HomeMy WebLinkAbout1971-057 Council OrdinancesORDINANCE NO. 57 id, VILLAGE OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA AN ORDINANCE ESTABLISHING A COMMISSION ON ENVIRONMENTAL QUALITY. The Village Council of Lino Lakes ordains: Section 1. Establishment: The Lino Lakes Commission on Environmental Quality is hereby established. Section 2. Purpose: The purpose of this ordinance is to establish a commission which will aid and be advisory to the Village Council of the Village of Lino Lakes in its efforts to encourage productive and enjoyable harmony between man and his environment; to promote efforts which will prevent or eliminate damage to the environment and stimulate the health and welfare of man; to enrich the under- standing of the ecological systems and natural resources important to the Village; and to insure a lasting quality of life within the Village of Lino Lakes. Section 3. Definitions: A. "Village". As used in this ordinance, "Village" refers to the Village of Lino Lakes, Minnesota. B. "Commission". As used in this ordinance, "Commission" refers to the Lino Lakes Commission on Environmental Quality. C. "Council" or "Village Council". As used in this ordinance, "Council" or "Village Council" refers to the Village Council of the Village of Lino Lakes, Minnesota. Section 4. Short Title: The commission created and established by this ordinance may be referred to as the Lino Lakes Commission on Environmental Quality. Section 5. Composition: The Commission shall consist of five members. Each member of the Commission shall be a resident of the Village of Lino Lakes. Section 6. Appointment and Compensation of Members: The members of the Commission shall be appointed by a majority of the Council and shall serve without compensation. -283 Section 7. Terms of Office: The members of the Commission shall be appointed for terms of two years. The Commission shall have five members whose terms shall expire at the next even numbered year ending after their appointment and four members whose terms shall expire at the next odd numbered year after their appointment. Section 8. Vacancies: Vacancies occurring on the Commission shall be filled for the unexpired term by an appointment by a majority of the Council. Section 9. Removal of Members: The Council, by a unanimous vote of all its members shall have the authority to remove any member of the Commission from office whenever, in its discretion, the best interests of the Village shall be served thereby. Section 10. Officers: The officers of the Commission may include a chairman, vice chairman, secretary and such other officers as the Commission may deem necessary. An election of officers by the members of the Commission from their membership shall be held at the first meeting after establishment of the Commission and thereafter at the first meeting of each year thereafter. Section 11. Duties of Officers: A. Chairman. It shall be the duty of the chairman to preside over all meetings of the Commission. In his absence, the vice chairman may preside or a chairman pro tempore may be selected to preside. B. It shall be the duty of the secretary to keep a record of all proceedings of the Commission, transmit its recommen- dations to the Council and any other commissions or bodies and perform such other duties as directed by the Commission. Section 12. Rules and Procedures: The Commission shall adopt a set of rules to govern its own meetings and proceedings. The rules may be amended from time to time, but only upon notice to all members that the said proposed amendment shall be acted upon at a specified meeting. A majority vote of the Commission shall be required for the approval of the proposed amendment. Section 13. Meetings: A. Regular Meetings. The Commission shall meet in regular session at least once a month at a time and place selected by a majority of its members. - 284 - B. Special Meetings. The chairman or any three members of the Commission shall have the authority to call special meetings of the Commission. Written notice of a special meeting shall be given to all members at least 24 hours prior to the time of the meeting, unless the time and place of the special meeting is set at a regular or regular adjourned meeting. C. Open Meetings. All meetings of the Commission shall be open to the public. Section 14. Powers and Duties of the Commission: The Commission shall have advisory powers and shall be subordinate to the Village Council. Any powers other than advisory powers shall be only as directed by the Council. The following advisory powers shall become the duty of the Commission: A. To gather information concerning the conditions and trends in the quality of the environment, both current and prospective, with the purpose of determining whether such conditions and trends are interfering or are likely to interfere with the goals of the Village as established by the purpose of this ordinance, and report to the Council. B. To develop and recommend to the Council policies to foster and promote the improvement of environmental quality, and meet the conservation, social, economic, health, and other requirements and goals. C. To make studies, surveys, investigations, research, and analysis relating to ecological systems and environmental quality and report its findings to the Council. D. To document and define changes in the natural environment, including the plant and animal systems, and to accumulate necessary data and other information for a continuing analysis of these changes or trends and an interpretation of their underlying causes, and report any such findings to the Council. E. To report not less than once each year to the Council on the state and condition of the environment in the Village, and to report on the work of the Commission. F. To make and furnish such studies or reports thereon, and recommendations with respect to matters of policy and legislation as the Council may request. - 285 - Section 15. Village Officials to Cooperate: All Village officials, department heads, employees and appointees are requested to cooperate with the Commission and render all reasonable assistance. Section 16. L'Allier, Mayor of Lino Lakes,' Minnesota Attached is a draft of an ordinance entitled "An Ordinance Establishing a Commission on Environmental Quality." It is my intention to have this ordinance introduced at our next regular meeting on July 26, 1971. I think it is extremely important that this ordinance be adopted. We find too often in recent years that people have paid only lip service in their desires to protect the ecological systems and natural resources. Adoption of this ordinance would, hopefully, enable us to practice what we preach and make our village a better place in which to live.
