Q3 Notable Actions & Events
• The week of July 10th, Police and Fire staff visited eight Lino Lakes Playground programs in our
city parks.
• On July 27th staff attended the Lino Lakes Family Corn Roast and participated in the 2nd Annual
Public Safety Softball Game.
• Police and Fire staff attended 44 Night to Unite (NTU) block parties on Tuesday, August 1st.
Lino Lakes block party attendees once again donated supplies for students in need as part of our
annual NTU events. Attached is a photo of the donated school supplies.
• On Thursday, August 10th Lino Lakes Public Safety and Parks and Recreation staff in
conjunction with staff from Centennial Lakes Police Department, Centennial Fire District,
Lexington Fire Department, and North Memorial Ambulance conducted the annual Safety Camp
at Centennial Middle School. Safety Camp is focused on prevention by educating community
youth on safety. This year 57 community 4th graders attended the event. Special thanks to Fiesta
Cancun for providing lunch and DQ for providing Dilly Bars to attendees.
• Staff conducted the annual Youth Firearms & Hunting Safety course which started on August 10
and culminated with a range & field day on August 26th. Twenty-one community youth
completed the program.
• Police and Fire Division staff participated in the St. Joseph of the Lakes Parish Festival on
Sunday, August 13, 2017
• The Officer Shawn Silvera Rotary Run took place on Saturday, August 19th.
• Police and Fire staff participated in the Blue Heron Days parade.
• A Car Seat Clinic was held at Fire Station #2 on September 28th. Eight families were assisted
with the installation of 11 car seats.
• Staff re-instituted the Lino Lakes Public Safety Citizen’s Academy, there are nine participants
and the Academy began on September 7th and will run through October 26th.

1. City of Columbus Asphalt Plant Update - Community Development Director 16
Grochala reviewed his written report and specifically information on the site of the 17
proposed development. He displayed an aerial view of the vicinity, pointing out 18
activities and uses in the area of the proposed plant. He explained the timeline for 19
receipt of an application by the City of Columbus. The traffic impacts are mainly to 20
Anoka County roadways and so the county has reviewed the proposal and submitted their 21
requirements. The Columbus City Council and Planning Commission have jointly 22
discussed the project. There was a citizen petition submitted requesting an 23
environmental assessment worksheet. The Minnesota Pollution Control Agency has 24
since determined that no worksheet is required. The site is currently zoned light 25
industrial and a rezoning would be required to heavy rezoning; a zoning text amendment 26
is being considered that would not require a rezoning for the development. The 27
Columbus council will be considering that text amendment in the coming weeks, and 28
vote on it at the earliest on November 8. If the text amendment were to go through, a 29
proposal for the project will follow. Mr. Grochala noted receipt of a plant evaluation 30
submitted by Running Aces Casino and Racetrack prepared by a professional real estate 31
consultant and indicating negative issues relating to the proposed development. Mr. 32
Grochala noted that the City of Columbus obviously has authority over land within its 33
boundaries; the City of Lino Lakes’ purview would mainly lie in the need for screening 34
and traffic issues. A formal letter could be submitted identifying the city’s concerns. 35

Council Member Kusterman confirmed that no utility connection through the City would 37
be required; Mr. Grochala added that the development is proposed to include a septic 38
system. The council discussed the resident feedback from the City of Columbus. 39

Mayor Reinert asked if there will be 500 trucks trips created each day and Mr. Grochala 41
reviewed the County traffic analysis that indicates about 300 trips on a high use day. 42
Mayor Reinert noted that it seems that a majority of the traffic would head south (through 43
Lino Lakes) from the plant. 44

Mayor Reinert remarked that the City doesn’t have a say in this and it seems as if the City 46
of Columbus is tailoring their rules for the development; he feels the City of Lino Lakes 47
will be negatively impacted based on the plans. He asked how important this issue is to 48
the City Council and how would they like to act. 49

Council Member Maher remarked that the council has a duty to advocate for citizens and 51
in this case it seems as if speaking up is about all the council can do. She feels that some 52
of the issue is just change and that it is hard but the pain eases over time. 53

Council Member Kusterman suggested that the situation calls for exercising diplomacy; 55
try to show the City of Columbus why this is a bad idea, now and in the future. He 56
suggests that council members attend the upcoming Columbus meeting. Council Member 57
Kusterman also questioned staff about the findings of the Running Aces commissioned 58
study – does it indicate any argument appropriate to this situation? 59

