HomeMy WebLinkAbout11/16/1977 P&Z MinutesNovember 16, 1977 o l The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:09 P.M. November 16, 1977 by Chairman Gourley. Members present: Gourley, Reinert, Shearen, Karth, Hill, Nadeau. Members absent: Schwankl. Mr. McLean Council liason was also pre- sent. The minutes of the October 19, 1977 Planning and Zoning Board meeting were considered. Mr. Reinert moved to approve the minutes as presented. Mr. Karth seconded the motion. Motion carried unanimously. Mr. McLean's Report Mr. McLean, Mr. Karth and Mr. Schneider had walked the proposed south side of the 7th Ave. Creek park area in Country Lakes on October 22, 1977. They suggested to the Council that this site is not acceptable and asked for a site of approximately 10 acres north of the Creek. The Council so moved. Mr. McLean presented a proposal for providing frontage to the duplex off of East Shadow Lake Drive. The Drovers State Bank would give the City a 60' strip to the house and a 75' strip for frontage with no proposal for surfacing the street. At the time the out - lot is platted the City would vacate this land. The Council so moved. Mr. McLean was notified today that Mr. Kronholm will meet with him again in a few days for further work on these two items. Lino Lakes City Council, Hugo City Council and representatives from Metro Open Space met November 5, 1977 and walked the area that is proposed by Metro Council for Otter Lake Regional Park. This City's position ias as well as Hugo's is that any reference to the Otter Lake Regional Park is to be deleted from both systems statements. This City has proposed a bikeway system on the roadbed on Bald Eagle Drive next to the asphalt surface and possibly some connecting walking trails. It was emphasized that our City Ordinance adequately protects the marsh lands. It was ali°pointed out that any bikeway or trail systems would be City owned, operated and controlled and not a part of the Metro Open Space program. No highlands will be considered. The Metro Council people said they would discuss this matter further. Mr. Nadeau asked if the bikeways and trail system would present serious maintenance pro- blems. Mr. McLean said that grants are available. Mr. Shearen said he thought that at one time Metro Open Space wanted all lands around Bald Eagle Lake. Mr. McLean said the Metro Open Space now say this was just a search area. Mr. Stanley had appled directly to the Council for a variance for a long driveway on one of the lots in Sunset Oaks. The building inspector was holding up his building permit for this variance. There was an attempt to reach the Planning and Zoning members by phone for their approval. The variance was granted with the reminder that the mainten- ance of this driveway is the responsibility of the home owner. Mr. Karth had presented an application for funding assistance for bikeways. The applicat- ion.was forwarded to Mr. Short for his suggestions. Mr. McLean reported that the Council had approved all of the October 19, 1977 Planning and Zoning Board recommendation. The Council accepted the street in Colonial Woods as part of the City's system for full maintenance. Page -2- November 16, 1977 Mr. Baber (Huber Property) Variance Mr. Baber representing Mr. Huber requested a variance for a long driveway on the property line of lots 5 and 6 on Bald Eagle Boulevard.%,c This driveway does not go to a residence. Mr. Baber presented the background beginningthe division of the land, the problems invol- ved with removing dirt from accross the street to construct the private driveway and res- titution for the dirt. He also explained his contact with the Corp of Army Engineers and the Division of Game and Wild Life. After all this Mr. Mobley told him he would need a variance for the driveway over 300' in length. Mr. Baber explained that both lots are now sold and the owners are aware that this is st- rictly a private driveway. The drivwway itself is approximately 16' wide and runs to the Hugo City line approximately 150' from Bald Eagle Boulevard. Mr. Shearen asked if a variance was necessary for a driveway that does not go to a resid- ence or other buildings. Mr. McLean said he thought the ordinance was for any driveway over 300'. He suggested Attorney Locher's opinion would be necessary. Mr. McLean told Mr. Baber that the Council has not taken final action on his request for a variance dated October 25, 1976 requesting a division of a lot into two lots each with less than 150' front footage. He further explained he will take this matter before the Council November 28, 1977 for the final action. Mr. Shearen moved to direct this application for a variance to Attorney Locher for his opinion as to the need for the variance. Mr. Hill seconded the motion. Motion carried unanimously. Mr. Shearen moved to direct the Clerk to inform Mr. Baber if the Ordinance does not per- tain to his application. Mr. Hill seconded the