HomeMy WebLinkAbout12/19/1973 P&Z MinutesDec. 19, 1973 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:20 P.M. by Chairman NcLean. cambers present; Karth, Shearen, Hill, Nadeau, Kelling. Absent; Farrand. Mr. Starr and ''r. Marier were also present. Karth moved to approve the minutes of November 21, 1973 as written. Seconded by Mr. Shearen. Motion carried. The rezoning hearing for Mt. Schmitz was called to order. Mr. `icLean read the publication notice. The mailing list to adjoining property owners was not here, cut Mr. McLean decided to proceed with the material available. The only stipul- -:tion that he would impose would be to designate the use category for the land. He questioned :•ir. Schmitz as to the use of the land. Mr. Schmitz said the land would be used for the erection of a pole type build- ing to house equipment for the installation of water and sewer. There would be ro sales and no office. The building would be of colored steel - 40'X60' - no floor at the present time he would fence the area with a security type fence. : . Schmitz said that most of his work is done on a bid basis or sub -contract- -ng and the office work is done out of his home. There would be doors 12'X13' aa?d the building would be about 20' at the ridge. 'fir_. Shear had no questions. Mr. Karth asked about customers. Mr. Schmitz said there would be none. Mr. Hill asked if the lots adjoining were vacant. Mr. Schmitz said one is erpty and he had talked to the owner of the house on the other lot and they had no objections. Mr. telling had no questions. Mr. Nadeau - none. Mr. Starr wanted to be sure that this hearing was just for the consideration of rezoning the land, and that 'Ir. Schnitz understood that he would have to present a plot plan when he applied for a building permit. He could see no p_oblems with the rezoning of the remaining portion of the land. He felt that die commercial zoning should extend to the rear of the lot lines in that area. 'sir. McLean asked if there was anyone in the audience who had any objections to the rezoning of this property. There was none. '°r. Yelling moved that if normal procedures are followed, then the recommendation from the Planning and Zoning would be for approval of the rezoning request to rezone the remaining portion of the land from residential to general Business. Due to the absence of the legal mailing list, these items must be bought out at the Council hearing on December 26, 1973. Mr. Schmitz must submit full building plans, plot plan including fence before a building permit will be issued. Seconded by Mr. Karth. Motion carried. Mir. Marier asked the Clerk to remind Mr. Schmitz that it would be wise to have a perc test done before he submits this material. Also, to call ?ir. Locher and he sure all the legal papers are available at the Council hearing. Mr. :McLean also requested that in the future, when a rezoning hearing is sched- uled, he would request that 'ir. Locher attend these hearings. (2) Dec. 19, 1973 Mr. Willey, representing Mr. .1enkveld, presented the Planning and Zoning Board with a proposed plat plan for land located on the west side of the Treatment Center. There was discussion as to the location of the land to be set aside for Park purposes. There was also consideration of access points to the land to the South and West. 11r. Willey was questioned as to the size of the lots and the front footage especially the lots located on the curve of the streets. Mr. Willey assured the Board that all lots met the requirements of the Ordinance and he ::"alt that any lot that had less than the 75' frontage *would have the require oota;e at the set back line. 47.. Willey asked the Board if the proposed light industrial zoning for that rea was the only thing that would be considered? T':ie Board assured 'k. Willey that the Comprehensive Land Use Map is a guide line T x: a rule. Mr. Karth asked if there would be the sale of homes as will as lots. . Willey said, No, they do not build homes. They sell the lots to several _`ferent builders and they compete with each other. They have found this /avoid t i Tact housing and insures a better designed and built home. "icLean asked what price range these homes would fall in. Mr. Willey thought 'wia.t somewhere in the range of $35,000.00. He also told the Board that he had contacted the Metro Sewer Board and as far as he could discover, there are no t '_,Ins for that area in regards to sewers in the near future. ▪ McLean asked for opinions from other members of the Boards. There were no :.,-''._Y... r'•�.Jections, i the members. The Board felt that if the plat is prepared properly sad perc tests