HomeMy WebLinkAbout01/17/1979 P&Z MinutesThe regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:15 P.M., Wednesday, January 17, 1979 by Mr. Gourley. Members present: Gourley, Reinert, Jonnson, Heath. Members absent; Mattson, Shearen and Schwankl. Mr. Reinert moved to approve the minutes of the November 15, 1978 meeting as prepared. Mr. Gourley seconded the motion. Motion declared passed. There were no minutes of the December 20, 1978 meeting. There had not been a quorum. Election of Officers Mr. Reinert nominated Mr. Gourley as Chairman of the Planning and Zoning Board for 1979. Mr. Johnson seconded the motion. Mr. Reinert directed the Clerk to indicate an unanim- ous ballot for Mr. Gourley. Mr. Gourley nominated Mr. Reinert for Co -Chairman of the Planning and Zoning Board. Mr. Johnson seconded the motion. Motion declared passed. Mr. McLean did not have a report. Variance - Lee Robinson Mr. Robinson requested a variance to add a parcel he now owns of Tess than 22 acres to an existing parcel owned by Mr. Nelson. The correct legal survey was now in the file and Mr. Reinert moved to recommend to Council that the variance be granted. Mr. Johnson seconded the motion. Motion declared passed. Mr. Gourley told Mr. Robinson this request will be considered at Council on January 22, 1979. Variance - Charles bloom Mr. and Mrs. Bloom requested a variance to divide a lot of 22 acres into two lots of 14 acres. Mr. McLean noted that there was a large pond on the northern most lot and that the City Ordinance required one acre of buildable land to qualify for the variance. Mr. Reinert moved to recommend to Council that this variance be denied. Mr. Johnson seconded the motion. Motion declared passed. Special Use Permit and Variance Mr. and Mrs. Dennis Cunningham Mr. and Mrs. Cunningham have requested a Special Use Permit to establish a horse board- ing facility and training and riding facility. Mr. Reinert moved to recommend to Council that this Special Use Permit be granted subject to payment of the fee. Mr. Johnson seconded the motion. Motion declared passed. Mr. and Mrs. Cunningham have requested a variance to construct an auxiliary building before the primary building. They wish to build the barn now and the house later this year. Mr. Heath moved to recommend to Council that this variance be granted. Mr. Reinert seconded the motion. Motion declared passed. Special Use Permit - Richard Klenck ' Page -2- January 17, 1979 Mr. Klenck had not arrived and the Special Use Permit was tabled until he arrived. Special Use Permit - Forrest Tagg Mr. Tagg was not present. Mr. Gourley suggested that since all the requested material is in the file action could be taken. Mr. Reinert moved to recommend to Council that the Special Use Permit be granted subject to the payment of the fee. Mr. Johnson seconded the motion. Motion declared passed. Plat - Oak Knoll Mr. Dobie who will represent Mr. Van Kleek had not arrived and the plat was tabled. Rezone - El Rehbein & Son, Jerry Blackbird El Rehbein & Son requested that property located in the 7800 block on Lake Drive be rezoned from commercial and agricultural R1 to Light Industrial. Mr. McLean suggested the Board could include in their motion something regarding the landscaping of this lot. Mr. Reinert moved to recommend to Council that this rezoning be approved and a public hear- ing be set and subject to requiring the landscaping as described in Mr. Blackbird/s letter to the City dated November 24, 1978 and completed to the satisfaction of this City. Mr. Johnson seconded the motion. Motion declared passed. Rezone - EI Rehbein & Son, Quadraminimums, Jerry Blackbird El Rehbein & Son presented a letter to the Board asking approval of a prelimiary plat of quadraminiums on Outlots H & K and part of Outlot J in Lake Addition #2. The Clerk's office has questioned the zoning of outlots H & K. Mr. Blackbird said that when El Rehbein & Son purchased the property they assumed it was already zoned for multiple dwellings. A preliminary plan has been drawn for 39 four unit dwellings on this 23 acre parcel. A 60' green walkway is planned as access to Lake Resnaneau. An association of Quad owners would be formed to maintain and direct the area. A large number of residents from the area surrounding Outlots H, J & K were in the audience and asked to be heard. Mr. Gourley stated that this was not a public hearing but a re- quest to consider this plat and a public hearing would be conducted by the Council. Mr. Reinert asked that since these residents were here tonight to let them be heard.. Mr. Gourley asked tb::rn to give their names before they spoke. Mr. Nelson, a resident of East Shadow Lake Drive presented a letter