HomeMy WebLinkAbout06/15/1977 P&Z MinutesJune 15, 1977 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:25 P.M. on June 15, 1977 by Chairman Gourley. Members present: Karth, Schwankl, Reinert, Nadeau, Gourley. Members absent: Shearen and Hill. Mr. McLean, Council Liason was also present. The minutes of the May 18, 1977 meeting were considered. Mr. Karth requested that a sentence be added to paragraph twelve, page 3 reading, "The Board had reservations about this request because there was a fire on this property in 1976 and cost the City a great deal of money." Mr. Nadeau moved to approve the minutes as amended by Mr. Karth. Mr. Karth seconded the motion. The motion carried unanimously. The minutes of the May 31, 1977 meeting were considered. There was not a quorum pre- sent and the minutes need not be approved. Mr. Reinert asked that the Clerk notify all Planning and Zoning Board members by tele- phone of all special meetings.' Yy Mr. McLeans Report Mr. McLean reported that the hearing for Rice Lake Addition was held May 23, 1977 and accepted by the City Council upon receipt of the approval of the Anoka County Highway Department. Mr. McLean noted that he had met with Mr. Kronholm regarding the park dedication in the Country Lakes area. He will have a further report later this evening. Mr. and Mrs. Gourley requested a variance and was approved subject to a 30' easement for road purpose. Mrs. Witte request for a variance to correct a pre-existing illegal land split was approved. Mrs. Kline's request for a variance:tosplit a lot in the Lexington Park Lakeview area was approved. Mr. McLean noted that Mr. & Mrs. Tauer presented a request for a variance to split a lot and was told that a correct legal description was needed. Mr. Fran Burque requested a variance to split a parcel of his property and it was app- roved. Mr. Vernon Walberg requested a variance to split a parcel off his property. He was told he would need a legal description. Mr. Warren Solheid had requested a Special Use Permit and was told by the Council that he did not need a Special Use Permit. Mr. and Mrs. Reinhold's letter regarding Mr. Glenn Rehbein's operation was noted. Mr and Mrs. Reinhold were told that Mr. Rehbein's operation met all City Ordinances and that any other problems would be a civil matter and they should contact their personal lawyer. Mr. Minkveld has presented a preliminary plat concept for information and will return to the Planning and Zoning Board and will prepare a preliminary plat for their consid- eration. Page -2- June 15, 1977 Midtaune's Green Acre plat was considered and he was told to continue with his plann- ing. Mr. Charles Nelson had presented a request for a variance to split a lot in Pine Vista 1 A special meeting was set for May 31, 1977. United Tire requested,a variance for a building constructed to close to the road right of way. The variance was approved. Mr. McLean noted the Planning and Zoning Board had requested comments from the City Engineer and Planner regarding Mr. Roland Ford's request for a land fill permit. The two sign permit applications were returned to the Building Inspector for further information. The checklist for platting procedures were approved with added recommendations. Mr. Scherer's request for a Special Use Permit was considered by the Council and app- roved subject to receipt of a report from Mr. Gotwald. Variance - Mr. and Mrs. Walter Tauer Mr. and Mrs. Walter Tauer had presented a request for a variance to split a lot they own on Lake Drive. Mrs. Tauer had brought the legal description in tonight. Mr. Nadeau felt two legal descriptions were needed since two lots were being created. Mr. Gourley noted that both legal descriptions were on the legal survey. Mr. Nadeau moved to re- commend approval of the variances based on the legal description provided and that a legal description be provided for each lot for the next Council meeting. Mr. Karth seconded the motion. Motion carried unanimously. Mrs. Tauer paid for the second var- iance this evening. Shenandoah 111 - Mr. Glenn Rehbein The Clerk read the recommendations of the City Planner and Engineer. Mr. Reinert felt that the extra long cul - de - sac would provide the City with costly maintenance pro- blems. Mr. Rehbein explained the type of curbing planned for that street and said he felt this type eliminated a considerable amount of maintenance. Mrs. Schwankl moved to recommend approval of the plat with the exception that the Board does not concur with the Planners recommendation regarding the length of the cul-de-sac and recommend that a publi hearing be set. Mr. Karth seconded the motion. Motion carr- y iAl, o -r+ c l ied unanimous) . Charles Nelson = Variance Mr. Nelson has requested a variance to divide Lot 6, Block 1 in Pine Vista 1. The lot is owned by Mr. Craig Johnson and had acquired additional property to the south so that each lot would be at least one acre in size. Mr. Gourley noted that two lots are being created and two certificates of survey and two fees are needed. Mrs. Schwankl moved to recommend approval of this variance providing both fees and a legal description iS provided for each lot. Mr. Nadeau seconded the motion. Motion carried unanimously. Midtaune Plat There was no one present from Midtaune Reality and the plat was not considered. Page -3- June 15, 1977 Rahovic Plat The Clerk read the City Engineer's and Planner's recommendations. A gentleman repre- senting Rahovic said they now wish to plat this area in a Phase 1 and Phase 11 devel- opment. Lots I, 2, 3, 4 and 5 of block 1 would be Phase 1. Also he wishes to build his own house on lot 2, block 2 but since this will be unplatted, the legal descript- ion will be by meets and bounds. Mr. McLean noted