RESOLUTION NO. 18-01
RESOLUTION APPROVING UTILITY FEE REFUND FOR LOT 1, BLOCK 1,
CHAVEZ PRESERVE
WHEREAS, the City Council approved the final plat for Chavez Preserve with Resolution No.
17-61 and the Development Agreement with Resolution 17-62 on July 10, 2017; and
WHEREAS, as part of the development requirements, the developer paid City Sewer
Availability (SAC) and Water Availability (WAC) fees. The SAC and WAC fees were registered
with Anoka County as assessments on November 30, 2017. The assessments were paid in full on
December 6, 2017.
WHEREAS, on unit of SAC and WAC fees were previously paid in 2002. Thus, the developer
is being credited for one unit of SAC and WAC fees. The credit due is $16,188.77
NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes
hereby approves the utility fee refund of $16,188.77 to Royal Oaks Realty, Inc.
Adopted by the Council of the City of Lino Lakes this 8th day of January, 2018.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Manthey and was duly seconded by Council Member Maher and upon
vote being taken thereon, the following voted in favor thereof:
Manthey, Maher, Stoesz, Rafferty, Reinert
