HomeMy WebLinkAbout05/18/1977 P&Z MinutesMay 18, 1977 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 7:05 P.M. on May 18, 1977 by Chairman Gourley. Members present; Karth, Shearen, Nadeau, Schwankl. Absent; Hill, Reinert. Mr. McLean was also present. On considering the minutes of April 20, 1977, Mr. Nadeau changed the words 'may be' to 'was' in paragraph 16, page 4. The Clerk also noted the word 'West" should be changed to 'East', page two, paragraph 13. This describes the easement on Pine Vista II plat. Mr. Shearen moved to approve the minutes as corrected. Seconded by Mr. Nadeau. Motion carried unanimously. Mr. McLean reported on the status of the suggested meeting with Mr. Ranta of the Metropolitan Council in conjunction with the systems statement. THis meeting has been cancelled due to the issues to be resolved surrounding the installation of the interceptor. Mr. Kronholm will be meeting with Mr. McLean, Mr. Gourley and Mr. Zelinka on June 6th to discuss the lands for Park Dedication in the Country Lakes Addition The Clerk is to contact Mr. Gotwald for the acreage in the plats. The Townhouse without frontage on the East side of the lake will also be considered The first item on the agenda was an application for a variance for a lot split by Mr. Dale Gourley. This lot is located on 2nd Avenue. However, at the present time there is only a 33' easement for street purposes. On the lower end of the street there are recorded easements for 93'. This street also ties into the new plat by Mr. Ullmer. The Planning and Zoning suggested the Engineer talke a look at this street and align with the Rice Lake Addition. Mr. Nadeau moved to recommend this Variance be granted subject to the Engineer', recommendation for additional right-of-way. Seconded by Mr. Shearen. Motion carried with Mr. Gourley abstaining. The Planning and Zoning Board requested the Engineer to check this and make recommendations for Council consideration. The next item was a variance for the transfer of title on a parcel of land of less than 24acres. This split had occured several years ago, but title cannot be transferred at the present time because of the ordinance requiring 2 acres. The land is owned by Viola Witte and the application was applied for by NorthNorth East Realty, the seller. Mr. Shearen moved to recommend approval. Seconded by Mr. Karth. Motion carried. This variance is for Tract 'A' only. If the other parcel is sold, a separate variance will have to be applied for. Also, Mr. Blackbird had paid for two variances, he should be refunded for one application. Mrs. Aneta Kline, represented by Mr. Stanley, had applied for a variance to split her lot on the corner of Lakeview and Gladstone in the Lexington Park Lakeview area. This is in line with the variances granted to other home owners with corner lots on that street. Mr. Karth moved to recommend approval -of this variance. Seconded by Mrs. Schwankl. Motion carried. Mrs. Audrey Tatter submitted a request for a variance to split a 200' lot located along Highway #8 into two 100' lots for the purpose of selling the South 100' feet. There were some discrepancies in the legal. Mrs. Tauer said when those lots were purchased, they were all recorded as 100' lots. The Planning and Zoning Board had no objections to the lot split, but they asked that the legal description be clairfied. This request will be held May 18, 1977 Page Two for that information. Mr. Fran Burque presented a request for a variance to split a one acre parcel from his land along 64th Street Mast. Mr. Burque has not received the legal description from the surveyor, but felt he would have this before the Council meeting on May 23, 1977. Mr. Shearen moved to recommend approval of this variance provided a legal description is available before this is presented for Council consideration. If the legal description is not presented, then no action be taken by the Council. Seconded by Mr. Karth. Motion carried. Mr. William Wahlberg presented a request for a vaaiance to split a parcel of land of less than 2% acres from his Father's land located on the Northside of Lilac Street. The remaining frontage was checked and found to be sufficient Mr. Wahlberg was informed his frontage and address would be on Lilac and if the entrance to his lot is built off his Father's driveway, this is his responsibility. Mr. Nadeau moved to recommend approval of this variance. Seconded by Mr. Shearen. Motion carried. Mr. McLean asked if there been an answer from Mr. Locher on the question of including or excluding the road -right-of-way in the acreage computations and the Clerk said, not as yet. This request is to be forwarded to Mr. Locher. Mr. Warren Solheid had submitted an application for a special use permit. Mr. Solheid was not present but Mr. Nadeau would answer any questions from the Board. Mr. Solheid is buying 5 acres of land from Mr. Nadeau that fronts on Cedar Street. He is a house painter. Mr. Nadeau said Mr. Solheid had called the City offices and had been told that he did not need a special use permit, but Mr. Nadeau felt that since Mr. Solheid will be working out of his home and will have a business phone, it was necessary that a special use permit be applied for. The Clerk said Mr. Solheid had called asking if a special use permit was necessary to park a van in his garage and had been told that it was not. He had told the Clerk that no painting materials would be stored at the location and his van met the weight restrictions. The matter of a business phone or a private phone used for business is not the criteria by which special use permits are issued and is not discussed in the