PLANNING ITEMS: A. 95-23-S, Centennial School District, Minor Subdivision, Elm Street Planning Consultant Brixius reviewed the request for a minor subdivision. Centennial School District #12 is in the process of preparing a bond issue for construction of a new school on property owned by the District north of Elm Street. Mr. Brixius indicated the property to be subdivided is Zoned R-1 and indicated as single family residential on the City's 1990 Land Use Map. The property owned by the School District is Zoned Public/Semi Public and adjoins the parcels to be subdivided. He noted at some point in the future, should the bond issued be approved, the PLANNING & ZONING BOARD August 9, 1995 School District will be required to rezone the newly acquired parcels and obtain a conditional use permit to allow construction of the new school. Mr. Brixius indicated staff recommends approval of the minor subdivision request with the following conditions: 1. The narrow strip of property to the east on Parcel B should be added to the parcel directly south of it to avoid confusion should the piece be split at a future date. These lots are currently two separate parcels of record owned by Mr. Leonard Thoeny. 2. The Park Dedication fee shall be waived on this minor subdivision. 3. Parcel G is not included in this request as it is a separate parcel of record and no subdivision is required. 4. After conveyance of land, the School District will combine all parcels and supply a revised survey illustrating one parcel. Chair Pro -tem Robinson asked about the discrepancy of two feet in the survey. The applicant indicated he is unsure how the discrepancy occurred, the stakes have been moved several times. Chair Pro -tem inquired if the School District will be utilizing the strip of narrow land. The applicant indicated they are in negotiation to acquire the land east of these parcels. Also the School District is completing acquisition of land to the north near the industrial park. Chair Pro -tem Robinson indicated the desire of the Economic Development Committee is to keep that area industrial. Mr. Herr inquired if the School District did not obtain the land to the east, what would they do. The applicant indicated he was unsure, but believed no one would want to live in the middle of the school's property. The School District would own property to the north, east, south and west of that parcel. Chair Pro -tem Robinson reiterated the Board's concern with the parcels being combined into School District property, due to no street access. The applicant indicated it would be the desire of the School District to combine all the parcels. Mr. Mesich inquired if rezoning would be necessary. 2 PLANNING & ZONING BOARD August 9, 1995 Mr.Brixius indicated when the plan comes into effect the land would need to be zoned Public/Semi Public. Currently the City is only looking for legal description of the land, if buildings are proposed, then the rezoning would need to be done. Mr. Brixius reported the request is to excavate (deepen), the rear yard swale in Pineridge II and III to allow lookout style homes rather than the original full basement ramblers and stockpile the excavated material to the south for future use. The amount of material to be regraded and stockpiled is approximately 7,000 cubic yards. Mr. Brixius indicated staff recommends approval with the following conditions: 1. Side slopes shall not be steeper than a 3:1 slope. 2. Height of the stockpile shall not exceed 6 feet. 3. Side slopes shall be seeded and mulched to prevent erosion. 4. Stockpile shall be monitored by owner and kept free of weeds. Chair Pro -tem Robinson inquired as to how far it would be from the rear lots to the stockpile. Mr. Brixius indicated it would be slightly over 100 feet. Chair Pro -tem Robinson inquired as to how long the stockpile would be there. Mr. Ted Matke, the applicant, indicated it would be there for approximately two years, or until the MUSA line changes. Chair Pro -tem Robinson inquired what the stockpile would be used for. Mr. Makte indicated it would be used for top soil. 3 PLANNING & ZONING BOARD August 9, 1995 Mr. Mesich inquired as to the current land use. Mr. Maki indicated the land is unused farm land. Mr. Herr expressed concern with condition number four, he wondered how the stockpile would be kept weed free. This property is located outside the current MUSA Boundary, however, it has been included in our recent MUSA/Comprehensive Plan Amendment as anticipated "Growth Area". Mr. Carlson plans to develop this property at a future date pending the outcome of the Comprehensive Plan Amendment request. A grading plan for the proposed regrading and stockpile has been reviewed by our Engineering Consultant, Steve Meth of SEH who recommended approval with several conditions outlined in his report dated August 1, 1995. A hand-held weapon discharging a single shot or pellet at a time. (4) Non -firearm. A crossbow, pellet gun, BB gun, and slingshots, including wrist rockets. (5) Firearms. For the purposes of this section, shall mean rifles, shotguns and handguns. (6) Bow and Arrow. Pointed tip arrow and bow. (7) Written Consent. A written record of consent to hunt upon a landowner's property. Such consent shall be signed by the owner and contain the following information: a. Name, address, phone number of the landowner; b. Name, address, phone number and date of birth of the hunter; and c. Description of the land upon which the hunter has consent to hunt and the date that such consent begins and ends. Hunters must have on their person a copy of the written consent with the above information and picture identification. (Section 504.01 amended by Ordinance 2-84, passed