ORDINANCE NO. 22
THE VILLAGE OF LINO LAKES
AN ORDINACE ESTABLISHING REGULATIONS FOR LAND IMPROVEMENTS AND STREET CONSTRUCTION
PROVIDING SPECIFICATIONS FOR CONSTRUCTION AND USE OF CERTAIN MATERIALS AND PROVIDING
FORTHE MANNER IN WHICH IMPROVEMENTS AND CONSTRUCTION SHALL BE COMPLETED IN THE VILLAGE
OF LINO LAKES, MINN.
The Village Council of the Village of Lino Lakes, Minnesota ordains:
SECTION 1. PURPOSE AND JURISDICTION
Pursuant to the applicable statuatory authority of the Village of Lino Lakes to regulate,
control and maintain Village streets as provided in Minnesota Statute 412.221, as amended,
the following regulations and apecifications including the exhibit or exhibits hereto
established. The specifications set forth herein shall apply to all streets hereafter
constructed within the Village of Lino Lakes and are considered as additional safeguards
made necessary through the rapid growth and expansion of the Village.
SECTION 2. DEFINITIONS
For the purpose of this ordinance certain words and terms are hereby defined as follows:
Specifications. A detailed statement of particulars. A detailed description
setting forth the dimensions, materials, workmanship and general conditions under which
any given type of construction is to be undertaken and carried forward by a contractor
for the Village of Lino Lakes.
Village. Is the Village of Lino Lakes, Anoka County, Minnesota.
Village Council. The duly elected governing body of the Village consisting of
Mayor, Clerk, and three trustees.
Village Engineer. A Registered Civil Engineer appointed by the Village Council to
furnish engineering services in connection with any Village work. The term also shall
include his authorized representatives.
Right-of-way. Is the land covered by a public road or other land dedicated for
public use or for certain private use such as land over which a power line passes.
Sub -base. Is the part of the road bed to be constructed between and elevation
which is three (3) inches below the profile grade.
Sub -grade. Is the top of the sub -base which is an elevation three (3) inches
below the profile grade.
Base. The top three (3) inches of the driving surface of the street being that
part which is to be stabilized with a bituminous material.
Profile grade. Is the grade shown on the profile which accompanies the plans for
the project. It is the proposed finished grade for the street.
Driving surface. Is the grade width of roadway lying between the two (2) gutter
lines as. constructed.
Stabilized base. Is the top three (3) inches of the driving surface as specified
in this ordinance stabilized using an asphaltic material.
Village Standard. Is the typical plan, cross-section or detail of construction
which is approved by the Village Council of Lino Lakes, for all construction of similar
nature.
Plant -Mix Bituminous Material. Is a sand and gravel aggregate mixed with a spec-
ified bitumous material in a stationary or traveling mixing plant.
Drainage. Is the removal of surface and storm water from any given area.
Municipal Water Supply. Is the furnishing of water through a water system which
is owned and controlled by a municipality in which it is located.
Community Water System. Is a water system which has been designed to serve a
limited area or community and which is usually privately owned.
Subdivision or Plat. Is a parcel of land divided into smaller parts such as blocks or
lots; also means a tract of land which is redivided anew after the first division.
Unimproved Lot. Is one which has been sold to an individual buyer in an unim-
proved state, that is, without any building having been constructed thereon.
Partial Maintenance. Shall include only that maintenance which is necessary to
permit access over the public street to the homes or buildings which might be construc-
ted in a given area at all seasons of the year.
Rough Grading. Is the grading work which has been done to bring the area within
the street right-of-way to approximately the designed finished grade.
Bitumous Material. As referred to in this ordinance is a cutback asphalt material
or an asphaltic cement.
Prime -coat. Is a light coat of bitumous material applied to a surface prior to
the placing of a mixture of aggregate or an aggregate and bitumous material.
Street Access. Is the right and ability to pass from a lot to a public street
without the nesessity of crossing private property.
Storm Sewers. A pipe line installed underground for the purpose of carrying sur-
face water from any given area.
Catch Basin. Is a structure usually placed at or near the gutter line of a street
and designed to recieve surface or storm water through an opening and provide a pass-
ageway into an underground storm sewer or culvert.
