16 1. Motorsports Facility Proposal, Noise Analysis—Economic Development
17 Coordinator Divine noted that the council requested additional information on the
18 potential for completing a noise analysis report regarding the proposed motorsports
19 facility(IMEDC proposal). She first distributed a Motorsports Noise Control report and
20 identified it as new information received from the developers. She then explained the
21 types of noise studies that could be conducted and the information that they would
22 provide, adding that it is difficult to get the overall feeling of something like a race track
L 23 without actually experiencing it. Noise is also subjective, since everyone doesn't feel the
24 same about levels and impacts. She reported to the council that IMEDC is still looking
25 for a reasonable level of support before investing in additional studies. She reviewed the
26 council's options as presented in the staff report.
27 The council discussed the options and their positions: it is appropriate to continue to
28 gather information; it is premature to consider support; economic development
29 opportunities in general are important to the city. Staff suggested that perhaps it comes
30 down to the council calling for a specific noise study, getting a request for proposals,
31 presenting that to the developers and asking if they are interested in funding it. A formal
32 request from the developers would be appropriate, and a proposed site plan would be
33 helpful along with escrow funds for the city's time to study the concept.
34 Code of Conduct—Administrator Karlson noted that the council has discussed adding
35 conflict of interest language to their code of conduct. Staff has provided the language that
36 was presented by the charter commission; it could be added to the council's code.
37 The council concurred that the proposed language should be added to the Lino Lakes City
38 Council Code of Conduct; an action accomplishing was added to that night's city council
39 meeting agenda. It was noted that the council's code doesn't apply to boards and
40 commissions so staff should report back how conflict of interest language could be
41 enacted for those groups, perhaps into the code of ordinances.
42 Dangerous Dog Ordinance—A council member explained that he was surprised when
43 he learned that the recently declared dangerous dog was released before all of the

44 conditions of the city were met. He feels it would be appropriate to amend the city's
45 animal control regulations (in the city code)to address that situation. The matter will be
46 discussed at the next regular work session on December 6.
47 Review Regular Agenda—The entire agenda was reviewed; directions were given on the
48 following items.
49 Item 3A,2011 City Fee Schedule—City Clerk Bartell explained that the schedule
50 containing most of the city's fees is adopted on an annual basis in the form of an
51 ordinance. The council questioned if the liquor investigation fee has been updated and
52 Ms. Bartell responded that staff intends to bring the liquor fees forward for consideration
53 early in 2011; the renewal period isn't until June/July. The council indicated that they
54 would be further reviewing the proposed fee schedule at the December work session.
55 Item 4A,Dangerous Dog Appeal—Chief Strege reported that the dog ruled dangerous at
56 the November 8 council meeting has bitten again. The department recommends that the
57 dog be destroyed; the dog owners have appealed that decision and will be addressing the
58 council.
59 Item 6B, Off-Road Vehicle Riding Facility—City Planner Smyser explained that a
60 property owner in a residential zoning area has created a racing/riding track in their yard.
61 Area residents have complained about the riding of motorcycles at this track. Staff
62 consulted the zoning ordinance and the city attorney and subsequently informed the
63 property owners that the facility is not an allowed use. That determination is being
64 contested by the property owners and therefore the council is being asked to make an
65 official determination.
66 The council received more information on allowable uses in residential and rural areas.
