AN ORDINANCE PROVIDING FOR THE LICENSING OF AND REGULATING DOG KENNELS IN THE VILLAGE OF LINO LAKES,MINNESOTA The Village Council of Lino Lakes ordains: SECTION 1 The keeping of or more dogs on the same premises, or other- wise on different premises, within the Village of Lino Lakes, whether such dogs are owned by the same person or not, irrespective of the purpose thereof, shall constitute a dog kennel, which shall be subject to an annual license fee for the operation and maintenance thereof. The owner or occupant of the premises on which such dog kennel is located shall be liable for such annual license fee. SECTION 2 When the keeping of the said dogs so constitutes a dog kennel, the dogs shall not be allowed to run at large at any time within the Village of Lino Lakes, either on the public streets or alleys thereof or other public grounds thereof or on private property located therein. SECTION 3 :The owner, keeper, or harborer of a dog kennel shall pay an annual license fee of $j`g _ therefore. Such person shall not be liable for the regular license:_ fees as levied in Section 3 of Village of Lino Lakes Ordinance No. 16�ayd said annual license fee shall be due and payable, before the oL, day of 6,,.44din each year, to theVillage of Lino Lakes, at the oftice of, the Village issue who shall such annual dog kennel license. The fees so paid shall go into the general revenue fund of the Villge. SECTION 4 Only one dog kennel license shall be issued to one location or premises, all parties of which are abutting to each other. SECTION 5 Licenses issued under the terms of this ordinance shil be required from and after and shall expire on the day of next following their issuance. SECTION 6 Dog kennels must be kept in a sanitary and healthful condition, both as to the dogs therein, and the public, at all times, and shall be open to complete inspection by any official of the Village of �.- Lino Lakes, at any time, without prior notice of such inspection. SECTION 7: Whenever a dog kennel is kept in an unsanitary or unhealthful condition (or both), or when the dog or dogs confined in such a dog kennel set up noise or noises from any cause whatsoever, whether in the daytime or nighttime, sufficient in volume to constitute a public or private nuisance, the owner, keeper or harborer of such a kennel, upon proper written notice from the Village Clerk or Constable, shall abate such nuisance, and if not so abated within the time set forth in such notice, shall be subject to all the penalties and provisions in any and all of the ordinances of the Village of Lino Lakes, in addition to the State laws relating to public or private nuisances and their abatement. SECTION The violation of this ordinance shall be a misdemeanor subject to a fine of not more than $100.00 or punishment by imprisonment for not more than 90 days. SECTION 9 Any such annual dog kennel license issued under this Ordinance shall be subject to theprior approval of the Lino Lakes Village Council as to the location thereof within the Village of Lino Lakes, the Village Council hereby reserving the right to, in all cases, refuse to approve issuance of any annual dog kennel license if the proposed location of the kennel shall be one which, in their opinion, they deem injurious to the public health or the public welfare of -- res.donts within the Village of Lino Lakes.
