ACTION ITEMS A. Natures Refuge/Preliminary Plat and Site Plan Review The approximately 95-acre proposed site is located north of Main Street and .3 mile west of Lake Drive. The site is bordered by single-family homes, Lino Lakes Elementary School, Main Street and undeveloped wetlands and woodlands. This site is one of the moset diverse natural communities in Lino Lakes. Within this site there are many wetland areas and rare plant species. Below are some of the recommendations that were mentioned in addition to the ones listed in the report. Mr. Asleson is recommendating that design consideration must protect the rare features of ths site to the greatest and least invasive design possible; including turtle barrier elimination (dropped curbing and preservation of continuity in turtle travel breeeding areas). Design should emphasize avoidance of rare plant species locations. Mr. Asleson has concerns about the borrow pits and will be working with the engineers to make sure it does not effect the wetlands. Mr. Asleson is recommending to relocate the trail and provide an adequate buffer that would protect the large wetland rare plants area. With the SWPPP that was submitted, Mr. Asleson added comments that he would also recommend. As far as trees are concerned , there are 141 total tree replacements required. These trees must not be planted in wetland restoration or preservation areas. Mr. Schwartz would like to make a recommendation to see public education or signage at trailhead or along the trail of the rare plant species in the area. Ms. Kaufenberg would also like to see that the city approved new resident education brochure, informs the homeowners of the uniqueness of the area. Ms. Holmes would like the word “should” to be changed to “must” if possible especially in recommendation #9 Mr. Sullivan would like to see the DNR reports when it comes in Ms. Holmes stated that the recommendations listed are good but would also like to add a statement that this is a unique site with rare plants species and the development must not destroy this area. Enivornmental Board January 31, 2018 Page 3 DRAFT MINUTES Mr. Schwartz made a MOTION to forward Natures Refuge/Preliminary Plat and Site Plan Review with the Environmental Board’s statement and recommendations. Ms. Andrzejewski supported the motion. Motion carried 6 - 0. B. Environmental Board Goals There was brief discussion about number two which stated, assisting Anoka County to ensure business recycling within the City as mandated. Questions were raised as to what if any business were participating in the program. Ms. Andrzejewski made a MOTION to approve the 2018 Environmental Board Goals. Ms. Kaufenberg supported motion. Motion carried 6 - 0. VII DISCUSSION ITEMS A. Recycling Updates Ms. Schultz reporting on the following; Recycling Saturday had about 35 participants mostly large items and appliances. Walter’s Blue Bag program, December’s results had 27 participates with .31 tons of organics. 2017 tonnage for the city was 1959.99 tons of co-mingle. And organics second half was 7.33 and had 135.66 yard waste. Ms. Schultz will find out what is the recycling goal for 2018. B. Blue Heron Rookery Mr. Aselson wanted to thank the volunteers that came out to apply sheating to the trees on the island. VIII. Respectfully submitted, Mary Fogarty Office Tech 1 1 ENVIRONMENTAL BOARD AGENDA ITEM 5A STAFF ORIGINATOR: Marty Asleson, Environmental Coordinator MEETING DATE: February 28, 2018 REQUEST: Preliminary Plat and Site Plan Review, Main Street Shops 2nd Addition APPLICANT: CM Properties 14, LLC C/O Bruce Miller 3460 Washington Drive, Suite 100 Egan, MN 55122 OWNER: Same PROPOSED DEVELOPMENT The site is a 17.32 acre parcel /1.5 acres of disturbed area; on the NE area of Main Street and Otter Lake Road, Immediately east of McDonalds in Lino Lakes. The proposed development will construct an extension to the private access drive from Otter Lake Road, commercial building, and adjacent parking lot. The 17.32 acre parcel will be subdivided and the final lot size is proposed to be 1.35 acres. The lot is undeveloped. The project is phase 2 of the commercial development known as Main Street Shops. SITE CHARACTERISTICS General site characteristics The site is currently used for agricultural purposes, and typically planted with row crops. The site, has a somewhat rolling topography. Elevations range from 923 at the south and eastern portions and down to about 910 at the wetland parts of the site. The majority of the stormwater from the site drains overland to the large wetland to the north. A small portion of the site drains to the SE to a lowland just off site. Soils Solis on the site are primarily sandy clay soils. Soil borings indicate mottling which is an indicator of a seasonal high water table within 2 feet of the ground surface. The 2 infiltration rate of these soils was determined using a double ring infiltrometer and was determined to be between 0.1 and 0.2 inches per hour. Land Cover The site has been used for agricultural cropping. Presettlement vegetation places this parcel in the Big Woods group. Maple, Basswood, Hickory woodlands grew on this site before settlement. Significant Resources There was one National Heritage feature found on the site. The Upland Sandpiper was recorded on the site in 209. The bird is a special concern resource that inhabits short native grasslands. It would