CONSENT AGENDA A) Consideration of Expenditures: i) November 13, 2017 (Check No. 107007 through 107139) in the amount of $398,769.45. B) Consideration of Resolution No. 17-125, Supporting Anoka County’s Rice Creek Chain of Lakes Park Reserve Master Plan Amendment C) Consider approval of October 23, 2017 Council Work Session Minutes Council Member Manthey absent D) Consider approval of October 23, 2017 Council Meeting Minutes Council Member Manthey absent E) Consider Amending City of Lino Lakes Flexible Spending Accounts Plan Action Taken: Motion by Maher, seconded by Manthey, to approve Consent Agenda Items 1A, 1B and 1E as presented, was adopted; Motion by Council Member Maher, seconded by Kusterman to approve Consent Agenda Items 1C and 1D as presented was adopted; Council Member Manthey abstained Council Agenda -2- November 13, 2017 2. ADMINISTRATION DEPARTMENT A) Consider Extending the Temporary Building Inspector Position, Jeff Karlson Action Taken: Motion by Rafferty, seconded by Maher, to approve the extension of employment as recommended, was adopted B) Consider Appointment of Parks Maintenance Worker, Jeff Karlson Action Taken: Motion by Kusterman, seconded by Manthey, to approve the hiring of Macklin Glasby as recommended, was adopted 4. PUBLIC SAFETY DEPARTMENT A) Consider Hiring of One Records Technician, John Swenson Action Taken: Motion by Maher, seconded by Rafferty, to approve the hiring of Brooke Jacobson as recommended, was adopted B) Consider Acceptance of Monetary Donation to Lino Lakes Public Safety Canine Unit, John Swenson Action Taken: Motion by Maher, seconded by Rafferty, to approve the acceptance of a donation from the Coss Family Foundation as recommended, was adopted 5. The Park Board reviewed the master plan amendment during the community engagement phase of the project at their May 15, 2017 Park Board meeting. Ms. Karen Blaska, Park Planner, from Anoka County Parks and Recreation Department attended the November 6 work session and presented the master plan amendment to the City Council. The properties were transferred to the City as part of the project financing. In 1999, following completion of the Civic Complex, the City sold the former Police Station (Lot 15) to the American Legion. In 2017, the American Legion expressed a need to expand parking to efficiently operate their existing facility. Through negotiations with the American Legion, the City Council reached an agreement for the sale of Lot 14, Block 2 of Carole’s Estates 2nd Addition for a price of $90,000. At the time of sale, staff had proposed utilizing the sale proceeds to assist in future economic development opportunities subject to the council’s discretion (i.e. Land Acquisition, Gap Funding, etc.). Council did not take formal action regarding this commitment at the time of sale. Staff is requesting council approval to transfer the sale proceeds to the Economic Development Fund and commit the funds to future economic development opportunities subject to the council’s discretion. RECOMMENDATION Staff recommends the approval of Resolution No. 17-126. BACKGROUND The construction contract for the 2016 Aqua Lane to Black Duck Drive Trunk Water Main Project was awarded to GM Contracting, Inc. on September 26, 2016 in the amount of $1,077,549.82. The project included the following: • The extension of a 12 inch diameter trunk water main directionally drilled from Aqua Lane to Black Duck Drive. This improvement provided a secondary line to serve the northwest portion of the City, and it loops the City’s system improving pressure and flow. • The extension of a 3 inch diameter sanitary sewer forcemain directionally drilled from the intersection of West Shadow Lake Drive and Sandpiper Drive to Black Duck Drive. It was cost effective to extend this utility at the same time as the water mian. This utility was installed for future extension down West Shadow Lake Drive. • A 12 inch diameter trunk water main connection from Well No. 6 to Birch Street. The water main is being extended to strengthen the system. The construction project is complete, and the final construction cost was $1,030,025.09. The project was under budget, and we hereby recommend that the City of Lino Lakes approve payment of Final Construction Pay Voucher No. 4 to GM Contracting, Inc. in the amount of $65,834.03. BACKGROUND The St. Clair Estates residential subdivision was platted in August of 2017. A builder for this development, Sharper Homes, has requested a vacation of a drainage and utility easement on Lot 2, Block 1. This lot is unique to the development due to the rear yard drainage system, as shown on the enclosed map. Sharper Homes is a semi-custom home builder, where they take standardized floor plans and make modifications to accommodate a buyer's needs. Lot 2 Block 1 renders some of their floor plans unavailable and may eliminate the possibility of a deck. Sharper Homes, is currently working with a buyer for this lot, and would like to assure the buyer that the stock plan meets their needs, and would allow for a modest deck. ANALYSIS The drainage and utility easement was put in place with the St. Clair Estates plat to maintain public access to the rear yard storm sewer and drainage system. The proposed changes include moving the storm sewer approximately 5 feet away from the building pad, and the associated portion of the drainage and utility easement be vacated. The developer’s engineer has submitted the proposed storm sewer design modification and easement vacation which was reviewed and approved by City staff. The proposed easement vacation is to accommodate Sharper Homes request for their semi- custom home proposed on Lot 2 Block 1 of St. Clair Estates. An Ordinance is required to vacate the easement and the City Council is to hold public hearings for the vacation. 2 RECOMMENDATION Staff is recommending approval of the 1st Reading of Ordinance No. 12-17 Vacating Drainage & Utility Easements, Lot 2, Block 1, St. Clair Estates. The City Council of Lino Lakes has determined to vacate a portion of the drainage and utility easement, as created and dedicated over, under, and across Lot 2, Block 1, in the plat of St. Clair Estates, Anoka County, Minnesota; and 2. A public hearing was held on November 13, 2017 before the City Council in the City Hall Council Chambers after due published and posted notice had been given and reasonable attempts were made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and 3. It appears to be in the best interest of the City to vacate such drainage and utility easements; and 4. Four-fifths of all members of the City Council concur with this ordinance. Commencing at the southwest corner of said Lot 2; thence South 89 degrees 57 minutes 45 seconds East, assumed bearing, along the south line of said Lot 2 a distance of 43.78 feet to the point of beginning; thence North 03 degrees 48 minutes 30 seconds East 80.17 feet to the north line of said Lot 2; thence North 89 degrees 57 minutes 45 seconds West along said north line 7.77 feet; thence South 01 degrees 45 minutes 01 seconds East 80.04 feet to the point of beginning.
