ADJOURN Meeting guidelines on reverse side. City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: Please address the meeting chair. State your name and address for the record. Please observe a 4-minute limit. The topic must relate to city business. Open Mike is for items not on the agenda. A spokesperson must represent a group of five or more—groups will have 8 minutes. The Presiding Officer may limit duplicative presentations. Remember,the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. Staff will present their report on the proposal. Board members will then ask City Staff questions about the proposal. The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. The Board will then discuss the proposal. No further public comments are allowed. The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. COMPREHENSIVE PLAN DISCUSSION A. Water Resources Sanitary Sewer Plan, Jonathan Christensen with WSB Goals &Policies o The City of Lino Lakes Sanitary Sewer System goal: Maintain the City's residents and businesses with an affordable and safe sanitary sewer system o Policies supporting the goal: ■ Provide a low-maintenance, cost-effective sewer system that meets the long-term needs of the City's residents and businesses ■ Provide sanitary sewer service to underdeveloped areas in a planned manner ■ Provide for the capacity and extension of sanitary sewer to developed areas of the City currently served by on-site systems ■ Establish an on-site septic system inspection program to identify potential failing systems ■ Where possible, direct public sanitary sewer improvements to areas identified as having failed on-site systems Existing Sanitary Sewer System o Local wastewater collection: owned and operated by the City ■ Three existing sanitary sewer districts: 8-inch to 24-inch gravity sewer lines and thirteen projection: 1.52 MGD by 2040 vs. Preliminary developable parcel-based projection: 3.02 MGD by 2040 Major Improvements Expected: District 1 o Primarily residential development o New residential, commercial, and mixed use development expected o Wastewater generated is collected at MCES Lift Station L69 —Adequate lift station capacity for projected 2040 and ultimate flows Major Improvement Expected: District 2 o Existing residential, commercial, industrial, and institutional developments, including Minnesota Correctional Facility o New developments of various land use types expected o connecting into the Blaine relief Mr. Christensen stated that the City will connect and will only be receiving flows from Lino Lakes ■ Chair Tralle asked who would be the payee of the Blaine relief Mr. Christensen stated that it will be covered by the Metropolitan Council Major Improvement Expected: District 3 o Existing residential, commercial, and industrial development o New developments of existing land use types expected o Wastewater generated discharges to MCES Interceptor 97-08 (with City of Centerville)—This interceptor projected to have sufficient capacity for full build out flows Major Improvement Expected: District 4 o Currently unsewered o New residential and mixed use development expected o Future wastewater flow will likely discharge to existing 18-inch gravity sewer October 11,2017 Page 3 ■ Mr. Stoesz asked if the City has JPA's set up with the Blaine intercept and other intercepts Mr. Christensen stated that this is slightly different because the City would be wastewater flows will likely discharge to existing MCES Lino Lakes Relief Interceptor, located at City boundary along Washington County Highway 8 —Interceptor projected to have sufficient capacity for full build out flows Discussion o Chair Tralle asked if sewer district 3 will be able to accommodate Watermark ■ Mr. Christensen stated that it will be able to ■ Mr. Grochala stated the City has penciled out the existing layout and falls in sewer district 3 o Mr. Stoesz asked how a meter is measured and what it looks like ■ Mr. Christensen stated that the meters are located in a gravity sewer or forcemain and there a different types of meters o Mr. Evenson asked where we are at on an onsite septic inspection program ■ Mr. Grochala stated it is contained in our program now and inspect new septic installations but have not established a point of sale inspection ■ Chair Tralle stated he understands the State requires a certificate of compliance when you sell your home ■ Mr. Evenson asked if the City was planning to inspect on an ongoing basis ■ Mr. Grochala stated the City requires a licensed inspector to do City's inspections Water Supply Plan, Jonathan Christensen with WSB Goals &Policies o The City of Lino Lakes Water System goal: Provide the City's residents and businesses with affordable potable water that is safe and of high quality for daily consumption and fire demand o Policies supporting the goal ■ Provide a low-maintenance, cost-effective water system that meets the long-term needs of the City's residents and business ■ Provide adequate water pressure for all residents and business ■ Continue working with adjacent communities to provide a cooperative water system for emergency services ■ Provide water service for developing areas in a planned manner by constructing new mains, water towers, wells, and water treatment plants DRAFT MINUTES Planning&Zoning Board October 11,2017 Page 4 ■ Protect the City's sustainable water supply through conservation by reducing the demand for water, improving the efficiency of water use, and reducing loss and waste of water ■ Protect the groundwater source from contamination by implementing the Wellhead Protection Plan Existing Water System o Six wells o Two water towers o One booster station o Over 80 miles of water main o Seven emergency interconnections with adjacent communities o Lino Lakes does not have a water treatment plant—The City does treat its well water at the well heads with chlorine for disinfection, fluoride to prevent tooth decay, and polyphosphate to sequester iron and manganese Water Demand Projections o The City of Lino Lakes delivers approximately 1.4 million gallons of water per day(MGD) ■ Mr. Stoesz asked if we can assume the difference between usage for sanitary sewer and water is used for irrigation Mr. Christensen stated that a lot of difference is contributed to irrigation but other factors include water supplier services, public works working on water system, leaks in system ■ Mr. Stoesz asked how the metering is done Mr. Christensen stated that the pumped from the wells is monitored by the City and DNR, the water that is being sold to residents/businesses is being monitored by the City ■ Mr. Masonick asked if the water table is remaining the same Mr. Christensen stated that the water table has remained stable Introduction: White Bear Lake Lawsuit o Ramsey county District Court Ruling (August 30th, 2017) ■ Minnesota Department of Natural Resources (DNR) allowed over- pumping of the groundwater aquifer in the region of White Bear Lake Judge ordered the DNR to review groundwater appropriation permits Impact: White Bear Lake Lawsuit o Portion of southeastern Lino Lakes falls within five miles of White Bear Lake ■ The City is closely following developments in this case ■ Will coordinate with DNR to ensure compliance with regional and state guidelines o Initial development of District 4 is proposed to be temporarily supplied by White Bear Township via an 8' water line along southern border of Lino Lakes ■ This may be an issue depending on outcome of this lawsuit DRAFT MINUTES Planning&Zoning Board October 11,2017 Page 5 o The City of Lino Lakes will review and adjust its Water Capital Improvement Plan as definitive conclusions become available &will continue water conservation and efficiency programs o Mr. Grochala stated our facilities are outside of the 5 mile radius and anticipate ongoing discussion with law enforcement and the DNR ■ The City will be affected and water conservation will become more important o Mr. Evenson stated that a lot of the area is not on city water and asked if lawn watering fall under private wells ■ Mr. Grochala stated that it is undetermined at this point The DNR stated that if it were in effect, 58 of the last 62 years would have be in effect o Mr. Stimpson asked if there have been conversations with neighboring cities looking at going deeper than the aquifer ■ Mr. Grochala stated that the next well down is Mount Simon which is still protected Would go shallower in the northeast area into the Ironton Franconia Will bring about water treatment issues sooner than expected o Mr. Masonick asked how a lake becomes impaired ■ Mr. Christensen stated that it is a designation based on the amount of sediment in a water body and