not be found on agricultural landscapes. The proposed project would not impact habitat for Upland Sandpiper. Blanding’s Turtle was recorded within ¼ mile of this parcel. It’s very possible the turtle would navigate across this property to nesting areas to the north. Street and curb design should allow for little resistance to Blanding’s Turtle if possible. Surface Water Drainage from the site drains to an existing pond which was constructed under phase 1. This pond then discharges to a large wetland to the north. The wetland outlets to ACD-55, Branch 8, which is tributary to JD3/Clearwater Creek and ultimately Peltier Lake. Peltier Lake, according to RCWD is the resource of concern (RoC). ACD 55, branch 8 public drainage system is not located within the parcel boundary. The RCWD has informed the applicant that the drainage system (ACD55, Br8) downstream of the project is constrained. RCWD Rule C.5 (d) states that adverse impact requirements for the project must be met by one of the two methods: • Show no increase in runoff volume for the 2-year, 24 hour event (7,029 cubic feet). By showing no increase in the 2-year volume, the project will not diminish the capacity of the drainage system for agricultural purposes. • Reduce the peak rate of runoff for the 2-year, 24 hour rain event to 0.03 cfs for the site (Rule C.5 (d)). This rate has been determined through an analysis by the District Engineer in the Hydraulics and Hydrology Evaluation Anoka County Ditch 55 memorandum dated May 6, 2013 which determines peak flow constraints necessary for development on all sites draining to the constrained downstream system. The volume requirement will be met through a water reuse system adjacent to the NURP (north side of lot), providing for 7,029 cubic feet of new rain event surface water; and the adjacent NURP providing a grassy swale for rate control. 3 The applicant must provide to the RCWD a detailed operations plan which meets the criteria for the proposed pump design, pumping rates, and the location of the irrigation area. According to the RCWD report, the project treats 100% of the new impervious area. The volume provided is greater than the RCWD rule for water quality requirement of 4560 cubic feet (1.1 inches over the 1.42 acres of impervious surface). With receiving an acceptable detailed plan, the proposed water reuse system meets the RCWD requirement for water quality treatment, design criteria, and adverse impact requirements. A maintenance declaration for the property was previously recorded with Main Street Shops. The agreement is co named with RCWD and the City of Lino Lakes as overseers of the convents that will run with the property to ensure an annual inspection by the owner of the property, and a report on the annual surveyed capacity of the pond, and to preserve the conveyances and other structures, to preserve hydraulic capacity, and to preserve healthy vegetation and design permeability. As part of this a specific maintenance procedure should be submitted for the water reuse system. Accordingly, the declarant must submit to the RCWD and the City annually, not later than January 31st of each year, a report listing inspection dates, facilities inspected, facility conditions and actions taken, and dates of action taken. Flood Plain RCWD modeling determined that the project is not within the flood management zone. The site is within a regulatory floodplain; but again the project does not impact the floodplain. Wetlands There are wetlands within the project parcel; however, the site does not impact them. Stormwater Pollution Prevention Plan A National Pollutant Discharge Elimination System (NPDES) permit is required for the project. All requirements of the NPDES permit must be documented and approved by the City. The submitted SWPPP looks good, including identified impaired waters within 1 mile of the site (Clearwater Creek), and sited additional BMP’s required for this area. No site soil disturbance of the site will be allowed until the applicant has submitted the entire NPDES requirements and including the name, phone number, and state certification of the responsible inspector for erosion control. The NPDES plan must be on site where it can be accessed at any time. The applicant must agree to submit all 4 required weekly and post rainfall event inspections, and corrections made to the City of Lino Lakes Environmental and Engineering Departments by email, txt message, or hand delivery by the next day after inspections and corrections have been made. AUAR Considerations The subject site is within the I-35E Corridor AUAR and is subject to the AUAR mitigation plan. Overall, the proposed subdivision complies with the AUAR mitigation plan in regards to natural resources, erosion control, surface water runoff, wastewater, cultural resources and farmlands. A major component of the AUAR is traffic and supporting transportation corridors. The extension of Otter Lake Road is identified as an important roadway improvement. Drinking Water Protection This site is in a Drinking Water Protection Area. The site is rated for a Moderate amount of vulnerability and a low sensitivity rating for area soils. The higher the permeability of the soils in a DWSMA, the higher the vulnerability. Tree Preservation There are no trees on the site. Lighting The plan supplied does not show measurements beyond the property line. The readings must