Manhole. A structure placed over a sewer with an opening at ground level and de-
signed in such a way as to permit access to the sewer for the purpose of cleaning or
inspection
Boulevard. The area of a right-of-way which is located between the gutter line of
the street ans property line on each side. Sometimes referred to as sidewalk or bench or
berm.
Building Permit. A written permit issued by the Village to allow the recipient
to construct or cause to be constructed any type of building or structure on any pro-
perty or land within the limits of the Village.
SECTION 3. BUILDING PERMITS
No building permits will be issued for any construction within the Village unless the
building site is located on an existing street which is being maintained by the Village
or unless provisions for street grading and construction have been made in full com-
pliance with this ordinance.
SECTION 4. PETITION
Before any improvement of any kind whatsoever is undertaken within the public right-
of-way, whether such right-of-way is located in new subdivisions or in an existing
subdivisions or plat, the owners shall petition the Village Council for the improvement
thereof.
SECTION 5. PETITION FORMS
Petitions for any improvement in the street right-of-way shall be submitted to the
Village Council for its approval. Petitioners shall use the approved Village form
which has been prepared for that purpose, these forms can be obtained from the Village
Clerk or the Village Engineer free of charge.
SECTION 6. ENGINEER'S PRELIMINARY REPORT
Upon the receipt of a petition from any property owner or owners, the Council shall
secure from the Village Engineer, a report advising it in a preliminary way as to
whether the proposed improvement is feasible and as to whether it should best be made
as proposed or in connection with some other improvement as recommended.
SECTION 7. DEPOSIT BY PETITIONERS FROM PRELIMINARY EXPENSE
A copy of the Engineer's preliminary report and estimate shall be furnished by the
Village to the petitioners. The petitioners shall be required to deposit an amount
equal to ten per cent (10%) of such preliminary estimate with the Village Clerk. This
money will be used to defray the expenses incurred by the Village in the preparation
of plans, specifications, legal service and advertising or any other preliminary ex-
pense involved in preparing for the public hearing. Any balance in this fund shall
be returned to the petitioners in the event that the work is not ordered after the
hearing, or it shall be applied to the cost of the project when completed.
SECTION 8. PLANS, SPECIFICATIONS AND BIDS
After the petitioners have deposited an amount equal to the ten percent (10%) of the
Engineer's preliminary estimate of the cost of any project, the Council shall instruct
the engineer to prepare plans and specifications for the project. After these plans
and specifications have been submitted to the Council by the Engineer and approved
by said Council, the petitioners may proceed with grading and installation of drainage
structures in accordance with said plans and specifications and under the supervision
of the Engineer' The petititoners may request this work to be done by the Village, in
which case the Clerk shall instructed by the Council advertise for bids for the con-
struction of the project. This advertising when necessary, shall be for such length
of time as the Council may deem advisable. This procedure to be in accordance with the
provisions of Minnesota Statutes Section 429, as amended.
SECTION 9. PUBLIC HEARING
After bids have been received, but before any contract is let or any work is ordered
by day labor for any improvement, the Village shall hold a public hearing on the pro-
posed improvement following two (2) publications in the newspaper of a notice stating
the time and place of the hearing, the general nature of the improvement, the estimated
cost, the area proposed to be assessed, and that the Village Council proposes to pro-
ceed under the authority granted by Minnesota Statutes Section 429; as amended.
SECTION 10. BOND TO GUARANTEE CASH PAYMENT FOR WORK BY PETITIONERS
After the public hearing described in the preceding section had been held and before
the award of any contract or the ordering of any improvement work by the Council, the
petitioners shall furnish a surety bond in the amount equal to one and one-half times
the cost of such work as submitted by the low bidder or in the case of day labor, work
as estimated by the Village Engineer. The surety bond shall guarantee the payment of
such assessment for all of the work contemplated in cash immediately upon its completion.
SECTION 1 1 . UNIMPROVED LOTS
When an owner lays out a subdivision for the purpose of selling unimproved lots to
individual buyers, the provisions of the preceding section requiring a surety bond to
guaranted the payment in full may be waived by the Council providing that such owner
agrees to an assessment on each lot in accordance with Minnesota Statutes Section 429,
as amended. In this event, the Councul shall determine the timing of the work in ac-
cordance with the best interests of the Village.
