VILLAGE OF LINO LAKES

STATE OF MINNESOTA
AN ORDINANCE REGULATING THE STORAGE OF INFLAMMABLE LIQUIDS.
The Village Council of the Village of Lino Lakes ordains:
Definitions - The following terms, as used in this
ordinance, shall be defined as follows:
a. "Inflammable liquids" include: Class I, ether, carbon
bisulphide, gasoline, naptha, benzine, benzene, collodion,
hydrocarbon, and liquefied petroleum gas; Glass II, acetone,
alcohol, amyl acetate, toluol; Class III, Kerosene, amyl
alcohol, turpentine, distillate.
b. A "garage" is a building of any sort wherein are housed
for rent, care, demonstration, storage or sale, for private
or public use, one or more vehicles containing in the tank
thereof any inflammable liquid for fuel or power.
c. A "service station" is a place maintained for retailing
inflammable liquids.
d. A "retail storage station" is a place equipped to retail
inflammable liquids in connection with any other line of
merchandise or enterprise.
e. A "general storage station" is any place where inflammable
liquids are stored, and sold in quantities of no less than
thirty (30) gallons.
f. An "approved" device is one held by the fire marshal to be
reasonably safe for use.
Licenses Required. - No person shall transport, have, or keep more
than one gallon of Class I inflammable liquids in any dwelling, six
gallons in any other building or ten gallons outside of any building;
or store or handle more than five gallons of any Class II inflammable
liquids in any dwelling, or ten gallons in any other building, or
twenty-five gallons outside of any building; or handle or store more
than twenty-five gallons of Class III inflammable liquids inside of
any building or fifty gallons outside any building; without first
obtaining a license.
Exception. - The installation and maintenance of oil burning
equipment shall be governed by the regulations specifically provided
therefor elsewhere in this ordinance, and shall not be affected
by any section of this ordinance, except that the license requirement
in the preceding section shall apply so far as applicable by its own
terms.
Issuance of Licenses. - The application for such a license shall be
approved by the Fire Marshal if, upon inspection, he shall determine
that the granting of the license will not endanger public safety from
fire or explosion. The application shall be referred to the Council.
If the Council grants the license the Clerk -Treasurer shall issue a
license to the applicant for the purpose stated in the application, on
payment of the fee.
The annual fees for licenses shall be per fee schedule as
established by resolution, from time to time, by the Village
Council; the fee schedule shall be on file in the office of
the Village Clerk -Treasurer and a copy available to anyone desiring
same. All licenses shall expire at midnight on December 31, of
the year of issuance.
Receptacles. - No person shall sell or cause to be sold, place or
cause to be placed any gasoline or benzine in quantities of more
than one pint in any receptable (other than a tank of the sort
authorized by this ordinance or a tank truck) except one of a
bright red color, tagged and labelled in large plain letters with
the name of the contents, or with the words "Inflammable Liquid,"
nor sell or place any other liquid in any such receptacle.
General Storage. - Except as otherwise provided in this ordinance,
inflammable liquids shall be stored outside of buildings, in
underground or above ground tanks, except that the storage of such
liquids above ground is hereby prohibited within the following limits.
Above Ground Tanks. - No person shall construct or maintain any
above ground tanks except as hereinafter set forth.
a. No tank may be constructed or maintained closer to the line
of adjoining property or to any other tank than shown in the
following table:

b. No above ground tank shall be constructed or maintained closer
to the nearest rail of a railroad or street car track carrying
passenger traffic or any state trunk highway, county road or
village street, than shown in the following table:

