The regular meeting of the Lino Lakes Planning and Zoning Board was called to order
at 8:08 P.M. October 20, 1976 by Chairman Gourley. Members present: Kelling, E.
Karth, Gourley, Nadeau, Hill. Members absent: Shearen and Reinert. Mr. McLean,
Council liaison was also present.
Mr. Gourley explained to the audience that the name plates on the desk did not apply
to the people presently seated.
Mr. Kelling moved to approve the minutes of September 15, 1976. Mr. Karth seconded
the motion. Mr. Nadeau noted that the police report on page 4 paragraph 3 was not
complete. The paragraph should include; "the police report stated that Chief Myhre
had observed the properties of Joe LaCasse, Jr., L. & B. Tree Service, Vincent Knopik,
and Henry Miersand noted the time observed and his findings. The Board did not take
any further action." Mr. Kelling amended the motion to include the above paragraph.
Motion carried.
Mr. Gourley presented the September 29, 1976 special meeting minutes. He noted
the changes on page I, paragraph 8 to include "District map for area I & 2" and
paragraph 11, page I changing the word control to guide. Mr. Nadeau stated that
a paragraph should be added noting; "Mr. Nadeau had stated that he felt the spec-
ial meetings were called for the purpose of discussing the business relating to the
Metropolitan Council demands and he reprimanded Mr. Gourley for inviting private
citizens to appear for reasons other than the planned agenda.' Mr. Nadeau moved to
accept the minutes as amended. Mr. Karth seconded the motion. Motion carried.
Mr. Gourley presented the October 13, 1976 special meeting minutes. The last para-
graph on page I was discussed. It was suggested that the paragraph should read,
"This acreage is not as likely to be developed in the immediate future.' Mr. Kelling
noted that Green Acres is documented proof of usage. After further discussion the
Board decided that it would not do any good to change the minutes. Mr. Karth moved
to approve the minutes as written. Mr. Hill seconded the motion. Motion carried.
Ronald Van Kleek
Mr. Van Kleek presented a request for a variance to builda new home on a lot of less
than 21 acres and without the required 150' frontage. Mr. Van Kleek's lot has front-
age of 69' on a 33' roadway easement.
Mr. Hill asked who owned the triangle shape lot fronting on Peltier Drive. Mr. Kell-
ing and Mrs. Anderson checked the assessors records and could not definitely deter-
mine who owned this lot. The Board suggested to Mr. Van Kleek that the simplest
thing to do is to buy the frontage property and then a variance would not be required.
Mr. Hill asked if the driveway easement is on the lot line and also is it on the
frontage property making a total of 66' easement. This was not determined. Mr.
McLean suggested that Mr. Locher could clear up this matter. It was also suggested
to Mr. Van Kleek that he and the lot owner to the north obtain ank dditional 33'
and construct a 66' wide City approved road across both lots. Then a variance could
be granted for a building permit.
Mr. Baber
Mr. Baber presented a map showing six lots of more than 22 acres and 4 lots with
150' frontage or more. Mr. Nadeau noted the two lots with existing homes. Mr.
M. Lean noted that 2 lots have less than 150' frontage. Mr. Baber explained that
the easement is a private easement for the use of the two adjoining property owners.

Mr. Baber elssplained to the Board that this is not a plat but a division by meets
and bounds and will be recorded as such.
Mr. Gourley said Mr. Baber would need a variance for the two lots of less than '50'
frontage. Mr. Baber was given the variance forms.
Mr. Chollett
Mr. Chollet has applied for a special use permit to park a mobile home on his property
for temporary use while his new home is being constructed. He stated his house will
be started later this week. A well is presently being dug. Mr. Gourley asked how long
he felt he would need the mobile home. Mr. Chollet felt he would be in his new home
by July, 1977. Mr. Gourley felt there should be a time limit on the special use
permit. Mr. Nadeau asked about the shape of the lot. Mr. Chollet stated he had
a variance for the lot.
Mr. Chollet said the mobile would be located in a grove of trees and partially screened
from view. After further discussion, Mr. Nadeau moved to recommend to the Council
that the special use permit be granted with the understanding that the mobile home
is to be moved out of the property by July, 1977:' Mr. Karth seconded the motion.
Motion carried.
Mr. & Mrs. Schlavin
Mr. & Mrs. Schlavin presented a request for permission to split their lot on Linda
and Laurene Streets into two lots. After discussion the Board.told them that they
need two variances, one for each lot of less than 22 acres with full legal descript-
ion of both lots. Mr. Kelling moved to recommend to the Council that two variances
with proper legal descriptions of each lot, proper forms completed and receipt of
the required fee for each lot be granted. Mr. Karth seconded the motion. Motion
carried.
Mr. Cheeseborough
Mr. Cheeseborough explained his need for a construction trailer unit for office space
only. He also showed the Board a picture of the unit. He further stated he would
need the unit for only a couple of years until he can afford to build a permanent
structure. He also said there is presently a pole structure on the property. Mr.
McLean asked for c!arification on the location of the property. Mr. Cheeseborough
explained.
Mr. Gourley returned Mr. Cheeseborough application for special use permit. Mr. Cheese -
borough needs the signature.of his neighbor to the North. Mr. Kelling said he is not
against acting on this matter tonight but would want several stipulations in the
motion.
Mr. Nadeau asked if this is commercial property. He was told it is not.
The Board told Mr. Cheeseborough that they need more time to consider this matter.
Mr. Kelling informed him he will need to consider a special use permit or rezoning.
Mr. Gourley said that he will be on the agenda for November 17, 1976 if he can re-
turn his application for variance at least 10 days before the meeting.

