HomeMy WebLinkAbout1971-043A Council OrdinancesORDINANCE NO. 43 A VILLAGE OF LINO LAKES ANOKA COUNTY, MINNESOTA AN ORDINANCE RELATING TO AND ESTABLISHING CONDITIONS OF EMPLOYMENT FOR EMPLOYEES OF THE VILLAGE OF LINO LAKES, AND REPEALING ORDINANCE NO. 43, PASSED BY THE VILLAGE COUNCIL OF LINO LAKES ON JANUARY 23, 1967. THE COUNCIL OF THE VILLAGE OF LINO LAKES, ANOKA COUNTY, MINNESOTA, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. All persons employed by the Village of Lino Lakes shall be employed subject to the provisions of this Ordinance and shall receive emoluments, benefits and privileges herein set forth. Section 2. The Council shall classify all positions of Village employment and shall specify those which are supervisory, salaried or hourly, such classification shall be made by council resolution. Section 3. Definitions. (A) "Permanent Full -Time Employee" shall mean an employee who has completed his probationary period and who serves in a position which is provided for in the budget on a permanent basis. (B) "Permanent Part -Time Employee" shall mean an employee who has successfully completed the required probationary period and is employed on a schedule of less than 40 hours per week. (C) "Temporary Employee" shall mean an employee who has not acquired the status of a permanent full-time employee or a permanent part-time employee, and shall include any per- son who is engaged inpart-time, seasonal or casual employ- ment and who is compensated on an hourly/monthly basis. (D) "Benefits" shall mean privileges granted to employees in- cluding vacation leave, sick leave, holiday leave, military leave and any other benefits approved by the Council. (E) "Fiscal Year" shall be January 1 through December 31 inclusive. -225- (F) "Related Employee" shall mean the following kin of either the employee or employee's spouse: children, mother, father, brother, sister, grandparents or first cousins. Section 4. Work Week. The regular workweek shall consist of forty (40) hours. Overtime to be used as time off at the rate of 12 hours for each hour worked, to be limited to accu mulated time of ten (10) days to be taken with approval of the Council. If the employee works on a Holiday, he shall have two(2) hours off as compensatory time for each hour worked. Section 5. Vacation Time. Permanent employees shall be en- titled to five (5) days vacation after one (1) year of service; ten (10) days after two (2) years of service. After five (5) years of service the employee shall be given one (1) additional day of vacation per year worked; this to be continued through the tenth (l0th) year of service. Vacations are to be taken in the year following anniversay or employment and each year there- after. Vacations must be arranged for at least thirty (30) days in advance and be approved by the Council. Section 6. Waiver and Accumulation of Vacation Leave. Vacation leave is intended as a period of rest and relaxation and may not be waived by an employee for the purpose of receiving double pay. No employee shall be permitted to accumulate vacation time from one year to the next, except that the Village Council may approve an accumulation of all or part of the previous year's vacation if, in their opinion, unusual circumstances exist. Section 7. Sick Leave. A permanent full-time employee shall be given five (5) days sick leave per year, non -accumulative, to be reviewed periodically. Section 8. Holidays. A permanent employee shall be paid for six (6) holidays as follows: 1. New Year's Day --January 1 2. Memorial Day --The last Monday in May 3. Independence Day -- July 4. 4. Labor Day --The first Monday in September 5. Thanksgiving Day --The fourth Thursday in November 6. Christmas Day --December 25. When New Year's Day, Independence Day or Christmas Day fall on a Sunday, the following day shall be a holiday. When these holidays fall on a Saturday, the preceding day shall be a holiday. In order to be eligible for paid holidays, employees must work the last work- ingday before and the first working day after such holidays, unless onvacation, on leave or otherwise excused. -226- Section 9. Hospitalization and Life Insurance. A permanent full- . time employee shall carry his own private insurance to which the Village will contribute a sum of Fifteen ($15.00) dollars per month or 50% of premium, whichever is less, upon proof of payment of premium. Section 10. Review. Any person who has been in the employ of the Village for a period of six (6) months shall be subject to review by the Village Council. Any employee who has been in the employ of the Village for a period of six (6) months shall not thereafter be discharged without good cause. Whenever such employee is to be discharged from his employment after six (6) months probation for a cause, he shall be suspended until a hearing before the Council. The hearing is to be held within ten (10) days of receipt of written notification; such notification is to be forwarded by United States Registered Mail to the last known address of such employee. Nothing in this section shall be construed to mean that the Council, or any authorized supervisor may not discharge an employee if his job has been abolished. However, an attempt shall be made to relocate such an individual in other employment in the Village if possible. Ten- ure provided by this section shall apply only to full-time jobs in the Village service and shall not apply to part-time or temporary jobs. If, after a hearing, the employee is reinstated, he shall be paid for time loss resulting from suspension. Section 11. Overtime. Temporary full-time or part-time employment in Village services shall be entitled to such pay schedules and such over time rates and other benefits of this Ordinance as the Council shall determine by resolution at the time of employment. All tempor- ary full-time or part-time employees who subsequently become permanent full-time employees shall be given credit for previous time worked in computing vacation time, sick leave time and wage increases. This credit shall apply only as to actual time worked during the prceding twelve (12) months and not to the period of employment preceding full- time status. Section 12. Employees not covered. Nothing in this ordinance per- tains to persons employed by the Village on a fee basis, or to police officers. Section 13. Employees not entitled to benefits. Permanent part- time and temporary full-time employees shall not be paid for sick leave, insurance benefits, vacation leave or holidays. This section shall not apply to administrative help except as it relates to sick leave and insurance benefits. Section 14. Qualifications. Employees shall pass a physical and be in good physical condition. They shall also have a valid Minne- sota driver's license and a valid Minnesota chauffer's license. This section shall not apply to administrative help. -227- Section 15. Title. Permanent full-time men shall each have the title of "Utilities Maintenance Man". Section 16. Retirement funds. All employees shall be enrolled in the Public Employees Retirement Association and Social Secur- ity as required by State Law. Any other benefits for retirement or pension shall be determined by the Council by resolution. Section 17. Repeal of Ordinance No. 43. Ordinance No. 43, of the Village of Lino Lakes, Anoka County, Minnesota, passed by the Village Council on January 23, 1967, is hereby repealed. Section 18. Effective Date. This Ordinance shall take effect and be in force after the date of passage and publication, ac- cording to law. Passed by the Village Council this 24th day of May 1971. ATTEST: h M.
