HomeMy WebLinkAbout09/21/1977 P&Z MinutesSeptember 21, 1977 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:20 P.M. September 21, 1977 by Chairman Gourley. Members present: Hill, Nadeau, Shearen, Gourley, Reinert. Members absent: Karth, Schwenk!. Mr. McLean, Council Jiason was also present. On considering the August 17, 1977 minutes, Mr. Gourley noted that the motion on paragraph 7, page I was not unanimous. Mr. Hill and Mr. Gourley voted, No. Mr. Gourley noted that the minutes did not reflect that Mr. Art Rehbein appeared before the Board to discuss his request for a variance for a lot without front footage on a street. The Clerk had checked with St. Paul Abstract and found the abstract dated December 15, 1964. Our Ordinance #22 dated October 14, 1957, section #3 requires that no building permits will be issued for any construction unless the building site is located on an existing street. The Clerk was instructed to forward these materials to Mr. Locher. Mr. Hill moved to accept the minutes as amended. Motion seconded by Mr. Nadeau. Motion carried unanimously. Mr. Reinert arrived at 8:25 P.M. Mr. McLean's Report Mr. McLean reported that the Public Hearing for Carole's Estates had been held and the plat approved. He explained the situation regarding the new street being constructed in Lino Air Park and reported that the Council had approved all the recommendations of the August 17, 1977 Planning and Zoning Board. On September 12, 1977 the Council held a Public Hearing on the sewer service zoning map and had approved the map. This map deals with Urban Sewer Service Districts i and 2. The Council did not act on any other service area and all other areas remain rural. Mr. Leonard Thoney - Variance Mr. Thoney presented a request for a variance to split a lot creating two lots with less than 150' frontage and less than 22 acres. After discussion Mr. Shearen moved to recommend to the Council that a variance be granted to divide a lot of 273.4' into two lots, one with a frontage of 135' and one with 138.44'. Mr. Reinert seconded the motion. Motion carried unanimously. Mr. Art Rehbein - Variance Mr. Rehbein had a copy of a variance granted in September, 1972. The Clerk was instructed to send a copy of this variance to Attorney Locher and check the minute book to determine the reason for the variance. Mr. Lee Robinson - Variance Mr. Robinson requested a variance to split out a piece of land less than 21 acres from an existing parcel. After discussing how this division would affect future development, Mr. Reinert moved to recommend to Council that this variance be granted but that the depth of the lot be changed to 267' from the road right of way to line up with the existing rear easement. Mr. Shearen seconded the motion. Motion carried unanimously. Old Business Page -2- September 21, 1977 Mr. Nadeau asked at what point was Mr. Scherer's Special Use Permit. He was told that the Council is waiting for a statement from the company that manufactures the furniture stripp- ing material. Mr. Gourley asked the Clerk to contact neighboring communities and ask what their sign permit fees are and forward this information to him. Mr. McLean noted that as of July 1, 1977 all farm residential buildings require building permits. Our Ordinance #66 effective August 8, 1977 requires a land use permit for all agricultural out buildings. The reason for the land use permit is to control the location of the buildings. New Business Mr. Gourley said the Planning and Zoning Board has been asked to consider the question of money in lieu of Park land. The current ordinance requires all developers to dedicate 10% of the platted area for parks or the cash value of 10% of the platted area. This value is usually negotiated with the developer. Mr. Glenn Rehbein has suggest to the Council on July 25, 1977 that they consider a flat fee per lot for park dedication where land dedication was not applicable. This would equalize the cost to the developers and the cost would be known'immediately. This fee could be coll- ected at the time a building permit fee was collected. Mr. Shearen asked if the fee would be collected when every house building permit was issued whether or not the house was located in a platted area. Mr. McLean said this had been sugg- ested. Mr. Shearen said he would ask other builders how this is handled in other cities. Mr. Nadeau felt if this fee is collected from all new building permits the 10% of the value of the property would probably have to be lowered. Mr. Gourley wondered what is wrong with continuing as we have in the past. Its difficult to negotiate. Mr. Shearen felt the whole thing should be dropped. Mr. Nadeau felt that it was not fair for the entire City to pay for parks in a new develop- ment. Mr. Gourley felt the people creating the need should pay for it. Mr. McLean suggested dealing with plats on a continuing basis and recommend a flat fee for individual new lots. Mr. Hill asked about the park dedication in Country Lakes. Mr. McLean explained that a meet- ing is scheduled with Mr. Kronholm for September 27, 1977 to finalize the park situation. Page -3- September 21, 1977 Mr. Nadeau asked where in Ordinance #56 is landscaping a permitted occupation. Mr. McLean read a list of permitted occupations from page 19 of Ordinance #56. Further discussion followed. Mr. Gourley pointed out page 16, section B,2 of Ordinance #56 to the Clerk. He felt there was a need to let all adjacent property owners know when a request for a Special Use Permit is being considered. Mr. Hill moved to recommend to the Council that park dedication in platted areas continue as it is presently being computed and individual lots be handled on a direct fee basis by Council action. Mr. Nadeau seconded the motion. Motion carried with Mr. Shearen voting, No. Mr. Gourley noted that Dick's Small Engine Repair does not have a special use permit. The Clerk was asked to mail an application to this business. Mr. Shearen moved to adjourn at 9:45 P.M. Mr. Nadeau seconded the motion. Aye.
