Council 33 Member Gallup seconded the motion. Motion carried on a unanimous voice vote. 34 35 ITEM ACTION 36 37 1A. Consideration of Memorandum of Understanding extending Local 49 (public works 58 employees) labor agreement for one year with negotiated amendments 59 60 3B. Consideration of Memorandum of Understanding extending AFSCME Local 2454 61 labor agreement for one year with negotiated amendments 62 63 3C. Consideration of Memorandum of Understanding regarding L.E.L.S. Local 299 64 (police officers) current labor agreement 65 66 3D. Consideration of Memorandum of Understanding regarding L.E.L.S. Local 260 67 (police sergeants) current labor agreement 68 69 Acting Administrator Tesch noted that the council had discussed these agreements at their work 70 session held just previous to the council meeting. The council has some concern about the 71 language in the agreements limiting the city's ability to lay off employees in 2010; the clause 72 would limit the council's flexibility in dealing with the budget. The city attorney was asked to 73 opine on the impact of the council not agreeing to that language in the tentative agreements 74 before them. 75 76 Attorney Langel remarked that if the memorandums of understanding before the council 77 constitute the unions' offer and the city removes something from them,they would then become 78 new offers on the city's part. The council can certainly vote the agreements up or down; a 79 change to the agreement would put it back on the bargaining table as a counter offer. When 80 asked if the city could change elements of a labor contract mid-term, Mr. Langel suggested that 81 such a change should be requested only under the most necessary of circumstances. 82 83 A council member noted that the council did not agree to the language in question and suggested 84 that taking it out would bring the parties closer to agreement. 85 86 The mayor remarked that the council has a proposed agreement and should vote it up or down. 87 88 A council member suggested that there is risk in losing the furlough concession if the agreement 89 goes back to the table; that would leave a hole in the budget. 90 2 COUNCIL MINUTES December 28,2009 APPROVED ' 91 When a council member recalled that the council intends to begin the coming year with early 92 budget discussions and asked if those discussions are intended to deal with 2010 or 2011, the 93 mayor elect explained that his intent is that the council work early on the 2011 budget and 94 implement new elements in 2010 if possible. 95 96 Mayor Bergeson moved to approve the Memorandum of Understanding extending the Local 49 97 labor agreement for one year with the negotiated amendments (Item 3A). Council Member 98 Roeser seconded the motion. Motion lost on a voice vote. (Yeas—Bergeson, Roeser;Nays— 99 Reinert, O'Donnell, Gallup). 100 101 Council Member Gallup moved to reconsider the subject matter of Item 3A. Mayor Bergeson 102 seconded the motion. Motion adopted on a voice vote (Council Member Reinert recorded as 103 voting nay). 104 105 Council Member Reinert moved that Item 3A be postponed to the next regular council meeting, 106 with direction to place the item on the January 4 work session. Staff also directed to begin 107 renegotiations with the employee groups. Council Member O'Donnell seconded the motion. 108 Motion carried on a voice vote(Mayor Bergeson recorded as voting nay). 109 110 Acting Administrator Tesch pointed out that a long holiday weekend lies ahead so it will be 111 difficult to get together with the unions before the January 4 work session. The council 112 requested that they be informed of any progress in the meantime. 113 L 14 Council Member Reinert moved that Items 3B, 3C and 3D be postponed in the same manner and 115 with the same direction as Item 3A. Motion seconded by Council Member Roeser. Motion • 116 carried on a voice vote(Mayor Bergeson recorded as voting nay). 117 118 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA 119 120 There was no report from the Public Safety Department. 121 122 PUBLIC SERVICES DEPARTMENT REPORT,RICK DEGARDNER 123 124 5A. Consideration of Resolution No. 09-117,Dissolution of Site Agreement between the 125 City of Lino Lakes and Centennial School District No. 12 126 127 Public Safety Director DeGardner reported that, based on council budget direction, he is 128 presenting a resolution that directs the termination of the existing site agreement between the 129 city and Centennial School District No. 12. This agreement is being terminated as a cost saving 130 measure on the part of the city. He noted that the agreement includes a termination clause and 131 the city has properly informed the district within the terms of that clause. 132 133 Council Member O'Donnell moved to approve Resolution No. 09-117 as presented. Council 134 Member Roeser seconded the motion.
