The regular meeting of the Lino Lakes Planning and Zoning Board was called to
order by Acting Chairman Mr. Nadeau, at 8:15 P. M., May 19, 1976. Board members
present; Kelling, Hill, Shearen, Karth. Absent; Houle, Gourley. Mr. McLean was
also present.
Mr. Kelling moved to approve the April 21, '1976 minutes as presented. Seconded
by Mr. Karth. Motion carried.
Mr. Larry Brokke appeared before the Board requesting a special use permit for
the parking of commercial vehicles on property he has purchased located on 20th
Ave. S.
Mr. Karth asked where the trucks were parked at this time and Mr. Brokke said he
had been instructed by the Council to park these vehicles in Centerville and that
is where they are. He had cleared a spot on the property in Centerville and is
using the driveway on the property in Lino Lakes to park them In Centerville.
Mr. Karth asked just what he was asking for in the special use permit. Mr. Brokke
said he is asking for access through his present driveway to reach the property
to the North and located in Centerville and permission to park a pick up at the
home.
Mr. Karth asked for how long and Mr. Brokke said he planned to have the land in
Centerville ready before freeze-up. Mr. Shearen asked if six months was long
enough? Mr. Brokke asked to have the time extended to December 31, 1976. Since
he had originally planned to park all vehicles on the Lino Lakes property, he has
had to change some plans. Since he is parking the larger vehicles on the Center-
ville property, he only needs a special use permit for use of the driveway.
Mr. Nadeau asked about the pick up trucks over 7000#, does he have any? Mr.
Brokke said, yes, he has a 3/4 ton that has a gross weight of 9000#.
Mr. Nadeau asked Mr. Kelling to assume the Chair since he is involved in this
discussion on a personal basis. Mr. Nadeau assumed a seat in the audience.
Mr. Kelling asked Mr. Brokke to make a definite statement as to what he is asking
for.
Mr. Brokke said he is asking for a special use permit to use his driveway for nine
months to park his trucks on the Centerville property.
Mr. Hill asked how much property he owned in Centerville and Mr. Brokke said
eight acres.
Mr. Shearen said the way he interprets the Ordinance, Mr. Brokke doesn't need a
special use permit for access.
Mr. Nadeau said he parks the vehicles on the Centerville property with part of
the vehicles over the property line and on the Lino Lakes property. Mr. Nadeau
said there is at least six cars parked in the driveway each day. He also felt that
with eight acres of land the trucks could be parked further in on the Centerville
property.
Mr. Kelling asked if the Ordinance says that employees cannot park on their
employer's property? He felt the Planning and Zoning Board could not limit this
type of parking as long as the cars were off the street and not creating a
trafic hazard.

Mr. Nadeau felet the* MOP. Brokke hada etthq bought the property thinking it wa*

he knowingly bought the land end felt he could use It for commercial purposes.
Mr. Karth said he is only asking for a special use permit for just nine months
and Mr. Nadeau replied that Mr. Brokke isn't going to comply to the special use
permit. Mr. Karth noted, if at the end of the special use permit he hasn't
complied with the stipulations, the Planning and Zoning Board would handle the
problem at that time.
Mr. Nadeau said Mr. Brokke could use the driveway on the Centerville side of the
property. Mr. Brokke said the property has piles of dirt and debris and is being
cleared by W. & G. Rehbein. If he used the Centerville driveway, his vehicles
would interfer with the clearing away of this material.
Mr. Kelling asked Mr. Brokke if the special use permit is granted, will he move
the vehicles back far enough so they are on the Centerville property?
Mr. Brokke said there is a pipe marked in the street and he has told the drivers
they must be beyond that marker. Mr. Brokke felt that the trucks are being
parked on the Centerville property.
Mr. Kelling said the Board had Listened to both men and had neither believed nor
'isbelieved either man, but felt that enough information had been heard to come
a reasonable conclusion.
��. Brokke interrupted to say that he had considered buying land from Mr. Nadeau.
The asking price was $1000.00 per acre but when contacted for a contract for deed,
Mr. Nadeau was asking $3500.00 per acre and wanted cash. Mr. Brokke said the land
would not pass a perc test. This is the only reason he contacted the people in
Centervitie and purchased their land. Mr. Brokke felt that Mr. Nadeau knew what
the land was to be used for when he was contacted to sell.
Mr. Kelling repeated this Board should come to some conclusion. Mr. Nadeau said
the issue is not clarified. He felt Mr. Brokke is using a residence as a comm-
ercial establishment in a residential area. He has his telephone listed at that
address and also has a sign attached to his mailbox, and Mr. Nadeau felt this
constituted a commercial usage.
Mr. Brokke was told the parking of the 9000# pick up in his driveway is a
violation of the Ordinance which limits the weight to 7000#. There has been
c. -me discussion on the revision of this ordinance, but it has not been considered
Eo date.
r. Hill moved to recommend to the Council this special use permit be approved
r;'ith the stipulation that all vehicles over 7000# gross weight be parked on the
Centerville property using the Lino Lakes property for access purposes onty and
this special use permit will expire December 31, 1976. The existing sign to be
checked by the Building Inspector. Motion was seconded by Mr. Karth.
Mr. Nadeau asked if there is to be a limit on the cars to be parked at the
property? Mr. Karth said there is no law that says the number of vehicles parked
at a certain location can be limited. `
Mr. Karth called for the vote. Motion carried with all present voting in favor
with Mr. Nadeau abstaining.

