future trail. b. Plan shall clearly show all parking lot areas, driveways and drive aisles as paved bituminous or concrete surface. 12. Sheet Cl Utility Plan: a. The private well shall be properly sealed unless it is going to be used for irrigation. b. The septic system shall be property abandoned. 13. Sheet LS 1.1 and LS 1.2 Landscape Plan: a. Erosion control measures shown include silt fence along Lake Drive. Comments: 1. Provide construction entrances at all access points. 3. Show location for temporary/permanent erosion control measures on the plans. 4. Silt fence required around the entire perimeter of the site. 5. The site drainage is split east/west at the front entrance of the proposed building. The easterly drainage area sheet flows to a catchbasin along the easterly curb line and discharges to the expanded storm pond. The westerly drainage area sheet flows to a rain guardian structure along the westerly curb line and discharges to the proposed infiltration pond. Existing surface drainage from Lake Drive is conveyed along a ditch that discharges into a parallel storm sewer system in Lake Drive. Comments: 1. City's required minimum diameter storm pipe size is 15". Revise discharge pipe size and flared end section from CB 1. Provide invert elevation for FES. 2. Detail the removal of existing storm sewer and construction of STM MH 2 over the existing storm sewer pipe. 3. A cross section of the proposed infiltration pond showing depths and materials used is required. 4. Infiltration test upon completion of the infiltration pond construction will be required. 5. Correct the total impervious area discrepancies: i. The narrative states the total impervious area is 1.40 acres ii. The proposed HydroCAD model states the total impervious area is 1.45 acres b. Verify enough water will reach the infiltration basin as the applicant must infiltrate 1.1 -inches over the impervious surface of the site in 48 hours or less. i. If the total impervious area of the site is 1.45 acres, the applicant would need to infiltrate 0.133 acre-feet: ii. Subcatchment B in the HydroCAD model only generates 0.091 of of runoff in the 2 -year event, not enough to meet the required infiltration volume. c. Lower the overland flow outlet elevation for the infiltration basin to insure it draws down in 48 hours. i. For the infiltration basin to draw down within 48 hours, the basin may only be 1.8 feet deep. d. The infiltration basin has sufficient capacity to meet the volume control requirements. The surface area of the infiltration basin is approximate 4,180 square feet. e. Include the existing contours of the ditch with labels to better define the grading of the infiltration basin. f. Add a defined overland flow section to the 908.0 -foot berm. i. This will double as an infiltration depth control to insure the pond draws down in 48 hours. g. Include the following notes in the plan for the infiltration basin: i. Install all temporary erosion control measures prior to the start of any construction operation that may cause any sedimentation or siltation at the site ii. The infiltration may not be used as a temporary sediment basin during constructions. iii. If sediment is introduced into the infiltration system during or immediately following excavation, this material must be removed within 24 hours. iv. Ensure all critical elevation are correct (including, but not limited, to top of media and inverts of overflows). v. Seeding and installation of erosion control blanket shall be completed within 48 of final grading on the infiltration system. vi. Do not remove temporary erosion control devices until after contributing drainage area is adequately vegetated. The proposed All Seasons Rental development is to be served by municipal sanitary sewer. An 8" PVC trunk sanitary sewer line with a 6" PVC sanitary sewer service stub was constructed within the Kelly Street right of way as part of the Pine Glen development. A 6" PVC sanitary service extension with a cleanout is proposed. Comments: 1. Sanitary sewer services to be Schedule 40 pipe. 2. The existing septic system must be properly abandoned/removed. 3. The existing sanitary sewer service along Lake Drive must be removed to the trunk sewer main. • Transportation The All Seasons Rental site proposes the creation of two access points on Kelly Street along with the relocation of the existing access drive off of Lake Drive. No additional right of way or public streets are proposed. Due to All Seasons Rental being an existing business at this location, no level of service increase along Lake Drive (CSAH 23) or Kelly Street is anticipated. Comments: 1. Review and approval by the Anoka County Highway Department of the realigned CSAH 23 access drive for the All Seasons Rental development will be required. • Floodplain Floodplain is not present on the All Seasons Rental development site. Topics for the July 12 meeting are: Results of June 22, 2017 Open House—Approximately 40 citizens attended the Open House. A summary report is attached. Results of Community Survey—The online survey was closed on June 23, 2017 and had 476 respondents. A report summarizing the results is attached. Potential Land Use Study Areas and Land Use Issues—Staff has identified a preliminary list of land use study areas. These are specific locations that should be reviewed as part of the Land Use Plan update. Several landowners also have requested that the City consider specific changes to the status of their property. Possible changes might include the future land use designations or utility staging. Attached is a table listing potential land use study areas, along with a map showing the areas by planning district. The table includes some data about each area (size, current planning status, utility staging) and a bullet list of issues or questions. For each study area, we have also provided a more detailed