are run, there would be no objections from this Board. Yr. Willey thanked the Board and left. Mr. Blomquist appeared before the Board asking for a variance on a lot located ▪ Co. Rd. J. After the Board examined the survey, ?Ir. Kelling, moved to recommend : o the Council approval of the variance. Seconded by 11r. Karth. Motion carried. • Lichtscheidl appeared questioning the legality of a lot located on Main St. Fe has money down on the lot and will buy if he can build on the lot. There was some question on the split being legal. Mr. Lichtscheidl explained haw the land was measured off and the lots sold and built on. After much discussion, Ir. e ling moved to recommend to the Counci]. that Mr. Lichtscheidl be allowed to L L Lid on this lot, limiting the recommendation to Plat 82902 -- Parcel 2610, in the interest of cleaning up a long standing mess. Seconded by 'Ir. Shearen. 'ct:ion carried. The Clerk was instructed to ask Ir. Locher if a variance is - cessary; also to check date of first sale of this lot. qtr.. LeTendre and 'Ir. Schlough appeared before the Board in conjunction with the 'Suilding being erected at the Skyline Auto Body. "r. McLean read I`1r. Starr's letter of Novenber 11, and November 20, 1973. After hearing the recommendations, Mr. LeTendre asked -what he should do first. Mr. McLean said that the reconnendations in Nr. Starr's letter must be adhered to and he must submit a topography map. He asked "'r. LeTendre about the temp- orary building. (3) Dec. 19, 1973 Nr. LeTendre said the building was being used as a shelter more or less for the men working on the steel. He felt that the building would be out of there by next June. Pt. Schlough said that he had never encountered the trouble any other place and that at the present time they are erecting one of their buildings in Centerville and have_ rrangeor rental space. Therefore they will be moving out of the riZlage as soon as the other building is completed. i�. Iarier questioned Mr. LeTendre about his knowledge of the building being elected. Mr. Letendre said he knew the building was being done. Mr. Schlough aid that he had contacted four members of the Council and he felt that they (-incurred with what he was doing. He understood that he could start the build - i g without a permit and if he could not get a permit, he would remove the c:{ acture. . McLean emphasized the point that the Board is not p es irin•g; Nr. LeTendre. 11 they are asking for is a schedule and that he folious t1 rules of the C,xdinances of the `tillage. If problems arise and he cannot complete his projects as scheduled, all he had to do is to let the Board know. P'> . Letendre said the structure is just a wind break for the workers for this c:-..-oter weather. The outside is different colors because they have run into a J:aterial shortage. He repeated that this is was just a temporary building. IcLean said that the Ordinances have no provisions for a temporary structure, s7 this must be treated as a permanent building. Hr. McLean asked Mt. Starr what his recommendations would be in a case Stich as Starr suggested that Mr. LeTendre putt all his information in a letter c•- biasing the letters of Sept. 18, and Nov. 12, 1973. Set up a schedule for the cpmpletion of his projects. If he is unable to complete on schedule, he can appear and ask for an extension of time. lair. Starr asked if Mr. LeTendre had any plans for the rear of the lots. He replied that at the present time he had none. Mr. Starr was concerned about the land - of the rearof the lots. Mr. LeTendre said that the rear of the .lots on 2nd Avenue and he also has an easement across the lot purchased by otration Enterprises. McLean reminded Mr. LeTendre that he must apply for a special use permit for 'r.he security fence that is being installed. He also asked how long it would i7ane lir. LeTendre to comply with the Board's request to combine his request in package. Mr. LeTendre thought a couple of weeks or less. This does not give enough time to make the next Council meeting. Seconded by ar. Karth. Motion carried. 'Ir. McLean presented a sign permit application from the Lino Lion's Club for a 'ign at Hank's Cafe. This is an informational sign. After discussion of this, Shearen moved to recommend approval of this sign application. Seconded by Hill. Motion carried. Starr had some changes to present to the Board in conjunction with the C_=nprehensive Land Use Map. Also, the meetings have been re -scheduled for Jan. 2. 1974 and Jan. 10, 1974 for the hearings for this plan. The Board listened the changes and discussed their impact with 'Ir. Starr. The meeting adjourned at 11:30 P.M.
