Review Regular Agenda,March 26,2012 Council Meeting

3A) Resolution No. 12-32,Approving Extension of Vadnaid Lakes Area Water
Management Organization (VLAWMO)Joint Powers Agreement—Administrator
Karlson noted that the request before the council is quite perfunctory in that it simply
extends the city's existing agreement with VLAWMO to the year 2016. A council
member asked if the length of the extension is appropriate, what has been done since the
past extension and also are there any inferred cost liabilities that could impact the city?
A council member also asked whether the organization is in any way a deterrent to
development in the city? Mr. Karlson noted that the four year extension is being
requested of all member cities. The mayor called upon the city's representative to the
group, Council Member Rafferty, for an update on activities. Council Member Rafferty
noted that the organization represents a very small portion of Lino Lakes. He has seen
that they are quite normally attempting to fulfill their duties as a water management
organization as would be expected. The mayor noted that he has heard about the terms
of the contract in the past as he's served on the council for several extensions periods. If
the council wishes to have more of a drill down on the terms, it would be appropriate to
hold off on approving the contract and allow additional time for that review. The council
will get an update from the organization at the next regular work session.

4A) Public Hearing and Resolution 12-28, Submitting an Outdoor Recreation
Grant Application to the Minnesota DNR—Public Services Director DeGardner noted
that the city is submitting a grant request for$125,000 to the DNR and as part of that a
public hearing to hear community comments on the application is required. He noted that
the recreation complex plans have been phased and this grant, if received, would support
phase one. He also noted that if this grant is received, it will be a great start; if it is not
received, the first phase would most likely not proceed without identification of another
funding source. The mayor noted that the city is committing funds and that should be a
positive in the grant determination process. Mr. DeGardner added that the application
L. 45 process requires that on-going maintenance costs be reviewed at the public hearing. The

council is supportive of the grant request and the mayor suggested that staff also seek a
letter of support from the city's state representatives, Runbeck and Chamberlain; the
mayor will communicate with the representatives and staff will follow up with a request.

6A) Resolution No. 12-29, Calling for a Hearing to Establish Cartway—Community
Development Director Grochala noted that the city received a petition to establish a
cartway from resident Adam Johnson, 2055 Otter Lake Drive. He lives at the end of a
public roadway just before a private bridge that provides access to other land, including ten
acres that Mr. Johnson owns. He has attempted to get access rights from the association
that controls the private roadway/bridge. Within the petition Mr. Johnson notes that he
proposes to use the land two to three times per week for walking and recreational driving.

City Attorney Squires reviewed the cartway statute which basically allows for forced
access to a landlocked parcel across someone else's property, made applicable in cities in
2006. If the petition is proper, the law says the council shall grant the access. Setting a
hearing, as is called for this evening, is the first step in the process. The council can
decide upon route, determine damages, charge costs incurred to the city as well as impose
maintenance responsibilities as appropriate. The council may adopt the order and resolve
issues at the public hearing date but can take more time if that is necessary.
6B) 2012 Intersection Signal Improvements
i. Consider Resolution No. 12-30,Approving Joint Powers Agreement with Anoka
County,Birch/Ware Signal Improvements
ii. Consider Resolution No. 12-31,Approving Joint Powers Agreement with Anoka
County,Main/Lake Signal Improvements

Community Development Director Grochala noted the two joint powers agreements with
Anoka County. Once these are authorized, the county will proceed with land
acquisitions. He reviewed the estimated project costs, noting a reduction from the
original estimate. The council will also be doing some roadway improvement on Lake
Drive. At the public open house on the projects, some residents expressed the desire to
have a cross walk added at Marketplace Drive and the county has decided to include that
feature.

The meeting was adjourned at 6:20 p.m.

These minutes were considered, corrected and approved at the regular Council meeting held on
April 9, 2012.
