The regular meeting of' the Planning and Zoning Board was called to order by Chairman
Gourley at 8:05 P.M., March 16, 1977. Members present: Schwankl, Gourley, Hill, Karth,
Reinert, Shearen. Members absent: Nadeau.
Mrs. Anderson read the minutes of the February 16, 1977 regular meeting. Mr. Karth
asked the minutes be amended to include in paragraph 4, page 1, a sentence stating that
"The street in the unnamed plat north of Birch Street is long and should be changed."
Mr. Karth asked what happened to phase 11 of Mr. Hansen's Otter Lake Estates. Mr. McLean
said the Mr. Hansen told the Council that he was going to eliminate phase 11 for the
present. Mr. Hansen will fulfill the requests of the Planner, Engineer and Rice Creek
Watershed Board.
Mr. Karth moved to approve the February 16, 1977 minutes as corrected. Mr. Reinert
seconded the motion. Motion carried unanimously.
Mr. McLeans Report
Kolstads Sunset Oaks - Mr. Kolstad had requested permission to obtain six or eight build-
ing permits to construct model homes. He said the homes would be constructed on lots
fronting on an existing approved roadway and would not be for occupancy. After discuss-
ion with Mr. Locher the Council did approve this request.
Crossways Gun Club - The Club had requested permission from the Rice Creek Watershed
Board and the Department of Natural Resources to clean a channel on the east side of
Rondeau Lake. Mr. Gotwald said the Council could not consider the application because
a set of plans was not included and there was no material for review. The Clerk was to
write to the DNR and the Rice Creek Watershed Board and ask for the drawings.
Mr. Short had met with the Physical Development Committee on February 17, 1977 and the
Council had met with the representatives of the Metro Council on February 23, 1977. There
will be another meeting on March 17, 1977. Mr. Shearen asked if density was one of the
was one of the problems. Mr. McLean said, Yes. Mr. Reinert felt that Metro Council
needed to be challenged. Mr. McLean read a portion of a letter from Metro Council re-
garding WPC40 and the problems between the Pollution Control Agency and Metro Council.
Mr. McLean felt the City should not be required to conform to a particular program that
is not required of all communities.
Mr. McLeans Planning and Zoning report to Council on February 28, 1977 included mention
of Mr. Glenn Rehbein's Plats Shenandoah East and the unnamed Plat north of Birch Street
Mr. Luther LeVessuers request to split his lot and request to combine two lots, Mr. Nelson's
submission of a proposed plat, Pine Vista Black Two, Drovers State Bank plat for four
townhouses on West Shadow Lake Drive, Mr. Hansen's Otterland Estates preliminary plat
approval. A hearing was set for April 11, 1977 at 8:30 P.M. on this plat. Mr. Hansen
was also told he must represent himself in these proceedings or state in writing who is
to be his agent.
Mr. McLean reported that Mr. Rasmussen of United Tire had not responded to the request
for a variance for his building. Mr. Tim Rehbine had presented a sketch of a plat south
of Main Street and was asked to redraw it.
Mr. McLean said Mr. Kronholm had tehephoned him and said he would like to get together
and determine how much land would be dedicated for parks in Country Lakes and where the
park should be located. Mr. McLean will get together with Mr. Kronholm.
Mr. Arnt of Arnt's Construction presented the Planning and Zoning Board a picture of
the building he would like to construct south of the Acton building on property now owned

by Acton Construction. Mr. Arnt also submitted a letter from Mr. Paul Miller's attorney
granting Mr. Arnt a non-exclusive access to his building. The Board told Mr. Arnt that
the building must have about I50r to 180T fronting on a dedicated City Street. They
asked Mr. Arnt to contact Mr. Miller and have him bring the driveway up to City Street
standards and dedicate it as a City Street and then the Board could consider his request
for a building permit.
