HomeMy WebLinkAbout06/23/1975 P&Z MinutesJUNE 23, 1975 The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M. on June 23, 1975 by Mayor Bohjanen. Councilmen present: Marier, McLean and Zelinka. Absent: Jaworski. Mr. Locher was also present. The Clerk corrected the minutes of June 9, 1975 on page 4, paragraph 3, second line: the number 575 should be changed to #572. Mr, Marier moved to approve the minutes as corrected. Seconded by Mr. McLean. Motion carried with Mr. Zelinka abstaining. The Clerk reported on the following items: ...Recommendations from the Tree Inspector for the disposal site for diseased trees. This area will be to the North and West of the City Hall. The use period will be from 12:00 Noon to 6:30 P.M. each Tuesday. A permit for disposal must be obtained from the City Clerk only with a removal notice from the tree inspector and only for residents of Lino Lakes. Mr. Volk will supervise the operation with burning to take place within 72 hours of disposal under reasonable burning conditions. This area will have a gate and will be locked. When the conditions are set for receiving the trees, these conditions win be published. Mr. McLean moved to authroize Mr. Voll to set this up with the Materials on hand. Seconded by Mr. Marier. Motion carried. ...Noted the receipt of $962.50 for sewage hauling in May. In connections with this, Mr. Zelinka asked If a contract had been received from the MWCC in regards to payment for hauling sewage. The Clerk said, No. Mr. Marler moved to instruct the Clerk to write to the MWCC and ask the status of the City proposal for the contract. Seconded by Mr. McLean. Motion carried. ...An application from Northwestern Bell for the installation of buried cable on West Rondeau Lake Drive just North of Main Street. This application had been approved by Mr. Gotwald. Mr. Zelinka moved to approve. Seconded by Mr. Marier. Motion carried with Mr. Marler abstaining. ...Read a letter from Mr. Doug Kelm of the Metro Transit Commission apologizing for the late arrival of notices to this City. He assured the Council every effort will be made to get the announcements out on time in the future. ...Read a letter from Glenda King of the Lino Tops Club asking permission to use the City Hail facilities on Thursday evenings for meetings. They would ask to store their scale here at the Hall. Mr. Marler moved to approve this request with the following stipulations: 1) if there is a special meeting they would have to find another•piace to meet; 2) a $50.00 Cleaning Deposit would have to be made; and 3) their scale would have to be stored some other place. The Council did not feel that the City would want the responsibility of that piece of equipment. Seconded by Mr. McLean. Motion carried. Read a letter from Mr. Boland giving the figure of 4,109 as the estimated population for Lino Lakes as of April 1, 1975. There was some questions on this figure. The Council felt that the figures used for last year's population•estimate was, larger. The Clerk is to check this out.... Ind -contact the office designated in the letter. JUNE 23, 1975 --2-- ...Read a letter from the Anoka County Auditor's Office noting there had been changes in the election laws and as soon as they are compiled, the Auditor will schedule a meeting to inform the Clerk's of those changes. ...Read a letter from North Central requesting a change in billing procedures for the tank located at the wellhouse. Presently there is a meter and the City is billed monthly. North Central would like to bill as the tank is filled. Mr. Zelinka moved to authorize this change at the next regular fill. Seconded by Mr. McLean. Motion carried. ...$290.00 had been received as the City's share of municipal fines. ...Read a letter from North Central asking for approval of a proposed 2" gas main on Evergreen Trail in the Pine Vista Addition. After some discussion, Mr. Marier moved to grant approval of this request providing City Ordinance regulations are met and with the Engineer's approval. Seconded by Mr. Zelinka. Motion carried. ...Read a letter from the County of Anoka dealing with the monies allocated for Summer Youth Employment. The City's share is $795.00. Mr. Zelinka moved to authorize the Clerk to sign the forms. Seconded by Mr. Marier. Motion carried. ...Read a letter from the Rice Creek Watershed Board stating that maintenance work done on ditches will be assessed to either the City or the affected property owners. Mr. Marler felt that this Is the responsibility of the RCWB and a letter to that effect should be written. Mr. Zelinka agreed but felt that since there will be some work done by prisoners located at the MMTC facilities before proceeding with further work, lets wait