Community Development Director Grochala said he recommends, if the council feels 61
strongly, that the City send another letter to the City of Columbus noting the variety of 62
concerns that the City has. 63

Council Member Manthey remarked that he is heavily against the proposal and is 65
surprised that the City of Columbus is willing to go against their own established plans 66
and welcome this plant. He’d like to combine efforts with the City of Centerville to 67
bring a unified voice to an opinion that will be sent to Columbus. He sees a huge impact 68
to the property up there and he’d like to see the City do whatever it can. 69

Council Member Rafferty said he is stagnant on the idea; this involves a county road that 71
makes things difficult to argue. He wonders if speaking with the Anoka County 72
Commissioner would help. 73

Mayor Reinert asked about the possibility of instituting restrictions in this city on such 75
things as truck traffic, mirroring what the City of Columbus is doing. Director Grochala 76
remarked that it could be difficult because that city’s conditions are related to issuance of 77
a conditional use permit. 78

The council concurred on a staff direction to prepare a letter to the City of Columbus 80
laying out the City’s concerns. That letter will be circulated among the council members 81
prior to being sent. 82

2. Centerville Road/CR J Intersection Change Evaluation (ICE) – City Engineer 84
Hankee introduced Chuck Rickert, WSB & Associates, who reviewed a presentation on 85
the study of Ash Street. Points made: 86
- Intersection of Ash Street and Centerville Road needs attention; 87
- Coordination among impacted cities and the county is necessary and is used to identify 88
issues and concerns; 89
- The report looked at existing conditions and found turn issues; looked at future 90

conditions with the possibility of build and no-build and the concept of best traffic 91
control: 92
- Operations analysis indicates that an all-way stop would not work, a traffic signal is 93
moderately recommended, and a roundabout receives the best mark. 94

The report recommends a roundabout as it represents the safest of the options. The 96
Mayor noted that the report indicates either a roundabout or a signal would work. Mayor 97
Reinert asked what body will decide on the traffic control and Mr. Rickert said all four 98
bodies of government will have a say in the matter. Mayor Reinert asked Public Safety 99
Director Swenson for his opinion and he reported that roundabouts are safer, traffic 100
signals create worse accidents, so he prefers the roundabout. 101

The council concurred to accept the report and indicated a preference for a roundabout. 103

3. Traffic Safety Review Process and Procedures Policy – Chuck Rickert, WSB 105
& Associates, noted that the city’s traffic committee has been established and functioning 106
for some time. The purpose of the group is to come together to review traffic matters. 107
The group has discussed development of a policy that could be used for matters that come 108
up. That proposed policy is before the council and it includes: 109

- the city’s engineer’s responsibility is primary; 111
- the policy covers requests from residents, the city council, the traffic committee 112
itself or staff; 113
- items to be considered: speed limit (under established guidelines), stop signs, 114
warning signs, crosswalks, and traffic calming. 115

Engineer Hankee indicated that staff is requesting that the council formally adopt the 117
policy. She added that the traffic group has already been using the policy unofficially 118
and has found it to be very workable and useful in providing information to the public. 119
Public Safety Director Swenson added that the policy provides clarity to staff as well as 120
the public who can be directed to a written document to promote understanding; it also 121
provides consistency. 122

Mayor Reinert asked how development of the policy was funded and Ms. Hankee 124
explained it was essentially developed under the general engineering services retainer. 125
Mr. Rickert explained that it contains policies developed for and by other cities and so 126
some content was not created but was already in place. 127

Council Member Manthey noted the sidewalk at Lino Lakes Elementary and he wonders 129
how this policy could impact that situation. Community Development Director Grochala 130
added that the County basically directed the changes at that location; the policy would 131
support that change. 132

4. Comprehensive Plan, Transportation – Chuck Rickert, WSB & Associates, 137
noted the report included in the packet. The discussion coming forward is based on 138
discussion about issue areas that are included in the report (i.e. automated vehicles, 139
changes in management techniques, flashing arrows on traffic signals). Birch Street was 140
a big topic of discussion and he noted that Anoka County has a process related to that 141
street and improvements in its five year plan. Mr. Rickert also mentioned pedestrian 142
improvements and the northern bypass. Moving forward staff will continue working on 143
developing a forecast model for 2040 (in conjunction with Anoka County). This is an 144
update and is provided to keep the council informed on the Comprehensive Plan process. 145

