HomeMy WebLinkAbout04/21/1976 P&Z Minutes- Page One - (eT7-) April 21, 1976 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:25 P.M. on April 21, 1976 by Chairman Gourley. Members present; Karth, Nadean, Shearen. Absent; Hill, Kelling, Houle. Mr. McLean was also present. The minutes of March 17, 1976 were corrected as follows; paragraph 4, add the following motion "Mr. Hill moved to recommend approval of this request to the Council. Seconded by Mr. Houle. Motion carried with Mr. Nadeau abstaining." Mr. Nadeau moved to approve the minutes of March 17, 1976 as correct- ed. Seconded by Mr. Shearen. Motion carried. Mr. Carey appeared before the Planning and Zoning Board requesting a special use permit for the operation of a saw sharpening business to be located at his home at 490 Pine Street. Mr. Karth asked what the hours of operation would be and Mr. Carey (:aid in the evenings - probably until around 9:00 or 10:00 P.M. 'fr. Carey was asked about the noise created by this operation and :2e said there would be very little - on the same order as a lawn nower. Mr. Carey said he has 10 acres and his immediate neighbors a: -e not that close. M. McLean asked if he would have a sign advertising his business +nd Mr. Carey said a small one that would be mounted on top of the aailbox - approximately 6"x28". Mr. Nadeau moved to recommend to the Council approval of the special use permit with the:rfzinimum size on the sign. Seconded by Mr. Shearen. Motion carried. Mr. Larry Brokke appeared before the Board asking procedural infor- mation on property he is buying in Lino Lakes. Mr. Brokke is in the tree removal business anti as such has vans, pick up trucks and several dump trucks. The property he has purchased is in Lino Lakes but he has also purchased property directly to the North which $ in Centerville. He plans to erect a pole building for storage and an office building on the Centerville property. In the meantime, he needs to use the property in Lino Lakes for parking of the vehicle: He will also be conducting his business from that location until :.uch time as the other buildings are constructed. Nr. Bakke was asked if any mechanical work would be done at the location and he said possibly oil changes but not any major work. Mr. Nadeau objected to this use of the area. He felt the commercial area from Centerville is spilling over into a residentail area in Lino Lakes. Mr. Henry Heirs, the former owner, conducted approximate the same type of operation such as parking his vehicles at that location, and Mr. Nadeau felt this should not have neen allowed and he would object to granting permission for this use to be continued. The Board felt Mr. Brokke should apply for a special use permit with a time stipulation as to just how long he felt he would need to use this property to park the vehicles. The Clerk is to check with the - Page Two - April 21, 1976 Attorney on this operation. Mr. Jerry Blackbird, representing North-NorthEast Realty, presented the Board with preliminary sketch for the Pine Haven Plat located just North of Main Street and East of Highway 8. This plat had been presented previously, but had been postponed by the developer. The size of the lots, the price range of the homes, the water table and the many facets of this proposal were discussed. Mr. Blackbird was asked to leave three copies of the sketch. The Clerk will for- ward them to the Engineer and the Planner for their comments and recommendations. Mr. Blackbird will also drop some brochures of the planned homes at the Clerk's office. iir. Shearen move to recommend thismatter be forwarded to the rngineer and the Planner for their recommendations. Seconded by rf.r. Karth. Motion carried. Hallblade, who owns lots on Maple Street, appeared asking the •rocedure for splitting a lot into either two or three lots. There wzs discussion as to how far the street is a dedicated street and if it would be necessary for Mr. Hallblade to present this as a plat. Me general consensus of the Board was this matter should be referred to the Attorney and the Engineer. Mr. Volk should be consulted as to the time table for the extension of Maple Street and just how !rr it will extend. The Board also felt since the depth of the lot .s quite shallow, it would probably be required to split this piece of land into two parcels rather than three. after talking to the Attorney and the Engineer, the Clerk is to relay any information to Mr. Hallblade. Mr.. William Koob appeared seeking permission to park a mobile home on property he owns on West Rondeau Lake Road for his partner while home is being constructed. Mr. Koob owns a portion of the land -nd is buying more on a contract for deed and the total land in- volved being approximately 30 acres. He has the necessary frontage on West Rondeau Lake Drive but a variance for the length of the driveway will be required. r'r. Koob will be doing most of the