Application of Rice Lake Elementary PTO 47 to conduct two excluded bingo events Approved 48 49 FINANCE DEPARTMENT REPORT,AL ROLEK 50 51 There was no report from the Finance Department. 52 53 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH 54 55 3A) First reading of Ordinance No.03-10 amending Chapter 701 of the City Code relating to 56 Liquor Licensing—City Clerk Bartell explained that the ordinance proposes two changes to the city 57 code as it relates to liquor licensing. It was determined recently that there is currently a requirement for 58 a conditional use permit for outdoor serving(liquor)areas however the city's zoning regulations do not 59 provide for a conditional use in certain zoning districts. The city attorney recommends therefore that 60 the language be removed. The second change relates to an amendment forwarded to the council by the 61 Planning and Zoning Board. The board recently considered some zoning amendments regarding 62 outdoor dining areas and sent forward a recommendation to add language to the liquor code that 63 clarifies a licensee's responsibility for order and containment in outdoor areas. 64 65 Council Member Gallup moved to approve first reading of Ordinance No. 03-10, as presented. 66 Council Member O'Donnell seconded the motion. Motion carried on a unanimous voice vote. 67 68 PUBLIC SAFETY DEPARTMENT REPORT,DAVE PECCHIA 69 70 There was no report from the Public Safety Department. 71 72 PUBLIC SERVICES DEPARTMENT REPORT,RICK DEGARDNER 73 74 There was no report from the Public Services Department. 75 76 COMMUNITY DEVELOPMENT DEPARTMENT REPORT,MICHAEL GROCHALA 77 78 6A) Resolution No. 10-16,Approving a Conditional Use Permit to allow fill in the floodplain at 79 the Chomonix Golf Course- City Engineer Studenski explained that golf course owner Anoka 80 County is planning to replace two bridges this winter and, as part of the project,will be mitigating 81 some floodplain and wetland areas. The course has wetland bank credits they can utilize to allow this 82 mitigation. Mr. Studenski reviewed the hauling plans for the materials that will be brought in and out 83 of the park. The city code requires a conditional use permit for the fill placement involved in this 84 project. The project should be completed by March 31, 2010. Mr. Studenski recommended a change 85 to the resolution to add the following language to condition 4, "or as agreed upon by the Public 86 Services/Safety." 87 Council Member O'Donnell moved to approve Resolution No. 10-16 with the change recommended by L 88 staff. Council Member Roeser seconded the motion. Motion adopted on a unanimous voice vote. 89 2 APPROVED 90 6Bi and 6Bii) Zoning Ordinance Amendment regarding Home Occupations, Second Reading �1 and passage of Ordinance No. 01-10, and approval of Resolution No. 10-17 authorizing 92 summary publication of said ordinance—City Planner Bengtson reviewed the ordinance 93 amendment that updates the city's zoning code as it relates to home businesses and institutes a three 94 tiered system for their regulation. Staff has responded to comments received at first reading and has 95 added a conditional use requirement for Level C and added some maximum limits to the number of 96 employees/customers/trips. Staff and the Planning and Zoning Board are recommending approval of 97 this ordinance. 98 99 Council Member O'Donnell moved to waive full reading of the ordinance. Council Member Gallup 100 seconded the motion. Motion adopted upon a unanimous voice vote. 101 102 Council Member Roeser moved approval of the second reading and passage of Ordinance No. 01-10 103 as presented. Council Member Rafferty seconded the motion. Motion adopted on a roll call vote: 104 Yeas, 5; Nays none. 105 106 Council Member O'Donnell moved approval of Resolution No. 10-17 authorizing summary 107 publication of Ordinance No. 01-10. Council Member Roeser seconded the motion. Motion adopted 108 upon a unanimous voice vote. 109 110 6Ci and 6Cii) Zoning Code Amendment regarding residential parking and exterior storage, 111 approve second reading and passage of Ordinance No. 02-10, and approval of Resolution No. 12 10-18 authorizing summary publication of said ordinance - City Planner Bengtson reviewed the x'113 ordinance amendment that clarifies existing regulations regarding residential parking and exterior 114 storage. This will make the code easier to use as all the language will be located in one area. 115 116 Council Member Gallup moved to waive full reading of the ordinance. Council Member O'Donnell 117 seconded the motion. Motion adopted upon a unanimous voice vote. 118 119 Council Member O'Donnell moved approval of the second reading and passage of Ordinance No. 02- 120 10 as presented. Council Member Roeser seconded the motion. Motion adopted on a roll call vote: 121 Yeas, 5; Nays none. 122 123 Council Member Gallup moved approval of Resolution No. 10-18 authorizing summary publication 124 of Ordinance No. 02-10. Council Member Roeser seconded the motion. Motion adopted upon a 125 unanimous voice vote. 126 127 6D, Consider first reading of Ordinance 04-10 amending the zoning ordiannce regarding 128 outdoor dining/seating and golf course definitions - City Planner Smyser reviewed the 129 amendments included in the ordinance. The first would remove the requirement for a conditional use 130 permit for outdoor dining areas at restaurants. This is not necessary because the required 131 administrative review will serve the same purpose without the redundancy of the conditional use 132 process. This is considered a business friendly change. The second change addresses outdoor seating 133 requirements for businesses that are not restaurants, such as coffee shops or convenience stores. The 3 APPROVED 134 third amendment adds provisions for golf courses to allowed uses within the zoning district where x,55 Chomonix Golf Course is located. 136 137 Council Member Roeser moved to approve first reading of Ordinance No. 04-10 as presented. 138 Council Member Rafferty seconded the motion. Motion carried on a unanimous voice vote. 139 140 6Ei and 6Eii),2010 Street Maintenance Projects (2010 Overly and Sealcoat Projects)—City 141 Engineer Studenski reviewed the plans for overlay and sealcoating city streets in 2010. 142 143 The mayor noted that this is particularly positive in that the city is fully funding both these projects 144 for the first time in a few years and that has a long-term benefit to preserving the city's roadways. 145 146 Council Member O'Donnell moved approval of Resolution No. 10-14 approving plans and 147 specifications and authorizing advertisement of bids for the 2010 Overlay Project. Council Member 148 Roeser seconded the motion. Motion adopted on a unanimous voice vote. 149 150 Council Member Gallup moved approval of Resolution No. 10-15 approving plans and specifications 151 and authorizing advertisement for bids for the 2010 Sealcoat Project as presented.