concentration of nutrients o Mr. Root stated the City does have a well within the 5 mile radius ■ Mr. Grochala stated that any modifications to our permits results in changes to our appropriations ■ Last Comprehensive Plan approved 900 million gallons a year, we are currently at 500 million galloons o Mr. Root asked about adding a new well ■ Mr. Grochala stated that we are going to have to build wells anyway o Mr. Laden stated that Blaine had issues with water supply and asked what we have in place to prevent issues ■ Mr. Christensen stated that the issue was caused by an error in the control system ■ Mr. Grochala stated that we have a lot of redundancy The City has a signal system that radios out to wells and messages staff when necessary ■ Mr. Johnson, WSB, explained, in detail, how the system works ■ Mr. Laden asked if the redundancy needs to be addressed in the Comprehensive Plan o Mr. Stimpson asked if we need to be talking about another tower ■ Mr. Christensen stated that another tower would not be needed until post 2040 ■ Mr. Root asked if there is a location being considered Mr. Grochala stated a study has been completed—search along Birch Street corridor, along a trunk line DRAFT MINUTES Planning&Zoning Board October 11,2017 Page 6 Other sites considered: school district along Rice Lake (Country Lakes Park), City Rec Complex o Chair Tralle asked if it would be feasible to shut down well 4 ■ Mr. Christensen stated that an analysis of existing demands would need to be completed and verify if a new well would need to be existing prior to taking well out of service ■ Mr. Grochala stated that well 4 has a pumping station to increase the pressure Major Improvements Expected o Installation of new 1.5 million gallon water tower—additional water tower will help the City provide adequate water storage and ensure sufficient fire flow through 2040 o Installation of at least one new well with a capacity of at least 1,000 gallons per minute before 2025 —It is anticipated that the projected maximum daily demand will exceed the firm capacity of the system's existing wells between 2025 and 2030 o Continued planning for the construction of a water treatment plant—The City's raw well water concentrations of iron and manganese exceed the EPA's recommended secondary levels Discussion o Mr. Grochala stated that the City has traditionally had a linear system o Mr. Masonick asked how deep the City's wells go ■ Mr. Johnson stated about 300 feet o Mr. Stoesz asked if there is anything the municipalities can do to decrease or gain efficiencies in the cost of treatment ■ Mr. Christensen stated that the best option is to reduce water demands through conservation measures ■ Mr. Johnson that the well would not be constructed under the tower ■ Mr. Stoesz asked it would be more cost effective to build the chemicals in bulk Mr. Grochala stated that we currently buying in bulk o Mr. Root ask about the central well treatment plan ■ Mr. Christensen stated that it includes a fair amount of water main— getting the raw water supply into the facility ■ Mr. Grochala explained existing water mains and City wells ■ Water treatment is very expensive,the only issues that the City currently has is water aesthetics o Mr. Stimpson asked if there is any issue with lack of well diversity ■ Mr. Christensen stated that the wells are currently in residential areas and alleviates that concern ■ Mr. Grochala stated that the City has a well head protection program in place o Mr. Stoesz asked if our plan includes updating existing wells with new pumping technologies ■ Mr. Christensen stated that well rehab set for the City ■ Mr. Grochala stated the DNR enacted the North and East Ground Water Management District—the City is within this district ■ Mr. Masonick stated a number of years ago, there was a Peltier Lake ■ Mr. Grochala stated that they are going to try and get a permit for this year o Mr. Stoesz asked how you deal with surface water fairness ■ Ms. Thompson stated that there is a section Cedar Lake ■ Mr. Grochala stated that it is an unnamed lake and included in DNR protected water inventory- may have been considered part of Poplar Lake o Mr. Stoesz asked about the re-pumping of ground water for irrigation analysis at Watermark ■ Mr. Grochala stated that stormwater reuse will be included in the Comprehensive Plan o Mr. Evenson asked if there are ways that the City can help improve the water quality ■ Ms. Thompson stated that making sure sanitary system is maintained, goose management plan, and encourage residents to pick up after pets o Mr. Evenson asked about sediments in ponds ■ Ms. Thompson said that the City has a maintenance program that is gone through every 5 years to verify the BMP's are functioning and new developments are required to put in water quality treatment device o Mr. Stoesz asked what the greatest innovation you see coming in the future ■ Ms. Thompson stated an increase in water refuse PLANNING& ZONING BOARD REGULAR MEETING I. APROVAL OF AGENDA The Agenda was approved as presented. III. APPROVAL OF MINUTES: Correction—Chair Tralle voted in favor of the 426 Pine Street Home Occupation Level C. Motion would carry to 5-2. Mr. Evenson made a MOTION to approve the September 13, 2017 Meeting Minutes. Motion was supported by Mr. Masonick. Motion carried 6 - 0. IV. DISCUSSION ITEMS Woods Edge Development Interest Community Development Director Michael Grochala presented the staff report Questions/concerns o Existing assisting living in same proximity o How would a larger senior community mix with this area o How would vertical/pad set up work? Addressing with businesses that residents of senior community would use o Multi-generational community Discussion o Mr. Laden asked what they are proposing for commercial o Mr. Stimpson stated that this is a plan that is exciting o First floor retail would include doctor's office, dental clinic, and eye care, the townhomes are for people in their 20's and 30's o Does not see a concern with the assisted living in the same area o Mr. Root stated mixed retail is good o Mr. Root asked what the tipping point is for how much assisted living is needed o Mr. Evenson believes that the current senior living facilities are almost full o Mr. Masonick asked how many people are required to support a mall o Mr. Laden stated that he likes this idea o Mr. Stoesz stated that he struggles with the first floor retail because of the vacancy across the street o Mr. Evenson asked for clarity on retail o Mr. Grochala stated that the developer feels they can possibly fill part of the retail area with their own needs—salon,pub, etc. o Chair Tralle stated we don't regulate liquor stores but we are regulating memory care o Chair Tralle stated that he is in favor of with improvement in the design o Mr. Laden stated that 100,000 square feet is ambitious and cutting back with mixed use o Chair Tralle asked if we need to review our standards with the original plans o Chair Tralle stated the overall consensus is that the board likes this idea Project Updates City Council approved the Amendment to the Land Use Plan of the PUD Development Stage Plan for Watermark DRAFT MINUTES Planning&Zoning Board October 11,2017 Page 11 Northeast Drainage Utility public hearing at the Environmental Board meeting this month St. Clair Estates is still under construction Century Farm North needs work Chavez Estates is moving forward Saddle Club 4th addition is happening next year—Marcel working through wetland issues Rehbein Arena was approved on Monday 49/J plan possibly coming through Planning and Zoning Board next month Ramp up planning on 35E side Anoka County has included in the 5 year capital improvement project Lake Amelia will likely be submitting another application White Bear Township would not be able to service them with water and sanitary sewer Current Comprehensive Plan amendment prior to the 2040 Comprehensive Plan update Mr. Stoesz asked if any meetings will be cancelled or adjusted due to the chambers update VII. REVIEW SCHEDULE: N/A BACKGROUND As part of the City's 2040 Comprehensive Plan update, the City's Engineer WSB &Associates, is updating the Parks, Trails and Natural Resources chapter to include open spaces and greenways. The new comprehensive plan chapter combines the stand-alone Parks,Natural Open Space/Greenways and Trail System Plan updated in 2004 in order to keep all pertinent information in one location rather than in separate documents. The goal of the updated Parks, Trails and Natural Resources chapter is to streamline the document and include only the most relevant information that is useful in terms of goals,policies and guidance and address changes to overall priorities. Maps