The regular meeting of the Planning and Zoning Board was called to order by Chakiiman
Gourley at 8:08 P.M. April 20, 1977. Members present: Gourley, Hill, Reinert, Nadeau,
Shearen. Members absent: Schwankl, Karth. Mr. McLean, Council liason and Mr. Volk
were also present.
Mr. Shearen moved to accept the minutes of March 16, 1977 as presented. Mr. Hill sec-
onded the motion. Motion carried unanimiously.
Mr. McLean read the Council minutes of March 31, 1977 pertaining to Council actions
on the Planning and Zoning recommendations. The Planning and Zoning Board had questioned
the pigeon house in Shenandoah. The Clerk had checked her records and no building permits
had been issued for this building.
Mr. McLean noted that the Council had approved the Special Use reguest from Mr. Elmer
Maisio to stable a horse on his property. Mr. Gourley asked that it be noted that the
Planning and Zoning Board had not completed action on this matter and had not recomm-
ended Council approval.
Molin Concrete - Mr. William Molin
Mr. Gourley asked Mr. Bill Molin to step forward and discuss the matter of the ditch
along side of their property on 4th Avenue and planting trees for screening.
4r. Volk stated he had inspected the ditch and it is not at its original level, probably
9" to 10" higher than previously. He felt it was not a great problem but could possibly
be and would like the ditch returned to the original elevation. Mr. Volk noted that some
of the Molin products were being stored on the road easement. Mr. Gourley noted that
he had observed that the material had already been moved.
The gravel in the ditch was discussed. Mr. Gourley noted that this condition is so
that it could lend itself to egres at this point. Mr. Molin said he did not want this
to happen either.
Mr. McLean asked Mr. Molin if he would plant trees on the North for screening. Mr.
Molin said it had not been a requirement. He felt they would not.
Mr. Hill moved to recommend to Council that Mr. Molin regrade the ditch to its original
grade and replace the vegetation in the ditch as necessary and plant two rows of trees,
pines or their equal on their west boundry to extend the extent of their storage yard
on 4th Avenue. Mr. Shearen seconded the motion. Motion carried unanimously.
Special Use Permit - Mr. Robert Reinertson
Mr. Reinertson has applied for a Special Use Permit to show ceramic tile to his customers
from time to time. He stated he is an installer not a salesman and would not be selling
tile from his home and would not be storing tile on his property. Customers would be
selecting their patterns only.
Mr. Reinertasked if this could generate increased traffic in the future. Mr. Reinertson
said, No. He felt that if he got to the point of showing tile often he could not keep
up with installing it.
Mr. McLean asked if he would be putting up a sign and advertising. Mr. Reinertson said
he would need some sort of sign. Mr. McLean noted that a sign permit would be necessary.

Mr. Reinertson said he had the signatures of all adjoining property owner but one on
his application.
Mr. Shearen moved to recommend to Council that this Special Use Permit be granted to
Mr. Reinertson for the purpose of showing sample ceramic tiles in his home and that
there be no storage of tiles except those transported in his vehicles. Mr. Hill sec-
onded the motion. Motion carried unanimously.
United Tire - Ronald Rasmusson - Application for a Variance
United Tire was not represented tonight. Mr. Gourley moved to forward this application
to Council. After further;dk cussion, Mr. Gourley withdrew his motion.
The Clerk was directed to contact Mr. Furlong, owner of United Tire and ask that the
$25.00 fee be paid and that he or his representative appear at the May 18, 1977 Plann-
ing and Zoning Board meeting.
Jerry Blackbird - Variance
Mr. Blackbird was not in the audience and the variance was not considered.
Mr. Nadeau arrived at 9:00 P.M.
Pine Vista II Plat - Charles Nelson
The Board reviewed Mr. Nelson's plat plan and reviewed the recommendations of the Planner
and Engineer. Mr. Hill asked if there would be a problem with drainage going north to
the adjacent property. Mr. Nelson said, No.
Mr. McLean noted that lots 1 and 2 in Pine Vista I are under an acre in size and do
not meet requirements. Mr. Shearen noted that the road is long and could create problems.
Mr. Nelson said he did not want to change his concept, he wanted to retain the large
lots and this street provides greater privacy. He also noted that the street lends
itself to future development in the area and future utilities. Also Metro Council wanted
the lots in line for future splits.
After further discussion Mr. Shearen moved to recommend to Council approval of this plat
without lots one and two from Pine Vista I and that the 30' easement be extended along
the entire eastern border of lot six to match lot sever. Also easements on the west E4'57-.
side of lots six and seven be designated road and drainage easements and the entire ease-
ment on the entire southern border of the plat be designated road and drainage easements.
Mr. Reinert seconded the motion. Motion carried unanimously.
Don Holzmeir - Floyd Miller property
Mr. Holtzmeir asked if he could build on a piece of property (plat #82903, parcel 5400)
located near W. Rondeau Drive and 81st Avenue. This property does not have any road
frontage, only a 60' road easement.
Mr. McLean pointed out that the City Ordinances require that there be 150' frontage on
an established road. The Board suggested that the easement be brought up to City road
specifications with a cul -de -s -c and dedicated to the City. A building permit could then
be issued.
Mr. Miller explained there is a lot available on the corner of W. Rondeau and 81st.

