HomeMy WebLinkAbout08/20/1975 P&Z Minutesf o 1,1' AUGUST 20, 1975 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:05 P.M. by Chairman Karth. Members present: Mr. Kelling, Mr. Nadeau, Mr. Shearan and Mr. Gourley. Members absent: Mr. Houle, and Mr. Hill. Councilman Marier and Attorney Locher. The minutes of the July 16, 1975 meeting were approved as presented by a motion from Mr. Kelling. Mr. Shearan seconded the motion. Motion approved. The first item on the agenda was a request from Mr. and Mrs. Kelly Baumgart to build a garage in front of their home located at 6133 Ware Road in Lino Lakes. The Baumgart's had appeared at the July meeting and were asked to come back with a specific description of where the want to place the garage and the exact measurments from the road. The Baumgart's presented copies of their perc test and a survey of the land to show the exact measurments. Mr. Karth aratced If the exact measurments of the drain field was available? Mr. Baumgart said no, the measurments on the copy of the perc test were only approximate measurments but they are the best they can come up with. Mr. Kelling questioned the effect a garage in the front would have on the rest of the neighbors. Mr. Karth and Mr. Baumgart said that the land on either side of the Baumgart residence were now empty. Mr. Karth asked when the house was built. Mr. Baumgart said the house was built in 1952 and the perc test was done in 1972 when they purchased the house. Before 1972 there was no plumbing of any sort there. Mr. Karth asked again about a tuck under garage and Mr. Baumgart said that it would cause more problems, particularly with water, than it would be worth. Mr. Shearan said that if the garage were placed where the Baumgart's desired it would only be setback 15' from the property line. After looking at a sketch of the property Mr. Shearan said the garage would only be 12' from the road and not less than 20' from the center of the road. Attorney Locher read from Ordinance 56, Sections 4.13, 4.14, 4.15 and 4.16; which detail the setback regulations of the City of Lino Lakes. Mr. Shearan, after reviewing the ordinance requirments moved to recommend to the Council denial of this request under the circumstances. Mr. Nadeau seconded the motion. Motion carried. Mr. Nadeau asked about putting the garage in the back. Mr. Baumgart said that it would take about 4 yards of fill to make it usable and he did not feel that it would not be feasible for them to do this. AUGUST 20, 1975 -2- The hearing for the petition of Charles Prokop add Stefan Jankus to change the name of Lakeview Avenue, in the Otter Lake Hills Plat, changed to Deer Pass Trail and for the City to accept partial maintainance of same was called to order at 8:20 P.M. by Chairman Karth. Mr. Locher read the Notice of Hearings that had been printed in the Forest Lake Times, as required. Mr. Locher stated he did not have the affidavit of Publication, but that he had spoken with the Forest Lake Times this day (August 20, 1975) and was assured that it had been printed at the right time. The Affidavit of Publication should be in the Clerk's office shortly. Mr. Locher then read the legal description of the parcel to be renamed DEER PASS TRAIL: and That part dedicated on the plat of Otter Lake Hills, according to the map or plat thereof on file and of record in the Office of the Register of Deeds in and for Anoka County, Minnesotak, known and described as LAKEVIEW AVENUE. A 60.00 foot perpetual easement for public right-of-way purposes over, under and across the following described property: The North Quarter of the Southeast Quarter of the Northwest Quarter of Section 36, Township 31 North, Range 22 West, Anoka County, Minnesota. The center line of said easement is described as follows: Beginning at a point on the center line of Lakeview Avenue as dedicated in OTTER LAKE HILLS, according to the recorded plat thereof, distant 0.45 feet east of the west line of said OTTER LAKE HILLS, as measured along said center line; thence Northwesterly a distance of 56.32 feet along a curve concave to the northeast and tangential with the center tine of said Lakeview Avenue, said curve has a radius of 59.76 feet and a central angle of 54 degrees; thence Northwesterly, tangent to said curve, 39.55 feet, and said centerline there terminating. Together with a perpetual easement for public right-of-way purposes over, under and across that part of said North Quarter which lies within the circumference of a circle having a radius of 50.00 feet. The center line of said circle is the terminus of the above described center line. AUGUST 20, 1975 -3- Mr. Locher then showed the members of the P & Z, and others from the audience, the plat map that showed exactly how this street would run. Mr. Locher suggested that at some time in the future that portion of Town Road that runs to West Road be renamed West Road in its entirety to avoid confusion. Mr. Keiling stated that if no-one had any objections to the renaming of Lakeview Avenue in Otter Lake Hills to Deer Pass Trail he will so move to recommend to the Council to rename and at the same