Mr. Glenn Rehbein presented his preliminary plat of the unnamed plat north of Birch
Street. He has re -aligned the entry road with Hokah Drive in Shenandoah and has
left provision for future expansion and possible acess on the east and west. Mr. Karth
suggested that these two accesses be directly accross from one another.
Mr. McLean said since this plat abuts the Anoka County Open Space he would suggest Mr.
Rehbein denote cash rather than land for park. Mr. Reinert said he has some reservat-
ions about strip platting. Mr. McLean asked Mr. Rehbein if he had sought out the feelings
of the adjacent neighbors. Mr. Rehbein said he had bought the land from Mr. Apitz on
the west and Mr. Apitz knew his intentions at the time. Mr. Rehbein did not comment
on Mr. Spe.iser's feelings.
Mrs. Schwankl felt the street should be straighten after it enters the plat.
Mr. Gourley told Mr. Rehbein he should continue with his plat by sending copies of the
plat to the City engineer, planner, Rice Creek Watershed Board and DNR.
Mr. Rehbein presented his preliminary plat for Shenandoah II. Mr. Shearen noted that
the park land in this plat lines up with the park in Shenandoah. Mr. McLean noted there
were two lots with less thatn 75' frontage. Mr. Hill asked Mr. Rehbein if the park area
was low and in danger of flooding. Mr. Rehbein felt it was not but would see that it
was properly drained. Mr. Hill asked about parking cars in the area. The Board felt
that since this is a neighborhood park there would be no problem. Mr. Rehbein said it
would be graded and seeded.
Mr. McLean suggested Mr. Rehbein name the streets.
Mr. Shearen moved to recommend approval of the preliminary plat of Shenandoah 11 subject
to the planner, engineer and Rice Creek Watershed Board recommendations and that all lot
sizes be at least standard size. Mr. Karth seconded the motion. Motion carried unanimously.
Mr. Clover appeared before the Board and asked approval for a trailer house to be used
as an office ori 20th Avenue where his kennels are located. Mr. McLean noted other resid-
ents who had made the same request and were denied. The Board told Mr. Clover that they
will continue this practice. Mr. Clover thanked the Board for hearing his request.
Mr. & Mrs. Maisio presented their request for a special use permit to keep a horse on
his brothers 8.1 acres north of their residence in Norden Manner. Mrs. Maisio said the
horse would be corralled on their lot behind the lot on which they live. After discuss-
ion the Board told Mr. & Mrs. Maisio that if the horse was kept completely on his bro-
thers acreage a special use permit was not necessary. However, if the horse was to be
corralled on their lot another special use permit would be necessary. The Clerk was in-
structed to talk to the City Attorney about this matter.
Mr. Ulmer presented his plat of Rice Lake Addition. He asked the Board if they thought
it was a realistic plan and could he continue with it.
Mr. Gourley suggested the street that comes off of 2nd Avenue be squared off not rounded.

Mr. Shearen said that there would have to be a cul - de - sac where one street dead
ended. Mr. Hill suggested that Mr. Ulmer might have problems with one of his neighbors.
Mr. Gourley asked if the owner of the hobby farm to the north was aware of the suggested
roadway. Mr. Ulmer said, Yes.
Mr. McLean suggested that since Sunrice Park was so near that a cash donation rather
than land for park purposes would be more appropriate.
Mr. Gourley asked Mr. Ulmer to have his plat redrawn with the suggested changes and send
copies to the City planner, engineer and Rice Creek Watershed Board for their comments.
The Board thanked Mr. Ulmer for appearing tonight.
Mr. Tim Rehbine presented his request for a variance to split a parcel of less than.
22 acres. Mr. Gourley asked the Board if there were any questions. There were none.
Mrs. Schwankl moved to recommend approval of these variances. Mr. Shearen seconded
the motion. Motion carried unanimously.
Mr. Rehbine submitted a new drawing of his plat located south of Main Street. Mr. Gourley
asked if the lots were at least one acre in size. It was determined they were not.
Mr. Shearen explained the problems we were having with Metro Council and minimum lot sizes.