and petition to the Board requesting the Board to deny the preliminary plat. The residents and Mr. Blackbird talked about several aspects of the plat. Since no one else gave their names their comments were not recorded but it is noted the residents were opposed to the plat because they believe it would devalue their property, increase the density too much and congest Lake Reshaneau. Mr. Blackbird pointed out there is already 23 acreas on the southwest side of Lake Reshaneau for park and lake access now owned by the City and also the density they are platting is less than the original town- house density. As for reducing the value of their residents, he felt this was not true. Mr. Reinert suggested that this Board could tonight recommend denial of the preliminary plat and pass it on to the Council. Mr. McLean noted that none of the consultants have F9age, -3- January 17, 1979 given their input and all facts should be presented to make an intelligent decision. The residents asked what they could do to stop this preliminary plat and Mr. Reinert suggested they talk to each of their Council men. He noted even if the Board recommend denial, the Council did not have to concur. Mr. Johnson noted that it would appear that to deny or not deny at this time would not be consistant with previous action of this Board. The Board has always requested input from the City consultants before coming to a decision. Mr. Reinert moved to table any further action on the preliminary plat documents as sub- mitted as stated in El Rehbein & Son's letter dated January 8, 1979. Mr. Johnson seconded the motion. Motion declared passed. Mr. Reinert moved to request the opinion of the City Planner and Engineer in regard to the requeded rezoning and preliminary plat of Outlots H, J & K of Lakes Addition #2 and this information be provided to each Planning and Zonimg member prior to the February meeting. Mr. Heath seconded the motion. Motion declared passed. Plat - Oak Knoll - Brian Dobie Mr. Dobie had arrived and the Board considered the Oak Knoll plat. Mr. Gourley asked if all documents were received and the Clerk said yes. Mr. McLean asked about the street Blue Bill Lane and Mr. Dobie said the City.Attorney had the abstracts for the street and Mr. Dobie said documents were prepared to grant Mr. Van Kl.eek ownership of the land to the street easement. Mr. Reinert moved to recommend approval of the plat subject to approval of the legal do- cuments required for conveyance of the street right of way and to also include the letter of credit for street construction. Mr. Heath seconded the motion. Motion declared passed. Rezone - Gene Mobley Mr. Mobley has requested that the property he owns on 22nd Avenue be rezoned from Limited Business to General Business to allow for full use of the land. Mr. Heath moved to recommend to Council approval of the request subject to payment of the fee. Mr. Johnson seconded the motion. Motion declared passed. Feasibility - Swenson Mr. and Mrs. Swenson presented a drawing of lot 12 in Equity Estates and asked if it would be possibie.to.sp.Jit this 10 acre lot into three lots and install a private drive and obtain building permits on all three lots. Mr. McLean explained there is presently a moratorium on splitting lots by metes and boumds in this City. Mr. Gourley explained that the Board has consistantly requested that lots meet City Code, 150' on an established street and felt even if the moratorium were lifted the Board would recommend denial of any request to divide any lot without the required street frontage. Mr. McLean suggested that Mr. Swenson have an engineer plot a street giving each lot the required frontage but with minimum length of street. Special Use Permit - Richard Klenck Mr. Klench requested a Special Use Permit to house vehicle over 9,000 lbs on his property on Rolling Hills Drive. Mr. Klenck has completed the form and has the signatures of the surrounding property owners. Mr. Reinert moved to recommend approval to the Council subject to payment of the r,<red - Page -4- January 17, 1979 fee. Mr. Heath seconded the motion. Motion declared passed. Old Business Mr. Gourley noted that a memo has been received from Mr. Mobley and Mr. Volk regarding Molin Concrete. He asked the Clerk to put this item on the April agenda. New Business Mr. McLean asked the Clerk to prepare the appropriate Ordinances for Mr. Heath and Mr. Johnson. Mr. McLean, Mr. Heath and Mr. Johnson will meet at City Hall on Saturday, January 27, 1979 at 9:00 A.M. to tour the City to acquaint Mr. Johnson and Mr. Heath with the various areas of development and boundaries. Mr. Reinert moved to adjourn at 10:30 P.M. Mr. Johnson seconded the motion. Aye