time recommend to the Council that they consider the rename of Town Road to West Road to avoid confusion in the future. After some discussion it was deceided that the second portion of the motion, i.e. to rename Town Road was premature at this time and Mr. Kelling withdrew his motion and restated it to: I recommend to the Council that they accept the petition to rename LAKEVIEW AVENUE IN OTTER LAKE HILLS PLAT TO DEER PASS TRAIL, as outlined in the legal description provided by the Attorney, and to accept Deer Pass Trail for partial maintenance which the applicants understand to be snow plowing. Mr. Shearan accepted the motion and seconded it, as such. Motion carried. The hearing on this petition closed at 8:30 P.M. The next item on the agenda was a discussion of theltproblems concerning Building Permit No. 46 which was issued to Mr. John Landers of 7181 Sunrise Avenue, Lino Lakes. This permit was issued on August 23, 1974, by the Deputy Clerk of the City. The permit was Issued for an addition to the home and a garage. No blueprints were forwarded to the Building Inspector for his approval prior to issuance. Several problems have arisen with the building that was put up end on August 5, 1975 the Building Inspector wrote to Mr. Landers outlining what needed to be done in order to comply with the State Building Code, to which Lino Lakes has incorporated into their ordinances. Mr. and Mrs. Landers questioned why there were not informed of alt this before the permit was issued. Mrs. Landers stated that when she applied for the permit she asked the Deputy Clerk and was merely told to contact the Building Inspector. She felt that the Clerk should have told her what she had to do. This problem, of issuing permits without the knowledge of the Building inspector, has since been instructed by orders of the Council no permits are to be issued without prior approval of the Building Inspector. All plans are to be submitted before any, permit can be issued. AUGUST 20, 1975 -4- Mr. Amundsen has been at the Landers property since the letter was sent and stated the following: 1. Ridge Line has been straightened out. 2. Window headers have been fixed to meet code. 3. The work is progressing on the center beam of the basement. 4. The work is progressing on the garage. Mr. Landers is to sheet inside of garage or resheet and properly nail outside covering. The remaining problem is the setback of the addition and garage from the road. As the building sits know it is in violation of Ordinance No. 56, Section 6.04A and Ordinance No. 6, Section 2 C. Sunrise Avenue is a County Road and the setback is 30' and the building set 29.6' from the edge of the tar. The problem is cars are being parked and they are on the road right of way and many complaints come in saying that it is impossible to see the other road when approaching the corner. Mr. Shearan wondered if a variance might not suffice in this case with the provision that no cars be parked in front of the garage at any time. Mr. Landers said that he would apply for the variance and return to the September P & Z Meeting. The next item for discussion was a request for a Variance to Ordinance No. 21 A to build a home . The variance is needed because there is only 100 front feet instead of the 150 front feet as required. Mr. Shearan asked if this wasn't the same request that Mr. Pariseau's son presented and was denied about a year ago. Mr. Pariseau replied that it was the same property but at that time they wanted to build a duplex and now they are planning to build a single family home at that same address. Mr. Shearan asked if a perc test had been done on the property yet? Mr. Pariseau said no, and that if it doesn't perc out they will fill the land in and leave it vacant, but landscape it. The land surrounding this was platted in 1963 but Lot D, which is in question, was not. A picutue of each house on the block was shown, with the vacant tot set it, the Pariseau's intend to build a home to conform with the rest of the buildings and showed tentative plans. AUGUST 20, 1975 -5- On the basis of the inform presented, Mr. Sheeran moved to recommend to the Council that. this request be granted. Mr. Kelling seconded the motion. Motion carried. Mr. Dave Sina was present to ask if he could bring forward Mr. Glenn Rehbein's plans at this time for the mini -storage units that were talked about in July. Because a special City Council Meeting will be convened immediatley after this meeting, the request was denied. Mr. Shearan asked Mr. Sina what kind of a tax base did they anticipate the building to bring in to the City. Mr. Sina said probably $100,000.00. On that basis, Mr. Shearan moved to hold a special P & Z Meeting on Wednesday, September 3, 1975 at 8:00 P.M. All members present agreed to this date and time and the Clerk was asked to send reminder notices to all. Mr. Sina said that he would bring the necessary information to the Clerk's office in order to get the information passdd along to the members. He thanked the P & Z members for their time. Mr. Nadeau moved to adjourn at 9 PM and the motion was seconded by Mr. Kelling. Aye.
