RESOLUTION NO. 17-96
RESOLUTION APPROVING AN EXTENSION OF TIME FOR THE SUBMITTAL OF
THE PUD FINAL PLAN/FINAL PLAT FOR WATERMARK
WHEREAS, review and approvals of plats are governed by Minnesota Statutes and City of Lino
Lakes ordinances; and
WHEREAS, on June 13, 2016 the City passed Council Resolution No. 16-51 approving a PUD
Development Stage Plan/Preliminary Plat for a residential development called Watermark; and
WHEREAS, Section 1007.024(6)(h)7 states unless a Final Plan covering the area designated in
the Development Stage Plan as the first stage of the PUD has been filed within one (1) year from
the date the City Council grants Development Stage Plan approval, or in any case where the
applicant fails to file Final Plans and to proceed with development in accordance with the
provisions of this Ordinance and/or an approved Development Stage Plan, the approval shall
expire. The City Council may at its discretion extend for six month intervals the filing deadline
for any Final Plan when, for good cause shown, such extension is necessary; and
WHEREAS, an extension of time for the submittal of the PUD Final Plan/ Final Plat by
December 13, 2017 was approved by the City Council on with Resolution No. 17-32; and
WHEREAS, Mattamy Homes has requested another 6 month extension while they finalize land
sale negotiations with Lennar.
NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes,
1. The PUD Final Plan/Final Plat for Watermark shall be submitted by June 30, 2018
unless an additional extension is granted by the City Council.
Adopted by the Council of the City of Lino Lakes this 9th day of October, 2017.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Rafferty and was duly seconded by Council Member Manthey and upon
vote beingtaken thereon, the following voted in favor thereof:
Raferty, Manthey, Kusterman, Reinert