be zero beyond the property line. No lighting fixtures were provided with the plan. All fixtures must be the cut-off lens type, i.e. downward focused, low intensity, and no light glare coming from the fixture. Landscape Plan As per city ordinance and road right of way safety/visibility reasons, all street ROW trees must be 30 feet from the corner of any entrance to the property from the street. Red Maple, Sugar Maple and Honey locust should be changed to a species that will tolerate clay type soils. Possible substitutes are Hackberry, Disease resistant Elm, Norway Maple, River birch, Kentucky coffee tree, American Linden, Tamarack, and Ginkgo. All Commercial turf, and shrub planting areas must be irrigated. A smart irrigation system with soil moisture sensors should be used. Sod areas planted with a fescue type of low maintenance fescue sod may not need any irrigation after established. It is recommended to try this in the sod areas if there is no foot traffic anticipated for these areas 5 Recycling A description of how the business will be participating in the required state law for business recycling must be provided. Lino Lakes Recycling and Anoka County would welcome a discussion with the business on accomplishing this. RECOMMENDATION Approve with Environmental Board comments. Forward on to Planning and Zoning Board and City Council with staff and Environmental Board recommendations and comments. ATTACHMENTS 1. The building will have a 35- space parking lot constructed NE of the building. The project is CUP because it is a childcare facility. Conditional Use Permits have requirements for parking and screening between given projects and residential areas. This project has no adjacent residential areas. The lot area of the site is 79,981 square feet or 1.8 acres. The disturbed area is 73, 723 square feet on 1.69 acres. The proposed impervious area is 38, 810 square feet or 0.89 acres. With that, the project requires an NPDES permit. This project is on the previously reviewed Miller’s Crossroad residential development in 2003. In 2003, the Environmental Board recommended that the project be denied because of the lack of input from the RCWD. Much has changed since 2003 in RCWD and City Rules. The site needs to be re- evaluated from a WCA and stormwater rule standpoint. The western portion of the site is within 1000 feet of the OHW of Baldwin Lake. This makes it fall in the Shoreland Overlay District. For Commercial development in the 2 Shoreland Overlay District, the impervious maximum allowed is 60%. This project meets that requirement. SITE CHARACTERISTICS General site characteristics The site is an open field. The site consists of type “A” soils and drains south and east to regional stormwater ponds, west to Hodgson Road ditch and north to the Birch Street ditch. The road ditch drains to an existing storm sewer system located near the site. Soils The soils on the site consist of about a half a foot of imported silty sand for topsoil, and other fill to a depth of about 9 feet. The fill consists of finely grained poorly graded sand. Land Cover The soil disturbance area of this site is a baron, mowed, non-native cover that has existed since 2003. Significant Resources There are two MN DNR listed wetlands on the site. The two wetlands are dug ponds considered isolated freshwater ponds and Terrene. Terrene means they are surrounded by upland. The wetland ponds are not part of a Wetland Management Corridor. There are no National Heritage recorded species on the site. As with all developments in an area with plenty of amphibians. Although there are already plenty of barriers to turtle travel on this corner site, adding additional barriers can be minimized by adding dropped curbing on the site. Surface Water Stormwater management facilities for the site include two infiltration basins. The infiltration basins drain to existing stormwater ponds. It appears the developer is proposing to raise the elevation of the site by 3 feet in order to meet infiltration separation rules for infiltration ponds. The RCWD rules do not require infiltration if infiltration cannot be accomplished. At this time there is no evaluation data from the RCWD if the site complies with rate and volume requirements, or what to do with the separation issues. The rules impose volume discharge restrictions based on the amount of impervious surface. If infiltration cannot be met the volume requirement must be met in some other way. 3 A 2003 report discusses an infiltration test that was done on the site with a 0.2 to 0.3 inches per hr. infiltration rate. The report refers to the location of the infiltration test site in an appendix page; however there is no location point on the boring/infiltration page. If the infiltration test was performed under the proposed infiltration areas, then we have good infiltration. If it were done somewhere else, a new test should be done in the infiltration basins to ensure they will infiltrate. Given the amount of fill in the area, additional soil borings under the infiltration ponds must be done. This is because an infiltration basin is more than a hope-full hole dug in the ground with infiltration basin language tied to it. If there are low permeability soils or a sub geologic formation that is impervious under it the basin will not infiltrate and we have NURP instead. The site soil borings do show fill to 9 feet down. Possible