map with the 2030 Land Use Plan and an aerial photo with the GIS wetland layer. For Area 1-A, some additional materials are provided (an excerpt of the 2007 Master Planning Study for Hodgson Road & CRJ.) It is not necessary for the Board to make decisions about the study areas at the July 12th meeting. The Board should discuss the following questions: • Should study areas be added? • Should any of the study areas be deleted? • Are there additional concerns or issues for each area? • What additional information is needed to help the City make planning decisions for each area? The last page of the table lists three general land use planning issues identified by staff. For this and future meetings, the starting time will change from 6:30 p.m. to 6:00 p.m. The time from 6:00 p.m. to 7:30 p.m. will be reserved for the Comprehensive Plan Update, with the regular business meeting starting at 7:30. Make sure Safe Routes to School is full, built out. Expand trail system to create a network connecting neighborhoods with retail & civic entities. The county needs to meet our local needs. Lake Drive between 35W and Main St. needs attention. Slower. Crosswalks. Mixed use paths. • Continue efforts to reduce traffic on Birch St. • Please fix 4th Street. • Intersection improve! CSA 21 Backups (near Ash Street) • Elmcrest/ Speed limit on Bald Eagle. Open House Feedback Results 3 June 22, 2017 f I f (INCA KES 2040 COMP PLAN Lino Lakes 2040 Comprehensive Plan Update Lino Lakes Community Visioning Survey The Community Visioning Survey was conducted from May 15th through June 23rd, 2017 using the online survey site "Survey Monkey." Participants were invited to respond through the City's website, a postcard and a newsletter mailed to all residents and businesses, and at the June 22nd Open House. Paper survey forms s were made available to residents unable to respond online. Many of the questions were open ended, with up to three responses allowed from each participant. This report summarizes the results and identifies key themes found in a review of hundreds of responses. The "word clouds" help visualize the most common words used in the answers to the questions. The Master Plan is intended to establish a general land use design with some specifics, such as road alignments, access points, and specified important design elements. It is not intended to drive out existing businesses. The Master Plan does not mandate the exact site layout or specific uses of individual parcels. However, because infrastructure design is the driving force of the study, individual parcel design must take into account the infrastructure needs for the larger study area. In addition, the plan specifies some fundamental design elements in specified locations to provide a common framework for all development in the area. Both the Master Plan drawing and the accompanying Planning and Development Requirements should be considered together to guide decisions on development. While recognizing the importance of the Land Use Map, it's important to acknowledge the realities of land development. Future development may involve assembling several land parcels. Site layouts may need some flexibility to ensure efficient design and safety, especially internal circulation. In addition, natural features don't follow linear property boundaries. Because of these and other factors, the actual boundaries on the Proposed Land Use Map should be considered somewhat flexible in order to accommodate development or redevelopment proposals within the study area. The Master Plan includes important amendments to the Proposed Land Use Map in the 2002 Comprehensive Plan. The Land Use Map is the guide for development in the city and the study area should develop with the land uses as shown on the map. Mixed use development is becoming more and more common, and the Hodgson/CR J area is a good location for it. The west side of Hodgson already is guided Mixed Use. The Master Plan recommends that the east side area currently guided Commercial be amended to Mixed Use. This would allow for, though not mandate, the inclusion of residential units, possibly in multi -story buildings. This would provide customers for the commercial development, and the commercial services would be convenient to the residents. There are a few specific locations that deserve attention from the perspective of the Proposed Land Use Map in the Comprehensive Plan and the zoning map. These minor inconsistencies should be addressed with the amendment of the Land Use Map. In the extreme southwest corner of the study area is a parcel forming a narrow strip that runs northwest/southeast. This parcel is guided for residential land use but zoned General Business. The narrow strip is not useable by itself and must be incorporated into the redevelopment of the abutting property. The land use map should be amended to include this piece in the Mixed Use land use category. The General Business zoning is appropriate. On the north edge of the study area, a parcel between Hodgson and Ware Roads is guided Commercial on the Hodgson side but the area east of the wetland is guided for Medium Density Residential. As noted above, the western portion should be guided Mixed Use. The specifics of the site—especially a wetland delineation—likely will determine how far Hodgson/CR J Master Plan page 31 EXCERPT, Hodgson Road & CRJ Master Plan Approved February, 2007 commercial development will extend east. Allowing for a flexible edge of the land uses, as recommended above, will allow a design that is sensitive to the natural resources. The zoning should remain General Business. Any future development review will examine rezoning needs. On the Ware Road side of the study area, a parcel is guided both Medium Density Residential and Low Density Sewered Residential. How or even if development will occur there is unknown. For