5. West Shadow Lake and LaMotte Project Update - City Engineer Hankee 147
explained the experience of the recent open house. Council Member Rafferty was in 148
attendance. 149

Council Member Rafferty indicated that he engaged with a few residents who had 151
questions. He feels that Community Development Director Grochala and WSB staff did 152
an excellent job in fielding questions and providing information. 153

6. Watermark Update- City Planner Larsen reviewed her written report. She 155
presented information on the proposed development, including the types of homes 156
proposed and a comparison to the previous proposal. 157

Mayor Reinert remarked that it was a two year process to get to a Mattamy proposal and 159
now this is a new prospect. 160

Ms. Larsen remarked that change can be anticipated within any ten year development. 162

Ms. Larsen continued with information on: Land area comparison, zoning, subdivision 164
ordinance, comprehensive plan compliance, final plat extension (to be considered at the 165
coming council meeting), and the recommendation of staff and the Planning and Zoning 166
Board. 167

Mayor Reinert discussed with staff the issue of when park and other amenity 169
development was to occur with the past proposal and the current. Ms. Larsen and 170
Community Development Director Grochala concurred that the previous plan may have 171
moved slower than expected on their development of the park, etc.; it’s a situation that is 172
more evident with the current plans and costs coming together. The new developer says 173
they would like to start from the south and work toward the north, including development 174
of the amenities as the project moves forward. 175

Council Member Manthey remarked that the council is in a situation where they must 177
look fresh at this development proposal without consideration of past promises. He 178
asked the developer representatives to explain their assurances. 179

Joe Jablonski, Lennar Homes, explained that they were originally thinking that they could 181
take off on this development much quicker but understood from council discussions that 182
more work was needed, perhaps with bigger phases. They realize at this point in the 183
calendar that there won’t be anything started in 2017. They are looking now at starting 184
in spring of 2018, beginning at the south where utility connection will be available. They 185
prefer to introduce as many products as they can at one time so they would initially offer 186
townhomes and perhaps two types of single family. Overall he feels the land use 187
proposed changes very little from the previous development proposal. He also talked 188
about the evolution that could occur; four years from now the market may not be calling 189
for the single level they’ve included in plans so a change would then be needed; but it 190
would be one that the council will hear about. Mr. Jablonski added that he feels it is 191
unfair to Lennar to be held to promises of the past proposal; they have a product and 192
process and they follow it. 193

Mayor Reinert remarked that this development is the largest number of homes in a 195
development ever considered for the city so it merits careful consideration. He feels the 196
master planned development is a benefit to the city and it doesn’t have to be the previous 197
proposal but it does need to fit this city. There also remains the situation that Lennar 198
will not own all the land at once so things could be chopped up. He believes the council 199
wants to work with the new developer and get it together. 200

Planner Larsen noted that the first phase is not just townhomes and Mr. Jablonski showed 202
on a map what they’d consider a first phase in 2018 and that would include three types of 203
product. The developer is asking for a comfort level on the sizes proposed. She also 204
pointed out the change in regard to not having a sales center developed at an entrance to 205
the development. Staff is requesting the council consider this at a higher level with the 206
realization that the details will keep coming as the development evolves. 207

Council Member Rafferty noted that the park proposed seems to be smaller. Ms. Larsen 209
pointed out three parks proposed. Council Member Rafferty asked about details for a 210
gateway and Mr. Jablonski indicated that they are reviewing options with staff and 211
believe they can accommodate something similar to the Mattamy proposal. 212

Planner Larsen explained that the development stage plan contains many details (based on 214
the previous proposal) and it is approved and remains in place. Changes will be council 215
reviewed. 216

Council Member Kusterman reviewed his position. He understands that this is one piece 218
proposed by a reputable builder. There is some risk but it is the way that development 219
comes forward. Staff and the advisory board have done their review and made 220
recommendations so he is able to consciously move forward. The alternative is that the 221
council makes it so hard for a developer that they walk. 222

Mayor Reinert instructed staff to provide council members with the entire development 224

stage plan. The change reviewed will be on the next council agenda for consideration of 225
approval. 226

