ARA <br /> ji <br /> 1"Reading: July 25, 2016 Publication: August 16, 20116 <br /> 2"Reading: Effective: September 15, 201 6 <br /> CITY OF LINO LAKES <br /> ORDINANCE NO. 07-16 <br /> ORDINANCE TO REZONE PROPERTY FROM LIGHT INDUSTRIAL (LI) TO <br /> PLANNED UNIT DEVELOPMENT (PUD) FOR LOT 1,BLOCK 1, <br /> CLEARWATER CREEK BUSINESS PARK <br /> The City Council of Lino Lakes ordains: <br /> Section 1: Findings of Fact <br /> 1. The City received a Land Use Application to rezone certain property from Light <br /> Industrial (LI)to Planned Unit Development(PUD) for Lot 1, Block 1, <br /> Clearwater Creek Business Park. <br /> 2. The Planning and Zoning Board held a public hearing on June 8, 2016 and <br /> continued the hearing to July 13, 2016. <br /> 3. Per Section 1007.015 (5),the City shall consider possible adverse effects of the <br /> proposed rezoning and its judgement shall be based upon, but not limited to,the <br /> following factors: <br /> a. The proposed action has been considered in relation to the specific <br /> policies and provisions of and has been found to be consistent with the <br /> official City Comprehensive Plan. <br /> The proposed development is consistent with the policies and provision of <br /> the Comprehensive Plan and AUAR. The PUD approvals include <br /> conditions to address the outstanding issues. <br /> b. The proposed use is or will be compatible with present and future land <br /> uses of the area. <br /> The proposed distribution center is consistent with the industrial land use <br /> classification. <br /> c. The proposed use conforms with all performance standards contained <br /> herein. <br /> The proposed 402,552 square foot distribution center is consistent with all <br /> performance standards when the recommended conditions of PUD <br /> approval have been met. <br /> 1 <br />
