HomeMy WebLinkAbout11/21/1979 P&Z MinutesThe regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:15 P.M., Wednesday, November 21, 1979 by Chairman Gourley. Members present; Schwankl, Shearen, Heath, Reinert, Gourley. Members absent; Doocy, Johnson. Mr. McLean, Council Liason and Mr. Schumacher, City Administrator were also present. The August 15th minutes were considered. Mr. Shearen moved to approve the minutes. Mr. Reinert seconded the motion. Motion declared passed. The September 5th special meeting minutes were considered. Mr. Heath moved to approve the minutes. Mr. Reinert seconded the motion. Motion declared passed. The September 26th special meeting minutes were considered. Mrs. Schwankl moved to approve the minutes. Mr. Heath seconded the motion. Motion declared passed. Mr. Goorrley noted that the August 8th special meeting minutes werenot approved. Mr. Reinert moved to approve the minutes. Mr. Heath seconded the motion. Motion declared passed. The October 10th special meeting minutes were considered. Mrs. Schwankl moved to approve these minutes. Mr. Heath seconded the motion. Motion declared passed. The minutes of the October 17th regular meeting were considered. Mr. Shearen moved to approve the minutes. Mr. Reinert seconded the motion. Motion carried. The October 24th special meeting minutes were considered. Mrs. Schwankl noted the absentee members were not listed,; Mr. Johnson and Mr. Shearen. Mr. Gourley asked these minutes be corrected to show absentees. Mrs. Schwankl moved to approve these minutes as corrected. Mr. Heath seconded the motion. Motion declared passed. Mr. McLean's Report Mr. McLean reviewed the items that were passed from Planning and Zoning to Council and informed the Board that the Council had passed the items as recommended. There was a note to Council from Mr. Mobley regarding the Donald Paul property that is now part of the Anoka County Open Space regarding dirt hauling by the County from this property. Mr. Mobley had stopped the dirt hauling. Mr. Gotwald and Mr. Mobley are dealing with this. Mr. Gotwald also felt the City should approve an ordinance dealing with the fill- ing of land such as is being done at the Woodshed Bar. Mr. Gotwald also talked about the idea of a developers agreement, providing a check list and setting forth the things that must be done on the development and making a contract type of agreement. Mr. Gourley asked about Mr. Mobleys letter dealing with Forrest Tagg. Mr. McLean said it was passed on to the Council and passed on to Mr. Locher. Mr. Gourley asked about the letter regarding the Lake Amelia gravel pit. Mr. McLean said this was forwarded to Mr. Gotwald to be concluded by him. Plat - Arena Acres - Ken Rehbein and Jim Kurth, Surveyor, Mrs. Schwankl asked to be excused from the considering of this plat. Mr. Gourley read the minutes from the Park Board regarding this plat. The Park Board suggested taking land preferably on the southeast corner of the plat, lots 16, 17 and 18. Mr. Gourley asked the Clerk to give Mr. Rehbein a copy of the Park Board minutes. Mr. Kurth explained the reasoning behind the planning of this plat and identified its location. He noted that they are at least one acre lots with a minimum 150' at set back line. Planning and Zoning Board 'November 21, 1979 Page -2- Mr. Gourley noted the letters from Milner Carley and Barton - Aschman were here this evening and read the Barton-Aschman letter to the Board. Mr. McLean asked what the total acreage was and Mr. Kurth said 652 acres. He noted the park dedication should be 6.5 acres. Mr. Shearen read the letter submitted by Milner Carley Engineering. Mr. Gourley noted the need for better circulation of traffic in the plat and the possible exit to 4th Avenue through Andall Street. Mr. Kurth said this may be a good way to go although there is an easement on the south end of the plat to 4th Avenue. There was more discussion on a second exit possibly to 4th Avenue. Mr. McLean noted this could be a second stage development. rMr. Kurth further explained the design. Mr. Gourley asked if the west portion could be platted in a second stage? Mr. Rehbein said it would be possible to build the road to 4th Avenue and this would give more lots to help pay for the road. The future re -subdivision aspect was considered in respect to sewer. Mr. Heath felt this is not the plat to address this problem, be did not see that this would get sewer for a long, long time. Mr. Gourley said the consensus is that the Board is not concerned with Item #3 on the Barton - Aschman letter. Mr. Reinert asked about the recommendation that additional investigation to determine the extent of poor soil conditions be performed. Mr. Kurth said the engineering would handle this. Mr. Gotwald will require more on this. Mr. Dobie was present and Mr. Rehbein presented the easement agreement that will be nec- essary to connect to Wood