October 27, 1976
The special meeting of the Planning and Zoning Board was called to order at
8:02 P.M. by Chairman Gourley on October 27, 1976. Members present; Karth,
Hill, Reinert. Absent; Kelling, Shearen, Nadeau. Mr. Bill Short, Planner, Mr.
George Gotwald, Engineer, and Mr. Landol Locher, Attorney, were also present.
Mr. McLean, Council Liaison, present.
Mr. Gourley stated this meeting was for the purpose of getting the reports from
the Planner and Engineer as to their meeting with -the Metropolitan Council Staff.
Also, to study the maps prepared by the Engineer as to the staging of the sewer
development, and to inform the Attorney as to the progress to this point.
Mr. Short presented a typed letter with comments from the Metropolitan Council
Staff on the points in question. When.a building permit is applied for in an
area where soild are considered to be marginal, the Planning and Zoning Board
had suggested the permit be stamped with a warning. The Metropolitan Council
Staff had suggested this stamp contain wording to the effect the City will not
expend funds to rescue him if he insists on building in that location.
Mr. Reinert said this would be fine for the original owner, but what about the
second and third owners who would have no knowledge of the original warning.
Mr. Locher told the Board of one County that will not record a legal description
of meets and bounds without the approval of the City. Mr. Reinert felt this is
a good thing, but when a buyer goes to register his deed, he has usually already
paid for the,property. There was discussion on this problem with no solution.
In Subd. 2, there is discussion of revising the platting ordinances to standardize
the requirements. This is one of the area for Mr. Locher to advise the Board.
In Section II of the comments, the one acre minimum lot size was acceptable in
some areas, but the overall gross density was unacceptable to the Staff. They
suggested establishing two rural districts - one residential and one agricultural.
This would create a density figure acceptable to the Metropolitan Council Staff.
There was discussion of the areas where the density figure could be one unit per
forty acres (such as the sod fields) and areas where the figure could be one unit
per ten acres. This is not a zoning ordinance, but to merely be used a guide, so
variances could be issued to these figures.
The septic system regulations being written by the PCA are not completed but,
the City will have to adopt them when they are finalized. The Board had no
problem with this.
Mr. Gourley asked what happens if the City disregards the density objections of
the Metropolitan Staff and submits this as planned by this Board? Mr. Short
said the general feeling of the Metropolitan Staff is they have the power to
limit the number of hook-ups in the interceptors.
Mr. Gotwald felt that since the Areas in the Country Lakes development have been
accessed and there is an interceptor available, or soon will be, the Metropolitan
Staff cannot refuse to serve those people. He felt they do not have as much
power as they seem to think. He said they will try to control, but he wondered
just haw far they can go in holding back development.
Mr. Gotwald had drawn maps showing the staged development in conjunction to the
urban service areas. He explained the reasoning behind the maps being marked as
they were. There was general agreement on these maps as presented.
Mr. Gotwald was asked if he felt these maps are sufficient to present as a part
of the cmerall package and Mr. Gotwald said, Yes, with a note of explaination.

The Clerk was instructed to get a copy of all special meeting minutes and mail
to the Attorney. There are several Ordinances that will need to be amended,
revised or repealed. The Attorney was asked to mark these Ordinance for change
and revision and mail a hand marked copy to the Clerk for distrubution to the
Planning and Zoning Board members for study.
The areas to be finalized are 1) Mr. Gotwald's maps; 2) Density information from
Mr. Short; 3) the three service areas; 4) Restrictive soils Ordinance; 4) septic
system regulations.
When this is completed, it will bascially be a revision of the Comprehensive Land
Use Plan. This is being required from this City approximately 3 years ahead of
all other communities. Mr. McLean had talked to Mr. Boland on the possibility of
getting financial assistance and he felt this is a possibility.
The timing for completion of these requirements was discussed. The date as set
by the Metropolitan Council is Dec. 31, 1976. The general consensus of the Board
was this work cannot be finalized by that date.
Mr. Short felt the Metropojitan Council Staff is impressed by the amount of work
already done although they will not say that to this City. He felt there would
be no problem in getting an extension.
The use of the word 'district' in talking of the rural areas was discussed. The
general feeling is that this word should not be used, instead use Rural Service
Area #1 and Rural Service Area #2.
When these things are all packaged into an understandable presentation, it will
sent to the Council for their consideration and then to the Metropolitan Council
for their approval.
Mr. Hill moved to direct Mr. Gotwald, Mr. Short, and Mr. Locher to proceed as
directed for reporting back to the Planning and Zoning Board. Seconded by Mr.
Reinert. Motion carried unanimously.
A special meeting was set for December 1, 1976 for consideration of this material.
The Clerk was asked to put the matter of asking for an extension on the agenda
for the secondfCouncil meeting in November.
Mr. Reinert moved to adjourn at 9:45 P.M. Seconded by Mr. Karth. Aye.
