60 3A) Consider Resolution No. 18-09, Approving an On -Sale Liquor with Sunday Sales
61 License for Katana Sushi - City Clerk Bartell reported that the city has received an application for
62 an On -Sale with Sunday Sales liquor license for a new restaurant called Katana. Sushi that plans to
63 open about March 1 at 730 Apollo Drive. Their application process is complete, the related fees have
64 been paid and insurance information has been provided to the City as required. In accordance with
65 the Lino Lakes Code of Ordinances, this application requires approval by the City Council.

67 Council Member Mamney moved to approve Resolution No. 18-09 as presented. Council Member
68 Maher seconded the motion. Motion carried on a voice vote.

80 6A) Public Hearing: West Shadow Lake Area Municipal Utility Extension — City Engineer
81 Diane Hankee reviewed a PowerPoint presentation that included information on the following:

83 - Map showing project area;
84 - Neighborhood meeting was held at which details were discussed;
85 - Staff is ready to submit permits to watershed and Army Corps of Engineers;
86 - Council will receive an update on designs at next work session;
87 - With roadway project under consideration, it is appropriate to consider the addition of
88 municipal utilities; the area includes some aged systems;
89 - Review of proposed improvements;
90 - Water and sewer lines proposed drawn on a map;

93 - Other costs (city trunk connection fee, Met Council Environmental Services fee and cost to

98 Council Member Rafferty noted that some additional costs were pointed out in the presentation. Ms.
99 Hankee explained the portion that the city pays, the amounts assessed and the ability for people to
100 choose to hook up right away or later. The additional costs would be assessed, with a payment
101 period available. Council Member Rafferty recommends that staff give residents as much
102 information as possible about their exposure to costs. Mayor Reinert suggested that proposed costs
103 could be compared to past proposed costs for this project and he believes they would overall be lower
104 cost to the residents.

106 Mayor Reinert opened the public hearing.

108 Greg Olson, 6916 West Shadow Lake Drive, longtime resident. He originally purchased a lot and
109 had to attend a Planning and Zoning Board meeting at which problems with building were brought
110 up. That was 1982 and at that time they were assured that sewer and water was going to be put in.
111 Additionally the road is in terrible condition. The numbers are high but he recognizes that the work
112 must be done. He thanks the council for moving this forward.

114 Lynn Francis, 6961 West Shadow Lake Drive, asked about the additional cost to bring the services to
115 the home. Ms. Hankee said there will be different situations based on settings; she predicts that the
116 cost will be between $5,000 and $10,000. Mayor Reinert remarked that each time this is discussed,
117 there can be some sticker shock but later on those numbers continue to go up.

119 The council asked if the value of the home will reflect the cost of these improvements and several
120 residents said they believe so.

122 Council Member Manthey remarked that he has public water and sewer and has been told by realtors
123 that the value is there.

125 Marg Penn, 7002 West Shadow Lake Drive, asked if there is any chance that the city could have
126 residents get work done in aggregate to get better prices and Ms. Hankee said that is possible.

128 Mike Trehus, 675 Shadow Court. Mr. Trehus remarked that deciding the project is up to the city
129 council and the residents of the area. That means that the minority must live with the majority's
130 decision. He reviewed costs that he's heard. He noted his research on grinder pumps and sewer
131 costs. He noted that he has brought information to share on good septic systems which can be very
132 low cost to operate and very reliable. He also provided information on water services. He noted
133 that the neighborhood has a big decision to make. He stated that they do not need municipal water
134 but he is acceptable to the sewer services. Based on his question, there was also discussion about

135 areas where the water will be extended. Mayor Reinert said he isn't convinced at this point that the
136 extension is needed and continues to receive data.

138 John Bergeson, 6996 West Shadow Lake Drive, spoke in support of extending sewer and water. He
139 is thankful for the road improvements and it makes no sense to put the road in without the sewer and
140 water. One point that has been missed is that if you have a functioning well and sewer, you don't
141 have to hook up to municipal utilities; you can keep the well and septic if they are maintained. He
142 feels that hooking up does make a positive difference when it comes time to sell a home.

144 Charles Puskas, 6994 West Shadow Lake Drive. He thanked Ms. Hankee for working with the
145 neighborhood; she has fielded a lot of questions and discussed a lot of concerns. He supports the
146 direction this is going and he encourages the council to proceed with the project.

148 Donnell Hansen, 6710 West Shadow Lake Drive. She has a newer septic system but she respects
149 other's needs and desires. She wants to know if people with septic systems will be asked to change.
150 Ms. Hankee said that septic systems must be compliant to remain. A building official determination
151 may be involved. Mayor Reinert said it's an important question. He feels that having a
152 noncompliant system would probably mean the system would have to be replaced anyway. People
153 should be able to know as much about that as possible ahead of the project. Council Member Maher
154 discussed with staff the threshold of "failure" that would be used.

156 Council Member Rafferty said he assumes that new development would be required to connect to
157 utilities; staff concurred. He also noted the survey numbers presented; it seems that only 33 people
158 responded out of 73

160 Pete Anderson, 6769 West Shadow Lake Drive, reported that he moved to the street in May. While
161 he did answer no to getting both utilities, he has heard the argument in favor of sewer. He has a
162 young family including four children and the cost is a big concern for him. He thinks he will have
163 costs even if he doesn't connect and down the line he knows there will be a connection requirement.
164 He also asked if this improvement will impact his property taxation as well. City Administrator
165 Karlson said he will check with the city assessor. The council said all information should be shared
166 with all interested parties.

174 improvement and repair is already included in the project;
175 - There is a proposed water system extension included (shown on a map);

177 - Proposed assessments were reviewed; other costs (trunk utility connection and cost of
178 connection from property line to house);

182 Council Member Stoesz asked about a delayed connection (such as someone connecting in Year 12)
183 and impact on how long someone would pay. Ms. Hankee said the cost would be whatever the city
184 charges for connection are at that time.

186 Mayor Reinert opened the public hearing.

188 Ms. Hankee presented a comment that was submitted in writing. Richard and Emily Biske, 1559
189 LaMotte Circle (letter on the file). Mayor Reinert recalled that in the past the issue of connection
190 would be forced by the city with certain road improvements. That situation has been reconsidered
191 and the forced element is no longer present. When a road is improved is decidedly a good time to
192 install utilities but he doesn't believe in pushing things on people. He doesn't see the interest here.

194 Joe Cameron, 1572 LaMotte Circle. He feels the neighborhood doesn't want water. Will a petition
195 be required? Ms. Hankee said she's received a few calls from the LaMotte area for the petition form.
196 Within 60 days the neighborhood can submit a petition.

198 Bernard Ward, 1549 LaMotte Drive. He is vehemently opposed to the water improvement. He
199 agrees with the roadway. To put water in where people don't want it is foolish. He will sign the
200 petition and he feels the overwhelming majority of residents do not want the water. They have great
201 water.

206 Easement Vacation — City Engineer Hankee reviewed the written staff report. This a requested
207 second reading of the ordinance. Council Member Stoesz asked there has been any phone calls or
208 other communication in opposition to this vacation; Ms. Hankee said no.
