Council 57 Member Rafferty seconded the motion. Motion carried on a voice vote. 58 59 3B) 2011 Labor Agreement with LELS Local 299 —Administration Director Tesch noted that staff 60 has been negotiating this contract for several months. A tentative agreement has been reached and is 61 being presented for council consideration. He reviewed the proposed contract terms. 62 63 The mayor thanked the members of Local 299 for their willingness to negotiate a fair contract. 64 65 Council Member Rafferty moved to approve the labor agreement as presented. Council Member 66 O'Donnell seconded the motion. Motion carried on a voice vote. 67 68 PUBLIC SAFETY DEPARTMENT REPORT,JOHN SWENSON 69 70 There was no report from the Public Safety Department. 71 72 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER 73 74 There was no report from the Public Services Department. 75 76 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA 77 78 6A) Second Reading of Ordinance No. 12-11, Vacation of playground easement at YMCA- 79 Community Development Director Grochala explained that the ordinance would allow the vacation of 80 some land originally intended for playground space. The vacated space would assist the YMCA in 81 expanding their parking. Staff concurs with the vacation as the intended playground space could be 82 relocated in future Legacy development. 83 84 Council Member O'Donnell moved to waive full reading of the ordinance. Council Member Roeser 85 seconded the motion. Motion carried on a voice vote. 86 87 Council Member Rafferty moved to approve the second reading and adoption of Ordinance No. 12-11 88 as presented. Council Member Roeser seconded the motion. Motion carried: Yeas, 4; Nays none; 89 Absent Gallup. 90 2 • COUNCIL MINUTES July 11, 2011 APPROVED 91 6B) First Reading of Ordinance No. 15-11, amending the zoning ordinance regarding variances 92 —City Planner Smyser explained that the 2011 State Legislature amended state law relative to criteria 93 for granting of variances. The criteria amendments involve the findings of hardship and conditions 94 that may be attached to a variance. The ordinance before the council would update the city's zoning 95 ordinance to reflect the changes in state law. The Planning and Zoning Board conducted a hearing on 96 the proposed amendment and recommended approval. 97 98 Council Member O'Donnell moved to approve the first reading of Ordinance No. 15-11 as presented. 99 Council Member Roeser seconded the motion. Motion carried on a voice vote. 100 101 UNFINISHED BUSINESS 102 103 There was no Unfinished Business. 104 105 NEW BUSINESS 106 107 8A) Emergency Ordinance No. 16-11, adding a new Chapter 1012 to the Lino Lakes City Code 108 establishing an electrical inspection program and Resolution No. 11-74 authorizing execution of 109 an agreement with David Kichler Inspections to provide inspection services—Community 110 Development Director Grochala explained that with the current state shut down, cities are looking at 111 picking up electrical inspection duties that were performed by the state. He is therefore proposing 112 that the council approve an emergency ordinance (under the charter allowance that the situation is a 113 health safety matter) adding an electrical inspection program. The language would sunset when the 114 state shut down ends. In the future, the council may want to consider making it a permanent situation 115 but that is a discussion for the future. Since the city doesn't have staff to accomplish the electrical 116 inspection, the action requested includes authorizing a contract with a private inspect 117 118 Council Member O'Donnell moved to waive full reading of the ordinance. Council Member Roeser 119 seconded the motion. Motion carried on a voice vote. 120 121 Council Member Roeser moved to approve Emergency Ordinance No. 16-11 and Resolution No. 11- 122 74, as presented. Council Member Rafferty seconded the motion.