differences in fill used from spot to spot may have changed, and or there are possible natural impervious layers that exist in the natural formation. If RCWD would require NURP instead of Infiltration ponds, than proposed vegetation must be changed to a standing water planting plan. The infiltration basin must not be a part of the play area. Fence and plantings must be kept off of the wetland easement SE of the building. Plan sheets need to better define water flow direction. Flood Plain There are no floodplain impacts on this site. Wetlands There are two wetlands on the site. The larger wetland on the NE corner of the site is a .22 acre Terrene Pond, isolated. A terrene pond is a wetland/pond completely surrounded by upland and is classified as a shallow open water community. The smaller wetland on the south and east side of property is a .13 acre Terrene pond with a deep marsh classification. Since this is not part of a wetland management corridor, a 10 foot buffer only is needed around the site wetlands. The developer is proposing to manage water quality by channeling water to the infiltration ponds. Stormwater is then guided to the two existing wetland/ponds after treatment. Rice Creek Watershed must review the surface water /stormwater issues for compliance to impervious surface rules and discharge rate control. Stormwater Pollution Prevention Plan 4 All aspects of an NPDES permit must be addressed in the project SWPPP. Although the developer has identified some of the key elements of the SWPPP, there are many issues that were not addressed on the sheet plan. The submitted SWPPP is more complete but it should be stated that no grading permit will be given until all aspects are addressed. Part of this project is within a Shoreland Overlay district for Baldwin Lake. This must be identified on a map with any other waters of the state within 1 mile of the project and water conveyance off the site identified with special BMP’s for any impaired waters identified. Additionally, the name of the SWPPP inspector, with the required inspection credentials and contact information must be received by the city prior to grading. As a condition of any City grading permit, all required SWPPP weekly and post rainfall inspection and follow-up corrections made must be received by the city no later than the day after inspections/corrections are made. The SWPPP must also be onsite at the start of the grading, in a place that anybody can have access to it at any Drinking Water Protection This is in a drinking water service management area. The parcel has a moderate vulnerability, and a low sensitivity rating. What this means is that infiltration ponds must have enough separation (2-3 feet), between the bottom of the pond and the OHGW so that surface water running off of impervious areas is filtered. Special precautions should be made during construction, and as part of the SWPPP to take extra caution with equipment on the site. This would include all fueling and greasing and oil changes or hydraulic changes/leaks. A containment under any fueling stations is required. A concrete washout area must be defined and designed so that concrete waste does not touch or is spilled/dumped on existing soils. There are no private wells on the site. Tree Preservation There are no trees on this site. Lighting The Photometric plan for lighting the site meet the requirements of the City. All fixtures should be downward focused, low intensity, cut-off type lens. Landscape Plan Landscaping on the road ROW corners must be pulled back 30 feet in both directions for road site-line reasons. Tree and Plants species matrix is appropriate. 5 Infiltration ground story plants are a 35-641 mix. This is a native Mesic Prairie mix. The Native planting must be accompanied with a 5 year maintenance plan. The plan must be done by a company that is reputable in the installation and maintenance of Native Prairie plants. The plan and company must be approved by the City. All sod areas must be irrigated. It is highly recommended that a Smart Irrigation system be installed with ground moisture sensors. Sod areas planted with a fescue type of low maintenance fescue sod may not need any irrigation after established. It is recommended to try this in the sod areas if there is no foot traffic anticipated for these areas. Recycling A description of how the business will be participating in the required state law for business recycling must be provided. Lino Lakes Recycling and Anoka County would welcome a discussion with the business on accomplishing this. RECOMMENDATION Approve plan based on staff and Environmental Board and RCWD approvals. The lot is zoned for General Business, and wishes to rezone to Light Industrial. Distinctive Elements Tile & Design, LLC is a tile installation business, and has been in business for 6 years. We have grown the business to the point that we need a shop/supply warehouse for installation supplies, and an office area for potential client meetings and business office purposes. The warehouse we wish to build on Apollo Drive will be primarily used for those purposes. There are currently no employees, but we will only ever have 1-2 employees, as this is a family business. Customers/Clients will only visit site 1-2 times per month, as this is meant to mainly be a supply location SITE CHARACTERISTICS Site Evaluation The Apollo Drive Business District