and see what is accomplished. ...A request by Northwestern Bell to place buried cable on Farm Drive (22nd Avenue) just south of County Road No. 14 and West of 135E had been received. Mr. Zelinka moved to approve this request contingent on the Engineer's approval. Seconded by Mr. Marier. Motion carried with Mr. Marier abstaining. Mr. McLean reported on the Park Board meeting held on June 16, 1975. The Board took the opportunity to tour the Park facilities and introduce Mr. Hanson to the Parks within the City of Lino Lakes. The plans for the Open Space were discussed. Many things are being considered But final plans will not be completed until early next year. Mr. McLean and Mr. Clausen will keep the Park Board and the Council informed of the actions of that Board. Mr. Cape had requested the use of the warminghouse on Tuesdays and Thurs- days during the month of July to hold gun training classes. The Park Board had recommended approval of this request. Mr. Marler so moved. Seconded by Mr. McLean. Motion carried. Mr. McLean recommended the placing of a fence parallel with the driveway into the City Hall about 25 feet West for parking. This fence to be placed so as to bar all traffic from the Park property. Materials on hand to be used for this. Seconded by Mr. Zelinka. Motion carried. Mr. McLean asked If there was a name to be considered for the replacement on the Park Board. Mayor Bohjanen said not at this time but he will have a name by the next Council Meeting. Mr. Marier reported on the meeting of the Planning and Zoning Board held on JUNE 23, 1975 --3-- June 18, 1975. A Mr. Ronald Grapp had applied for a Special Use Permit to repair Volkswagons as a full time business on his property located on 20th Avenue. Mr. Grapp had been instructed to return with all property owners signatures necessary for consideration of this request. In the meantime, Mr. Grapp had stopped in at the office and Informed the Clerk that he no longer wants the Special Use Permit since he is moving out of state. Mr. Marler. moved to accept the withdrawal of this request and to refund the filing fee of $25.00. Seconded by Mr. Zelinka. Motion carried. Mr. Emil Jandric requested a variance to Ordinance 21 A in order to sell a townhouse unit located on Outiok K. He was told to plat the lot according to City Ordinance and ask for a variance to sell after the platting is approved. Mr. Marier so moved. Seconded by Mr. Zelinka. Motion carried. Mr. Merle Chollett requested a Variance to Ordinance 130. 21 A in order to split a ten acre parcel into two lots, sell the front home and land and :onstruct a new home on the rear portion. This would necessitate a driveway of approximately 900 feet. The Planner and Engineer had presented their recommendations, this includes contacting the Rice Creek Watershed Board ;n conjunction with a culvert to be placed in a ditch. The P & Z had recommended approval of this variance with the stipulation that all recommendations of the Engineer and Planner be adhered to. Mr. Marier so moved. Seconded by Mr. Zelinka. Motion carried. Mr. Al LaMotte had applied for a Special Use Permit for the dismantling of junk vehicles and hauling of these Yehciies and scrap Iron from his father's farm located at 6510 -12th Avenue. This is a part time business and he has been doing this for the past 15 years. The Planning and Zoning Bored recommended approval providing no more than 6 cars are there at any one time and no complaints are received. There is to be a yearly review of this Special Use Permit. (Mr. LaMe1te has received a ticket by the Police Department and must go to Court.) Mrs. Margaret Hammer requested a variance to Ordinance 21 A to split and sell a portion of her property located at 765 Oak Lane. There are two residences <r:, approximately ten acres of land. The P & Z had recommended approval of this variance. Mr. Marier so moved. Mr. McLean seconded the motion. Motion carried. i.r. Borgren was present to disucss the possibility of building on Maple Street iaut since the exact location and si•e of the land was not clear, Mr. tyorgren was asked to consult with the City Planner and return to the Fa meeing in July. Mr. Richard Juleen requested a variance to Ordinance 21 A to split a lot located at 7109 Lakeview. A new home will be constructed on the rear of the lot and will face the side street. There was some discussion as to the side setbacks. The P&Z had recommended acceptance of the 15' setback. Mr. Marier so moved. Seconded by Mr. Zelinka. Motion carried. JUNE 23, 1975 --4-- The Special Use Permit granted to WCCO for the construction of a radio tower on Holly Drive expires on June 28, 1975. Mr. Fred Memmer and Mr. Tom Doer were in the audience. They