construction together with his i:3rtner and it could be one to one and one half years before the home is completed. He was told this Board has been very reluctant to grant such permits. This has been done in cases of terminal illness and when actual construction is being done and then only for one year. Mr. Koob saiid he is also planning a deep well to be used for irrigation. He was told he would have to file an application with the Rice Creek Watershed Board. The Clerk will contact Mr. Cardinal for the necessary papers. Mr. Koob has a small pond of water that he would like to drain and refill. The Watershed Board will also have to be notified of this action. - Page Three - April 21, 1976 Mr. Koob will let this Board know of his plans. Mr. Rick O'Connel asked the Board about establishing a riding stable at 1403 Birch Street. He has contacted Mr. Glanzer who manages the land for a corporation and the house is for sale. Mr. O'Connell said he can lease the remainder of the land with option to buy. There is a total of 305 acres. Mr. O'Connell was asked about the fences and he said there would be no fences. He would provide corrals for containing the animals and : • leave the land open for riding trails. The only places fences would be placed would be to deter riders from entering private property. Mr. O'Connell was asked wheee As is located now and he said in White Bear Lake. Mr. McLean asked Mr. O'Connell if he was aware of the plans of the Anoka County Park Board to establish a riding stable in the area of Mr. Kelling's property? This stable is to be a part of the Open Space Program. Mr. McLean suggested Mr. O'Connell contact .°?r. David Tork.ildson with the possibility of working in conjunction_ :.pith the County program. There was some question as to the zoning of this property. The •'1erk is to research back minutes for the possibility this land has Seen rezoned to commercial. Mr. O'Connell will return to the Board with his information. Mr. LeRoy Houle had applied for a building permit to construct a pole building on his porperty on Birch Street to be used for the storage of his truck and equipment. He has four acres of land. The Planning and Zoning Board asked that Mr. Houle apply for a special use permit with the consent of the adjoining property owners. Under Old Business, Mr. Gourley asked about the recommendations submitted by Mr. Mobley - has any one any ideas for approving or .:hanging? It was suggested these thoughts be ready for the next .neeting. There was a question of issuing permits for the drilling of wells. The Clerk asked if there is an ordinance covering this. The general consensus was the State Plumbing Code covers this matter. The Clerk was asked to check this matter with the Engineer and the Attorney. Mr. Nadeau suggested a copy of the State Plumbing Code be obtained for use by this Board. The Clerk was instructed to call for the Costs. Mr. Gourley presented some ideas for the re -designing of the Specie: Use Permit form. The marked copy was given to the Clerk for typing. She is to have this ready for the next meeting. - Page Four - April 21, 1976 There was discussion of the special use permits now on record and how many are still valid. It was suggested an inquiry form be drawn up to be mailed to all special use holders now in the files. If the property has changed hands, the permit is automatically cancelled. The Clerk will prepare this form for Board consideration A letter from Mr. Phil Lewis of WCCO had been received explaining the delays in the approval for the tower they plan to construct in Lino Lakes. He asked an extension of the special use permit until the aniversary date in 1978. After some discussion, Mr. Nadeau roved to recommend to the Council approval of this request. Seconded by Mr. Karth. Motion carried. Mr. Gourley and Mr. Hill had gone over the Comprehensive Land Use elan and marked some ares they felt should be changed and updated. The Clerk was instructed to type these notes Indicating the pages and suggestions, and mail to all members for study. Zr. Jim Lowell, who lives on Birch Street, told the Board he would like to see the Ordinance governing the keeping of bees changed. He felt the amount of acreage was not important since bees range far from the hive. He felt that rather than acreage, the Iimit should be on the number of hives that could be kept. Mr. Gourley said the Ordinance is not designed to protect the bees but to protect the people from the bees. After some discussion, it was suggested to Mr. Lowell he write his suggestions as to the changes he would like considered and present this to the Board for consideration. Mr. Lowell agreed to do this and said he felt he was responsible for the bees regardless how many acres of land he has or the number of hives. He asked to be put on the agenda for the May meeting. Mr. Shearen moved to adjourn at 11:25 P.M. Seconded by Mr. Karth. Aye.