Street. If Mr. Holzmeir purchases this lot there would be plenty of access to the other
property. Mr. McLean explained this would be for Mr. Holzmeir and Mr. Miller to work
out.
Ardell Johnson - Application for a Variance
Mr. Johnson asked for approval to split his lot at 6909 Lakeview Avenue into two lots,
one fronting on Lakeview Ave. and one fronting on Glenview Avenue.
Mr. Gourley explained this is a lot on an existing plat and this does comply with ex-
isting development.
Mr. Reinert moved to recommend to Council approval of this variance. Mr. Shearen sec-
onded the motion. Motion carried unanimously.
Shenandoah Third Addition - Glenn Rehb(bin
Mr. Rehbein was not present. The plat was not considered.
Rice Lake Addition Plat - Ulmer
Mr. Ulmers Rice Lake Addition Plat was considered. The Planners and Engineers recomm-
endations were read and discussed. Mr. Gourley noted that some lots did not meet the
one acre minimum.
Mr. Reinert noted that the original drawings showed one acre lots and wondered why the
Engineer did not follow through on the final concept. Mr. Ulmers Engineer is also the
City consulting engineer and he is aware of the requirement. He felt this causes add-
itional problems and expenses for Mr. Ulmers and this should have been avoided. Mr.
Ulmers said he would take this matter up with Mr. Gotwald, the engineer.
Mr. Hill asked if there would be any drainage towards Elm Street. Mr. Ulmers said only
street runoff.
Mr. Nadeau moved to recommend to Council approval of this plat with the condition that
all lots be at least one acre in size with 150' road frontage and that the Engineer
has this prepared for Council consideration April 25, 1977 and subject to the Planners
and Engineers recommendations and that the Council set a public hearing. Motion seconded
by by Mr. Reinert. Motion carried with Mr. Shearen abstaining.
West Oaks Plat - James R. Hill, Mr. Brueggerman
Mr. Hill presented his plat and explained that this is a redesign and continuing study
of West Oaks of Otter Lake formerly owned by Mr. Paul Albrecht.
Mr. Hill was given copies of the Engineers and Planners reports.
Mr. Hill said he would like the Planning and Zoning Board to approve this preliminary
concept so: that he can continue presenting his plat to the many• other governmental
agencies that will have to be involved.
Mr. Shearen noted that some of the lot sizes did not meet Ordinance requirements.
Mr. Shearen moved to recommend to the Council approval of this plat subject to the Eng-
ineers and Planner suggestions and require that all lot be at least one acre with at

least 150' on a City approved roadway and recommend that a public hearing be set. Mr.
Hill seconded the motion. Motion carried unanimously.
The Board thanked the Gentlemen for coming.
Midtaune - Preliminary Plat
A Gentleman presented the preliminary plat for Midtaune Realty. He was given copies of
the Engineers and Planners reports.
Mr. McLean asked what size the lots would be. He was told they would like to build on
one acre but sell only 4 of the acre with the house and retain ownership Of the remain -
3/4 of the acre.
Mr. Gourley felt that since the City has required one acre Tots from all other developers,
this practice should be continued. He also suggested aligning the roads with Mr. Ulmers
roads and the existing roads.
The Board thanked the Gentleman for appearing.
Sign Applications

Antiques - Gene Mobley
Mr. Shearen asked why these applications need Planning and Zoning approval. It was not
determined why sign application come before this Board.
Mr. Shearen moved to recommend approval of all three signs proved they meet the require-
ments of the sign ordinance and the applications are properly completed and the fee is
paid. Mr. Hill seconded the motion. Motion carried unanimiously.
Mr. Gourley noted that he had received a letter from Mr. & Mrs. Paul Reinhold. He asked
the Clerk to put it on the May agenda. Mr. Gourley asked the Clerk to check with Attorney
Locher on this matter.
Mr. Gourley asked the Clerk to ask Attorney Locher for written recommendations on Ord-
inance #21.
Mr. Shearen asked about the required setbacks for a new house and whether or not our
ordinance spells out whether or not a house can be set back further than the adjacent
houses. It was determined that a house can be set back further than the adjacent houses
but would need a variance if the driveway was over 300' long.
Mr. Gourley said the Clerk had checked for a building permit on a pigeon house in Shen-
andoah but found none. Mr. Shearen moved to recommend that the Council look into the
complaint on this matter. Mr. Reinert seconded the motion. Motion carried unanimously.
Mr. Nadeau felt that the Clerks office may be giving inaccurate information to the public
regarding Special Use Permits. The Clerk will check to see if a special use permit is
required for someone who is a self employed painter and decorator.
Mr. Gourley asked that the Police reports on Sparkle Wash, Skyline Autobody and R & E
Restoration be placed on the May 18, 1977 agenda.

Mr. Gourley noted that the Clerk had prepared a check list for developers who are sub-
mitting plats for approval. The Clerk will make copes of this form and send them to the
Planning and Zoning Board members for their comments and suggestions.
Mr. Shearen asked why only 2/3rds of adjoining landowners are required on the special
use permit application form. The Clerk will ask for Attorney Locher's comments on this
matter.
Mr. Reinert moved to adjourn at 11:30 P.M. Mr. Hill seconded the motion. Aye.