are currently being updated to illustrate changes to parks,trails and greenway systems. Topics of discussion will include: Identify changes to parks (new and future) Identify change to trails and greenways Funding Park dedication RECOMMENDATION Discussion item only. ATTACHMENTS 2040 Comprehensive Parks, Trails and Natural Resources Summary 1 Summary of the 2040 Comprehensive Parks,Trails& Natural Resources Plan City of Lino Lakes, MN Goals&Policies The City of Lino Lakes continues to actively manage and protect its water resources. The Parks,Trails and Natural Resources Plan supports the City by outlining eight primary goals with corresponding policies related to the following: 1. Development and maintenance of parks 2. Access to Rice Creek Regional Park waterways 3. Development and connections of trails and greenway systems 4. Protection of natural resources 5. Preserve and improve water quality 6. Provide parks and natural open spaces for residents for recreation and protection 7. Develop approaches to deal with ecological challenges and threats 8. Identify important natural resources and encourage responsible adjacent land uses Park System Plan The park system plan defines the varying classifications of parks and identifies each existing and proposed park with current descriptions, development considerations and updated costs. Changes to new and proposed parks are updated on the overall parks,trails and greenway plan. Identification of regional parks remain in the plan chapter. Trail System Plan The trail system plan defines the varying classifications of trail types. Changes to new and proposed trails are updated on the overall parks,trails and greenway plan. Identification of regional trails and connections to regional trails have been updated in the plan chapter. Greenways and Natural Resources The greenway and natural resource plan defines the varying classifications to include Natural Resource Protected Area, Natural Resource Conservation Area, and Natural Resource Enhancement Corridor. Changes to areas defined for greenways, open spaces and natural resources are updated on the overall parks,trails and greenway plan. The plan also provides strategies for preserving and protecting greenways, natural resources and open spaces and ongoing management and restoration. In November 1995, Council approved a Conditional Use Permit for the church to construct a 35,000 sf addition to the building. The church currently owns the single family home located at 202 Elm Street and it is used as the pastor's residency. This property is being sold. Zoning and Land Use The property is zoned R-1, Single Family Residential and allows for churches (Public, Educational and Religious Buildings) with a conditional use permit. The area of the proposed church rectory/single family drains to the southwest to a 15" storm sewer pipe. The City Engineer has reviewed the site plan and does not see any issues. Detailed grading plans will be submitted and reviewed with the building permit application. A stormwater maintenance agreement is not required. Public Utilities The site is served by municipal 16"watermain and 24" sanitary sewer main along Willow Pond Trail. The proposed church rectory/single family house will hook-up to the existing 8"watermain service and 6" sanitary sewer service located north of the house. These utilities have capacity to handle one single family home. Landscaping and Tree Preservation Plan A 50 foot wide tree stand exists along the west property line and will not be disturbed by construction. Other significant trees (spruce, maples, elm) are noted on the survey near the location of the proposed single family home and they will not be disturbed. Canopy cover, foundation landscaping, open area landscaping or boulevard trees will not be required. Architectural Plans and Exterior Building Materials The church rectory/single family home meets the requirements of Section 1007.043(2)(a) regarding Building Type and Construction for Single Family Dwellings. The church rectory/single family home has a main floor area of 1,929 sf and has 3 bedrooms and 3 bathrooms. Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by the implementation of stormwater management practices such as grading, erosion and sediment control during construction, on site stormwater management and low floor-groundwater separation. Land Use Plan The Comprehensive Plan guides this property for Low Density Residential. The proposed church and church rectory/single family home construction is consistent with the designated land use and residential neighborhood. Housing Plan The goals and policies of Housing Plan are not negatively impacted by the construction of the church rectory/single family house. 4 Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible and to reduce unnecessary traffic. The church is accessed via Elm Street and there will be no change to the existing driveways for the church rectory/single family house. Elm Street is a major collector road and no impacts to the traffic levels of service are anticipated. Sanitary Sewer and Water Supply Plan The site is served by municipal 12"watermain and 8" sanitary sewer main along Elm Street. The proposed church rectory/single family house will hook-up to the existing 8" watermain service and 6" sanitary sewer service located north of the house. These utilities have capacity to handle one single family home. Wetlands There are no wetlands on site. Floodplain There is no floodplain on site. Shoreland District The parcels are not within a Shoreland District. AUAR The parcels are not within the I35E AUAR corridor. Conditional Use Permit The property is zoned R-1, Single Family Residential and allows for churches (Public, Educational and Religious Buildings) with a conditional use permit. Any change involving a structural enlargement of the facility requires an amendment to the conditional use permit. 5 The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: 1. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: a. Land Use Plan. b. Transportation Plan. c. Utility(Sewer and Water)Plans. d. Local Water Management Plan. e. Capital Improvement Plan. f. Policy Plan. g. Natural Environment Plan. The proposed construction of a church rectory/single family home for the pastor's residence is consistent with the policies and recommendations of the comprehensive plan. 2. The proposed development application is compatible with present and future land uses of the area. The proposed construction of a church rectory/single family home for the pastor's residence is compatible with present and future land uses. The current land use to the north across 1-35Ware townhomes, to the south are single family homes, to the west are townhomes and to the east are single family homes. 3. The proposed development application conforms to performance standards herein and other applicable City Codes. The proposed construction of a church rectory/single family home for the pastor's residence meets zoning performance standards of the General Building and Use Provisions and R-1, Single Family Residential zoning district. 4. Traffic generated by a proposed development application is within the capabilities of the City when: a. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. 6 b. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. c. If the existing LOS outside of the proposed subdivision is D,traffic generated by a proposed subdivision will not degrade the level of service below D. d. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. e. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. f. The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer-financed improvements to correct any street deficiencies. g. The LOS requirements in paragraphs a. to d. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange. h. The City does not relinquish any rights of local determination. The church rectory/single family home will utilize the existing west driveway egressing/ingressing onto Elm Street. The church rectory/single family home will not generate any excess traffic or change the level of service. Elm Street has structural capacity to accommodate one new single family home. 5. The proposed development shall be served with adequate and safe water supply. The site is served by municipal water that can accommodate the demands of a new church rectory/single family home. 6. The proposed development shall be served with an adequate and safe sanitary sewer system. 7 The site is served by municipal sanitary sewer that can accommodate the demands of a new church rectory/single family home. 7. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. No City funds are being expended on this project. 