HomeMy WebLinkAbout1960-025 Council OrdinancesORDINANCE NO. 25 VILLAGE OF LINO LAKES ANOKA COUNTY, MINNESOTA AN ORDINANCE LICENSI:G AND REGULATING THE KEEPING OF DOGS, PROVIDING FOR THE LICENSING OF DOG KENNELS AND REPEALING ORDINANCE NO. 16. The Village Council of the Village of Lino Lakes, Minnesota do ordain as follows: SECTION 1. Running at large prohibited. No dog shall be permitted to run at large within the limits of this village. ' SECTION 2. Control of dogs, The restriction imposed by Section 1, shall not prohibit the appearance of any dog upon the streets or public property when the dog is under the immediate control of the person charged with its care. SECTION 3. License required. No person shall keep any dog within the Village without securing a license therefrom the Clerk, who shall keep a record of all licenses issued and shall issue a metal tag for each license. The annual license fee shall be $2.00 for each male dog or spayed female dog and $5.00 for each female dog. Licenses heretofore issued and licenses issued hereafter shall expire on the 1st day of January next following their issuance. SECTION 4. Impounding. The dog catcher, every constable and every police officer shall impound any dog found unlicensed or running at large and shall give notice of the impounding to the owner of such dog, if known. In case the owner is unknown, such officer shall post notice at the Village polling place, that if the dog is not claimed within 4 days of the posting of the notice, it will be disposed of. If such dog is not claimed within the time specified and all fees and charges paid, the dog catcher or any constable or those directed by them shall dispose of such dog unless it is requested by a licensed education— al or scientific institution under Minnesota Statutes 35.71. The dog catcher or constable or their subordinates shall cause any dog impounded to be housed and fed in a humane manner. An impounding fee of $3.00 and a charge of $.75 per day for feeding shall be charged for any dog impounded. SECTION 5. Kennel. No person, firm or corporation shall harbor, maintain, or keep for pleasure or profit, four (4) or more dogs without securing a license therefore from the Village Clerk. The license fee shall be $50.00 per year. This fee shall be in lieu of the license fee prescribed in the preceding sections for each dog kept in such kennel. No kennel license shall be issued by the Clerk unless the applicant therefore has complied with the zoning ordinances of this Village. Kennel licenses shall expire on the 1st day of January next following their issuance. The Clerk shall keep a record of all kennel licenses issued and shall issue a written receipt for each license issued. SECTION 6. Penalty. Any person, firm, or corporation violating any pro— visions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $100.00 or by imprisonment in Village or County jails for not more than 90 days. SECTION 7. Repeal. Ordinance No. 16, passed February 27, 1956, is hereby repealed. SECTION S. Effective date. This ordinance shall be in full force and effect from and after its passage and publication according to law. Passed by the Village Council this 13th day of June, 1960. /s/ Arnold A.
