State Stat. 115A.94 Section 46 Subd. 4 states there shall be a 90 day period where the city shall supervise the development of plans or proposals for organized collection. We under- stand that it is Council policy to serve on$' one major board or committee at a time, so we moved Paul down to alternate on this basis. Tom Green is a newcomer to this community with no track record in community service. He wants to get started on a committee dealing with open space and wildlife, but is short on training along these lines. If the Council is willing to either expand committee membership to nine or establish an alternate category, we recommend that both Paul and Tom be included, Concerning item #3 (technical advisors), Patricia Tufts applied for committee membership, but subsequently decided to withdraw her name. How- ever, she indicated a willingness to serve as a technical advisor, if asked by the committee, and is extremely well-qualified to do so. Rd. J), Conditional Use Permit and Site Plan Review BACKGROUND Shoreview Covenant Church is planning to build a three -phased church development on Co. Rd. J. (Ash Street) between Baldwin Lake Road and Woodridge Lane. The property is Zoned R -1X and requires a conditional use permit for church construction. The Comprehensive Plan identifies the area as single family residential. The Planning and Zoning Board reviewed this item at two public hearings. Initial concerns centered around future development of the area, in particular, access to Outlot B of Woodridge Estates and future use of the northern portion of the church property. The owner of Outlot B, Richard Carlson, has discussed a possible land exchange/trade with the church for property on the north side of the site adjacent to Oakwood Lane. Mr. Carlson met with the Church Building Committee, however, they were unable to reach an agreement on a possible land exchange. The Church also met with residents of the area to discuss the church plans. The main concern at this meeting was the potential. use of the north portion of the site for park purposes and what types of activities might be allowed in the park. The church has had some preliminary discussion with City Park Staff concerning a possible lease/purchase agreement for park land on the north side of the church site, however, these meetings have been preliminary in nature. Any future development of the church property for park purposes or single family development will require further review by the City. The Church has agreed to install a park trail through their parcel of property as outlined on the Park Comp Plan and they will be working with the Park's Department on the exact location. SITE PLAN REVIEW SETBACKS: City Code provides the following setback requirements: 40' front setback from Co. Rd. J. (Ash Street), 30' rear setback, 10' side setback. The proposed structure meets the setback requirements. The Parking setback requirements are 5' on the side and 5' on the front, however, Staff would recommend a 15' setback on both the front and side to provide adequate buffer between the church and the adjoining residential parcels. BUILDING HEIGHT/EXTERIOR: Phase one and two are proposed to be constructed at an elevation of 32', phase three will be approximately 45' which is the maximum allowed by the ordinance. Exterior construction will be wood frame with aluminum siding and face brick accent. PARKING/CIRCULATION: 79 parking spaces will be provided along Co. Rd. J. (Ash Street) with an additional 65 spaces to the rear of the building for overflow parking and future expansion parking. Staff would recommend curb and gutter be provided for the front parking area and all access drives, future parking areas shall comply with City Standards upon completion of additional phases of development. Handicapped parking spaces shall comply with ADA Rules and Regulations. Turn lanes shall be provided as recommended by the Anoka County Highway Department. The County has approved one access drive off County Road J. This access drive has been installed and is currently being used by the MCES for pipe storage in conjunction with the Ware Road Lift Station improvement project. TRASH HANDLING: The current plan does not indicate a trash handling area. Trash handling shall be noted on final plans and properly screened from the street and adjoining property owners per City Approval. LANDSCAPING: A detailed landscaping plan has been submitted which indicates a row of evergreens along the west property line to screen the parking and access drives from the adjacent residential property. The City Forester and CSO Officer shall review and approve the final landscape plan prior to any construction on the site. LIGHTING: The CSO Officer has reviewed the lighting proposal and recommended some minor changes to the plan. These changes shall be incorporated into the site plan prior to any construction. GRADING/DRAINAGE/UTILITIES: Sewer and water are available to serve this site. Final plans will be subject to the review and approval of the City Engineer. PARK DEDICATION: A park dedication fee will not be required as there is no subdivision of the property at this time. However, a park trail will be required. The Church has agreed to the installation of the trial segment and will work with City Staff on the exact trail location. The Church will also continue discussions with City Staff regarding possible lease/purchase of park land on the north side of the site. For Council information, the Church will be renamed from Shoreview Covenant, however, a new name has not been selected to date. After considerable discussion, the Planning and Zoning Board recommended approval of the Conditional Use Permit to allow construction of the church buildings and Site Plan Review with the following conditions: 1. Proper building permits shall be obtained for all construction on the site and 1% of the construction costs be escrowed via cash or letter of credit to insure completion of all site improvements. 