8. The proposed development will not involve uses, activities,processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The proposed construction of a church rectory/single family home for the pastor's residence is an allowed use within the R-1, Single Family Residential zoning district with an approved conditional use permit. The addition will not generate excessive traffic, noise, smoke,fumes, glare or odors. 9. The proposed development will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. There are no natural, scenic or historic features on the existing site. Specific Conditional Use Permit(CUP) Requirements In addition to the administrative requirements of a conditional use permit, the following specific performance standards of Section 1007.090(9)(d) must also be met: 1. Side yard setbacks shall not be less than fifty(50) feet. The side yard setback of the proposed single family home is 214 feet from the west property line and 600+feet from the east property line. 2. Adequate screening from abutting residential uses and landscaping is provided in compliance with §1007.043 (17) of this Ordinance. The proposed construction of a single family home for the pastor's residence is located on the west side of the existing church parking lot. Landscape screening exists along the west property line. No additional screening is required. 3. Adequate off-street parking and access is provided on the site or on lots directly abutting or directly across a public street or alley to the principal use in compliance with §1007.044 of this Ordinance and that such parking is adequately screened and landscaped from surrounding and abutting residential uses in compliance with §1007.043 (17) this Ordinance. 8 The proposed single family home has a 3 stall garage that will provide adequate off- street parking. RECOMMENDATION Staff recommends approval of the conditional use permit for the construction of a church rectory/single family home for St. Joseph at the Lakes located at 171 Elm Street with the following conditions: 1. Proof that PID # 18-31-22-34-0002 and PID # 18-31-22-34-0012 have been combined with Anoka County Property Records and Taxation Division shall be required prior to issuance of a building permit. 2. The single family home/church rectory is accessory to the church and shall only be occupied by members of the church. 3. The single family home/church rectory shall be connected to municipal sanitary sewer and watermain. Applicable fees shall apply. 4. A building permit is required prior to construction. The proposed development is a master planned residential community located in the northwest quadrant of I-35E and CSAH 14/Main Street. It contains 12 parcels totaling approximately 372 gross acres and consists of a residential mix of 706 single family lots and 165 townhome units totaling 871 housing units. In February 2017 the City was informed that Mattamy Homes was moving out of the Minnesota housing market and selling off its existing land holdings, including the Lino Lakes site. Mattamy 1 Homes has since been working on a potential sale of the development to Lennar, a leading home builder in the Twin Cities and nationally. Lennar proposes to develop Watermark using the same street,parks, trails and utility layout; however, some changes to the PUD Development Stage Plan are required to create a master plan that supports their life cycle housing products. Lennar is proposing a 3 step approach to amend the PUD Development Stage Plan: • Step(September/October 2017): PUD Development Stage Plan Amendment to the Land Use Plan to modify lot sizes o On October 9, 2017, the City Council approved Step 1-Land Use Plan Amendment with Resolution No. 17-95. • Step 2 (November/December 2017): PUD Development Stage Plan Amendment to modify architectural design standards • Step 3 (March/April 2018): PUD Final Plan/Final This Land Use Application is for Step 2. ANALYSIS In June 2016, the Council passed Resolution No. 16-51 approving the PUD Development Stage Plan/Preliminary Plat for Watermark. The resolution established architectural design standards for the single family homes and townhomes for the development. Lennar is requesting an amendment to these design standards. The applicant's narrative (attached)provides information on each of the house plans and product types. The proposed Mattamy townhome floor areas ranged from 1,712—2,198 s£ Single Family Homes Lennar is proposing a variety of house plans and variations that are different for each lot width (55', 60', 65' and 75' widths). The developer has provided floor plans, elevations, and color/material palettes. Lennar's single family homes are categorized by the Lifestyle Villa Collection, the Discovery Collection, and the Landmark Collection. Each collection has a variety of different floor plans and elevations for a combination of over 40+ different single family home products. Each house plan will be reviewed by the City prior to building permit to ensure that the ordinance standards as modified by the PUD are met. However, because this development will be constructed over a period of time, we expect that new or modified house plans will be added to the product line and would be administratively reviewed and approved by the City staff. With each PUD Final Plan/Final Plat phase, the developer shall submit house elevations, floor plans, material samples, color palettes for all buildings proposed in that phase and a draft of the Homeowners Association documents. The materials should ensure that the design of homes elevations be varied with a minimum of five different styles provided in the development and that homes in proximity to each other not look alike in terms of the combination of color of siding, accent and roofing materials. The home under consideration will be compared to the two homes on each side and to the three homes directly facing it. Section 1007.043(2)(a) This section details general building design standards for single family homes in regards to foundations, width, roof pitch and exterior wall appearance. Staff Comments: 1. The proposed Lennar single family house plans meet these standards. Section 1007.093(4) The following Building Design Standards of the City's R-2, Two Family Residential District will be used as a baseline for the Lifestyle Villas and the Discovery homes (staff comments are in italics): 3 (4) Building Design Standards. (a) Floor Area. The minimum footprint area, less garage area, for single and two family dwelling units shall be as follows: 1. Single Family Dwellings. 3 Bedroom Rambler 1,050 square feet 2 Bedroom Rambler 1,010 square feet 1-1/2 Story 980 square feet Split Foyer/Entry 980 square feet Split Level—3 level minimum 980 square feet Two Story 850 square feet The Lifestyle Villas are 2-3 bedroom ramblers with floor areas rangingfrom 1,500 sf to 1,900 sf. The Discovery and Landmark Collection are two story homes with floor areas ranging from 1,800 sf to 3,400 sf. The floor area requirements are met. 2. Two Family Dwellings. Eight hundred(800) square feet first floor above grade, plus one hundred(100) additional square feet for each bedroom. There are no two family dwellings proposed. (b) All dwellings without basements in this district shall be required to provide an additional one hundred(100) square feet of floor area to house utilities. All dwellings without basement have an additional 100 sf of floor area. This requirement is met. (c) Garages. All single family dwellings shall have a double garage and shall comply with the following: 1. Compliance with the Building Type and Construction Standards of§1007.043 (2), and All single family dwellings have double garage. This requirement is met. 2. All garages, except side or rear loaded garages, shall not protrude forward of the front wall of the house,unless the house includes a front porch that is unenclosed, a minimum of 8 feet in depth, and extends across 100 percent of the front fagade of the house. The garage shall then not protrude forward of the front porch, and Lennar's single family homes have 6 foot deep porches. Staff would support a minimum 6 foot porch depth vs. the required 8 foot. Some of the single family house plans do not meet the R-2 District requirements because the garage protrudes forward of the house and porch. 