that the plat is in the sewer service district and could be platted into smaller lots. The gentleman said that smaller lots would ruin the appearance of the area. The Clerk was instructed to send copies of the Engineer's and Planner's letters to the developers and they will work out the Phase 1 and Phase II aspect of the plat. West Shadow Lake - The Griffin Companies, Inc. Mr. Alshouse, representing the Griffin Companies and Drovers State Bank appeared be- fore the Board with a map showing the possible platting of eleven lots on outlot B on West Shadow Lake Drive. He would like to have it surveyed and a preliminary plat pre- pared. Mr. Gourley noted that the outlot is located on a private road. Mr. McLean said the road would have to be completed to City specification and dedicated to the city. He also noted that it would have to be proven that the lots would support on site septic systems since municipal sewers are not available. After discussing several ways of providing an approved roadway, Mr. Nadeau noting that lots could be split at the time municipal sewer is installed, Mr. McLean noting park dedication, the Clerk was instructed to send copies of the Clerks letter to the Chair- man of the County Commissioners and copies of the platting ordinances and procedures to Mr. Alshouse. TkielGentle n from the audience asked if this meant he could not get a building permit at this time. He was told he could not get a building permit until all these issues were resolved. Walter Friese - Special Use Permit Mr. Friese has requested a Special Use Permit to store and sell fireplace wood from his residence. Mr. Friese was not present and the fee was not paid and the request was not considered. Mr. Nadeau felt the Board should formulate a policy regarding certificates of survey for sub -divided properties. Mr. Nadeau moved that in the future the Planning and Zoning Board policy will be to take action on variance requests only after a certificate of survey discribing subject property with a legal description of each individual parcel has been provided. Mr. Reinert seconded the motion. Motion carried unanimously. Sign Permits Sign permit application from Forest Tagg, Rite -Way Waterproffing and Getty Refining were considered. Page -4- June 15, 1977 Mr. Tagg's application needed further information regardingthe construction of the sign. The Clerk was also instructed to write to Mr. Tagg and let him know that he will need a Special Use Permit if he is operating a sand plasting business from his home. Rite - Way Waterproofing The sign application from Rite - Way Waterproofing was considered. The road set back was unclear and was held until this could be cleared up. The sign application from Getty Refining & Mktg. was considered. After determining the application was to add the word "FOOD" to a sign already erected. Mr. Nadeau moved to recommend approval of the permit. Mr. Reinert seconded the motion. Motion carried unanimously. Mr. Gourley asked the Clerk to write to Attorney Locher and again request his opinion in writing regarding the minimum lot sizes to update Ordinance #21. Mr. Gourley noted that Mr. Fords request for a landfill permit had been referred to the P.C.A., D.N.R. and Minn. Polution Control Agency for their comments. Mr. McLean reported on his meeting on June 6, 1977 with Mr. Kronholm regarding the park dedication in Country Lakes. Mr. Gredvig and Mr. Gourley were also present at this meeting. Mr. Gotwald had determined that there are approximately 184 acres in the Country Lakes Addition of which approximately 15 acres are owned by N.S.P. This would indicate a park dedication of 16.9 acres by Drovers State Bank and 1.5 acres by N.S P. There is an area off of 7th Street where the creek crosses 7th St. of about 5.5 acres that has been considered for park purposes. Mr. McLean felt this is probably the only opportunity the City has to acquire lake front property. Mr. Nadeau asked if this was buildable land and Mr. McLean felt it was all high land and usable. Mr. McLean has asked for the City Planner's and Engineer's and Mr. Locher's recommend- ations. Mr. McLean said they are still working out NSP'S parks consideration. West Shadow Lake Drive was discussed at this meeting. Mr. Kronholm will be contacting the County Commissioners about this. Mr. McLean noted that the Building Inspector was instructed to issue a red tag to a trailer parked on a lot on Otter Lake. Mr. Gourley noted that the performance bond for the Building Inspector is in the amount of $1,000.00. This amount should be $2,000.00 by Ordinance. The Clerk was instructed to correct this and check to see if the Building Inspector was covered by the Errors and Ommissions policy. Mr. Gourley felt more direction is needed regarding sign permits. The members of the Planning and Zoning Board feel they do not adequate knowledge of sign construction to make a proper decision. Mr. Karth said that sometime ago the Planning and Zoning Board had directed the Building Inspector to perform this duty. Mr. Nadeau noted that the Building Inspector had allowed a basement to be dug to close to the road -right-ofway and it cost the builder a couple of hundred dollars to correct the location of the basement. Page -5- June 15, 1977 Mr. Nadeau questioned if anyone could put up a pole building on a lot. Mr. McLean noted that the City will be receiving the Metropolitan Systems Statement within the next couple of weeks. The Planning and Zoning will have to deal with the Statement within 60 days and will probably have to meet in July to generate a response to the Statement. Mr. Gourley will arrange a meeting with the City Engineer and Planner. Mr. Reinert moved to adjourn at 11:10 P.M. Mr. Nadeau seconded the motion. Aye.