Mr. Gourley suggested that Mr. Rehbine redraw his plat lot sizes at least one acre and
send the City planner, engineer, and Rice Creek Watershed Board a copy of the plat for
their comments. If these requests are returned to the Clerks office before April 11,
1977 the Clerk will put him on the agenda for April. The Board could then review the
plat for preliminary approval.
United Tires request for a variance for their building was considered. Since there was
no one there to represent United Tire, Mr. Hill moved to table the request until the next
meeting. Mr. Reinert seconded the motion. Motion carried unanimously. The Clerk was
instructed to contact Mr. Rasmussen and ask him to appear at the April meeting. Akso
the fee of $25.00 has not yet been received.
Mr. Ken Kaiser appeared before the Board and explained his plan to purchase the convent
at St. Joseph's Catholic Church for the purpose of a half way house for persons ages
15 to 30 years of age who have just been released from a chemical treatment facility.
There could be as many as 14 people living at the halfway house at one time.
Mr. Kaiser was asked if this is a commercial venture, is it a profit making venture?
He said, Yes. Mr. Gourley asked the problem of a profit venture located on tax exempt
property. Mr. Kaiser said he would like to purchase the property or at least obtain a
long term lease.
Mr. Kaiser was told that the convent did not front on a dedicated City street and this
problem would have to beresolved if he purchased the property.
Mr. Gourley asked Mr. Kaiser to complete a special use form. He also asked that a copy
of Mr. Kaiser's proposal to the church be attached to the special use request form.
When these items are received in the Clerks office, Attorney Locher will be asked for his
opinion.
The Board thanked Mr. Kaiser for coming.
Mr. Gourley said Mr. Hendrickson had called him regarding Moline Concrete. The Clerk
had received a communication from Moline saying they are willing to do whatever necessary

to clean their property.
Mr. Gourley asked the Clerk to ask Moline Concrete to appear at the April 20, 1977 meeting.
He also asked that Mr. Hendrickson be here. The Clerk was asked to provide the Board
with all the minutes pertaining to Moline Concrete as well as diagrams.
Mr. McLean asked the Board members to drive past the Moline property to familarize them-
selves with the situation. Mr. McLean asked that Mr. Volk also be there.
Mr. Reinert moved to have all the sign applications received because of the Building In-
spectors inspections last fall be turned over to Mr. Mobley and ask him to locate the
signs and show locations by a cartoon drawing and request the proper fee. The applic-
ations will be considered at the April 20, 1977 meeting.
Mr. Gourley said that Attorney Locher had informed him that Ordinance #21 is not specific
in what constitutes minimum footage on a lot. After further discussion it was decided
to contact Mr. Locher and have him comment in writing his recommendations as to how to
take care of this problem for the April 20th meeting.
Mr. Mobley's sign application was considered. The Clerk was instructed to bill Mr. Mobley
for the fee. Mr. Landers sign request was considered. The Board wanted to know what
the sign would say and where it will be located as well as a drawing showing the location
of the sign on the property. A fee of $10.00 is also due.
Mr. Byron's request for a sign at Skyline Auto Body was considered. The Clerk was asked
to write to Mr. Byron and ask him to make a drawing showing exactly where this sign is
to be located and what the sign will say and request the proper fee.
Mr. Reinert moved to table all three sign requests until further information is received.
Mr. Hill seconded the motion. Motion carried unanimously.
Mr. Gourley asked the Clerk to request Chief Myhre to make a written report to the Plann-
ing and Zoning Board on Skyline Auto Body, Sparkfewash and R & E Restoration. The Board
will consider the reports at the April 20, 1977 meeting.
Mr. Gourley asked the Clerk to ask the Clerk for a building permit for a pigeon house
on Totem Trail in Shenandoah. He understood the structure was in poor condition.
Mrs. Schwankl moved to adjourn at :IMO P.M. Mr. Reinert seconded the motion. Aye.