4 a. The following house plans shall be omitted: i. Discovery Collection-Columbus and Hudson ii. Lifestyle Villa Collection-Valencia b. Staff would support house plans that include a minimum 6 foot deep porch and the garage only protrudes past the porch a maximum of 6 feet. i. The following house plans would be acceptable: 1. Discovery Collection-Hamilton, Lewis and Sullivan 2. Lifestyle Villa Collection-Brighton, Buckingham and Oxford 3. If the garage door faces the street, the length of the garage wall facing the street shall not be greater than fifty percent(50%) of the length of the entire front facade of the structure; except on houses that comply with all of the following conditions: a. The second floor living space extends over the two-car portion of the garage; and b. The garage doors are decorative and have a strip of windows; and c. Garages in excess of two stalls shall be broken up so the additional stalls are recessed four feet from the main garage facade; and d. Garage width does not exceed 32 feet. Some of the house plans do not meet the 50%garage length requirement but only by I or 2 feet. Staff could support this variation. Staff would support a 2 foot recess on additional stalls vs. the required 4 foot. The two and three car garages do not exceed 32 feet in width. Any four car garage may exceed 32 feet if recessed a minimum 2 feet from the main garage facade. (d) All dwellings shall comply with the Design and Construction Standards of§1007.043 (2)• The single family dwellings comply with these standards. Resolution No. 16-51 This resolution details the following additional single family home Architectural Design Standards: 1. The following are acceptable exterior materials and styles for both the single family homes and the townhomes: 5 a. Exterior Materials i. Vinyl, aluminum or steel siding (acceptable only on single family homes, not townhomes) ii. Brick iii. Stone iv. Stucco v. Wood vi. Engineered siding products such as LP board, Hardie board or similar b. Styles i. Lap siding ii. Board and batten iii. Shakes 2. One of the following three architectural features shall be incorporated into the single family home side and rear elevations that are visible from 20th Avenue (CSAH 54), Street A, and the public park: a. A minimum of 4 inch window trim on side and/or rear elevations to match the dimensions of the front elevation. b. Incorporate trim and banding in complementary colors to add interest and variety to the side and/or rear elevations. c. Incorporate more than one exterior material and/or style on the side and/or rear elevations. Staff Comments: 1. The proposed single family homes meet these design standards. 2. The developer shall provide a map highlighting the applicable single family lots abutting 20th Avenue (CSAH 54), Street A and the public park. Townhomes Lennar's Colonial Manor/Patriot Collection proposes 2 types of row style townhomes, the Adams/Monroe and Jefferson/Madison and 1 type of back-to-back style townhome, the Franklin/Revere. All units are on 32' wide lots. Buildings will integrate a mix of 4, 5 and 8 units. The developer has provided floor plans, elevations, and color/material palettes. Each townhome plan will be reviewed by the City prior to building permit to ensure that the ordinance standards as modified by the PUD are met. However, because this development will be constructed over a period of time, we understand that new or modified townhome plans may be added to the product line and would be administratively reviewed and approved by the City staff. 6 With each PUD Final Plan/Final Plat phase, the developer shall submit townhome elevations, floor plans, material samples and color palettes for all townhomes proposed in that phase and a draft of the Homeowners Association documents. The materials should ensure that the design of elevations be varied in the development and that townhomes in proximity to each other not look alike in terms of the combination of color of siding, accent and roofing materials. The townhomes buildings under consideration will be compared to the other townhomes on each side and across the street. Section 1007.043(2)(b) This section details the following general building design standards for townhomes (staff comments are in italics): (b) Two Family and Townhome Design and Construction Standards. 1. Unit Width. The minimum width of a two family or townhome dwelling unit shall be twenty-four(24) feet. Minimum floor area per unit shall be established within the zoning district. The proposed unit widths are 32 feet and the minimum floor area is 1,700 sf. The required minimum lot widths of 24 feet and minimum floor area of 1,100 sf are met. 2. Unit Construction. a. Building elevations and floor plans shall be furnished illustrating exterior building materials and colors to demonstrate compliance with §1007.043 (2)(b)2.d. of this Ordinance. Building floor plans shall identify the interior storage space within each unit. Building elevations and floor plans have been provided. b. Decks or Porches. Provision shall be made for possible decks,porches, or additions as part of the initial dwelling unit building plans. Ground level patios are incorporated into the house plans. This requirement is met. c. Minimum Overhang: In case of gable roof, a minimum eighteen(18) inch roof overhang, soffit shall be required for all dwelling unit building plans. The gable roofed overhangs are 24 inches. This requirement is met. d. Exterior Building Finish: The exterior of townhome dwelling units shall include a variation in building materials which are to be distributed throughout the building facades and coordinated into the architectural design of the structure to create an architecturally balanced appearance. In addition, townhome dwelling structures shall comply with the following requirements: 7 i. A minimum of twenty-five (25)percent of the combined area of all building facades of a structure shall have an exterior finish of brick, stucco and/or natural or artificial stone. ii. Except for brick, stucco, and/or natural or artificial stone, no single building facade shall have more than seventy-five (75) percent of one type of exterior finish. iii. For the purpose of this section, the area of the building facade shall not include area devoted to windows, entrance doors, garage doors, or roof areas. Resolution No. 16-51 details specific exterior building finish requirements and these will be analyzed later in this staff report. 3. Storm Shelter. In cases where dwelling units are constructed slab on-grade, provisions shall be made to provide for storm protection either internally to the unit or in a separate storm shelter structure. Compliance with this requirement shall be based upon Federal Emergency Management Agency(FEMA) guidelines and standards which are on file with the City Building Official. Storm protection has been provided internally to the units. The Building Official has reviewed the units for FEMA compliance. 4. Outside Storage. Outside storage shall be allowed only in designated areas which are screened in accordance with §1007.043 (17) of this Ordinance and under the ownership of the property owners' association subject to other applicable provisions of this Ordinance. No outdoor storage is proposed. 5. Garages. a. Each dwelling unit shall include, at a minimum, a double garage. b. Garages shall comply with the following minimum size standards: i. Dwellings With Basements. Four hundred forty(440) square feet. ii. Dwellings Without Basements. Five hundred forty(540) square feet. iii. Garages shall be a minimum of twenty(20) feet in width. Each townhome unit has a double garage. The townhomes are slab on grade and do not have basements. The intent was to ensure adequate storage area; however, the proposed units exceed the City's minimum floor area by 600 sf so PUD flexibility is possible. This flexibility would be consistent with other townhome developments in the City and Mattamy's approvals. Lennar is requesting flexibility in the garage sizes and garage widths. 