HomeMy WebLinkAbout2018-072 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 18-72 APPROVING PUD DEVELOPMENT STAGE PLAN/PRELIMINARY PLAT FOR SADDLE CLUB FOURTH ADDITION WHEREAS, the City received an application for PUD Development Stage Plan/Preliminary Plat for Nature's Refuge hereafter referred to as "Development"; and WHEREAS, City staff has completed a review of the "Development" based on the following: • 4/30/2018: Civil Plans, prepared by Plowe Engineering • 4/30/2018: Certificate of Survey and Preliminary Plat, prepared by E.G. Rud & Sons • 3/17/2017: Engineering Field Report, prepared by Carl Anderson Engineering • 3/13/2013: Northern Technologies, Inc. Soil Borings • 4/9/2018: Stormwater Drainage Report, prepared by Plowe Engineering • 3/22/2018: Wetland Permit Application prepared by Kjolhaug Environmental Services; and WHEREAS, a public hearing was held before the Planning & Zoning Board on May 9, 2018 and the Board recommended approval of the "Development"; and NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes hereby makes the following: FINDINGS OF FACT PUD, Planned Unit Development Per Section 1007.024(1) Purpose and Intent, the PUD, by allowing deviation from the strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., by conditional use permit or a mixture of uses by rezoning to a PUD District, is intended to encourage: a. A development pattern in harmony with the objectives of the Comprehensive Plan. The proposed Saddle Club Fourth Addition PUD conservation subdivision is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and utilities. The development upholds the City's public values by creating a multi functional open space greenway corridor integrated with the stormwater conveyance system and wetland management. Saddle Club Fourth Addition is consistent with residential land use and density requirements. Safe transportation corridors and public utilities also serve the development. b. Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such 1 developments. Flexible site design with narrower right-of-way widths and reduced setbacks allows Saddle Club Fourth Addition to develop a residential conservation subdivision and construct a multi- functional greenway corridor and storm water management system. Some lots may be custom graded for custom built homes. This will also preserve desirable natural resources and trees. c. The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. Wetland buffers and conservation easements will protect the wetland vegetation areas. The seed bank existing in the wetland soils supports rare plant species. Tops soils that are removed from the wetland buffer areas shall be returned to the same area to the greatest extent as possible. d. A creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. Saddle Club Fourth Addition connects the Foxborough and Saddle Club conservation subdivisions and provides a contiguous multi functional greenway corridor by integrating the stormwater management system, wetland management and open space areas and trails into one unified system. e. An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. Reduced right-of-way widths and setbacks provide an efficient use of land and lowers development and public investments. f. Promotion of a desirable and creative environment that might be prevented through the strict application of City zoning and subdivision regulations. Strict application of a 60 foot right-of-way width and 30 foot setback would result in greater impacts to the wetlands and natural resources. Preliminary Plat Per Section 1001.013, Premature Subdivision: (1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to the following criteria shall be denied by the City Council. (2) Conditions for establishing a premature subdivision. A subdivision may be deemed premature should any of the following conditions not be met. (a) Consistency with the Comprehensive Plan. Including any of the following: 1. Land use plan; 2. Transportation plan; 3. Utility (sewer and water) plans; 2 4. Local water management plan; 5. Capital improvement plan; and 6. Growth management policies, including MUSA allocation criteria. Saddle Club Fourth Addition is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and utilities. The development is also consistent with the local water management plan, capital improvement plans and growth management policies. (b) Consistency with infill policies. A proposed urban subdivision shall meet the city's infill policies. Saddle Club Fourth Addition is consistent with infill policies. The development is within the current Utility Staging Area 1 A (2008-2015). The cost, operation and maintenance of the utility system is consistent with the normal costs projected by the water and sanitary system plans. No future utility costs are proposed. (c) Roads or highways to serve the subdivision. A proposed subdivision shall meet the requirements for level of service (LOS), as defined by the Highway Capacity Manual. Saddle Club Fourth Addition meets the requirements for level of service (LOS). A Traffic Impact Study analyzed traffic impacts at the CSAH 34 (Birch Street) intersection and determined they will continue to operate acceptably at Level of Service A. The additional 8 lots from Saddle Club Fourth Addition and the connection of Fox Road will not negatively impact the level of service operations. (d) Water supply. A proposed subdivision shall be deemed to have an adequate water supply. Saddle Club Fourth Addition will have an adequate water supply. The site is served by an 8" watermain along Fox Road. The water system has capacity to serve this 9 lot residential development. (e) Waste disposal systems. A proposed subdivision shall be served with adequate waste disposal systems. Saddle Club Fourth Addition will be served with an adequate waste disposal system. The site is served by an 8" sanitary sewer pipe will connect from Foxborough to Saddle Club along Fox Road. The sanitary system has capacity to serve this 9 lot residential development; and BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby provides the following PUD, Planned Unit Development flexibility for Saddle Club Fourth Addition: 1. Reduced road right-of-way width from 60 feet to 50 feet. 2. Reduced front and rear setbacks from 30 feet to 25 feet; and BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby approves the PUD Development Stage Plan/Preliminary Plat for Saddle Club Fourth Addition subject to the following conditions: 3 1. Comments from WSB City Engineer letter dated May 2, 2018 shall be addressed. 2. Comments from the Environmental Coordinator letter dated May 1, 2018 shall be addressed. 3. A copy of the RCWD permit application shall be submitted to the City. 4. Developer shall prepared deeds for Outlots A, B and C. 5. Developer shall provide a house plan with deck for Lot 2, Block 2. 6. Right -of -Way, Drainage and Utility Easement shall be vacated in conjunction with Council approval of PUD Final Plan/Final Plat. 7. Sheet L2, Tree Inventory & Removals: a. Tree Inventory Table shall have consistent headers e.g. "Rem" vs "Save". 8. Sheet S2, Preliminary Plat: a. It shall be noted on the preliminary plat that "Lot 2, Block 2 has limited ability to construct accessory structures, decks or additions." Adopted by the Council of the City of Lino Lakes this 11th day of June, 2018.