SECTION 12. PARTIAL STREET CONSTRUCTION
It shall not be intent of this ordinance to force the construction of all of the streets
in any subdivision. The owner or developer shall be permitted to petition and furnish
bonds for the construction of certain streets in the subdivision without having to in-
clude all of the streets at any one time. In constructing part of the streets, it will
be necessary for the owner of diveloper to include streets which will make a complete
circuit, that is, they shall leave a finished street and return to a finished street
so that there will be no dead ends when the construction has been completed. Building
permits shall be issued only for those lots having access to a street which has been
constructed or for which the construction bonds and agreements are on file in the office
of the Village Clerk.
SECTION 13. CONSTRUCTION OF STREETS
The full width of right-of-way shall be granted, including sub -grade of the area to be
improved, in accordance with plans prepared by the Village Engineer and in accordance
with the applicable ordinances for street construction of the Village. The constuuction
of all streeta shall include a minimum Village Standard which shall include the following:
The grading of the entire width of the right-of-way to the appooved Village section as
shown on all plans, a copy of which has been made a part of the specifications; the con-
struction of a sub -base nine (9) inches in thickness over the entire width of the driving
surface, that is, gutter to gutter using porous material which shall be approved by the
Engineer; the construction of a stabilized base using three (3) inches of crushed gravel
completely stabilized with an asphaltic material the construction of a plant -mixed bit-
uminous curb using gravel and asphaltic cement; the shaping of the boulevard section be-
tween the gutter line and the property line and the complete sodding of this area. The
driving surface of each newly constructed street shall be finished through the use of a
seal coat and aggregate as deccribed in the Village specifications.
SECTION 14. STREETS HAVING LESS THAN STANDARD WIDTHS
In cases where any temporary or permanent street has a width less than 60 feet, the design
and specifications for construction shall be considered as special. The Village Engineer
shall design such street in such a way as he deems best for the contemplated use. The
petitioner shall be required to enter into special agreements pertaining to the construc-
tion of these streets.
SECTION 15. PARTIAL MAINTENANCE
After a street has been completed to a point where is can be used and after building per-
mits have been issued for construction of buildings on property fronting on said streets,
the street shall be placed on the routine maintenance list of the Village. Snow plowing
r \ operations will be carried on in the winter time and general blading operations in the
summer time on these streets at the expense of the Village. This shall not in any way
constitute final acceptance by the Village and such maintenance or partial acceptance of
P, the Council shall not have any effect upon agreements existing between the Village and
the owner for further improvements on such streets.

SECTION 16. GENERAL CONSTRUCTION SPECIFICATIONS
The following specifications are general and will apply to each and every street hereafter
constructed in the Village. Definite and detailed specifications and plans shall be de-
signed by the Village Engineer for each individual project based upon its own location and
special features. The detailed specifications shall be in accordance with this general
outline.
SECTION 17. GRADING
(.A) The full width of the right-of-way shall be graded, including the sub -grade of
areas to be stabilized, in accordance with the design prepared and staked by the Village
Engineer and in accordance with the standard typical cross -sections attached hereto.
(B) After the rough grading has been accomplished and the street is at the approxi-
mate established grade, the center thirty-two (32) feet, lying sixteen (16) feet on each
Aide of the centerline shall be lowered to an elecation which is twelve (12) inches below
the established profile grade. The sub -base shall be cons+ructed within this area to a
depth of nine (9) inches. The material used for the sub -base shall conform to the re-
quirements of the current Minnesota Department of Highways specifications for Highway Con-
struction, Section 3138 for Class 5 aggregate, this material shall be placed in layers
not more than four (4) inches i.n compacted thickness. Compaction shall be obtained by
the method of ordinance compaction.
SECTION 18. ROAD MIXED BITUMINOUS BASE
The construction of the bituminous base shall include the placing of the necessary gravel
material and the application of bituminous material as described herein. This work shall
all be included in one operation, that is, the contractor shall place the gravel material
on the roadway as specified only at such time as the application of the bituminous material
shall follow immediately. The aggregate shall conform to the requirements of Section 3138
for Class 2 aggregate modified to permit a minimum of these (3) passing the No. 200 sieve.