6. Utilities. a. Public Utility Service. Separate public utility services shall be provided to each unit unless exempted by the City Engineer. b. Sewer Connection. Where more than one (1)unit is served by a sanitary sewer service, all maintenance and cleaning shall be the responsibility of the property owners' association or owners. Separate public utility services are provided to each unit. These requirements are met. 7. Homeowners'Association. A homeowners' association shall be established for all quadraminium, three and four plex multiple family and townhome developments subject to review and approval of the City Attorney. The homeowners' association shall be responsible for all exterior building maintenance, approval of any exterior architectural modifications, landscaping, snow clearing and regular maintenance of private driveways and other areas owned in common when there is more than one (1) individual property owner having interest within the development. Homeowners'Association documents shall be provided with each phase of development. Section 1007.094,R-3 Medium Density Residential Development 9 The following building design standards apply to the townhome units (staff comments are in italics): (4) Impervious Surface Coverage Area. The impervious surface of the property shall not exceed fifty percent(50%) in a Medium Density Residential land use area, or sixty-five percent (65%) in a High Density Residential land use area. The developer shall provide the impervious surface coverage area calculations for the townhome development. (5) Building Design Standards. (a) Floor Area. The minimum livable floor area for each multiple family dwelling unit shall be seven hundred(700) square feet plus one hundred(100) additional square feet for each bedroom. Dwellings with shared access shall be required to provide adequate floor area within the building to house utilities. The dwellings have individual access and have an additional 100 sf offloor area to house utilities. (c) All dwelling units shall have parking provided in accordance with §1007.044 (6). The developer shall parking data with the PUD Final Plan/Final Plat to verify compliance. (d) All dwellings shall comply with the Design and Construction Standards of§1007.043 (2)• These design criteria were analyzed previously in this staff report. 10 (6) Height Regulations. No building shall be erected or structurally altered to exceed the height of the greater of three stories or thirty-six (36) feet in height except as allowed by §1007.043 (3). The height of the proposed townhomes as measured from the base of the structure to the average height of the highest gable is 22 ft to 24 ft. This requirement is met. Resolution No. 16-51 This resolution details the following additional townhome Architectural Design Standards (staff comments are in italics): 1. The following are acceptable exterior materials and styles for both the single family homes and the townhomes: a. Exterior Materials i. Vinyl, aluminum or steel siding(acceptable only on single family homes, not townhomes) ii. Brick iii. Stone iv. Stucco v. Wood vi. Engineered siding products such as LP board, Hardie board or similar b. Styles i. Lap siding ii. Board and batten iii. Shakes Lennar is requesting vinyl siding be allowed on the townhomes. They are agreeable to include engineered trim products. This would be the same stipulation applied to the Woods Edge townhome development. 2. The following minimum architectural standards shall be incorporated into the townhome neighborhood: a. A minimum of three (3)unique building facades (A, B and Q for each elevation of the townhomes shall be provided. Three unique building facades are proposed with the Jefferson/Madison, Adams/Monroe and Franklin/Revere products. This requirement is met. b. A table of architectural fagade data shall be included for each elevation. A table has been provided. 11 c. A unique building color package shall be included for each phase of development. Unique building color packages were included with this submittal and will also be required with each phase of development. d. At no point will the same fagade and same color package be specified on buildings that are immediately adjacent to or directly across the road from each other. Adjacent building color packages and facades will be reviewed with each phase of development to ensure compliance. e. A minimum of 4 inch window trim on side and/or rear elevations to match the dimensions of the front elevation. Lennar proposes 6 and 10 inch window trim on all elevations. This requirement is met. f. In no case shall any exterior material be less than 10%. To clarify any confusion, in no case shall any exterior material or style per elevation be less than 10%. For example,per the fa(ade data chart provided by Lennar, on the rear and side facades, board and batten, shakes and shutters and brick/stone are less than 10%. These shall be revised. g. Front elevations shall have a combination of 3 exterior materials and/or styles as defined above. The front elevations have a combination of 3 exterior materials and/or styles; however, one of the exterior materials is vinyl siding with engineered trim products. Lennar is requesting vinyl siding be allowed. h. At least 60% (e.g. two of the three buildings) of the facades in each phase shall include brick, stone or stucco on the front elevation. All 3 of the townhome buildings have brick or stone on the front elevation. This requirement is met. i. Rear elevations shall have a combination of 2 exterior materials and/or styles. To clarify, a minimum combination of 2 exterior materials, or 1 exterior material and 2 styles shall be required. The 2 styles shall be of contrasting or complimentary colors. The rear elevations do include 2 exterior materials; however, they shall meet the 10% requirement. j. Rear elevations shall include some vertical trim or element to break up the longer horizontal planes. 12 Rear elevations include vertical trim. This requirement is met. k. Side elevations that are exposed to roadways or open space and are highly visible will incorporate architectural details to match the front fagade (e.g. the Tanager and the Maxwell Side (exposed)). The Tanager and Maxwell products were specific to Mattamy Homes and are no longer applicable references. The four Lennar townhome side elevations facing Street A shall include brick, stone or similar engineered product. These side elevations shall also have 2 other exterior materials or I other exterior material and 2 styles. The 2 styles shall be of contrasting or complimentary colors. Per the Preliminary Plat, these are lots 899, 903, 904 and 808. 1. Side elevations that are not exposed to roadways or open space shall require only one exterior material (e.g. Maxwell (unexposed)). The Maxwell product was specific to Mattamy Homes and is no longer an applicable reference. Side elevations not exposed to public streets (e.g. Street A) shall require only one exterior material. in. Decorative garage doors are required on all units. Decorative hardware is provided on the garage doors. This requirement is met. n. At least 60% of the buildings shall have decorative garage doors with windows for any given development phase. All garage doors have faux windows. This requirement is met. Additional Staff Comments: 1. Additional screening(e.g. landscaped berm,partial fence, hedge, etc) shall be included along rear elevations of the townhome neighborhood along the trail to screen personal items such as grills, lawn furniture etc. 2. Language will be added to the resolution to ensure all single family home front elevations include brick, stone or similar engineered product. The front elevations shall also have 2 other exterior materials, or 1 other exterior material and 2 styles. The 2 styles shall be of contrasting or complimentary colors. a. The Lennar products meet these standards but want to add clarification. 13 Next Steps If approved, Lennar will proceed to the final Step 3, submittal of PUD Final Plan/Final Plat. RECOMMENDATION Staff recommends approval of the Watermark PUD Development Stage Plan Amendment #2 to the Architectural Design Standards subject to the conditions noted in this staff report. Staff also recommends the following revisions to Resolution No. 16-51: ARCHITECTURAL DESIGN STANDARDS 1. The following are acceptable exterior materials and styles for both the single family homes and the townhomes: a. Exterior Materials i. Vinyl, aluminum or steel siding 1. One of the following three architectural features shall be incorporated into the single family home side and rear elevations that are visible from 20a'Avenue (CSAH 54), Street A and the public park: a. A minimum of 4 inch window trim on side and/or rear elevations to match the dimensions of the front elevation. b. Incorporate trim and banding in complementary colors to add interest and variety to the side and/or rear elevations. 14 c. Incorporate more than one exterior material and/or style on the side and/or rear elevations. 4. The following minimum architectural standards shall be incorporated into the townhome neighborhood: a. Flexibility may be allowed during PUD Final Plan/Final Plat phases to allow for a lot depth of 120 feet only if a public value of creating open space or protecting a natural resource is achieved. 3. The 100 year High Water Level shall not encroach into any yard. 4. Wetlands and buffers shall not encroach into any yards. 5. The required 10 feet drainage and utility easement above the HWL may be included in the lot as part of the standard D&U easement. BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby approves the PUD Development Stage Plan/Preliminary Plat for Watermark subject to the following conditions: 1. The post development discharge rates shall not exceed the discharge rates established and adopted by RCWD in Northeast Lino Lakes prior to issuance of building permits. 