HomeMy WebLinkAbout2018-131 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 18-131 APPROVING A SUMMARY OF ORDINANCE NO. 13-18 FOR PUBLICATION WHEREAS, the City Council approved Ordinance No. 13-18, updating the City's therapeutic massage regulations and enacting a new chapter regarding disorderly houses; WHEREAS, the City Council approved first reading on September 10, 2018 and the second reading and final passage on September 24, 2018; and WHEREAS, Ordinance No 13-18 is lengthy and MN Statute 412.191 allows the City to publish a summary of an ordinance; and WHEREAS, the City Council has determined that the summary clearly informs the public of the intent and effect of the ordinance; and WHEREAS, the publication in the official newspaper will include a notice that a full printed copy of the ordinance is available at city hall; NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes that the City Council approves the summary in Attachment A for publication according to state law and the City Charter. Adopted by the Council of the City of Lino Lakes this 8th day of October, 2018. The motion for the adoption of the foregoing resolution was introduced by Council Member Rafferty and was duly seconded by Council Member Manthey and upon vote being taken thereon, the following voted in favor thereof: Rafferty, Manthey, Maher, SToesz, Reinert The following voted against same: none ATTEST: Julia. e Bartell, C Ty C ATTACHMENT A CITY OF LINO LAKES SUMMARY OF ORDINANCE NO. 13-18 AMENDING CHAPTER 616 OF THE LINO LAKES CODE OF ORDINANCES RELATING TO THERAPEUTIC MASSAGE. Ordinance No. 13-18 provides for updates to the following sections: 616.02 Definitions: Accredited institution and massage therapist; 616.04 Application for License: Background information to be provided; 616.06 & 616.06 Conditions Governing Issuance: Additional investigation requirement; and disqualifiers; 616.17 License Restriction: Hours of operation and habitation of premises; 616.08 Inspection: Equipment requirements; 616.09 Grounds for Revocation: Revocation based on offenses; previous license infractions; 616.10 Suspension of License for Violations: Circumstances calling for immediate suspension. Passed by the Lino Lakes City Council on October 8' 2018. This is a summary of the adopted ordinance. A full printed copy of the ordinance is available at city hall. CITY COUNCIL AGENDA ITEM 1F STAFF ORIGINATOR: Julie Bartell, City Clerk MEETING DATE: October 8, 2018 TOPIC: Consider approval of Resolution No. 18-131, Approving Summary Publication of Ordinance No. 13-18 VOTE REQUIRED: 3/5 INTRODUCTION The City Council has approved the first and second reading of Ordinance No. 13-18, updating the City's regulations regarding therapeutic massage and adding new language regarding disorderly houses. BACKGROUND The City Charter states that, "Every ordinance shall be published at least once in the official newspaper as soon as practicable and such publication may be by summary of its contents as provided by state law." Although Ordinance No. 13-18 was adopted by the council on September 24, 2018, a summary for publication was not approved. Since the ordinance is lengthy and there is a cost associated with publication, staff is recommending that the council approve the attached summary. RECOMMENDATION Consider approval of Resolution No. 18-131, Approving amendments to Chapter 616 relating to Therapeutic Massage; and Adding a new Chapter 510 relating to Disorderly Houses.
