CITY OF LINO LAKES
COUNTY OF ANOKA
STATE OF MINNESOTA
AN ORDINANCE REGULATING THE USE OF PUBLIC PARKS AND PUBLIC
GROUNDS IN THE CITY OF LINO LAKES, ANOKA COUNTY, MINNESOTA;
PROVIDING FOR ENFORCEMENT AND PRESCRIBING PENALTIES FOR THE
VIOLATION OF ITS PROVISIONS.
The City Council of the City of Lino Lakes, Anoka County,
Minnesota, does ordain as follows:
SECTION 1. DEFINITIONS.
1. Public Parks and Public Grounds, when used herein,
shall mean any real property owned or leased by the City of
Lino Lakes.
2. City, shall mean the City of Lino Lakes, Anoka County,
Minnesota.
3. Vehicle, shall mean any vehicle conveyance, whether
motor powered, animal drawn, or self-propelled. The term shall
include any trailer in tow of any size, kind or description.
Exception is made for baby carriages and vehicles in the service
of the City.
SECTION 2. REMOVING, DEFACING OR DESTROYING PROPERTY
PROHIBITED.
No person shall remove, deface, destroy, diminish or
impair the value of public property located on or within any
Public Park or Public Grounds located in the City, including
buildings, structures, trees, shrubs, grass, vegetation, signs,
tables, benches, fireplaces, trash receptacles, notices or plac-
ards, boundary markers or fences, or any other public property
either real or personal.
SECTION 3. ERECTION OF STRUCTURES.
No person shall construct or erect any tent, building or
structure of any kind, whether permanent or temporary in character,
or run or string any public service utility into, upon or across
any Public Park or Public Grounds, except with a special written
permit issued by the City Clerk -Treasurer, after prior City Council
approval.
SECTION 4. LITTERING.
No person shall litter or cast or allow to remain any
rubbish or trash of any kind or nature in or about any City Public
Park or Public Grounds.
SECTION 5. ALCOHOLIC BEVERAGES.
No person shall possess, display, consume or use intoxi-
cating liquor on any City Public Park or Public Grounds. No
person shall possess, display, consume or use non -intoxicating
malt liquor in any City Park or Public Grounds except in desig-
nated picnic areas approved by the City Council.
SECTION 6. VEHICLE TRAFFIC.
Vehicles shall be driven or parked only in designated
areas on any City Public Park of Public Grounds and shall be
driven therein at a maximum speed of 5 miles per hour.
SECTION 7. PUBLIC PARK AND PUBLIC GROUNDS HOURS.
No person, except authorized City personnel shall enter
or be in or remain in any City Public Park or Public Grounds
between the hours of 10:00 P.M. and 7:00 A.M., except by special
written consent of the City Clerk -Treasurer, after prior City
Council approval.
SECTION 8. OVERNIGHT PARKING OR OCCUPANCY.
Overnight parking or occupancy within any City Public
Park or Public Grounds is prohibited.
SECTION 9. OPEN FIRES PROHIBITED.
No person shall build a fire in any place in any City
Public Park or Public Grounds, at any time, except in fire-
places or receptacles provided therein by the City.
SECTION 10. WASHING OF VEHICLES.
No person shall wash any vehicle on any City Public Park
or Public Grounds.
SECTION 11. DISCHARGE OF FIREARMS.
No person, except law officers in the discharge of their
duties, shall discharge any firearms on any City Park or City
Grounds, at any time. "Firearm" shall include b-b guns, sling
shots, air rifles and bows and arrows and any variation thereof.
SECTION 12. SALE OF ARTICLES.
No person shall sell any articles or solicit for the sale
thereof, on any City Public Park or Public Grounds.
SECTION 13. POSTING SIGNS AND PLACARDS.
No person shall paste, glue, tack or otherwise post any
sign, placard, advertisement or inscription, whatsoever the same
may be, on any City Public Park or Public Grounds, without the
prior written permission of the City Clerk -Treasurer, after
prior approval of the City Council.
SECTION 14. RIDING OF HORSES AND OTHER ANIMALS.
No person shall ride a horse or any other animal on any
City Public Park or Public Grounds except on designated trails
or paths.
SECTION 15. UNATTENDED ANIMALS.
No person shall allow any animal, of any sort, to go
unattended or without physical restraint in any City Public Park
or Public Grounds.
SECTION 16. BOISTEROUS, PROFANE OR INDECENT LANGUAGE,
CONDUCT AND ATTIRE.
No person shall emit or use abusive, boisterous, profane
or indecent language, engage in such conduct as listed in this
Section, wear any attire as listed in this Section, or place or
carry any placards or signs as listed in this Section in any City
Public Park or Public Grounds.
SECTION 17. CLIMBING OF TREES AND ON BUILDINGS.
No person shall climb any trees or climb on any building
or structure in any City Public Park or Public Grounds.
SECTION 18. POSTING OF AREAS.
The City Council of the City of Lino Lakes, shall have
the authority to determine, from time to time, the areas of any
City Public Park and Public Grounds, in which other activities
and conduct not amenable to efficient operation of such Park or
Public Grounds, shall be prohibited, and shall post appropriate
signs to notify persons thereof.
SECTION 19. DRUNKEDNESS.
No person shall enter or be upon any City Public Park or
Public Grounds while under the influence of any intoxicating
liquor or 3.2 beer or malt liquor.
SECTION 20. FIREWORKS.
No person shall possess or discharge any fireworks in any
City Public Park or Public Grounds, without the written consent
of the City Clerk -Treasurer after the prior approval of the City
Council.
SECTION 21. VARIANCES.
Variances to the strict application of this Ordinance
may be granted only by the City Council and only in unusual cir-
cumstances. Nothing herein shall prohibit the normal care,
operation or functions of the City or its authorized agents in
or on any City Public Park or Public Grounds.
SECTION 22. PENALTIES FOR VIOLATION.
Any person violating this Ordinance, or any provision
thereof, shall be guilty of a misdemeanor and shall, upon con-
viction thereof, be subject to a fine of not in excess of $300.00
or to imprisonment for 90 days or both.
SECTION 23. EFFECTIVE DATE.
This Ordinance shall be in full force and effect upon and
after its passage and publication according to law.
Passed by the City Council of the City of Lino Lakes, Anoka
County, Minnesota, this 13th day of May , 1974.
