TOPIC: Consideration of Resolution No. 98-03 authorizing
eminent domain proceedings, Highway 49/23 project
BACKGROUND:
Staff is requesting Council action to authorize the use of eminent domain to
obtain certain property located at the southeast quadrant of the intersection of
Lake Drive and Hodgson Road (refer to attached map). The city attorney and
staff has discussed this issue previously with the Council
The purpose for obtaining the parcels is for economic development purposes.
Staff has been negotiating with the property owner regarding special
assessments to the parcel. The city is requesting to obtain the parcel and
combine it with excess Anoka County right of way for development purposes.
OPTIONS:
1. Approve resolution No. 98-03 authorizing the acquisition of property through
eminent domain proceedings.
2. Retum to staff for further consideration

RESOLUTION AUTHORIZING EMINENT DOMAIN
RESOLUTION NO. 9 R _ n R
WHEREAS, the Lino Lakes Economic Development Authority has determined
that the quadrant of the intersection of Lake Drive and Hodgson Road located
south and easterly of said streets is suitable and desirable for economic
development within the City of Lino Lakes; and
WHEREAS, the City of Lino Lakes in conjunction with the State of
Minnesota and County of Anoka has recently relocated and realigned the
intersection of these two roadways; and
WHEREAS, the relocation of such roadway has caused excess right-of-way
to exist in said quadrant; and
WHEREAS, the County of Anoka which presently has title to said right-of-
way has indicated a willingness to convey same to the City of Lino Lakes; and
WHEREAS, the City deems It necessary in order to make the development of
said quadrant economically feasible it is necessary to combine such excess right-
of-ways with property owned in said quadrant by George Reiling; and
WHEREAS, the City and George Reiling have attempted to negotiate a
purchase of such property but have been unsuccessful; and
WHEREAS, the City has the authority to acquire property for economic
development by eminent domain or otherwise pursuant to Minn. Stat. Chap. 117
and Section 469.101,
NOW, THEREFORE BE IT RESOLVED, that the Lino Lakes Economic
Development Authority hereby authorizes the acquisition of the land located

southerly and easterly of the intersection of Hodgson Road and Lake Drive by
eminent domain or otherwise pursuant to Minn. Stat. Chap. 117 and Section
469.101. The specific legal description of the area shall be determined by a land
survey.
BE IT FURTHER RESOLVED, that attorneys, William G. Hawkins and
Associates, are authorized to file the necessary petition therefore and to pursue
such action to a successful conclusion or until it is abandoned, dismissed or
terminated by the City or the Court.
BE IT FURTHER RESOLVED, that said attorney is authorized to obtain such
survey and title information as is necessary to pursue such action as authorized
herein.