c. No such tank may be constructed or maintained within four
Hundred (400) feet of any depot, school, church, place of
detention or other public building or within two hundred (200)
feet of any place of human habitation.
d. All tanks of more than 1,000 gallons capacity shall have
all openings which may contain inflammable vapor provided with
a 40 x 40 mesh, non -corrodible wire screen. A safety valve
must be provided and manhole covers must be kept closed by
weight only.
e. All such tanks must be provided with danger signs painted
conspicuously on their sides bearing the words "Inflammable,
Keep Fire and Lights Away" in letters at least three inches
high.
f. All such tanks shall be protected by an embankment or dike
with a capacity at least one and one-half times the capacity of
the tank and not over four feet high. Such embankment shall be
constructed of earthwork or reinforced concrete without openings
through it. Earthwork dikes shall be compactly built with a
three foot crown and a slope of at least two to one on both sides,
that is, the horizontal leg of the right triangle outlining a
cross section of the dike shall be at least twice as long as the
perpendicular leg thereof. All brush, weeds, and combustible
material must be kept cleared away from the embankment and space
around the tank.
g. All such tanks shall be constructed on a firm foundation and
if of metal shall be electrically grounded. Tanks set more than
one foot above the surface of the ground must have a noncombustible
foundation and supports.
h. The premises upon which such tanks are constructed must be
surrounded by a substantial fence, adequate to keep out all
intruders.
i. All such tanks must be painted with a suitable rust -resisting
paint.
j. All emptying and filling of such tanks shall be by pumpage and
such emptying or filling shall be done only when there is a man
in constant attendance on the pump. The motor and pump must be
located in a separate building at least twenty-six (26) feet from
the tanks, warehouse and garage, or entirely surrounded by fire-
proof wall.
k. All such tanks shall be of material of sufficient thickness
to hold the contents safely, and shall have a factor of safety
at joints of at least 2.5. All riveted points shall have an
efficiency of at least sixty per cent (60%). No verticle tanks
shall exceed thirty (30) feet in height.
Underground Tanks - All underground tanks shall conform to the
following regulations:
a. The top shall be below any piping to which they may be
connected, and at least three feet below the surface of the
ground.
b. When under a building, the top shall be at least two feet
below the lowest floor. The floor above the tank shall be of
reinforced concrete nine inches thick extending twelve inches
beyond the outline of the tank in all directions.
c. No tank may be installed or maintained in any street, alley
or public ground; or under any sidewalk except by ordinance
granting a franshise therefor.
d. Tanks shall be set on a firm foundation and enclosed in
concrete or surrounded with soft earth or sand, well tamped
into place.
e. The storage permitted in underground tanks shall be as follows:
When the top of the tank is lower than all floors, basements,
cellars, or pits of buildings, and all sewers, catch basins
and manholes (1) within a radius of 50 ft. - Unlimited
(2) within a radius of 40 ft. - 50,000 gals.
(3) withio a radi_zs of 30 Et. - 20,000 gals.
(4) within a radius of 25 ft. - 10,000 gals.
(5) within a radius of 20 ft. - 5,000 gals.
(6) within a radius of 10 ft. - 1,500 gals
When such tank is not lower than such basements of other
structures, within a radius of ten feet the storage is hereby
limited to 500 gallons and the tank shall be entirely encased
:tn six inches of concrete.
Service Stations. - All Service Stations shall be installed,
conducted and maintained in accordance with the following rules:
a. All tanks used for storage of inflammable liquids shall be
underground tanks installed as provided in the preceding section.
b. Delivery of inflammable liquids of Classes I and II from
tank wagons or tank cars shall be made direct to the storage
tank through the filling pipe from the receptacle from which
the liquid is being drawn. No tank wagon may make such delivery
with its engine or motor running.
c. Delivery of inflammable liquids from the storage tank shall
be made through pumps, which are mechanically perfect and so
constructed as to prevent leaking or splashing. At the completion
of each delivery the discharge hose must be completely emptied
or hung up so that no liquids may run therefrom. When the service
station is closed, each pump shall be so locked as to prevent the
drawing of liquids therefrom.
d. Buildings used as service stations shall be fireproof and shall
be heated by steam or hot water. The heating plant shall be in a
fireproof room with no opening except an outside entrance. This
paragraph shall not apply to buildings now being used as service
stations, except that no stoves will be permitted under any circum-
stances.
e. No service station may be located within four hundred feet
(400) of any public building.
f. No inflammable liquids may be kept in or dispensed from said
buildings in open containers and no light or flame shall be
permitted within any such premises.
g. No person at any service station shall dispense any inflammable
liquids to a motor vehicle while the motor of said vehicle is
running.
h. The maximum amount of storage of inflammable liquids permitted
in any service station is 10,000 gallons.
Garages. - The storage of inflammable liquids in and near garages for
use therein or to be dispensed therefrom shall conform to the following
rules, as well as those in preceding sections:
a. All garages shall be equipped with sand traps and grease traps
which shall be cleaned often enough to keep any sand or inflammable
liquid or grease from entering the sewers.
b. No garage shall ever be kept or allowed within fifty feet of
any building or place used for a school, hotel, or public building
used as a place of assemblage or detention.
Miscellaneous. - a. No person except by express direction of
a municipal officer in an emergency shall place or allow to be
placed in any sewer, any inflammable liquid.
b. No person may smoke or strike any match or cause any spark
within fifty feet of any place where inflammable liquids are
being dispensed or used in open containers, or stored or kept
for sale; nor shall any stove or open flame be permitted in any
such room or place.
c. No person shall use Class I or Class II inflammable liquids
in starting or feeding any fire except in heating devices designed
to use such liquids as fuel.
d. Fuel supply of inflammable liquids to stationary internal
combustion engines shall be by pumpage from tanks, and not by
any system of gravity -flow.
e. Whenever any inflammable liquid shall have escaped from any
tank, by leakage or overflow or in any other manner, it shall be
the duty of the owner and of the occupant and of the person in
charge of the premises to notify the fire marshal and the chief
of the fire department at once of such fact, in order that pre-
caution may be taken to minimize the resulting fire hazard.
Inspection. - The Fire Marshal shall inspect all installations of tanks
and other equipment designed to handle inflammable liquids before the
same are placed in operation and no person shall use any installation
or cover or cause any such installation to be covered from view before
the same has been inspected. The Fire Marshal shall also make a
monthly inspection of all premises which are under permit to store,
dispense, or use inflammable liquids, and require compliance with the
terms of this article by written orders which shall state the time in
each case within which such compliance must be made.
Time for Compliance. - All installations which do not conform to the
requirements of this article shall be made to do so within ninety (90)
days after this ordinance becomes effective. The Fire Marshal shall
report to the Council at the end of such ninety (90) day period all
persons who have failed to comply herewith and the location of said
non -complying installations and the Council will take such steps as
seem necessary to secure compliance herewith.
Sale and Storage of Gasoline: General. - No person shall sell, offer
for sale, deal in, keep, or handle any motor gasoline, kerosene,
furnace oil, or lubricating oil as defined in the 1929 Session Laws
of Minnesota, Chapter 425, as amended or as same may be amended or
replaced from time to tirne, contrary to the provisions of said Chapter.
Violations - Penalties. - Any person, firm or corporation violating
any of the provisions of this ordinance shall be guilty of a misdemeanor,
and upon conviction thereof shall be fined in an amount not to exceed
$300.00 or imprisoned for not to exceed 90 days, or both. Each day
that any violation is continued shall constitute a separate offense and
punishable as such.
Effective Date. - This ordinance shall take effect upon its passage
and publication according to law.
