19 Ivy Cavegn, 311 Linda Lane, addressed the council regarding public safety staffing. She urged
20 the council to fill two vacant positions in the police department. The city is well served by the
21 department.

62 2A) Resolution No 10-78 Adopting Preliminary 2010/2011 Property Tax Levy-Finance
63 Director Rolekexplained that state law requires that the city council adopt a preliminary tax
64 levy for the coming year on or before September 15. The council met on the matter and
65 arrived at a figure of$8,660,000 for the 2011 preliminary levy. That figure would provide for
66 a decrease in taxes and is well below the state mandated levy limit. He reminded the council
67 that this preliminary figure may be decreased but cannot be increased. There will be more
68 discussion of the 2011 budget by the council and staff followed by adoption of the final budget
L 69 in December.

71 Council Member Roeser moved to approve Resolution No. 10-78 as presented. Council
72 Member Gallup seconded the motion. Motion adopted on a unanimous voice vote.

74 2B) Consider Resolution No. 10-79 Setting 2011 Budget/Tax Levy Public Hearing Date-
75 Finance Director Rolek noted that the city is required to hold a public hearing on its proposed
76 tax levy and budget and the action before the council would set that hearing date and time.

78 Council Member O'Donnell moved to approve Resolution No. 10-79 as presented. Council
79 Member Roeser seconded the motion. Motion adopted on a unanimous voice vote.

81 2C) Consider Resolution No. 10-80 Canceling the 2010/11 Debt Service Tax Levy For
82 G.O. Tax Increment Financing Bond Series 2007A—Finance Director Al Rolek reported
83 that the city considers on an annual basis the need to levy for the debt service on these bonds
84 and has again determined that tax increment revenue and Municipal State Aid (MSA) funds
85 will be sufficient without a levy in 2011. The resolution before the council will cancel the
86 debt service levy.

106 6A) Public Hearing(continued from 8/23/10) on Ordinance No. 09-10, Establishing a
107 Storm Water Utility—The mayor announced that the council would not be considering approval
108 of this ordinance this evening but would be hearing comments as part of the continued public
109 hearing. The council is not ready to make a decision on this matter and will continue their review
110 of the matter at their next regular work session.

112 The following comments were received during the public hearing.

`-114 Amy Donlin, 6100 Centerville Road, read a statement indicating her concerns. The original
115 wetlands of the area were negatively impacted by the growth and development in the city. The
116 retention and other mitigation efforts have not acted in the same manner as those original
117 wetlands so now the city is paying and must attempt to determine how to deal with water
118 management. She lives on a farm and is a good steward of the environment. She is concerned
119 that the real offenders should be paying their fair share to correct the problems they caused.

121 Mike Trehus,Lino Lakes,wondered why street sweeping is considered part of storm water
122 management and is included in a proposed budget when it's been a long term practice. He is
123 concerned that the budget for storm water management this year is $125,000 and would jump to
124 more than$500,000 next year. That proposed budget looks like a revenue enhancement system
125 for the city. If a fee is enacted, it will never go away.

127 Dean Hausladen, Lino Lakes, noted that he has reviewed the entire proposal and is unconvinced
128 of the need for this utility. He fears it represents a blank check and the work should be done but
129 as part of the city's regular budget. The fee is open ended so it will only go up.

131 Council Member Rafferty moved to close the public hearing. Council Member Roeser seconded
132 the motion. Motion adopted on a unanimous voice vote.

134 The mayor added that the city's responsibilty to perform storm water management work will and
L.,35 must be done. The question is how that work will be funded. The budget at this time is a first
136 proposal and will be further reviewed by the council.

138 6B) Discharge Ordinance:
139 i. Consider 2"d Reading of Ordinance No. 10-10,Regulating Discharges into the Storm
140 Sewer System of the City of Lino Lakes—Environmental Coordinator Asleson reported that
141 this ordinance that establishes regulations relative to illicit discharges and that is required under
142 the city's permit allowing the discharge of water into lakes, rivers and wetlands, is being
143 presented for second reading and adoption.

145 Council Member O'Donnell moved to waive full reading of the ordinance. Council Member
146 Roeser seconded the motion. Motion adopted on a unanimous voice vote.

148 Council Member Gallup moved to approve the second reading and adoption of Ordinance No.
149 10-10 as presented. Council Member Rafferty seconded the motion. Motion adopted: Yeas, 5;
150 Nays none.

159 6C) Consider Resolution No. 10-77,Extending Development Stage Pg Plan/Preliminary
160 Plat and Conditional Use Permits,Main Street Village - City Planner Smyser explained that
161 staff is presenting a resolution that would allow an extension to the time allowed for the
162 developers of the Main Street Village project to submit a final plat for their project. The delay is
163 due to the widespread slowdown in development activities.

165 Council Member Gallup moved to approve Resolution No. 10-77 as presented. Council Member
166 Roeser seconded the motion. Motion adopted on a unanimous voice vote.

168 6D) Consider Resolution No. 10-73, Electing to Continue Participating in the Local
169 Housing Incentives Account Program Under the Metropolitan Livable Communities Act,
170 Years 2011 -2020—City Planner Smyser explained that that city has participated in this program
171 since 1995 and has benefited from receipt of four grants during that period. The resolution
172 before the council would continue the city's ability to participate in the program. This
173 participation includes the establishment of new housing goals that are more simplified than in the
174 past and which have been reviewed by the council. The tax increment financing payments that
175 the city is paying for the 35W interchange project further qualifies the city's participation.

177 The mayor confirmed that the city's financial obligation to participate is already in place and he
La.. 18 understands that this keeps the door open for the city to seek program funds but does not obligate
179 the city to do so.