Duck Trail in Mr. Dobies subdivision. Mr. Dobie asked that Mr. Locher receive_a copy of this to see that it is properly recorded. Mr. Dobie gave the Board a copy of the agreement and Mr. Rehbein said he would give the original to Mr. Locher for recording. Mr. Rehbein asked if 6.5 acres were required for park,could the dedication come from some other area than requested by the Park Board? Mr. Rehbein suggested another area. Mr. Gourley said the City could accept three acres plus cash to equal the required dedication. It was noted that the dedication is based on $1,500.00 per acre value. Mr. Rehbein asked how long will it be before the road to 4th Avenue is required? It was noted this is up to the Council. There was further discussion of the park dedication. Mr. Rehban said that what is needed now is resolving the question of the street to 4th Avenue and resolve the park dedication./ Mr. Rehbein was told that the plat would be tabled until the above questions were resolved. Special Use Permit - Dale V. Ramsden Mrs. Ramsden was present. Mr. Gourley exptaiined the location of the property to be in- volved with the Special Use Permit. Mr. McLean asked if this property would be used as commercial property. Mr. Gourley said Mr. Ramsden is in the blacktopping business. Mr. McLean asked what equipment would be there and Mrs. Ramsden explained three trucks, two rollers, paver that attaches to the truck etc. Mr. Gourley asked if a building would be built. Mrs. Ramsden said, yes, Mr. Gourley said that he feels this entire area is designated for this type of use. Mr. McLean felt the question should they be looking at rezoning and Mr. Gourley said not now Planning and Zoning Board November 21, 1979 Page -3- this probably could be taken care of when the Comprehensive Rezoning District map is prepared. Mr. McLean noted that for Mr. Klenckthe Special Use Permit was specified "non -transferable" and the equipment was limited. Mr. Shearen questioned the location of the proerty and Mrs. Ramsden and the Board explained. Mr. Reinert moved to recommend to Council approval of the Special Use Permit to Dale Ramsden for the use specified on the application. Mr. Heath seconded the motion. Mo- tion declared passed. Mr. Gourley said this will be on the November 26, 1979 Council agenda about 8:30 p.m. Special Use Permit - Mr. and Mrs. Jerry Christianson Mrs. Christianson presented a letter from Mr. and Mrs. Leonard Husnik indicating they did not object to this request for a Special Use Permit to operate a kennel to bred collie show dogs Mr. McLean asked how many dogs will be held at this kennel? Mrs. Christianson said it varies but usually four and five adults and then occassionally puppies. Mr. Reinert asked about "debark" as listed on the Special Use Permit request. Mrs. Christianson explained the procedure the reason being it reduces annoyance to the neigh- bors. Mr. Shearen asked if there were plans for the kennels, Mrs. Christianson explained. Mr. Gourley explained that when licenses were issued to the other two kennels in the City the City put a limitation on the number of dogs that could be kept in the kennel. Mr. Reinert moved to recommend the issuing of a non -transferable Special Use Permit to Mr. and Mrs. Jerry Christianson to include the maximum of eight adult dogs. Mr. Heath seconded the motion. Motion declared passed. Mr. Gourley stated this will be on the Council agenda November 26, 1979. Plat - Forrest Glen Mr. Menkveld was not present and the plat was not considered. Special Use Permit - Timothy Rehbine Mr. Rehbine would like to use one side of a duplex for the purpose of operating his con- struction business and for a model home. The location would be a duplex he plans to build on 77th Street in the Plat Carole's Estates. Mr. Gourley read the minutes from the October 17, 1979 regular meeting regarding this request. Mr. Rehbine noted the October 17th minutes said two lots were rezoned R2, actually five lots were rezoned R2. Mr. Gourley asked Mr. Rehbine if he talked to Mr. Mobley about the size of the driveway. Mr. Rehbine said Mr. Mobley said if there were no more than 10 employees a regular drive- way was all that was required. Mr. Gourley felt this could be a problem and suggested Mr. Rehbine talk to Mr. Mobley about fencing as well. Mr. Gourley asked if parking could be restricted to "off street" parking. Mr. Shearen moved to recommend to Council that a Special Use Permit be granted to Tim Planning and Zoning Board November 21, 1979 Page -4- Rehbine to provide a duplex one half to be used as a business and model home facility and to provide "off street" parking for employees and be "non -transferable". Mrs. Schwankl seconded the motion. Motion carried. Mr. Rehbine was told this would be on the November 26, 1979 Council agenda. Mr. Gourley asked about the problem Mr. Rehbine was having on Knoll Drive regarding the side setback