COUNCIL MEETING OCTOBER 23, 1989
parcel would be reduced to 1.06 acres. The Planning and
Zoning Board reviewed the request and recommended that a
variance be required for the creation of an undersized lot.
They approved both the minor subdivision and variance
requests with a stipulation that a revised certificate of
survey be prepared showing two utility easements. This would
prevent a new house from being located on an easement and
when sewer does become available, the east lot: can he divided
into three regular city sized lots.
Mr. Reinert moved to approve Planning and Zoning application
No. 89-48 contingent upon the applicants preparing a revised
certificate of survey showing two twenty (20) foot easements
for utilities and drainage dividing the east parcel into
three 76.6 foot lots and the newly created 25 foot parcel to
be combined with the western parcel. Mr. Bisel seconded the
motion. Motion carried unanimously.
Mr. Bisel moved to approve Planning and Zoning application
No. 89-49 for a variance for an undersized parcel of property
located at 7790 Lake Drive. Mr. Reinert seconded the motion.
Motion carried unanimously.
LIAISON REPORTS
Park Board, Andy Neal - Mr. Neal told the Council that on
Thursday he and Mr. Ray Johnson met with the Anoka County
Supervisors and they are proposing to build an ice rink in
East Bethel and they also said they have enough money to
build a covered ice rink in Lino Lakes. Mr. Neal relayed
this information to the City Administrator. He talked to
County Commissioner Margaret Langfeld and she says that she
does not know anything about this. The people at this
meeting agreed that the best location for this covered ice
rink would be the Regional Park. This facility would include
parking and could also be used to soccer in the summertime.
Mr. Neal explained that Mr. Nissen was appointed the chairman
of the Chain of Lakes Regional Board. Mr. Neal also noted
that in 1989 36,000 additional rounds of golf were played
over 1988. This might support the need for a road tax on
each round of golf played at the Chomonix Course. There was
additional discussion at the Chain of Lake Regional Board
meeting regarding the possibility of the Chomonix Golf Club
becoming a cross country ski shop.
The entrance to the Regional Park was also discussed. The
bridge on Aqua Lane will cost approximately $120,000. This
entire project is on hold until an archeology study is
completed.
At the meeting Chain of Lake Regional Board meeting, the City
of Circle Pines made a remark regarding contracting with the
City of Lino Lakes for park services. They have lost their

Mayor Benson referred St. Paul newspaper article that;
appeared in the paper about two weeks ago. This article
dealt with a contract between Ramsey County, Falcon Height,
Lauderdale and Roseville. He asked the Administrator to get
a copy of this article so that it could be given to the City
of Centerville because Ramsey County was requesting a sizable
amount of money from each city for their services. This
could be used as a comparison. Mayor Benson suggested that
Lino Lakes prepare a set plan wits. costs. He asked that the
Administrator and the Chief prepare a presentation to be
brought hack to the Council for their input. Mr. Reinert
suggested that a combination of Option #1 and Option #2 would
be more appropriate. Mr. Bisel told the Council that White
Bear Township just went through this process and he asked
that this data also he available.
Mr. Reinert moved to approve a combination of Option #1 and
Option #2 and have the Chief and City Administrator prepare a
proposal and set a work session with the entire Council on
the matter. Mr. Bisel seconded the motion. Motion carried
unanimously. This work session will be help prior to the
next Council meeting.
PLANNER'S REPORT - JOHN MILLER
Minor Subdivision for Tom Vail for Property Located in
Ulmer's Rice Lake Addition - Mr. Miller explained that is a
request to split a one acre lot by dividing the lot in half
and then splitting the back half into to lots thereby
creating three lots. The Planning and Zoning Board has
reviewed this request and has recommended approval since it
meets all the requirements of the minor subdivision policy.
Mr. Bisel asked if the lot could be split into four lots.
Mr. Miller said not until sewer and water is available to the
front of the lot. At this time the front portion with Mr.
Vail's home will be served by a septic system and well. Mr.
Stahlberg noted that this requests meets the two out of three
criteria in the present minor subdivision policy.
Mr. Bisel moved to approve the request in Planning and Zoning
Board application No. 89-47. Mr. Reinert seconded the
motion. Motion carried unanimously.
Minor Subdivision for Brad and Helen Elledge for Property
located at Lake Drive and Oak Lane - -M-r. Millerexplained
thaf the Elledges own two parcels at the above location.
They have sold the west parcel fronting on Lake Drive and
after a certificate of survey was completed it was found that
the septic system encroaches on the eastern parcel. This
request is to transfer title to 25 feet of the eastern parcel
to the western parcel. This would increase the total area of
the western parcel to 89/100's of an acre. The eastern