motion. Motion carried unanimously. James Davis - Variance Long Driveway Mr. Davis applied for a variance for a long driveway on a piece of property he is buying on Ware Road. Mr. Gourley said he could see no problems with his request other than a certificate of survey is needed and the actual owner of the land should apply for the variance. Mr. Reinert moved to recommend to the Council that this variance be granted subject to ownership of the land and that a certificate of survey be provided. Mr. Shearen seconded the motion. Motion carried unanimously. Constance Grundhofer - Special Use Permit Mrs. Grundhofer applied for a Special Use Permit to operate a beauty shop in her home. Mr. Gourley asked if there were any questions about the application. There were none. Mr. Reinert moved to recommend to the Council that this Special Use Permit be approved. Mr. Shearen seconded the motion. Motion carried unanimously. Rezoning - Feed Rite Controls, Inc., Thomas Dellich Mr. Gourley stated that Feed Rite has not stated what zoning designation they would like. He suggested light industry. Mr. Dellich said they waited to discuss this point. Mr. Dellich gave the Board a brief background on Feed - Rite Controls. Feed Rite is a dis- tributor of chemicals dealing primarily with municipal and industrial potable water and sewage systems. They have outgrown all their present facilities and wish to expand. Mr. Page -3- November 16, 1977 Dellich stated that municipal chemicals will be distributed from this area. The Lindy Company, one of their divisions will package some materials from this location. Mr. Reinert asked if chemicals such as anhydrous ammonia willl be used at this site. Mr. Dellich said at their East Hennepin site only. Mr. Gourley asked if some of the chemicals wer flamable. Mr. Dellich said 'yes'. Mr. Nadeau asked what size trucks would be coming into this facility. Mr. Dellich said there would be a few semi -truck and trailers but mostly one ton size units. Mr. Reinert asked if the hazardous chemicals were regulated by the State. Mr. Dellich said they were regulated by PCA, OSHA and the State. Mr. Hill asked if there could be any effluent getting into the air or ground. Mr. Dellich said holding tanks would be installed if this type of chemical were to be used at this fac- ility. Mr. Gourley said that further information would be needed before action can be taken on this rezoning request: 1. A certificate of survey for the entire parcel of land. 2. The City Engineer and Planner should review the request and submit their recommendations to the Board. The Clerk will forward the necessary information to them. 3. The City Attorney Lando! Locher should check to see if the City needs to institute any further controls. The Clerk will forward the necessary information to him. 4. Feed Rite Controls should check the fire services. Proper extinguishers will have to be available on the site. Mr. Hill asked Mr. Dellich how soon he would like a recommendation from the Planning and Zoning Board. He said they would like to start work on the site as soon as the frost is out of the ground. Mr. McLean said this information will be forwarded to the Planner, Engineer and Attorney. Copies of all correspondence received fromthese consultants will be sent on the Mr. Dellich and he will be placed on the December 21, 1977 agenda. Mar Don Plat - Marlin and Keith Tramm Mr. Tramm presented a plat for Mar - Don Homes located on 77th Avenue on property formerly owned by Amelia Husnik. Mr. Gourley told Mr. Tramm that the City Engineer had briefly looked over the plat and said that the lots under the power line would be unbuildable. Also a topographical survey would be needed and suggested he talk to Mr. Gotwald about it. Mr. Nadeau asked Mr. Tramm if he wanted the Clerk to submit this plat to the City Engineer and Planner for review or wait for a new concept drawing. Mr. Tramm said he would prefer to wait for a new drawing. Mr. Tramm asked if the City allowed platting in phases. He was told 'yes'. He also asked if a building permit could be approved before the streets were completed. He was told 'yes' if he posted a letter of credit or a bond. Mr. Tramm will have his concept redrawn and bring it to City Hall for the City Planner and Engineer to review. Old Business Page -4- November 16, 1977 Mr. Gourley said he will meet shortly with Mr. Hill to review the sign ordinance. New Business Mr. Gourley asked the Clerk to check the status of the trailer at Moline Concrete. The Clerk was asked to inform Chief Myhre of a possible ordinance violation at this location. Mr. Reinert moved to adjourn at 9:40 P.M. Discussion followed. Mr. Hill asked about the jurisdiction of the City regarding the One Shot Gun Club located at the end'of Marshan Lane. Mr. McLean said he would speak to Mr. Torkildson about this since the property be- longs to the Anoka County Open Space. Mr. Shearen seconded the motion to adjourn. Aye.