of a house. Mr. Rehbine said he is going to get the surveyor and Mr. Mobley out to the lot to see what can be done. Rezone - Land and Oaks, Inc. - Ken Tschida Mr. Gourley read the letter from Barton - Aschman regarding this property. Elmcrest Avenue was discussed. The point being the road would not support any industrial traffic. Mr. Heath questioned Bloch: #2 zoning. Mr. Tschida said whatever the Board prefers, either heavy or light industrial. One proposed use is a green house. Mr. Tschida said now they have a time problem.and did not realize there would be a problem with Elmcrest. Mr. Gourley read the letter from the Anoka County Highway Department. In regard to the paragraph regarding the additional 27' for street right-of-way the City policy is not to require the additional dedication but to require additional set backs. Mr. McLean said this gets away from the idea that the County will get this land free. Also the County does not have any otdinances or legislation to back up this requirement. Mr. McLean asked for topogs. There were none. Mr. Gourley referred to the planners letter regarding frontage road. Mr. Tschida said the County has no plans for one Mr. McLean said there remains the problem of Elmcrest Avenue, need for topogs and soil borings. Mr. Tschida said the soil borings are needed for the platting but not required for rezoning. Mr. Gourley said there is a request for rezoning not platting in the file. Mr. McLean read the requirement for light industrial and what operations were allowed in a light industrial area. It was noted that Acton is light industrial. Mr. Gourley said this could be sent on to the Planner and Engineer for more detail study or a recommendation for rezoning as presented on the map tonight with the understanding that a Special Use Permit is needed just for the land use. There was further discussion. Mr. Heath moved to recommend that Block #1 be rezoned General Business and Block #2 and #3 be rezoned light industrial. Mr. Gourley asked for withdrawal of the motion until after further discussion. Mr. Heath agreed. Mr. Gourley said the Palnner had addressed himself to setback requirements. Lot #1 was only 100' wide. Mr. McLean said that the industrial park was rezoned only after they had shown complete plans and prepared a package. Mr. Gourley said they had to put in some streets. Mr. Gourley said as stated before they can go two ways. Plarfiing and Zoning Board November 21, 1979 Page -5- Mr. Heath moved to recommend to Council that Block #1 be rezoned to General Business and Block #2 and #3 be rezoned to light industrial with the stipulation that in Block #1 the lines be moved so that they 132' frontage lot be Lot #1 and the 100' frontage lots be #2 and #3 with the access to County Road #14 be limited to two access and the County requirement of an additional 27'rwi,ilrnot be necessary but an additional set back re- quirement will be necessary and the Council set a public hearing. Mr. Shearen seconded the, motion. Motion carried. Mr. Gourley told Mr. Tschida that this will be on the Council agenda November 26, 1979 about 8:30 p.m. Mr. Gourley noted that Mr. Tschida will have to come back to the Planning and Zoning Board for a Special Use Permit before any construction can be started. Old Business Mr. Richard Berget did not appear tonight or last regular Planning and Zoning meeting and the Clerk was asked to contact Mr. Berget and ask him what his intentions are in respect to Lot #11 of Goldens Rice Lake Terrace. Plat - Royal Oaks Estates - Shoreview Mr. Gourley read the letter submitted with this plat. The plat is located in Shoreview adjoining Lino Lakes sourthern boundary just south of Baldwin Lake Road. The City of Shoreview has asked if this City has any comments or questions on the proposed development. Mr. Gourley said his only concern is that the County has input on the capacity of County Road "J". The entire access is County Road "J". It was noted/that the area contains 193 acreas and 498 housing units plus two 150 unit apartments: Mr. Gourley suggested the only action this Board could take was to forward it to the Council listing the Boards concern for County Road "J". Mr. Shearen moved to pass this plat on to the Council with the recommendation that the Council express its concern for additional traffice on County Road "J". Mrs. Schwankl seconded the motion. Motion carried. Mr. Gourley noted in Ordinance #56 on page 13 the section dealing with unsewered areas in non-residential areas need a Special Use Permit. The City has not been enforcing this part of the ordinance. Mr. Shearen said he understood that a Special Use Permit could not be made non -transferable and wondered if this would cause a problem. Mr. Gourley noted the Ordinance stated the Council could put any conditions they want on Special Use Permits. Mr. Heath moved to ajourn. Mr. Shearen seconded the -motion. Aye.