Mr. & Mrs. Charles Cape
Mr. & Mrs. Cape showed the Board a 2 section map pointing out their property and +heir
plans for dividing it. The Board asked if this property was located on a City approved
street. Mr. Cape was told that the Clerk will check to see what the status of the
street is.
Sparkle Wash
Sparkle wash has applied for two sign permits and the Board asked to talk to them
about the condition of their property before the permits were issued.
Mr. Gourley read from the minutes of October 28, 1976 regarding the planting of trees
as screening. Mr. Stenberg, of Sparkle Wash, said he had misunderstood the time
limit on the tree planting. He said they would be planted. He also said the cars
and other vehicles in the area will be cleaned up. Mr. Kelling moved to recommend
to the Council that both sign permits, upon receipt of the required fees be approved.
Mr. Karth seconded the motion. Motion carried.
Mr. Koob
Mr. Koob arrived. He is requesting a variance for a 1120' driveway so that he can
build a new home at the rear of his property. He said he has about 1,000 feet as
frontage on Rondeau Road. Mr. Kelling informed him he would have to maintain this
driveway himself. Mr. Koob said he understood this. Mr. Kelling also recommended
that the driveway easement be 60' wide in the event that land would be subdivided
along side of it and later developed.
Mr. Kelling moved to recommend to the Council that a variance be granted for this
driveway provided that Mr. Koob would provide a 60' roadway easement. Mr. McLean
asked him to bring a complete legal description of the property and a completed app-
lication for a variance and the proper fee to the City office before the Council
meeting on October 25, 1976. The motion was seconded by Mr. Nadeau. Motion carried.
Harold Hanson
Mr. Marlin Hanson presented concept plans of a preliminary plat for the Board to
inspect. The Board reviewed the plans. Mr. Gourley asked what was the smallest
lot and was a lot at least one acre. Mr. Hill asked what the easement was for.
Mr. Hanson said it was still in the talking stage. Mr. Gourley asked who will own
the nature areas. He was told Mr. Hanson will retain ownership.
Mr. Gourley asked the Clerk to send copies of the concept plans to the City Engineer
and City Planner and other members of the Planing & Zoning Board not here tonight.
Mr. Gourley told the Board to be prepared to act on the engineer and planners sugg-
estions. Mr. Hanson said he will have the preliminary plat in the office at least
10 days prior to the next meeting.
Mr. Hanson presented his request for a variance for one lot,lot A, which is less than
21 acres, at the southern most section of the plat. A legal description and proper
fee for the variance accompanied the request. Mr. Kelling moved to recommend to
the Council that a variance be granted wii-h the request that if at all possible
that this lot become part of the plat. Mr. Karth seconded the motion. Motion carried.
Mr. Gourley stated that Mr. Hanson should be at the October 25, 1976 Council meeting.

Mr. Harold Hanson spoke to the Board of his concern that the regulations concern-
ing platting would be changed during the period he is platting his,land. He tole
of the expense involved if changes had to be made. Mr. Gourley told him that the
Board can pretty well say that the standards will not change during the period he
is concerned about.
The Board thanked Mr. Hanson for coming tonight.
New Business
Mr. Gourley stated that he did not want to deviate from the rule that all business
to be considered by the Board be sent to the members at least 10 days in advance
of the meeting. He suggested there be a check list for the Clerk to use to deterrine
that all necessary information is ready for Board consideration on any given request.
He felt it all could be cut and dry.
Mr. Gourley suggested another item be added to the agenda, Item #3 entitled 'Mr.
McLean's Report of Council Action on Planning and Zoning items.' Mr. Gourley re-
quested that Board members receive copies of the Council minutes as well.
Mr. Gourley read a letter from Mr. Murphy of Stillwater Township. The letter requests
information regarding the best method of proceeding with a comprehensive plan for
the Metro Land Planning Act, 1976. Mr. Hill moved to send the letter to the Council
for a response. Mr. Karth seconded the motion. Motion carried. Mr. Gourley request-
ed that a copy of the letter be sent to all Board members.
Mr. Gourley reminded the members of the special meeting on October 27, 1976.
Mr. Kelling moved to adjourn at 11:08 P.M. Mr. Hill seconded the motion. Aye.