July 23, 1984). In no event shall said person discharge a shotgun where the projectile or pellets leave the premises upon which said person is authorized to hunt onto some other premises. (6) A private landowner or person with written consent from the landowner may use a bow and pointed -tip arrow, provided that no arrow used shall pass beyond the boundaries of his property, nor shall any shooting of arrows occur within 500 feet of any school site (includes adjoining school district property), building on adjoining property or occupied residence, without the consent of that landowner, nor in any event create a nuisance or danger to other persons. Notification shall be by first-class mail. Such notification shall include the Affidavit of Mailing completed by the City and a list of all persons who have been notified pursuant to this section. Mr. Hawkins will present his review at the City Council meeting. An outline of the advantages and the disadvantages of the City of Lino Lakes adopting a contract electrical inspection program are as follows: Advantages: The City could realize revenue generated from the permit reviews in the amount of about $7,000.00 per year. This is based on the electrical permit fees from 1994. This would more than cover the administrative cost of the program. The City would be able to confirm, cross reference and control electrical p i nits.. Under the current program, there is no way for the City to check to make sure that the person obtaining the electrical permit has also obtained a building , plumbing or mechanical permit. Other cities such as White Bear Lake, White Bear Township, Woodbury, Oakdale, Roseville, Shoreview, Deephaven and North Oaks presently have a contract electrical inspection program. All are pleased with the program. Mr. Peterson is very competent and qualified. He is familiar with the City. As you know, this plan was mandated during the 1993 Legislative Session with no provisions for funding established. Whereas we agree that certain initiatives coming down from governmental organizations may make sense, an accompanying funding sources is vital. As representatives of the citizens of Lino Lakes, we feel compelled to voice our concerns regarding the continued imposition of unfunded state mandates. As Governor, you are well aware of the burden placed upon the citizens of Minnesota as a consequence of unfunded federal mandates. The League of Minnesota Cities has, for the past two years, made the elimination of this practice one of its primary goals. Today's political climate is one where government is seen as big spending, and unresponsive to the real needs of its citizens. Economically, cuts in HACA and other state aids, coupled with mandates, force municipalities to raise taxes for initiatives that are not a priority for the community. Over the past several years, the Lino Lakes City Council has made great strides towards holding down spending and prioritizing the programs we provide to our residents. In a seperate motion, the council authorized an additional $200.00be expended towards the city picnic. The (up to $200.00) should have been applied to the second authorization for funds, not the pretax refund. The dollar amount in the pretax refund that should have been spent on the picnic is $328.79. The Council needs to approve the total amount of pretax refunds be applied to city picnic. AGENDA ITEM NO. 11C STAFF ORIGINATOR Marilyn Anderson, Clerk -Treasurer DATE August 25, 1995 TOPIC Update Regarding Block Party, Woodridge Estates BACKGROUND At the August 14, 1995 Council meeting, a block party on Woodridge Court was approved. A letter opposing the block party from a resident on Woodridge Court had been received, was included in the Council packet and noted at the Council meeting. Since that time, another resident has sent a letter in opposition to the block party. Both residents appeared at the August 23, 1995 Council work session and restated their opposition to holding the block party in the Woodridge Court cul-de-sac. The City Clerk was instructed to contact the persons organizing the block party to determine approximately how many residents would be attending the party and to see if the party could be relocated. The City Clerk contacted the block party organizers and was told that party informational materials had been sent to approximately 70 households. Attendance at the block party could be approximately 150 people. After the Council work session on Wednesday, the block party organizers met with the two (2) residents who opposed holding the party on Woodridge Court. The organizers of the party explained that they did not want to create a neighborhood dispute and agreed to move the party to a specific location on Woodridge Lane. This would mean that Woodridge Lane, a through street, would be blocked for the party. Comments were solicited from the Chief of Police, the Fire Chief and the Public Works Superintendent. All agreed that blocking a through street could cause problems for emergency vehicles and could cause problems if someone drove through the barricades. However, since City Staff is considering a block party policy which would address block parties in a through street, all agreed that holding the block party on Woodridge Lane is the only solution at this time. Both the Police Department and the Public Works Department will provide as much protection as possible. Holding the block party in the nearby park or at the south end of Oakwood Lane was discussed with the block party organizers. Both sites had been considered but ruled out because of the mosquito problem. It was suggested that both sites be considered next year and mosquito control researched.