informed the P&Z that WCCO is still in the process of obtaining permission from the FCC and would request a one year's' extension of the Special Use Permit. WCCO should have an answer by that time. The PSZ had recommended approval of this extension. Mr. Marier so moved. Seconded by Mr. McLean. Motion carried. An application for a Schmidt Beer Sign to be located at the Blue Heron had been considered and found to conform to the City Ordinance. The P&Z had recommended approval. Mr. Marier so moved. Seconded by Mr. Zelinka. Motion carried. Mayor Bohjanen reported, -on the eeting4hd1d"oh rlday, June, 20, 1975 in connection with the sewer problems In Shenandoah. Mayor Bohjanen asked the Clerk to read the minutes of that meeting. There were several corrections. Plan No. 1 as submittedby Mr. Burandt would serve a maximum of 600 homes. Mr. Marier asked when it is expected there will be 600 homes in that area? The cost figures as submitted by Mr. Burandt were discussed with the feeling that they were within 10a of actual cost. There was general agreemnt that something must be done to aleviate the situation that exists In that area. Mr. Locher said that installations can be petitioned int wo ways; either by a petition with 35% of the residents signing or by a 4/5 vote of the Council. Either way, puBlicatlon of the notice is required. These notices must be published twice- one week apart and 10 days before the hearing is scheduled. Notices must be mailed to all affected property owners. This necessitates the defining of the area to be served. Neither of the two plans define an area to be served. Mrs. Peterson of the Metropolitan Council had requested that one of the plans be accepted in order to set the wheels in motion to solve the problems In the Shenandoah area. There was a suggestion from the audience of installing the mains and laterals in the area and using a holding tank to be purmpted and hauled by the City in much the same manner as Country Lakes is now. Mr. Zelinka felt that this would not meet with Metropolitan Councils Ppproval. This would also be a very temporary thing at the most and is not a solution to the problem. Mr. Zelinka said that the interceptor cis proposed by Mr. Burandt would only be constructed to the City's borders zid it would become the responsibility of the City of Lino takes to construct the Interceptor to the affected areas. An immediate solution is impossible since It would take the Engineer approximately four weeks to compute the cost figures and the spread the assessment on the affected areas. Here again the area to be served must be defined. ,'i question from the audience was raised. What happed to the residents of that area if the homes are ;red tagged by the PCA? They can be forced to move from their homes. JUNE 23, 1975 --5-- Mr. Locher said this is possible. He also said this interceptor can be forced by the PCA. Mr. Marier said the cost of this interceptor's construction cannot be passed onto the entire City. This Is not feasible. Mr. Barter felt that the developers have a responsibility and that the Council must wait for the Engineer's plan. Mayor Bohjanen said that if either of the two plans presented to the Council is accepted, it will mean that the Lino Lakes' Comprehensive Land Use Plan must be revised. Mr. Zelinka said Mrs. Peterson had asked the Council to make a decision to accept either Plan No. 1 or 2. He felt without aid, the only feasible plan is number 1. The area to be served must be defined, people who are affected notified, compute the cost,hold a public hearing and proceed from that point. Mr. Zelinka moved to authorize the Engineer to conduct a cost study on ;Ian # 1 also a holding tank in Shenandoah, then to call a public nearing. Mr. Locher noted that if a holding tank is constructed in the Shenandoah area, only the cost of the tank will have to be assumed by the City. The developer will put the lines in the street. This tank would also requrie PCA approval. Mr. Cliff Hagen, Mechanic for the City, said the tanker truck will not service another area. It has a lot of hard miles on it and is in no condition to double the work. Mr. Marier repeated that this is the responsiblity of the developer and he will not support an interceptor that will be assessed against the people who are not receiving services. One lady from the audience said that this has been occuring for three years and she has no intentions of living with the problem any longer. The possiblity of a law suit against the developer has been discussed. This would involve the City who would then be sued by the developer. The City could only enter into a suit against the Metropolitan Council. X>3yor Bohjanen felt that most people do not