2. The Park Board shall approve a trail location through the site and discuss possible leased recreational space for the neighborhood - with the Church Development Committee. The Church will be responsible for grading and rocking the proposed transportation trail, the City Parks & Recreation Department shall provide the bituminous paving for the trail per City Specifications. 3. Access to the property and turn lanes, if applicable, are subject to the review and approval of the Anoka County Highway Department. 4. Final landscaping plans are subject to the review and approval of the City Forester and CSO Officer. 5. Final lighting plans are subject to the review and approval of the CSO Officer for compliance with CPTED Recommendations. 6. Final Grading/Drainage/Utility plans are subject to the review and approval of the City Engineer. 7. Proper permits shall be obtained from the RCWD. 8. Concrete curb, gutter and bituminous surfacing shall be provided for the front parking area and all access drives. The rear parking area shall be provided with curb, gutter and bituminous surfacing upon completion of additional phases of development. All parking areas and access drives shall be located 15' from any property line. 9. The three phases of development shall be made a part of this conditional use permit with no future public hearing required. Tentative scheduling of the phases are 2-4 years for Phase 2 and 5+ years for Phase 3. Site Plan Review will be required for each phase of development City Code. 10. The City of Lino lakes is required to update its Comprehensive Plan, which includes a transportation component, per Metropolitan Council rules. Planning for the Comprehensive Plan process Baas begun by the formation of a task force steering committee. Staff has interviewed and received a proposal from SRF Consulting Group, Inc., to prepare a Transportation Plan component of the Comprehensive Plan and to assist the steering committee with transportation issues or questions. The attached agreement outlines the scope of services and the basis of payment. The not - to -exceed amount for the transportation Plan is $21,500.00 with additional costs for SRF attendance at meetings and public informational meetings. In addition, if the City elects to have a special area study done, it is estimated that it will cost an additional $1,000.00 to $3,000.00 per study area. it is estimated that the Transportation Plan will cost from $30,000.00 to $40,000.00 depending on the number of meetings and special area studies done. The year Sandbur Days will be held the weekend of September 6th, 7th and 8th. This annual event requires two (2) licenses and one permit. A Special Event permit application for the use of Sunrise Park has been submitted to Marty Asleson, Parks and Recreation Director. The application is complete, the required insurance policy naming the City as additional insured has been received and the proper fee has been paid. A City park hold harmless agreement has been provided. The applicants are working with the Police Department, the Public Works Department and the Centennial Fire District to coordinate activities. A food license is required from Anoka County and will be delivered by Anoka County on the first day of the event at the time the Anoka County makes their inspection. A copy of the food license must be posted in the area where food is sold. The 3.2 Beer License application has been received. The applicatio is ca plate the proper fee has been paid, and a certificate of insurance has been received. The Cabaret License application is also complete and the fee has been paid. This license is required to regulate entertainment where on -sale beer is being served. The Sandbur Days event has been held in Sunrise Park for many years. On this same weekend, Waldoch Sports will hold their annual snowmobile races on grass and the Men's Club at St. Joseph Catholic Church will hold their annual auction. The Police Department is aware of all of these events and additional Police Officers will be working that weekend. The snowmobile club organizing the snowmobile races reimburses the Police Department for traffic control and Reserve Police Officers usually staff a booth at Sandbur Days. The Lino Lakes City Code, Section 401.29 and Section 402, Subdivision 6 provides that all delinquent sewer and water utility bills shall be certified to the County Auditor for collection with the property taxes. Attached to this "green sheet" is Resolution No. 96 - 98 which lists all delinquent sewer and water billings. I am asking for City Council approval to hold a public hearing on September 23, 1996 to take public input on the matter. All property owners who have not paid their utility billings will be notified by mail and be will be given an opportunity to give their input at the public hearing. The City will continue to receive payments on the delinquent accounts and will certify only the unpaid portion of the delinquent billings. OPTIONS 1. I was directed to obtain title to the parcel for use as open space or mitigation. The parcel is shown on the attached map. The former owner had researched options for use of the land, however, no part of the parcel was deemed buildable. Since there was no use for the parcel, the former owner allowed it to forfeit to the State. I applied for title of the parcel and recently received the title. The purpose of this "green sheet" is to let you know the status of the parcel. Please note the letter from Gene Rafferty, Anoka County Land Commissioner in which he states that the parcel can only be used for open space. The law allows these parcels to be used only for open spaces. We had to accept this condition to gain support of the DNR and as you well know without their support the bill would not have passed.