consistency, the entire parcel should be guided Medium Density. The Rural zoning is appropriate. Any future development review will examine rezoning needs. Planning and Development Requirements General • This Master Plan is to be incorporated into the Lino Lakes Comprehensive Plan with an amendment of the Comprehensive Plan. This includes amendments to the Proposed Land Use Map: the area east of Hodgson Road should be designated Mixed Use instead of Commercial. Minor inconsistencies in the Proposed Land Use Map should be corrected as well, and zoning amendments should follow if and when appropriate . • The land use boundaries on the Proposed Land Use Map should be considered somewhat flexible in order to accommodate natural features, land assembly and other physical issues. • Rezoning as part of new development applications will be examined for consistency with the Comprehensive Plan and this 49/J Master Plan. • The Master Plan is the guiding plan for development in the area. The Master Plan is intended to show a general land use arrangement with some specific design elements. The individual site layouts and uses are to be determined as part of the development review process, but should be based on the Master Plan, including specific elements noted below. • Tax increment financing and tax abatement on qualifying properties should be considered potential tools for implementing the Master Plan. Transportation and Access • Accesses to Hodgson Road and Co. Rd. J are to be located at the points indicated on the Master Plan. Hodgson/CR J Master Plan page 32 EXCERPT, Hodgson Road & CRJ Master Plan Approved February, 2007 o There is to be one full access on Hodgson Road, located 990± feet north of the CR J intersection (approx. 330 feet south of the northern edge of the study area). This access is to be centered on the property line east of Hodgson at this location. No other new permanent accesses are to be allowed. As development occurs, the City will work toward eliminating all other accesses along Hodgson. o Temporary accesses onto Hodgson Road may be considered if one property develops prior to the creation of access to CR J. Such temporary accesses must be removed when the CR J access is created. The removal must be included in conditions of approval for the project. o Between Hodgson and Ware Roads, there is to be only one new access onto CR J, located as close as possible to midway between Hodgson and Ware. This access should be centered on the mid -way property line. This new access is to be constructed as right in/right out only. No other new accesses are to be allowed. The City will work toward eliminating all other accesses along CR J. o From the full access on Hodgson, a circulation route is to be created leading east of Hodgson to the access point on CR J, providing access to all properties in the area. This should be a public road. However, an access drive with mutual easements across properties is a possible solution if it provides adequate access and circulation. o West of Hodgson Rd., there is to be one access onto CR J, located as far west as possible from the Hodgson/CR J intersection. This new access is to be constructed as right in/right out only. This will be a driveway into the development site , and there will be access easements on that site to provide access to, from, and through property to the north, leading to the full access on Hodgson. No other new accesses are to be allowed. The City will work toward eliminating all other accesses along CR J. • The access points, right of way, and internal circulation routes noted above are to create a circulation network serving all properties in the study area rather than individual driveways onto arterial and collector roads that serve only individual properties. • For properties on the eastern edge of the study area, access to Ware Road is a possibility if the City judges the design to be safe. This does not preclude the need for public right of way or easements elsewhere. • The Hodgson/CR J intersection is to be signalized prior to or as part of any significant development in the study area. This is to be a cooperative effort of Anoka and Ramsey Counties, the Cities of Lino Lakes and Shoreview, and developers. Specific design requirements are to be determined. • Other road improvement needs such as additional lanes, median, and the like will be designed in cooperation with Anoka and Ramsey Counties, the Cities of Lino Lakes and Shoreview, and developers, as appropriate. Hodgson/CR J Master Plan page 33 EXCERPT, Hodgson Road & CRJ Master Plan Approved February, 2007 • The quantity of development of the area will be limited to ensure that traffic generation does not exceed the capacities of Hodgson Road, the intersection with Co Rd J, or the new access. Development shall not create the need for a traffic signal at the new full access on Hodgson Road. o Planning for the area must look forward to full development of the study area so as not to allow one project to "use up capacity" so that other sites cannot develop without creating the need for a signal at the new access. • Right of way will be dedicated with development to ensure adequate right of way for Hodgson and CR J as well as for the internal circulation system, as necessary. • The offset of Ware Road and Mackubin Street should be addressed by realignment of Ware Road to form a four-way intersection. Trails, Open Space • A trail connection, included as an `enhancement corridor' in the Parks, Natural Open Space/Greenways and Trail System Plan, will be established across the study area. This will link to the existing trail connection to Woodridge Lane on the west, cross through the study area, and link to a future trail in Ware Road. The specific alignment of this trail corridor across the Master Plan area will be determined as development occurs. • An, open, focal point green