2. The developer shall provide a Master PUD Development Stage Plan/Preliminary Plat booklet for the entire development that establishes discernable public values and baseline development standards for both the single family and townhome neighborhoods. 3. The developer shall provide a Master PUD Final Plan/Final Plat booklet with each phase that establishes the baseline development standards for that phase. 4. The developer shall enter into a Master PUD Development Agreement for the entire development. a. This shall occur with the first phase of development. 5. The developer shall enter into separate PUD Development Agreements with each PUD Final Plan/Final Plat phase of development. 6. The developer shall submit one draft Master Homeowner Associations (HOA) document for the entire development. 7. The developer shall submit draft sub-HOA's with each PUD Final Plan/Final Plat phase of development. 8. The developer shall submit recorded copies of the Master HOA document and applicable sub-HOA documents prior to issuance of non-model building permits for each phase of 16 development. 9. Tree Preservation and Landscape, Buffer and Screen Standards a. Detailed landscape berm plans and sections are required along CSAH 54. b. Landscape screening and buffers shall be installed along CSAH 54, I-35E and in between the townhomes and commercial. c. Attention shall be made to the location of landscape plantings, buffer and berms in regards to grading, storm sewer and utility location, catch basins, etc. d. Water re-use pump stations shall be viewed to determine if screening is required. 10. Single Family Neighborhoods a. Detailed house architectural plans, color renderings and material palette shall be submitted with each PUD Final Plan/Final Plat for all single family lots b. The developer shall provide a map highlighting the applicable single family lots abutting CSAH54, Street A and the public park. 11. Townhome Neighborhood a. A separate plan set detailing the townhome neighborhood shall be required. b. Detailed architectural plans and color renderings shall be submitted for all townhome building elevations with each PUD Final Plan/Final Plat. 12. Parks and Trails a. Details on water fountains shall be required with PUD Final Plan/Final Plat. b. A Trail Phasing Plan shall be required with PUD Final Plan/Final Plat. c. A "trail corridor" shall be installed along one side of Street B in lieu of sidewalk to make a connection to the park. The trail could be bituminous or concrete. 13. Wetlands and Buffers a. The lots surrounding Outlot A shall be evaluated to verify proper wetland buffers (10-25 feet) can be established outside of lots. b. Wetland area calculations differ from Sheet 23 and Wetland Permit Application and shall be adjusted accordingly. c. Conservation easements for wetland buffers shall be recorded with the final plat. 14. Water Re-use a. Irrigation system for public park, berm area and townhome open space shall utilize stormwater re-use as recommended in the Watermark Water Re-Use Feasibility Study. 15. F000dplain a. The base flood elevation shall be determined by the applicant. b. A Conditional Letter of Map Revision(CLOMR) and Letter of Map Revision (LOMR)will need to be obtained from the Federal Emergency Management Agency(FEMA) to verify the floodplain is not impacted by development. 16. The developer shall submit a revised PUD Development Stage Plan/Preliminary Plat 17 based on the following staff comments: a. The approval allowed up to 871 residential units and 144 acres of open space based on Mattamy Homes' proposed Land Use Plan (see attached Mattamy Homes' project narrative and excerpts from the Preliminary Plat Image Booklet). On April 24th, 2017, the City of Lino Lakes granted an extension of time to December 13th, 2017 for the submittal of the Final Plan/Final Plat. U.S. Homes Corp, dba Lennar, 13605 361h Avenue, Suite 600, Plymouth MN 55447, is requesting a Planned Unit Development Architectural Standards Plan Amendment for Watermark. She is requesting a curb cut width of 28 feet be allowed. City ordinance allows for a maximum 26 foot curb cut/driveway width. ANALYSIS Earlier this summer, the property owner made improvements to their driveway without a permit. The driveway was resurfaced and widen to 28 feet all the way to the curb. Per Section 1007.044(3)(h): 1 7. Curb Cut/Driveway Width. No curb cut shall exceed twenty-six (26)feet in width within a residential zoning district, or thirty-six (36)feet in width if the property is in a commercial, industrial, or public/semi public zoning district, as measured at the street right-of-way line unless approved by the City Engineer. The driveway associated with such curb cut may increase in width at an angle not greater than forty-five (45) degrees. Attachment 3 is a Driveway Exhibit depicting a 26 foot wide curb cut and 45 degree angle. The property is zoned PUD, Planned Unit Development for an urban residential subdivision. The City Engineer does not approve widening of the curb cut. The property owners would be required to cut out a 40 square foot concrete section of the driveway. They are requesting a variance instead of having to cut out a section of the driveway. CRITERIA AND FINDINGS OF FACT No variance shall be granted unless it meets all the criteria in paragraphs 1. through 7. below. The City shall make findings regarding compliance with these criteria. 1. The variance shall be in harmony with the general purposes and intent of the ordinance. The general purpose and intent of the ordinance is to alleviate or prevent congestion of the public right-of-way and to promote the safety and general welfare of the public, by establishing minimum requirements for off-street parking of motor vehicles upon various parcels of land or structures. The variance to allow for a 28 foot curb cut/driveway width is harmonious with the general purposes and intent of the ordinance. 2. The variance shall be consistent with the comprehensive plan. Per the Comprehensive Plan, the property is guided for Low Density Residential land use. The variance request is consistent with the comprehensive plan. The applicant's property is intended for single family dwellings with houses, garages and driveways. 3. There shall be practical difficulties in complying with the ordinance. "Practical difficulties," as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by the ordinance. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. The property owner proposes to use the property in a reasonable manner; however, there is no practical difficulty in complying with the required 26 foot curb cut/driveway width. 4. The plight of the landowner shall be due to circumstances unique to the property not created by the landowner. 2 The plight of the landowner was created by the landowner installing a driveway without a permit. There are no unique circumstances to the property causing them to not be able to comply with the ordinance. 5. The variance shall not alter the essential character of the locality. The variance will not alter the essential character of the locality which is a single family residential neighborhood with houses, garages and driveways. 6. A variance shall not be granted for any use that is not allowed under the ordinance for property in the zoning district where the subject site is located. A minor subdivision and variance are required. 1 ANALYSIS Outlot A, Lino Air Park North was platted in 1977. This portion of the outlot is 2 feet wide and 1,283.33 feet long and runs along the north side of Carl Street. These types of parcels are commonly referred to as "spite strips". This outlot came to staff s attention when working with Randy Rennaker. Mr. Rennaker was interested in purchasing the vacant parcel east of 345 Carl Street (PID#07-31-22-14-0005) and the residential parcel at 7801 4th Avenue (PID #07-31-22-14-0004) from Richard and Jean Goldade. Mr. Rennaker wishes to construct a single family home on the vacant parcel and sell 7801 4th Avenue. The vacant parcel is a substandard unsewered lot of record. Per Section 1007.042(1): (d) Any substandard unsewered lot of record existing at the effective date of this Ordinance and held in separate ownership different from the ownership of adjoining lots may be used for the erection of a structure conforming to the use regulations of this Ordinance provided that: 1. The lot was a separate parcel with its own parcel identification number on the date of the adoption of this Ordinance. 