HomeMy WebLinkAbout2018-005 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 18-05 APPROVING A SUMMARY OF ORDINANCE NO. 01-18 FOR PUBLICATION WHEREAS, the City Council approved Ordinance No. 01-18, vacating a drainage & utility easement on Lot 1, Block 1, Pine Glen; and WHEREAS, the City Council approved the first reading on January 8, 2018, and the second reading and final passage on January 22, 2018; and WHEREAS, Ordinance No. 01-18 is lengthy and MN statute 412.191 allows the city to publish a summary of an ordinance, and WHEREAS, the City Council has determined that the summary clearly informs the public of the intent and effect of the ordinance, and WHEREAS, the publication in the official newspaper will include a notice that a full printed copy of the ordinance is available at City Hall. NOW, THEREFORE, BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes, Minnesota that the City Council approves the summary in Attachment A for publication according to state law and the City Charter. Adopted by the Council of the City of Lino Lakes this 22nd day of January, 2018. The motion for the adoption of the foregoing resolution was introduced by Council Member Rafferty and was duly seconded by Council Member Maher and upon vote being taken thereon, the following voted in favor thereof: Rafferty, Maher, Manthey, Stoesz, Reinert The following voted against same: none ATTEST: Bartell, City Cler Jeff Reine , ' a or ATTACHMENT A CITY OF LINO LAKES SUMMARY OF ORDINANCE NO. 01-18 AN ORDINANCE VACATING DRAINAGE AND UTILITY EASEMENT Section 1: Findings The City Council of Lino Lakes has determined to vacate in its entirety the drainage and utility easements of Lotl, Block 1, Pine Glen; and A public hearing was held on January 8, 2018 before the City Council in the City Hall Council Chambers after due published and posted notice had been given and a reasonable attempts were made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and The final plat of SS Properties Addition shall be recorded that dedicates new drainage and utility easements; and Section 3: Effect This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter and upon filing of the final plat of SS Properties Addition. Passed by the Lino Lakes City Council on January 22, 2018. This is a summary of the adopted ordinance. A full printed copy of the ordinance is available at City Hall.