Elledge, Application #89-48. Variance #89-49.
Background: The applicants own a trapezoidal parcel of land
located in the southeast quadrant of the intersection of Lake
Drive and Oak Lane. There are however two legal descriptions
for the parcel.
As the attached certificate of survey shows dwelling, garage,
kennel and other accessory buildings are located on the west
side of the parcel. The entire parcel, which covers an area
of approximately two acres, has been offered for sale and a
buyer has been found for the western part of the property.
However, as the correspondence from Jeff Joyer shows the
applicants are requesting to transfer a 25 foot wide strip of
land from the eastern legally described parcel to the western
parcel.
According to Joyer, "The purpose of this request is to
eliminate a septic encroachment along the east line and
provide a more suitable back yard for the existing home on
Tract 1." It would also move the kennel and one accessory
building onto the western parcel.
In terms of area the eastern or vacant legally described
parcel would be reduced in area from 1.18 acres to 1.06 acre.
By my calculations (I'm not sure the certificate of survey is
accurately prepared), the western legally described parcel
would have its area increased from .79 acre to .89 acre.
A variance is necessary for the creation of an undersized
parcel. The Planning and Zoning Board reviewed the requests
on October llth. The members recommended approval with
contingencies as shown below.
Options: 1. Approve a Minor Subdivision for Helen and Brad
Elledge for property located at 7790 Lake Drive, Application
#89-48 contingent upon the 1) applicants preparing a revised
certificate of survey showing two 20 foot easements for
utilities and drainage dividing the 64Qi parcel into three
76.6 foot lots and 2) the newly created 25 foot parcel be
combined with the western parcel.
2. Approve a variance for an undersized parcel for property
located at 7790 Lake Drive, Application #89-49.
3. Table the requests for further study
4. Deny the requests.
Recommendation: As 1 noted in the staff report to the
Planning and Zoning Board these actions will "legalize
reality". Options 1 and 2 should be implemented.

Comprehensive Plan: The 1987 comprehensive plan shows the
land planned for expansion residential uses. This includes
large --lot unsewered residential uses. It is the intent of
the plan however that parcels in this area be utilized in a
manner that will not preclude more intense residential
development in the future.
Zoning/Subdivision/Park Dedication Ordinances: The land is
currently located in the city S -R suburban residential zoning
district. The minimum lot size in that district for newly
created parcels is 2 1/2 acres. Neither of the two parcels
meets that requirement either before or after the proposed
minor subdivision. A variance is required for creation of
undersized parcels.
No park dedication is required as no new buildable parcels
are being created. In theory anyway the owners could have
sold off the eastern part of their property for a dwelling as
it meets the requirements of having a separate legal
description, i.e. it's a lot of record.
Professional Opinion: It might be argued that by reducing
the vacant parcel from 255 feet to 230 feet, the city would
create a situation where the vacant land could be subdivided
into only two 80 foot wide parcels instead of three. This
would not be good use of the land for either the city or the
landowner. The other side of the coin is that some might
must be given to the present situation and that changing the
dimensions of the parcels works to "legalize reality." In
addition it could be argued that "the two -of -three rule"
could be applied to create three future lots measuring 76.6 x
202 feet.
My recommendation is to recognize the real world and
accommodate it.
Recommended Action: Motion to recommend to the city council
approval of a minor subdivision for Brad and Helen Elledge
for property located at 7790 Lake Drive, Application #89-48.
Motion to recommend to the city council approval of a
variance, Application #89-49 for Brad and Helen Elledge to
create an undersized lot in a suburban residential zoning
district; incorporating a existing drainfield, existing
kennel, and existing accessory building with the property on
which the dwelling (principal structure) is located.
