The Open Space meeting was called to order at 8:10 P.M. on Aug. 2, 1973
by Chairman McLean. Members present; Clausen, Marier, Zelinka. Absent;
Lehman. Mr. Dave Torkildson, County Representative was also present.
Mr. McLean summarized the action to this date and asked the members if
they had a chance to read the current resolution. Some had and some had
not. In order to inform the people in the audience, Mr. McLean read the
resolution. Mr. McLean questioned the wording in the last paragrapp. He
asked Mr. Torkildson if the phase' hereinabove described' pertained only
to this paragraph or did it refer to entire resolution.
Mr. Torkildson said he wasn't sure of the intent - he would have to check
with the County Attorney.
Mr. McLean also questioned the intent of paragraph 3. Mr. Torkildson agre'd
that something was missing. The thoughts were not tied together• and the
intent of the paragraph was not clear.
gr. Zelinka questioned the total acreage figure - the maximun number of
acres was 2500 but the map shows a total of 2695 acres. There was discuss -
!on on the acreage with Mr. Trokildson explaining that the figure of 2500
+c.res was before the Baldwin Lake area had been added and parts of the
Jandric property had been added after the figures had been compiled.
Mr. Marier felt that in order toagree on the Resolution which refers to
Exhibit A (the map showing the proposed open space area) it would be
necessary to have the total acreage and the boundaries.
Mr. Zelinka moved to split paragraph 3 into paragraphs 3, 4, & 5 by adding
the word 'Whereas' after the word 'Council' in the fifth line and start a
new paragraph; Add 'Whereas after the word 'community' in the eighth line
and start a new paragraph; He believed that by this action the meaning
would be clear. The motion was seconded by Mr. Clausen. Motion carried
with Mr. Marier voting, No, because he did not know the intent of the
County as to this particular paragraph.
Mr. Zelinka then suggested that in paragraph #8 which would become paragraph
;110 with the above split of paragraph #3, to include the following phase.
After 'hereinabove described' add 'in this paragraph only'. He so moved.
Seconded by Mr. Marier. Motion carried.
Mr. McLean said the major differences in the maps centers around the
Jandric property. He went over the two maps noting the areas that are in
question.
Mr. Marier felt that the boundaries should be pulled back to the original
outlines as presented by the Village and include just the minimum area.
Mr. McLean said the concern of the Commission was by including this much
area, the County would be putting the Jandric project in jeopardy. He
felt this :could possibly put the Villlage in a bad position because of
the money we have invested in that area. Mr. McLean also thought this
might give Mr. Jandric the opening necessary for defaulting on this project
swing that with so much of the developable land taken it was not a

profitable venture.

Mr. Torkildson felt that this would have to be answered by legal counsel.
Only an attorney would have the answers to this sort of a question.
Mr. Zelinka remembered Mr. Jandric's representative saying they could live
with the smaller area. Mr. McLean remembered this also but he felt that
you can live with a situation and not necessarily like it.
Mr. Marier asked Mr. Torkildson if Mr. Jandric had agreed with this map.
Mr. Torkildeen said, No, the only contact he had had with Mr. Jandric was
at the meeting here when the alternate maps were presented. There had been
no other contact or discussion.
Mr. McLean said one of the areas for discussion is the golf course. Mr.
Torkildson said that in order to present a map to the Metro and DNR, on
areas being considered with the application for funds, they were expected
to have appraisals on these areas. That was the purpose of the appraisals.
Mr. Zelinka asked if the golf course is included, wouldn't the resolution
have to be changed to reflect this land in the percentage for passive use.
:1r. Torkildson didn't think so, since the planned acreage for passive use
was well withing the allowable amount.
Mr. McLean questioned the color coding around the Peltier Lake Island.
The Board had requested that the Rookery and the Island be coded in a
different color denoting these areas are for observation only and are
not to be used for any other purpose.
Mr. Torkildson said he had never heard of this being done but if this was
the way they wanted it, he would have it coded as such. He also said that
when the time came for the site map to be laid out, he would request that
a committe from Lino Lakes be appointed to work with them on the develop-
ment of the areas.
Ar. Clausen asked about the Baldwin Lake area being included with the area
from Ramsey County. He had seen a map including tha area.
Mr. McLean said this was why they had requested that the area be included
in this map - so as not to have this process repeated when that area was
to be considered. This way it is all in one plan.
Mr. Bohjanen asked Mr. Torklidson if this committee from the Village would
help in the decisions of what activities go into what areas?
Mr. Torkildson said, Yes, this is the way the County preters to work on
these projects.
Mrs. James Koehler asked Mr. Torkildson why they were so interested in the
21 acres their house is on. Why was it so important that they take her
home?
Torkildson said that in the past they had discovered problems if lands