7. Woods Edge Development Interest – Community Development Director 228
Grochala noted the approximately nine acres left in the Woods Edge development area. 229
They have an interested buyer for the purpose of developing a senior community. He 230
explained that the original plan calls for mixed use and certainly commercial in that first 231
block. Staff is working with the interested party and they (the developer) feel they can 232
address the city’s needs. Staff would like to know if the proposal is a consideration for 233
the council before proceeding with the concept. Some concerns: existing uses of the 234
same type, public safety needs, and commitment to commercial down the line. He will 235
also be seeking review of the city’s Economic Development Advisory Committee. 236

The mayor recalled the original plans for the area, calling for this area to be a sort of 238
entrance to the area. It was confirmed that the proposer doesn’t have experience in 239
development of commercial. Staff directed to continue the conversation and see what 240
more specific discussion develops. Council Member Rafferty indicated that he isn’t in 241
favor of another senior facility at this time. 242

8. 2017 Telecommunications Right-of-Way User Amendments- Administrator 244
Karlson reviewed his written report. He noted a new telecommunications technology 245
that could be made available to residential properties by use of city right of way and 246
facilities such as poles. There has been state legislation that allows the siting of the 247
hardware. It is highly recommended that the city adopt an ordinance regulating the 248
installation of this equipment. The city currently has a general public right/of/way 249
ordinance. The city can charge for use based on actual costs. Administrator Karlson 250
noted that he will be getting more information. 251

Council Member Maher explained that the legal work in developing an ordinance is being 253
offered through North Metro TV and that would keep the costs to each city low. 254

Administrator Karlson said he personally opposed the state legislation that put this into 256
place but it passed and the city is now required to accommodate the facilities. There are 257
unknowns such as what will the antennas look like. 258

Mayor Reinert suggested that the city doesn’t seem to have enough information yet but 260
doesn’t want to ignore the prospects of it either. Administrator Karlson said this is an 261
informational item at this point; he will continue to follow the matter. 262

9. Vehicle Replacement Policy Update - Council Member Rafferty said he wants 264
clarification on the policy specifics. Staff has provided information on the policy 265
developed in April. He understood, noting past council minutes, that the policy was to 266
be considered for all fleet vehicles. 267

Council Member Manthey recalled that the example at the time the policy was discussed 269

was police and fire vehicles so that is what occurred to him. Mayor Reinert said he was 270
thinking about vehicles within a range, excluding something like a street sweeper. 271
Primarily it was a public safety vehicle discussion. 272

Mayor Reinert said he would entertain a discussion about public works vehicles and a 274
policy or guidelines for them. The Public Services Director would have to be involved in 275
that discussion. 276

Council Member Rafferty pointed out a specific situation where a Public Services Ford 278
Escape was sold for a certain price, at a certain mileage and after a certain amount of time 279
of use. He feels that there should be more discussion. 280

Mayor Reinert reiterated the basic policy of five years or 100,000 miles. 282

9a. RFP for Engineering Services – Mayor Reinert remarked that his request for this 284
item actually related to RFPs for various services, not specifically engineering. He is 285
suggesting that the council have that conversation. Reviewing contracts through an RFP 286
process has traditionally served to bring forward better deals. 287

Administrator Karlson provided the council with a list of RFP plans and reviewed said 289

Mayor Reinert recalled good results from past RFPs. It can bring forward a result that 292
confirms that the current services are right and come at the best cost. Council Member 293
Maher noted that it’s appropriate for the city to pay attention. 294

Mayor Reinert suggested that the IT services should be reviewed next year. Administrator 296
Karlson remarked that the city would probably have to hire someone to assist with an 297
RFP process for that type of service because it is so far reaching. Mayor Reinert 298
suggested a review of Metro INet services by their staff first, including a comparison of 299
their services/costs with the market. 300

Staff and the council identified the Agent for Property/Liability/WC as the first RFP and 302
then the financial advisor review. Then to follow Civil Attorney and engineering. 303

Council Member Kusterman noted that some services aren’t strictly a commodity 305
situation; they are services that are harder to measure. Also he noted that each RFP costs 306
money to prepare and somewhere that cost is charged. The City should be convinced on 307
the front end that there is value to be gained in the process. 308