2. It can be demonstrated that the lot can accommodate the proposed principal structure, onsite well if the public water system is not available, and an onsite wastewater treatment system including both a primary and secondary drain field area in accordance with MN Stat. 7080 and other applicable requirements. 3. The lot has direct frontage on an improved public street which has been accepted for maintenance by the City of Lino Lakes. 4. All building and site improvements adhere to all required setbacks. In 2009, the City passed Resolution No. 09-52 approving a"blanket variance" for these types of Xcel Energy parcels. Unfortunately, the resolution was specific to Xcel Energy owned parcels and would not apply to outlots; however, the rationale for approval is the same. The general purpose and intent of the R, Rural ordinance is to aid in guiding development toward fulfillment of the Comprehensive Plan. The variance is in harmony with the general 3 purpose and intent of the ordinance by eliminating an unbuildable outlot and combining 3 parcels with existing rurally zoned parcels. 2. The variance shall be consistent with the comprehensive plan. Per the Comprehensive Plan, the property is guided for Low Density Residential land use. The variance request is consistent with the comprehensive plan. The newly created parcels will remain rurally zoned and allow for the construction of single family detached dwelling on the vacant parcel. 3. This is the site that has previously been considered for a grocery store. The land is currently zoned GB, General Business but guided mixed use in the Comprehensive Plan, intended for both commercial and residential development. The Hodgson Road & CRJ Master Planning Study was prepared for the mixed use area and approved by the City Council in 2007. The study was incorporated into the 2030 Comprehensive Plan. The plan is intended to establish a general land use design with some specified important design elements. As noted in the comprehensive plan, future amendments of the Plan may be appropriate to address evolving community needs, market forces, and regulatory requirements. The plan had four objectives: 1. Identify appropriate land uses (present and future) in the study area 2. Plan for road improvements to provide good access and circulation 3. Identify routing &Phasing solutions for utilities to facilitate future development 4. Plan for redevelopment while recognizing existing businesses. The planning study assumed that approximately half of the area would develop with residential uses at approximately 10 units per acre overall. The Comprehensive Plan allows the density to range from 8 to 15 units per acre. Anal The concept plan shows that the entire Morris property is proposed for residential development. The proposal currently includes single level townhomes, an assisted living facility and a proposed market rate multi-family building. A total of 162 residential units are proposed, which would meet the required mixed use housing density. The plan also includes two retail buildings, containing approximately 21,000 square feet, on the adjacent properties to the south. While the property owner has had discussions with the abutting property owners, the proposed development would not necessarily include redevelopment of those sites. The owner is currently seeking feedback on the proposal. Discussion by the Planning & Zoning board is not intended to be a formal review but rather a conversation regarding the general mix of uses and layout of the site and expectations. While there are a number of architectural, design and aesthetic elements that would need to be addressed the concept plan does accomplish the following master plan objectives: 1. Establishes Hodgson and CR J accesses at locations consistent with the master plan. 2. Provides access through the site to service commercial area to the south. 3. Includes a mix of housing types. 4. Building density and massing transitions from the lower profile townhomes, adjacent to exiting residential, to larger, higher density uses to the south and east, along Hodgson Road. 5. Provides right-of-way for Hodgson Road improvements. 6. Would provide for extension of public utilities to serve the site and abutting uses. Staff is working with WSB and Associates on a proposal to extend trunk sanitary sewer and water to the area. It appears that through refinement of the design, additional goals could be achieved including: 1. Development of stronger connections to existing trails and neighborhoods. 2. Creating green buffer between new and existing development. 3. Providing pedestrian facilities along both Hodgson and internal streets. 4. Shifting buildings close to intersection corners and street to establish strong "cornerstones" and street presence. Staff has been very forthcoming with the owner and developer that the City is not looking for a typical residential development in this location. The city has thousands of acres available, both guided and zoned for residential development, that can accommodate townhomes. Any residential development considered for this site should bear a high standard for architectural design, incorporation of site amenities and serve as a catalyst for redevelopment of the surrounding properties. REQUESTED BOARD DIRECTION Staff is seeking Planning & Zoning Board comments regarding the proposed concept and more specifically the following questions: 1. Would the City consider rezoning the property from GB, General Business to a residential Planned Unit Development provided the plan accommodates commercial development to the south? 2. Would the City consider converting commercially zoned land to residential uses in absence of any associated commercial development? (a) Except as provided for in §1007.042 (1)(d), and §1007.042 (2)(b) of this Ordinance, the minimum unsewered lot size within any zoning district is ten(10) acres. (b) Where the following conditions exist, a lot of a minimum of one acre may be created, provided that: 1. A habitable single family home has been constructed prior to July 13, 1992; or 2. There exists a habitable single family home constructed after July 13, 1992, and the creation of a new lot is needed to provide security to a third party lending institution for owner financing of the existing habitable single family home. The following conditions shall apply to any lot created hereunder: 3. The new lot that has a minimum area of one acre contains an existing habitable home, and 4. The balance of the property is ten(10) acres or more, and 5. The new lot that has a minimum area of one acre contains one acre of contiguous buildable land, not including road right of way, electrical transmission line easements or pipeline easements, and 1 6. Both the one-acre-minimum lot and lots made from the remaining land must meet all minimum lot requirements and provide for meeting setback and other structure requirements, and 7. It can be demonstrated that all unsewered lots can accommodate the proposed principal structure, onsite well if the public water system is not available, and an onsite wastewater treatment system including both a primary and secondary drain field area in accordance with Minn. Stat. 7080 and other applicable requirements. 8. For lots created under (b)2. herein, the applicant making a request for a lot split based upon requirements of a lending institution shall provide written verification from the lender of such requirements at the time the application is filed. 9. For lots created under(b)2. herein, the property owner shall record with the Anoka County recorder a covenant that prohibits the transfer of any lots created under this section unless the same is combined into one parcel with the balance of the owner's property from which it was split or in accordance with the provisions of§1007.042 (2)(a). This requirement shall not apply to any conveyance by a lending institution who has acquired title as a result of a mortgage foreclosure. ANALYSIS This ordinance relates to unsewered lots in rurally zoned districts. Rurally zoned parcels are required to be a minimum of 10 acres. This ordinance is intended to allow for a 1 acre parcel with an existing single family home be created. There is a situation in that the original single family home was built prior to 1992. It burned down in 2015. The property owner would like to rebuild the house and then split off the house on 1 acre. Is the intent of the ordinance to allow for the 1 acre split if there was a house existing prior to 1992? Or is it the intent of the ordinance that the house to be split off has to be built prior to 1992? RECOMMENDATION Discussion only. ATTACHMENTS None. 2
