HomeMy WebLinkAbout2016-001 Council Ordinances1St Reading: May 23 , 2016 Publication: June 21 , 2016 2nd Reading: June 13 , 2016 Effective: July 21 . 2016 CITY OF LINO LAKES ORDINANCE NO. 01-16 AMENDING TITLE 500, CHAPTER 505 OF THE LINO LAKES CODE OF ORDINANCES RELATING TO OPEN BURNING. The City Council of the City of Lino Lakes, Anoka County, Minnesota, does ordain: Section 1. That Section 505.02, of the Lino Lakes Code of Ordinances be amended as follows: 505.02 DEFINITIONS. FIRE CHIEF. The Safety Director Public FIRE MARSHAL and ASSISTANT FIRE MARSHALS. The Public Safety Director or his/her designee, who is acting in good faith to enforce the Minnesota State Fire Code and local ordinances. Section 2. That Section 505.05, Subdivision 3(a), of the Lino Lakes Code of Ordinances be amended as follows: 505.05 OPEN BURNING PERMITS. (3) Permit application for open burning and permit fees. (a) Open burning permits shall be obtained by making application on a form adopted by the Public Safety Department. The permit application shall be presented to the Fire Chief, Fire Marshal or an Assistant Fire Marshal. Each application shall be accompanied by a fee, as set annually by City Council ordinance. Adopted by the Lino Lakes City Council this 13 day of June, 2016. The motion for the adoption of the foregoing ordinance was introduced by Council Member Kusterman and was duly seconded by Council Member Maher and upon vote being taken thereon, the following voted in favor Kusterman, Maher, Manthey, Rafferty The following voted against same: none Ju e Bartell, City ler Jeff Rein , rayor CITY COUNCIL AGENDA ITEM 3A STAFF ORIGINATOR: Jeff Karlson MEETING DATE: June 13, 2016 TOPIC: Consider 2nd Reading of Ordinance No. 01-16 VOTE REQUIRED: 3/5 INTRODUCTION Staff is requesting City Council consideration of a second reading of Ordinance No. 01-16, "Amending Title 500, Chapter 505 of the Lino Lakes Code of Ordinances Relating to Open Burning." BACKGROUND This amendment simply states that open burning permits shall be obtained through the Public Safety Department instead of the Centennial Fire District. RECOMMENDATION Approve 2nd reading of Ordinance No. 01-16, "Amending Title 500, Chapter 505 of the Lino Lakes Code of Ordinances Relating to Open Burning," with the following actions: (1) dispense with the full reading of the ordinance; and (2) a roll call vote for adoption of the ordinance.