Mayor Reinert noted that Lennar has modified their plans in response to the council’s concerns. He 102
stated that he is happy to have Lennar, a nationally recognized builder, involved. He noted the 103
limited request for action at this time. He noted that this is a large development and must be done 104

Council Member Rafferty recognized Lennar’s work to take on a development and fit that into their 107
business plans. That is not an easy task. He is happy Lennar has good staff involved and he also 108
recognized city staff for their work in bringing this forward. He later added his thanks to the Public 109
Safety staff for working through the plans. 110

Mayor Reinert noted the development lay out; he favors the inclusion of water areas in the plans 112
because that fits this city. 113

Council Member Manthey thanked Lennar for sticking with the original layout – it’s an easier 115
consideration for the council than if everything were changed. 116

Permit Level C at 426 Pine Street – City Planner Larsen recalled a previous discussion this year for a 127
similar use by the same applicant but at a different address on Pine Street; the council did deny that 128
request. The applicant is now proposing the same use at a locaiton that would address many of the 129
concerns that were heard upon his initial request. The site proposed is a former bike arena but that is 130
no longer the use. 131
Ms. Larsen reviewed the requirements for the home occupation proposed. On an aerial photo, she 132
noted how the structures and areas are proposed to be used. The Planning and Zoning Board 133
recommendation as well as conditions of the use were explained. 134

Mayor Reinert remarked to the applicant (who was present) that he is pleased the property works so 135
much better for the use proposed. He asked Ms. Larsen to review the screening requirements as well 136
as where equipment would be stored. Ms. Larsen reported no concerns from neighbors. 137
Council Member Rafferty said he recently visited the area and he’s thankful that the city can provide an 138
area and keep a good family in the city. 139

6D) Consider Resolution No. 17-114 Accept Quotes for the Birch Street Trail Replacement 142
Project and the Century Farms Trail Project – Mr. Bourassa reviewed the written staff report. 143
Quotes have been received on the trail replacement project (area showed on overhead). The need for 144
replacement was reviewed as well as the inclusion of ADA improvements to the trails. He reviewed 145
the engineer’s estimate which was just over the quote received. Staff recommends award of the 146
project contract to the low quoter. 147
Council Member Rafferty asked if there is any concern about performing trail work in the fall (cooler 148
weather). Mr. Bourassa noted that there is always special care taken to follow technical 149
specifications when work is conducted in the fall. If the weather were to turn bad, the project would 150
be pushed back. Council Member Rafferty noted that he is proud of staff for addressing the situation 151
at Century Farms North and getting their trail on the schedule. 152

6F) Consider Resolution No. 17-113 Accepting Quotes and Awarding a Contract, Bald Eagle 166
Boulevard, Driver Feedback Signs – Brian Bourassa, WSB & Associates, reviewed the written staff 167
report. This project is coming forward at the request of the council. Community Development 168
Director Grochala noted that the contract is about two hot spots identified through speed studies that 169
need these driver awareness signs. Mr. Grochala noted that the cost of the work would be funded 170
from the council contingency account because there is no fund set aside for this specific use. Mayor 171
Reinert asked why not a street or public safety account? Staff indicated that there was no budgeted 172
funds in either of those areas to cover this. 173
Council Member Kusterman noted that a company from Sacramento California is involved. Mr. 174
Bourassa explained that the equipment will be provided by that company and installed by city staff. 175

Chuck Rickert, WSB & Associates, reported. He noted the council’s discussion at the last work 180
session. They are recommending a roundabout at the Centerville Road location (to be planned 181
through the county and in conjunction with adjoining communities). When funding becomes 182
available, the project can move forward. 183
Mayor Reinert asked about timing for the project. Community Development Director Grochala noted 184
that other community’s approval will be requested and funding will be sought. The county will be 185
approached as well. The city’s part will play out in its capital improvement program. 186

INTRODUCTION
The Knights of Columbus #9905 have applied for an exempt permit to conduct a raffle on
Saturday, January 5, 2018 for a fundraiser benefit event. Funds raised will be used for
educational scholarships.
BACKGROUND
Non-profit organizations are allowed, under the State Gambling Statutes, to apply for an
exemption from a gambling license if they conduct five (5) or fewer gambling occasions per
calendar year. The Knights of Columbus #9905 conducts five (5) or less per calendar and,
therefore, remains exempt from requiring a gambling license.
Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 does, however, require that the non-
profit organizations applying for the exemption permit, notify the city that they are applying for
the exemption and receive local approval.
The application and background materials are on file in City Clerk’s office.
RECOMMENDATION
Adopt a motion approving the application for exemption with no waiting period.

their Off-Sale Liquor and Tobacco Licenses.