was reviewed by the Environmental Board around 1999. At that time it was determined that the excavated storm/infiltration ponds were 2 adequate to service the entire Apollo Drive business area. Since then, surface water management requirements have increased to the standards of what they are today. The site area is 0.83 acres, with a proposed impervious area of 11, 880 square feet. Soils Soils are sandy with high infiltration rates. The water table is deep enough so there are no separation issues. Land Cover The lot has some undetermined species of trees on the west side of the property. The ground surface is non-native mowed grasses. Significant Resources There are no significant resources of this site. Surface Water The developer is proposing to build an infiltration basin. The basin will be reviewed by RCWD and our city engineers to ensure the water quality and water quantity standards are being met. Flood Plain There is no Floodplain on the site Wetlands There are no wetlands on the site. Drinking Water Protection This is not in a Drinking Water Service Management Area. Tree Preservation There are Hardwood trees on the west side of the property that continue on to the property at 501 Apollo Drive. There are Evergreen screen trees on the adjacent property to the east. The developer is showing the tree lines of both areas inside of perimeter control fencing. SWPPP 3 An NPDES permit is not needed for this site. An erosion control plan is needed. A rock entrance is needed. Silt fence is shown on the plan for perimeter control. The developer must protect all storm drain inlets within 200 feet of the property on Apollo Drive. Lighting The developer must submit a photometric plan. The developer must submit lighting fixtures. The fixtures must be a low intensity, downward focused, cut-off type lens. Landscape Plan Tree and shrub plantings are appropriate. Seed mix must be given to city. It is preferred to have a native seed mix in the infiltration pond. Since this is in the front of the building, a native, alternative lawn such as a variety of Fescue. All sodded areas must be irrigated. Sod areas planted with a fescue type of low maintenance fescue sod may not need any irrigation after established. It is recommended to try this in the sod areas if there is no foot traffic anticipated for these areas. Recycling A description of how the business will be participating in the required state law for business recycling must be provided. Lino Lakes Recycling and Anoka County would welcome a discussion with the business on accomplishing this. RECOMMENDATION Approve with staff and Environmental Board recommendations and comments. Hampton Properties is proposing to develop approximately 17 acres of land into a mixed- use development consisting of 50 townhomes, 80 apartment units, and 32 memory care and high acuity assisted living units. The units will be part of a homeowners association. SITE CHARACTERISTICS Site Evaluation This is a Concept Plan look at the Environmental Issues. The site appears to have one wetland in the NE corner of the proposal. The Concept Plan has two ponds drawn on the site concept plan. One pond is adjacent to a wetland on the NW side of the project and the other is one the sw side of the project proposal. It is unknown at this time if a wetland delineation was done. 2 Soils The soils map provided by the developer shows sandy soils on the site. It is unknown if there were soil borings done. Soil borings will have to be done for infrastructure and building design. If the proposed pond on the site is proposed to be an infiltration pond, the city would need borings in the pond bottom to determine that the infiltration pond will infiltrate, and that there is adequate separation between the bottom of the pond and the OHGW elevation. Land Cover It appears from photography that there are mixed hardwoods and softwoods on the site, with grassy, mowed open areas. The softwoods appear to be a mixture of different kinds of spruce, pine and cedars. The softwoods are non-discernable. A detailed tree inventory, and tree preservation plan would need to be done if this project goes forward. Significant Resources There are no signature features on this site that would indicate rare plants or animals. There are no NHIS data for this site. Surface Water There are 4 catchment areas on this parcel. Future surface water allocations should try to stay in the same catchment areas. Flood Plain There is no floodplain on the site. Wetlands There is a wetland on the concept plan. If this wetland has not been delineated, that must be done. Stormwater Pollution Prevention Plan The project will need to have an NPDES permit, and full SWPPP submitted. Tree Preservation A tree preservation plan will need to be submitted. 3 Landscape Plan A detailed landscape plan will need to be submitted. Boulevard trees are required and escrow money obtained for these trees. Since this is an assisted living and memory care facility area, the use of trails and flower garden plantings should be planned for this development. A small handicap accessible community garden area would also be desirable in this area for programming open space landscaping. Alternative lawns are preferred to cultured bluegrass sod. In areas where there will be foot traffic, then sod areas must be irrigated. Smart irrigation systems should be used that have soil moisture sensors.