around a home are acquired and that particular home is left isolated,
surrounded by Park lands. At the present time there is nothing definite
as to the acquisition of her home.
Mrs. Koehler said that at the present time they have people picnicing on
their front lawn, fishermen park in their yard and all sorts of inconven-
iences, and they still choose to live there. So who is the County to
decide on whether she would or would not like to live in a Park area. She
felt that this decision should be hers and not that of the County.
Mr. Marier asked Mr. Torkildson if every effort would be made to bypass
this home.
Mr. Torkildson said this home is on lake shore property and their main
purpose is to preserve the lake shore.
Mrs. Koehler said that when they decided to build and were told they needed
22 acres, they didn't question the Village. They decided to take the lake
shore and pretect it.
Mr. Torkildson said that the County Park Board does not care to buy any
home that will not effect the development of the Park. At the present
time the park access road is not adequate. News ones will have to be
constructed. There has been discussion of relocating the road so that it
will be behind the homes hoping that the Village would vacate the present
road so the property owners would not have a road in front and back of
their homes. There is a possibility that when this is done it could be
arranged in such a fashion as to make it unnecessary for them to acquire
this particular home.
Mrs. Harold Leibel asked if there was a map showing where this roadway
would be. Mr. Torkildson said, No, this would not be available until the
site map is laid out.
Mrs. Koehler wondered if the present road could be extened.. Mr. Marier
repeated his question.
Mr. Torkildson said he thought that was a fair statement. The County Board
is reluctant to acquire homes that are not a deterent to the development
of the Park. When a site plan is developed, and a decision is made as to
the road, then the Kohlers will have to decide whether they want to stay
or sell and move at that time.
Mr. McLean was concerned that once the boundaries are set, these lands are
then virtually frozen. The land would be removed from the market but the
owners would continue to pay taxes onthis property. At what point in
time would the Board release these lands if they were not to be used for
Park purposes?
Mr. Torkildson said that once the boundaries are set, then they have never
to his knowledge released any lands within those boundaries. Mr. Torkildson
said their target date l'as already been set back by one month.

He thought it would take about 5 years for the completion of the land
acquisition. They have 1 million dollars now and need about IZ million
more.
The Board was concerned over the removal of lands from the market for
that period of time, yet the owners would still be required to pay taxes
on that land. They were also concerned about the appraisals. Would the
appraisals done now be the ones used at the time of acquisition?
Mr. Torkildson said, No, any appraisal over one year old cannot be used.
The property must be reappraised.
Mr. Zelinka asked if, after the boundaries are set, and an individual out-
side this area wants to give his lands to the Open Space, can this be done?
Mr. Torkildson said under the terms of the Resolution, the County would
have to come back to the Council and acceptance of this land would have
to be by mutual agreement between the County and the Village Council.
Mrs. Leibel asked about the area blocked out at the intersection of County
Road 14 and Interstate 35W. She was told this had been left that way for
a future interchange to built by the Highway department as a possible
entrance to the Open Space area.
Mr. Marier suggested scheduling another meeting as soon as possible. Mr.
McLean asked how soon Mr. Torkildson could have the revised copies of the
Resolution. He said by Monday, Aug. 6, 1973. ivir. McLean suggested that
as soon as this can be agreed on, the Committe would have a recommendation
for the Council.
Mr. Marier said the Council would have to act on the Resolution and the
land use. The boundaries would then be set at a public hearing.
Mr. Zelinka reported the Council had appointed a committee of 3 persons
to check the pros and cons of municipal management of the golf course.
TLis area is still very much in question.
Mr. McLean asked how this would work. Mr. Zelinka said his understaning
was that the County would acquire the golf course and lease it to the
Village for $I.00 per year, the Village then operates the course.
Mr. McLean requested the Board members to look over the minutes of previous
meetings, study their notes and be prepared to make a recommendation to
+he Council at the next meeting.
Mr, Torkildson asked about 'Exhibit A' which is the map referred to in
the Resolution, will the committee go back to the original boundaries?
Mr. McLean said the Committee would recommend to the Council either their
r:cceptance of the map and resolution or their rejection. The Council would
make their decision on the Board's recommendation. Mr. Torkildson es!f,ed
tnat he be notified of the Council meeting and be put on the agenda. The
nextmeeting was scheduled for Aug,22, 1973. Mr. Marier moved to adjourn
at 9:30 P.M. Seconded by Mr. Zelinka, Aye.