INTRODUCTION
Eagle Liquor currently has an Off-Sale Liquor and Tobacco license and is in the process of
moving their location from 730 Apollo Drive to a new building at 617 Apollo Drive.
BACKGROUND
The application submitted to the City is complete, the related fees have been paid and insurance
information has been provided to the City as required.
In accordance with the Lino Lakes Code of Ordinances, Section 701 relating to Liquor
Licensing, this application requires approval by the City Council. The code also requires that
opportunity shall be given to any person to be heard for or against the granting of the license.
The council may then, in its discretion, grant or refuse the application.
If local approval is granted, Eagle Liquor’s application for an off-sale liquor and tobacco license
at the new address will be forwarded to the Minnesota Alcohol & Gambling Enforcement
Division for review. The State of Minnesota is the licensing authority for liquor licenses.
The applicant is aware that approval is subject to all the provisions and conditions of the laws of
the city, state and federal government.
RECOMMENDATION
Staff recommends the approval of the Off-Sale Liquor and Tobacco Licenses for Eagle Liquor.

BACKGROUND
Staff annually brings before the City Council delinquent water and sewer utility charges for
certification to the County Auditor for collection with the following year property taxes. Effected
property owners received mailed notice of this proceeding and have been allowed ample time to
pay the delinquent charges.
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 17-117, authorizing the certification
of delinquent water and sewer utility charges to be collected with 2017 property taxes payable in
2018 at an interest rate of 8% per annum.

WHEREAS, notice of such certification was mailed to effected property owners, and
WHEREAS, the City Council has met to consider the certification of such delinquent water and
sewer charges.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that
the Clerk is hereby authorized to certify the delinquent water and sewer charges as indicated on the
attached listing to the Anoka County Auditor to be collected with the 2017 property taxes, payable
in 2018 at an interest rate of 8.00% per annum.

INTRODUCTION
The Council is being asked to approve the appointment of Randy Brandt for the vacant Parks
Maintenance Worker position in the Public Services Department.
BACKGROUND
Mr. Brandt has seven years of experience in public works parks and holds certifications in turf
maintenance, tree inspection, and playground safety. He currently works full-time in the City of
Victoria in parks/ trails/ and street maintenance.
The hourly rate of pay would be $24.45, which is step 2 of the union wage schedule. Mr. Brandt
will begin employment on November 7, 2017.
RECOMMENDATION
Approve the appointment of Randy Brandt for the Parks Maintenance Worker position.

INTRODUCTION
Staff is requesting City Council consideration to adopt the assessment role for weed abatement
charges payable in 2018.
BACKGROUND
City Code Section 904 declares weeds or grass growing in excess of eight inches in height to be
a public nuisance. Property owners in violation of this requirement are notified and provided
an opportunity to cure the nuisance. If the violation is not addressed within a specified period
of time City staff and/or private contractors are directed to abate the nuisance. The cost of
abatement is charged to the property owner. In the event that the property owner fails to pay
the costs incurred the City may certify the charges against the property for collection with
property taxes as a special assessment.
Minnesota Statues § 429.101 provides for the special assessment of certain service including weed
elimination from properties. Special Assessments levied under this statute are subject to the
procedural requirements of M.S. § 429.061 which requires the determination of the costs to be
assessed and a public hearing to adopt the assessments.
There is one property proposed to be assessed for costs incurred in 2016 and 2017. The total
amount to be assessed is $300.00. The amount charged is based on staff time for completing
the work and administrative costs.
The property owner was notified by mail in accordance with the law.
RECOMMENDATION
Staff Recommends Approval of Resolution No. 17-123.