space is to be created where the Woodridge Lane trail connection enters the study area. The specific design of this focal point will be reviewed with any development application for the site. • A trail should be constructed along Hodgson Road in accordance with the City's parks and trails plan. This could be accomplished with sidewalks in the study area. • The wetland complex in the northeast part of the study area, shown as `natural resource protected area' and `natural resource conservation area' in the Parks Plan, should be protected as open space to the degree possible. Detailed information submitted with development proposals will be examined to determine the possibilities for these areas. • Greenspace buffering is an important design element for new development along the border with existing neighborhoods such as Woodridge Estates and Rohavic Oaks. Municipal Utilities • All new development must have sanitary sewer and water service. Possible exceptions prior to the availability of utilities include renovation of existing structures if the building Hodgson/CR J Master Plan page 34 EXCERPT, Hodgson Road & CRJ Master Plan Approved February, 2007 code allows it without utilities. However, the preference is for all uses in the study area to have municipal utilities. • Several options exist for utility service, as described in this study document. West of Hodgson, the preference is for connection to the Woodridge Lane sanitary sewer. • Water trunk lines must be looped, and development must provide the looping. Site Design, Urban Form • The intent is to create an urban form for the area. • Development layouts are to include buildings at intersection corners to establish the "cornerstones" of the area's urban form. • As another means of pursuing an urban form, development is to avoid lining Hodgson with large parking lots. This could include the following elements. o Buildings fronting along Hodgson in addition to the cornerstone buildings o Extensive landscaping and screening of parking lots will be required along Hodgson and CR J, including boulevard trees and decorative fencing or walls. Landscaping must be included on the street side of fences or walls along parking lots. • Larger parking areas should be planned with internal landscaping, pedestrian sidewalks or walkways and be divided into smaller areas where possible: o Pedestrian walkways provided in larger parking lots should be landscaped, include path lighting, and provide direct access for pedestrians to an entrance of a commercial building; o Walkways should be raised, paved areas or defined paths distinguished by striping or a change in paving provided that pedestrians are kept safe from vehicular travel on the route to an entrance of a commercial building. • Sidewalks are to be constructed on both sides of Hodgson Road and on the north side of Co. Rd. J to form connections to the trails to the development areas and contribute to the urban form of the area. • Pedestrian circulation should be an important design factor within the development areas to facilitate pedestrian and bicycle circulation among businesses and residential sites. Such circulation routes must be safe and aesthetically pleasing. • Design guidelines must be prepared for any new development project in the area. Developers should submit draft guidelines with development applications. Design Hodgson/CR J Master Plan page 35 EXCERPT, Hodgson Road & CRJ Master Plan Approved February, 2007 guidelines for each project must include attention to previous projects in order to coordinate design throughout the study area. After being refined in collaboration with City staff, design requirements shall be incorporated into the approval of the development. • Buildings must be designed with "four-sided architecture", using the same quality materials on all sides. o All facades shall be articulated with a variety of materials, glazing, awnings, or other details to add visual interest. o Building design elements should include an expression of a building base (of brick or stone), a middle, and a top with cornice elements at the top of the first floor and the top of the building. o Roof lines and cornice details shall be completed in a three-dimensional manner so that the features on the back of the roof or similar unfinished areas are not visible o The front facade may have a unique design or more significant glazing. • Commercial buildings must incorporate trash and service areas within the buildings rather than utilizing outdoor enclosures. This will conserve land and maximize the potential for outdoor seating and pedestrian friendly amenities. • It is not the intent of this plan to specify housing unit styles. However, garage units must not access directly onto the main access drive or the main public streets through the development . • The Hodgson/Co Rd J intersection is a gateway and appropriate elements are to be included in the development of the corners of this intersection. • The interface between new residential and commercial uses should be flexible. For example, new development in central areas can be multi -family, commercial, or mixed use. This would be consistent with the flexible land use lines noted above. Maintaining safety and quality of life are important considerations. • Lighting is to be appropriately scaled to a pedestrian friendly development. Lighting should be directed downward and screened to reduce light pollution, glare, and impacts on adjacent residential areas. • Security or service lighting should be limited in coverage area and designed to reduce glare. This could include such features as rain gardens, swales, dry creeks, infiltration chambers, and other ecologically based methods along with more traditional ponds and pipes. • Stormwater management ponds, if used, should be designed to be a site amenity, including appropriate landscape elements.