want to get involved in such a costly and lengthy law suit. This will not solve the problem of no sewers and only delay any action that might have been taken. Mr. Zelinka asked the Clerk to read his motion and added to include the Planner to check the necessary changes that would be required by the Metro- i:olitan Council in the City's Comprehensive Land Use Plan. Also to compute the costs for Plan No. 2. The motion was seconded by Mr. McLean. Motion carried. JUNE 23, 1975 --6-- Mayor Bohjanen told the people that he would ask Mr. &otwaid to have an answer to this motion within 10 days or at least by the next Council meeting scheduled for July 14, 1975. Mr. Marier felt that this is all that can be done at this time and asked that the meeting proceed. Mayor Bohjanen reported that the and received a letter of resignation from Mr. Richard Holman of the Police Department. Mr. Marler moved to accept the resignation. Seconded by Mr. McLean. Motion carried. The clerk was asked to write a letter of "Thanks` to Mr. Holman. Also to inform the Police Department and the Personnel commission of the vacany and ask if prospective patrolmen could be Interviewed at the Personnel Commission meeting scheduled for June 24, 1975. Mayor Bohjanen announced that he had been appointed as Co -Chairman of the Flag Raising Ceromony at the Anoka County Courthouse to be held at 6:30 A.M. on July 4, 1975. All present were invited to attend. Hr. Locher reported that he had received confirmation of the "ride -along" rrms that were presented by the Police Department. The insurance Company concurrs with the practice. Mr. Zelinka moved to authorize the use of these forms and the Police Depart- ment to instigate the program. Seconded by Mr. McLean. Motion carried. An application for a Dance License and a 3.2% Beer on and off sale application had been received from Mr. John Quinian of the Aragon Ball- room. Mr. Locher found one signature missing. Mr. McLean moved to approve the applications with the stipulation that the missing signature be inserted. Seconded by Mr. Marier. Motion carried. There was no old business from the floor. Under new business, Chief Myhre reported that he had received 21 calls conerning stray dogs within the list month. He asked if he could authorize MAPSI for petrol duty at least three hours per week in order to slow this down. There will be a cage here at the Hall for holding dogs picked up by the Police. Chief Myhre said that Fince this orginazation patrols Blaine it is possible to -co-ordinate the ;p3 trolling. He would contact them and set this up as to the time and the areas to be patrolled. Mr. Zelinka moved to authorize Chelf Myhre to use NAPS! for a maximum of ten hours until the next Council meeting on July 14, 1975. Seconded by Mr. Marler. Motion carried. After some discussion, Mr. Zelinka moved to approve requisitions #578 through and including #582. Seconded by Mr. Mclean. Motion carried. Mr. Volk had submitted a schedule of mileage for use of his provate car while on City business. There was discusion of this matter with Mr. Volk feeling that the City vehicle is unsafe. There has been replacement of the tires and he had authorized the Parkd Department to use the behicie. JUNE 23, 1975 --7-- Mr. McLean requested Mr. Hagen, City Mechanic, to evaluate the vehicle and to report back to the Council on July 14, 1975 as to the condition of the vehicle and what is necessary to bring 1t up to a safe condition. Mr. Volk said the teen-agers who are working under the Summer Youth Programs have been picked up at their homes for work. The Council Instructed Mr. Volk that this procedure is to cease. The youths will have to find their own transportation. Mr. Marier said that in order to be paid mileage for use of a private vehicle -- the owner must have authorization for that use. Mr. Volk was asked if had obtained that authorization and he said, No. Mr. Zelinka was concerned that City equipment: doe not last as long as Industrial equipment. Mr. Hagen said that some of the equipment was Pretty well used when purchased by this City. Mr. Marier moved to cancel the mileage voucher. Seconded by Mr. Mclean. Motion carried with Mr. Zelinka abstaining. lfter some discussion of the financial position of the City and the fat that the State Aid payment had not been received as expected, Mr. McLean moved to approve the payroll authorizing the Clerk to arrange for $3,600.00 to warrants to cover these checks and the outstanding bilis. Seconded by Nr. Zelinka. Motion carried. Payroll checks #3004 through and including A3029. Outstanding bilks are covered by checks #6467 through and including /S471. FSK. Marier moved to adjourn at 11:00 P.M. Seconded by Mr. McLean. Aye.
