The regular meeting of the Lino Lakes Planning and Zoning Board was
at 8:05 p.m. by Chairman Karth. Members present; Shearer, Lombardi,
L'Allier. Absent Nadeau. Councilman Marier and Attorney Locher were

Seconded by Mr.
Mr. Charles Nelson whose rezoning hearing was scheduled to be heard at this time
was not present. The Board held up the preceding until Mr. Nelson arrived.
In the interim, the Clerk had received an inquiry from Mr. Jerald Wi dcett who owns
6 acres along County Road 'J', West of Highway 49. He is requesting permission to
erect a double bungalow on this property. After much discussion and consulting the
existing Ordinances, Mr. Locher said that a double bungalow is permissiable in that
location. This is allowable under Ordinance No. 56.
Mr. Lombardi asked how this would have been handled under Ordinance No. 6 and was
told the same rule would apply.
The rezoning hearing for Mr. Robert Nelson was called to order at 8:20 p.m. Mr.
:1- rvey Karth presented a letter from Mr. and Mrs. Robert Nelson concurring with the
-ezoning and apologizing for not being able to attend this meeting.
Mr. Locher read the mailing list and the legal description of the property involved,
Mr. Karth asked if there was anyone in the audience wtio objected with this rezoning
There was no one.
After some discussion as to the operation in this location, Mr. Kelling moved to
recommend to the Council that this Land be rezoned to commercial.
Mr. L'Allier wondered if this is rezoned to straight commercial, if the operation
could be regulated. He was concerned that this property not develop into a junk
yard in conjunction with the proposed antique business.
Mr. Kelling amended his motion to include that all inventory be stored inside, the
owner has one year to start the business or zoning will revert to the original
zoning, adequate off street parking area to be blacktopped and nothing to be
stored outside the buildings.
Mr. L'Allier seconded the amended motion. Motion carried.
Mr. Shearen questioned Mr. Karth on the response of the State to the signs that are
proposed. Mr. Karth said that he could not get a definite answer from them until
this rezoning is taken care of. He thanked the Board for their action.
Nr. Olson of West Rondeau appeared before the Board with a request for the install-
ation of a septic system at his present home that will not meet present codes. There
is no way a system can be installed to meet the present code. Mr. Frank Husnik is
to do the work. The present system is about four years old and had been put in with
no bottom in the septic system.
(2) Sept. 18, 1974
Mr. L'Allier suggested to have the Engineer take a look at this problem. Mr. L'Allier
moved to recommend to the Council that Mr. Olson contact Mr. Gotwald and that the
best possible system be put in at the address. Seconded by Mr. Shearen.
Mr. Olson said the system he is proposing to install has the approval of the Anoka
Health Department and it is the best possible system that can be installed. What
he wants is a letter from the City that this system will pass the plumbing
inspection.
Mr. L'Allier withdrew his motion since Mr. Olson is asking for is the approval.
Mr. L'Allier moved to have the Clerk contact the Anoka Health Department for a
letter of approval on the proposed system and if it meets with their approval, then
it would be approved by the City. Seconded by Mr. Sheeran. Motion carried.
14r. Charles Nelson was still not in attendance, but the rezoning hearing was called
to order at 8:40 p.m.

Nr. Nelson is requesting that the 300 foot strip along the East side of Highway #8
that is zoned commercial be rezoned to residential.
Mr. Karth asked if there was anyone present who objected to this rezoning. One
lady from the audience objected but gave no reason. Another lady was concerned
.bout the number of homes to be built in the plat and the impact this would have on
the school system. The size of the lot was questioned. One lady asked how building
pe-tnits could be issued on these lots when they were less that the 211 acres
required by the City Ordinances.
Mr. Karth told her that the 21 acre requirement is only for unplatted land and does
not apply to platted areas.
She wondered if this plat would speed up the installation of water and sewer. She
asked when water and sewer would be installed in that area.
Mr. Karth said there is no plans for water and sewer in that area at the present
time and he had no way of knowing when these utilities would be installed.
Another lady asked if this plat would have a central water system or would there be
pry vate wells?
Karth said he did not know. This sort of information would be discussed at the
-:, .rings for the plat. This hearing is only to consider the rezoning of the
cymnercial part of the land to residential. This request for the elimination of the
commercial zoning is to protect a residential area.
Mt. Shearen moved to recommend to the Council approval of this rezoning request.
Seconded by Mr. Hill. Motion carried.
(3) Sept. 18, 1974
Mr. Prokop and Mr. Jankus presented their revised petition to the Planning and
Zoning Board. They had also received a soil analysis from the Anoka County Soils
Department stating that the soils in that area are of the Hayden type and serve as
an excellent base for roads. Also, this type of soil provides for excellent
drainage.
Mx. Shearer felt that if the building permits could be restricted he would approve
alternative #3.
Lombardi wondered if the City can legally stop people from building on their
c,-swn property. He felt that this question will be resolved by the State and in not
:o'i distant future.
g'',rLocher reviewed the Johnson case where the building permit was denied but this
'as on a 20 foot easement.
There was discussion on the type of street that serves that area and Rolling Hills
.rive is an oiled street at the present and he felt that an oiled street in the
Lrea would be sufficient.
P{r. Locher brought up the requirement of extending the roadway 150 foot into Mr.
Ja--:kus's property and accepting this as a public roadway.
^_;-sire was more discussion on the possibility of other lots in the area being sold
aid the people applying for building permits.
Kelling moved to recommend to the Council a variance to Ordinance 22 under
:'sction 27 accepting alternate #3 with the stipulation that when other lots are
tp.td the street be brought up to City specifications, at property owners expense,
that the street be wind rowed with the oil, mixed and then packed down, this street
will be accepted for partial maintenance only, this to include the 150' into the
Jeakus property, building permits to be issued one to each of the two petitioners,
only, turn around into the Jankus property to end in a cul-de-sac with a 100'
eiameter. Seconded by Mr. Shearen. Motion carried.
Mr. Prokop thanked the Board and asked that copies of thise minutes be mailed to him.
Mere re was no old business.
ui3.nr new business, Mr. Hill brought up the problem of the horses at Old Highway 8
-14 Elm Street. He felt that this situation should be looked into. The names of the
p:<•pie involved must be obtained first.
?x, Locher brought up the differences between the State statutes and the City
Oruinances in who is to be notified and how in the cases of rezoning. The City
Ordinances reads 'registered' mail but Mr. Locher has been using 'certified' mail
vith a return receipt requested. He felt this is sufficient and suggested that
pa -haps the Ord. should be changed to read as such.
Mr. Lombardi suggested the elimination of reading the entire legal description. He
thought if it was posted in the Hall this would be enough. The Board members agreed.
