RESOLUTION NO. 18-41
APPROVING ESCROW AGREEMENT FOR INDIVIDUAL SUBSURFACE
TREATMENT SYSTEM COMPLIANCE FOR 465 ASH STREET
WHEREAS, Property Owner of 465 Ash Street in Lino Lakes has requested a building permit
and does not have a compliant Individual Subsurface Treatment System (ISTS). To obtain a
building permit Owner is required to have a compliant ISTS or connect to municipal utilities;
and
WHEREAS, The City of Lino Lakes does not currently have municipal utilities available in this
area, and the City of Shoreview has municipal utilities in the area. The Owner requested to
connect to the City of Shoreview's municipal utilities; and
WHEREAS, Joint Powers Agreement and a Comprehensive Plan amendment are required to
facilitate Owner's connection to the City of Shoreview's municipal system. These items are
concurrently being processed; and
WHEREAS, Lino Lakes and the Owner wish to enter into an escrow agreement whereby the
City holds the value of an ISTS system in escrow and the City issues a building permit. Once a
compliant connection is approved by the Cities of Lino Lakes and Shoreview the escrow may be
released;
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes the Escrow
Agreement for Individual Subsurface Treatment System Compliance for 465 Ash Street is
approved.
Adopted by the Council of the City of Lino Lakes this 9th day of April, 2018.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Maher and was duly seconded by Council Member stops7. and upon
vote being taken thereon, the following voted in favor thereof:
Maher, Stoesz, Rafferty, Reinert
The following voted against same:
None (Absent - Manthey)