ordinance dealing with special use permits, therefore there is no guide by which this matter can be judged. The Clerk felt that with the information that had been given to her, there was no reason to apply for a special use permit. Mr. Shearen agreed and moved to recommend to the Council that if the Council felt it was necessary for special use permit, that one be granted. Seconded by Mr. Karth. Motion carried. Mr. and Mrs. Reinhold had written a letter of complaint dealing with Mr. Glean Rehbein's operation on Lake Drive. Mr. Locher had been asked for an opinion on this matter. His answer was read to Mr. and Mrs. Reinhold. There were points they disagreed with, but Mr. Locher's letter stated these matters are a civil matter since Mr. Rehbein's operations are within the provisions of the City ordinances. Mr. and Mrs. Reinhold were advised that if they plan to pursue this matter, they should consult their own Attorney. Mr. Glenn Rehbein was not present and Shenandoah III was not considered. Mr. Menkveld had submitted hand drawn sketches for platting of two parcels of land he owns. These sketches were very preliminary and Mr. Menkveld was told May 18, 1977 Page Three the lots were too small and the adjustments he would have to make in the plat. Mr. Menkveld said he was basically asking for information. He will prepare preliminary according to the -information he had received and re -submit. Midtaune had submitted a preliminary plat for the 40 acres directly North of Sunrise Park abutting Sunrise Avenue. The topography and street grads were not included and the suggestion of realigning thestreets to connect to the existing streets in the Lexington Park Lakeview Area. The agent for Midtaune asked if a building permit could be had for the construc ion of a model home on this land? Since there is more than adequate frontage on Sunrise, the Plannijg and Zoning Board felt this could be handled the same way as in Sunset Oaks - a building permit could be issued with no occupancy until the final plat is approved. Midtaune will prepare the topography maps and the street grades and realignment and re -submit. Mr. Charles Nelson applied for a variance for a lot split in Pine Vista I to allow the installation of a street for acess to Pine Vista II. Mr. Nelson said that he cannot purchase the land from the owner to the East. He presented a sketch to the Planning and Zoning Board with an alternate suggestion as to the alignment of the street. The Planning and Zoning requested Mr. Nelson to have this drawn by Mr. Gotwald and to give his opinion on the use of this by Fire trucks and snow plows. It will also be necessary to get Mr. Locher opinion on an easement within the property. Mr. Shearen felt the variance for the lot split could be approved if both section had one acre and the new street alignment is feasible. A special meeting for the consideration of this was set for May 31, 1977 at 7:30 P.M. Mr. Roanld Rasmussen presented a request for a variance for a building too near the street right-of-way on Maple Street. Mr. Rasmussen explained his reason for putting the building as such. He had felt he was within the ordinance at the time. Mr. Shearen moved to recommend approval of. this variance for a non -conforming building in order to clear an existing violation. Seconded by Mr. Karth. Motion carried. The request by Mr. Roland Ford to establish a land fill at his home location on Hodgson Road was considered. The Planning and Zoning Board asked the Clerk to forward this to the Engineer and the Planner for their recommendations. Their comments should b emeeting. Mr. Gourley felt that Sparkle Wash was dismantling cars at that locations and asked for a new report from the Chief. Mr. McLean asked about the house on the corner of Elm and Sunrise that had a sagging roof and was told the roof is straight and the siding is progressing. May 18, 1977 Page Four The sign permit applications were considered. There was some question on the flashing light as proposed by Skyline Auto Body and on the wood construct- ion as proposed by Restoration Enterprise. These are to be returned to the Building INspector for clarification. The Clerk had prepared a proposed checklist for platting. This is to be for- warded to the Council for their consideration. The matter of the existing pigeon house was discussed. This matter is to be turned over to Mr. Kelling. Mr. Peter Scherer had submitted an application for a special use permit to strip and refinish furniture in an existing building at his home on 64th St. Mr. Scherer said there is no drainage and no chemical dumping. The material used is bio -degradable, can be used with bare hands, there is no need to wear a mask, it non-combustiable, no fans are needed and Mr. Schere said the material is returned to the original containers, ship back to the seller and recycled. Mr. McLean asked if Mr. Scherer_has an brochures on this material? He suggest- ed Mr. Scherer get some literature and present to the Council so they are aware of what is being done. Mr. Scherer was asked the size of the operation and_:if he would have any employees and Mr. Scherer said, it is strictly a one man operation and he will only be refinishing furniture he owns. Mr. Scherer said there are three such operations in Saint Paul, he will get information from them before the Monday night Council meeting. Mr. Shearen moved to recommend approval of this special use permit subject to receipt of specs on material used in the stripping process before the Council meeting. Seconded by Mrs. Schwankl. Motion carried. Mr. Shearen moved to adjourn at 10:57 P.M. Seconded by Mrs. Schwankl. Aye.