The bituminous material for the prime coat shall be MC-1 and shall be applied to the pre-
pared sub -base at the rate designated by the Engineer which shall be not less than 0.1
gallon and not more than 0.3 gallons per square yard. The bituminous material for the
mixture shall be MC-3 unless otherwise designated, and shall be applied as directed in the
detailed specifications for the particular project, depending upon the character of the
aggregate being used.
SECTION 19. BITUMINOUS SEAL COAT
The bituminous seal -coat shall be constructed in accordance with the material and con-
struction requirements of Section 2356 of the Minnesota State Highway Dept. specifica-
tions. The rate of application shall be as directed by the Engineer, within the range
of 0.18 gallons to 0.22 gallons per square yard. The aggregate shall conform to the re-
quirements of Section 3127. The exact gradation and rate of application shall be as
specified for each project and as directed by the Engineer.
SECTION 20. BITUMINOUS CURB
The bituminous curb shall be composed of a mixture of aggregate and asphaltic material
constructed on a prepared base in accordance with the detailed specifications and in
conformity with the lines and typical cross -sections on the detailed plans for each
particular project. Mixing of the hot -mix used in the construction of bituminous curb
shall be done in an approved pug -mill mixer of not less than three (3) cubic yards ca-
pacity. Unless otherwise specified in the detailed specifications, the aggregate shall
conform to the requirements of Minnesota Highway Dept. specifications Section 3139.
Type AB-2. The asphalt shall be Type Ac-1 (85-100) penetration unless otherwise desig-
nated_ The amount of asphalt used shall be from 6 to 8z per cent by weight of the total
mix.
SECTION 21. STORM SEWERS
Where considered necessary to insure adequate drainage of any street hereafter construc-
ted in the Village, the Village Engineer shall design adequate storm sewers, together
with necessary catch basins, manholes and other appurtenances. Detailed plans and speci-
fications for this work shall be included with those designed for each particular pro-
ject.
SECTION 22. BOULEVARD SOD
The boulevard on each side of the street, that fs, the area between the curb and the pro-
perty line, shall be uniformly finished to fit the top of the curb. This area shall be
completely covered with sod in accordance with the detailed plans and specifications de-
signed for the project.
SECTION 23. TREES
Street trees having a truck diameter (measured 12 inches above the ground) of not less
than two and one-half inches shall be planted along all streets, where trees do not exist.
These trees shall be placed on the boulevard in a straight line parallel with and eight
(8) feet from the property line. This requirement will be satisfied and it is preferable
if an equivalent number of trees of the same size are planted in a naturalistic way in
the front yards of the adjoining lots.
SECTION 24. DRAINAGE
All drainage shall be accomplished in connection with the grading operations of the street.
Wherever it is possible to do so, the water shall be carried in storm sewers under the
ground, proper catch basins and manholes shall be constructed to adequately collect all
surface water in the area. Wherever any Village storm sewer is located, it will be nec-
essary that the owner shall connect to that storm sewer with the sewer which is to carry
water out of his particular street. In cases where larger pipes than that which is re-
quired to carry the water from any particular street is advisable, the Village may elect
to participate in the cost of such construction.
SECTION 25. WATER SUPPLY
Wherver municipal water is available or wherever a community water system can be extended
the developer of any new subdivision shall be required to connect each and every house to
the water system. All of this work shall be done prior to the stabilization of any street
base. This shall also apply in cases where detailed plans and specifications for sanitary
sewers to serve the district in which the subdivision is located are available.

SECTION 27. VARIATIONS AND EXCEPTIONS
' The Council may permit variations from these requirements in specific cases which, in its
opinion do not affect the general sense of this ordinance.
SECTION 28. VALIDITY
If any section, subsection, sentence, clause or phrase of this ordinance is, for any
reason, held to be invalid such decision shall not affect the validity of the remaining
portions of this ordinance.
SECTION 29. EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage and publica-
tion according to law.
Adopted by the Village Council of the Village of Lino Lakes, Minnesota, this 14th day of