Mr. Nadeau said Mr. Brokke is not completely aware of the Ordinances of the
City ouch as the sign ordinance - the building zone he fives in - Mr. Nadeau
wanted it noted in the minutes this home is located in an area zoned for single
family residences. He also wanted to ciarify one point - the offer for his land
was only $500.00 per acre.
Mr. Keliing said the discussion is closed. The price of the land is not the
province of this Board. The motion for a recommendation to the Council has been
made and passed and the discussion will accomplish nothing.
Mr. Mclean told Mr. Brokke he will take the recommendation to the Council and the
final action on this matter will be handfed on May 24, 1976 at the regular
Council meeting.
Mr. Brokke thanked the Board for their time and attention.
Mr. Nadeau resumed his seat as Vice -Chairman and resumed the meeting. Mr. LeRoy
Houle has applied for a special use permit for the construction of a pole type
building for the storage of his equipment. Mr. Houle had the signature of his
adjoining neighbors. The footage for the setback from the street and the side
lot tine was discussed. Mr. Houle said that he planned to use part of the
building for a shop for the maintenance for his equipment. Mr. Keliing moved to
recommend to the Council approval of this special use permit for the storage of
Mr. Houle's commercial equipment in this building. Seconded by Mr. Shearen.
Motion carried unanimously.
Mr. Blackbird was here representing EI Rehbein Construction in reference to the
Pine Haven Plat. The Planner's and Engineer's recommendations were read. The
necessity for current soil borings was noted in both reports. Mr. Blackbird
said he would have these prepared.
Lee Starr of the Metropolitan Planning was present to present to the Board
the things that wilt be necessary for the City to conform to in connection with
the installation of the interceptor. Mr. Starr said the discussion on this
could take some time - he would suggest a special meeting be scheduled for just
this purpose. Mr. Starr said the June 1, 1976 date for the passing of the
Resolution could be extended to July 1, 1976 in order to allow the City time to
out the necessary changes. A letter from Mr. Boland will confirm this
Insion of time.
Mr. Starr gave the Planning and Zoning Board copies of the material he had
prepared that outlines the areas for consideration. Copies will be sent to the
Council, Engineer, Attorney, Planner and members of the Planning and Zoning Board
who are absent from this meeting. Mr. Starr said the main objective is to define
a reasonable course to both Councils. Mr. Starr felt it would take approximately
sbx months to work out all the problems and come to a conclusion..
M-. Fran Burque appeared before the Board with several land transfer proposals.
He asked if he needed a variance for the transfer of title of this land. After
cc:suiting Mr. Burque's map, it was found that two of the parcels contain more
than the required 21 acres, therefore needed no variance. One parcel is only
45' wide and is being sold to an existing homestead to be used as a driveway.
Mr. Burque was advised he would need a variance for transfer of this parcel.
Mr. Burque will contact the Clerk's office for the necessary forms.
Mr. Keliing moved to ask that Mr. Burque apply for a variance for Tract A, if
there are any questions on the other two tracts, to contact the Planning and
Zoning Board. Seconded by Mr. Shearen. Motion carried.

Mr. Moore had applied for a sign permit for a new sigh at the Blue Heron.
Mr. Mobley had contacted Mr. Moore and had worked out the problems but had
not turned the application in for consideration at this meeting. However,
since the construction of this sign must be approved by the Building Inspect-
or, Mr. Shearen moved to recommend approval of this sign permit contingent upon
Mr. Mobley's approval. Seconded by Mr. Karth. Motion carried.
Mr. Edmundson appeared before the Planning and Zoning Board to present several
"oncepts for developing forty acres of land that he has purchased at the end
o; 62nd street. There will be 34 $o Z$ homes located on the forty acres and
,'-he design will utilize the high spots for homes and he plans to retain as
meny of the trees as possible. The Board recommended the elimination of as
many of the cul-de-sacs as possible, otherwise they felt the basic design was
g --i. He was told he would need soil borings and a topography map showing the
dr^inage. Mr. Edmundson was aware of these things but had just wanted to get
some ideas on what this Board would require of him.
Mr. Edmundson said he would redesign the plat and present at a later meeting.
There was some discussion on the fee requirements in connection with special
use permits and variance. More will be discussed on this at a later meeting.
Mr. Shearen moved to adjourn at 11:15 P. M. Seconded by Mr. Karth. Aye.