RESOLUTION ADOPTING ASSESSMENT
2017 WEED ABATEMENT CHARGES
WHEREAS, pursuant to City Code Section 904, any weeds or grass growing upon any lot or
parcel of land in the City of Lino Lakes to a greater height than eight (8”), or which have gone or
about to go to seed are declared to be a nuisance; and
WHEREAS, certain property owners in noncompliance with such code requirements were notified
and provided the opportunity to comply with such provisions; and
WHEREAS, upon failure of the property owner to comply with the provisions of said notice, the
City Weed Inspector ordered the abatement of such nuisance, in accordance with the City Code
Section 904, and charged the property owner thereof for expenses incurred by the City; and
WHEREAS, certain properties are delinquent in the payment of such Weed Abatement charges;
and
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and
heard and passed upon all objections to the proposed assessment of Weed Abatement Charges.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes,
Minnesota:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof as
Exhibit A, is hereby accepted and shall constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of
one year, the first of the installments to be payable on or before the first Monday in January 2018,
and shall bear interest at the rate of 8 percent per annum from the date of the adoption of this
assessment resolution. To the first installment shall be added interest on the entire assessment from
the date of this resolution until December 31, 2018.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with interest
accrued to the date of payment, to the City, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution; and he/she may, at any time
thereafter, pay to the City the entire amount of the assessment remaining unpaid, with interest
accrued to December 31 of the year in which such payment is made. Such payment must be made
before November 15 or interest will be charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.

BACKGROUND
The property owners have submitted a signed waiver, which waives their rights to a hearing and
waives their rights to appeal under the Lino Lake City Charter and/or Minnesota Statute 429
provided that the assessment associated with the improvement is levied against their property, or
they have entered into a Performance Contract with the City. We are prepared to adopt the

24, 2107. The Agreement provides for the assessment of trunk water, sanitary sewer and surface
water fees.
The total amount to be assessed is $343,116.15. In the above referenced Development Agreement,
the developer has waived any and all procedural and substantive objections to the special
assessments.
The developer has reviewed and approved the assessments. Attached is the proposed assessment
roll.

WHEREAS, pursuant to the development agreement dated June 1, 2017, the developer waives all rights to a
hearing on conducting of local improvements which will benefit the properties within the Northpointe 5th Addition
development which requested connection to City utilities,
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes:
1. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby
accepted and shall constitute the special assessment against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of fifteen years,
the first installment to be payable on or before the first Monday in January, 2018, and shall bear interest
at the rate of five percent (5%) per annum from the date of the adoption of this assessment resolution.
To the first installment shall be added interest on the entire assessment from the date of this resolution
until December 31, 2018. To each subsequent installment when due shall be added interest for one year
on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to the
County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30
days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City the
entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made before November 15 or interest will be
charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be
extended on the property tax lists of the County. Such assessments shall be collected and paid over in
the same manner as other municipal taxes.

INTRODUCTION
Staff is requesting City Council consideration to adopt assessments for the Chavez Preserve
Development pursuant to the Development Agreement for the project.
BACKGROUND
The City Council approved the Development Agreement for the Chavez Preserve on July 10,
2017. The Agreement provides for the assessment of trunk water, sanitary sewer and surface water
fees.
The total amount to be assessed is $91,681.98. In the above referenced Development Agreement,
the developer has waived any and all procedural and substantive objections to the special
assessments.
The developer has reviewed and approved the assessments. Attached is the proposed assessment
roll.
RECOMMENDATION
Staff is recommending approval of Resolution No. 17-124, Adopting Assessments, Chavez
Preserve which Requested Connection to City Utilities.

RESOLUTION NO. 17-124
RESOLUTION ADOPTING SPECIAL ASSESSMENTS, CHAVEZ PRESERVE
WHEREAS, pursuant to the development agreement dated August 2, 2017, the developer waives all rights to a
hearing on conducting of local improvements which will benefit the properties within the Chavez Preserve
development which requested connection to City utilities,
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes:
1. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby
accepted and shall constitute the special assessment against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of fifteen years,
the first installment to be payable on or before the first Monday in January, 2018, and shall bear interest
at the rate of five percent (5%) per annum from the date of the adoption of this assessment resolution.
To the first installment shall be added interest on the entire assessment from the date of this resolution
until December 31, 2018. To each subsequent installment when due shall be added interest for one year
on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to the
County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30
days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City the
entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made before November 15 or interest will be
charged through December 31 of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be
extended on the property tax lists of the County. Such assessments shall be collected and paid over in
the same manner as other municipal taxes.
Adopted by the City Council of Lino Lakes, Minnesota this 23rd day of October, 2017.
