HomeMy WebLinkAbout2018-161 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 18-161 APPROVING A SUMMARY OF ORDINANCE NO. 16-18 FOR PUBLICATION WHEREAS, the City Council approved Ordinance No. 16-18, vacating a portion of the street right of way and drainage and utility easements dedicated with LAKES ADDITION NO. 1; and WHEREAS, the City Council approved the first reading on November 13, 2018, and the second reading and final passage on November 26, 2018; and WHEREAS, Ordinance No. 16-18 is lengthy and MN statute 412.191 allows the city to publish a summary of an ordinance, and WHEREAS, the City Council has determined that the summary clearly informs the public of the intent and effect of the ordinance, and WHEREAS, the publication in the official newspaper will include a notice that a full printed copy of the ordinance is available at City Hall. NOW, THEREFORE, BE IT FURTHER RESOLVED by The City Council of The City of �—� Lino Lakes, Minnesota that the City Council approves the summary in Attachment A for publication according to state law and the City Charter. Adopted by the Council of the City of Lino Lakes this 26th day of November, 2018. The motion for the adoption of the foregoing resolution was introduced by Council Member Raffertyand was duly seconded by Council Member Maher and upon vote being taken thereon, the following voted in favor thereof: Rafferty, Maher, Manthey, Stoesz, Reinert The followins4 voted against same: none ATTEST: Juliann Bartell, City Jerk'-- ATTACHMENT A CITY OF LINO LAKES SUMMARY OF ORDINANCE NO. 16-18 AN ORDINANCE VACATING DRAINAGE AND UTILITY EASEMENT (LAKES ADDITION NO. 1) Section 1: Findings The City Council of Lino Lakes has determined to vacate a portion of the street right of way and drainage and utility easements dedicated with LAKES ADDITION NO. 1; and A public hearing was held on November 13, 2018 before the City Council in the City Hall Council Chambers after due published and posted notice had been given and a reasonable attempts were made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and Section 3: Effect This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter and upon recording of the Street Right of Way and Drainage and Utility Easement Vacation. Passed by the Lino Lakes City Council on November 26, 2018. This is a summary of the adopted ordinance. A full printed copy of the ordinance is available at City Hall.
