CITY OF LINO LAKES
COUNTY OF ANOKA
STATE OF MINNESOTA
AN ORDINANCE ESTABLISHING A POLICE DEPARTMENT, IN THE CITY OF' LINO LAKES,
ANOKA COUNTY, MINNESOTA.
The City Council of the City of Lino Lakes, Anoka County, Minnesota,
does ordain as follows:
SECTION 1. There is hereby created a department of this City which
snail hereafter be known as the Lino Lakes Police Department.
SECTION 2. It shall be the responsibility of the Lino Lakes
Police Department to preserve peasie and public order, prevent and detect
crime, and enforce laws and Ordinances of the State of Minnesota, County of
Anoka and City of Lino Lakes, within Lino Lakes City, and as authorized by
the City Council.
T.a? ".SECTION 3. The Lino Lakes Police Department shall be directed and
supervised by a Chief of Police. The members of the Lino Lakes Police Depar-
tment shall consist of the Chief of Police and such other police officers as
the City Council shall hire.
SECTION 4. The members of the Lino Lakes Police Department shall
be peace officers, and shall be the only persons who shall receive compen-
sation from the City for their services as such peach officers.
SECTION 5. The Members of the Lino Lakes Police Department shall
he hired by the City Council, and shall be subject to removal by the City
Council at any time, but after any person has been a member' c f' the f ino_ Lakes
Police Department for more than 6 months, he may demand written charges and
a public hearing on such charges before the City Council prior to the date
when his final removal takes effect. Such hearing must be held within 10
Ways. The decision of the City Council may suspend such person without pay
and may designate some person to perform his duties during such suspension.
If suspension is found unjustified full restitution with pay shall be made.
SECTION 6. The Chief of Police shall be responsible to the City
Council and shall make complete reports on the operation of the Lino Lakes
Police Department to the City Council as requested by the City Council.
Other members of the Lino Lakes Police Department shall be' resprxtii$te• arfd•
aeceu stable to the -C i3 ef'of Police, who dha11 be responsible for the proper
training and disciplice of such other members. The Police Chief may suspend,
without pay, any member of the Lino Lakes Police Department for refusal or
neglect to obey orders pending final action on discharge or retention of
such member by the City Council, by resolution.
SECTION-7. Said tdmbers of the Lino Lakes Police Department shall
receive such salaries as shall be fixed by the City Council, by resolution
and dates of payment therof shall also be set by the City Council.
SECTION 8. WORK WEEK. The regular work week shall consist of
forty (40) hours. Overtime to be used as -time off at the rate of 11 hours
for each hour worked, to be limited to accumulated time of ten (10) days to
be taken with approval of the City Council.
SECTION 9. VACATION TIME. Full time Police Officers shall be
entitled to five (5) days vacation after one (1) year of service; ten (10)
Cava after two (2) years of service. After five(5) years of service the
Officer shall be given one (1) additional day of vacation per year worked;
this to be continued through the tenth (loth) year of service. Vacations are
to be taken in the year following anniversary of employment and each year
thereafter. Vacations must be arranged for at least thirty (30) days in
advance and be approved by the City Council.
SECTION 10. SICK LEAVE. A full-time Police Officer shall be given
five (5) days sick leave per year, non -accumulative, to be reviewed
periodically.
SECTION 11. HOLIDAYS. A full-time Police Officer shall be paid
for six (6) holidays as follows:
1. New Year's Day -- January 1
2. Memorial Day -- The last Monday in May
3. Independence Day -- July 4
4. Labor Day -- The first Monday in September
5. Thanksgiving Day -- The fourth Thursday in November
6. Christmas Day -- December 25
If a Police Officer is scheduled to work on a holiday, he or
she will be paid an additional days pay.
SECTION 12. HOSPITALIZATION AND LIFE INSURANCE. A full-time
Police Officer shall carry his own private insurance to which the City will
contribute a sume of Twenty-five $25.00) dollars per month or 50% of premium,
whichever is less, upon proof of payment of premium.
SECTION 13. DEFINITIONS.
(A) "Permanent Full -Time Police Officer" shall mean an officer
who has completed his probationary period and who serves in
a position which is provided for in the budget on a permanent
basis.
(B) "Permanent Part -Time Police Officer" shall mean an officer
who has successfully completed the required probationary
period and is employed on a schedule of less than 40 hours
per week.
That the period of time which a person has spent under this Section
shall be considered toward and as a part of the probationary period for
consideration under Section 14 herein, and otherwise herein, so that once a
person has worked, under this Section, for more than 6 months he shall be
considered as having worked his full 6 months probationary period under this
ordinance.
SECTION 14. REVIEW. Any Police Officer who has been in the em-
ploy of the City fdr a period of six (6) months shall be subject to review
by the City Council. Any police officer who has been in the employ of the
City for a period of six months shall not thereafter be discharged without
good cause. Whenever such Police Officer is to be discharged from his
employment after six (6) months probation for a cause, he shall be suspend-
ed until a hearing before the Council. The hearing is to be held within ieri
days of receipt of written notification; such notification is to beforwarded
by United States Registered Mail to the last known address of such Police
Officer. Nothing in this section shall be construed to mean that the Council
or Police Chief may not discharge an officer if his job has been abolished.
However, an attempt shall be made to relocate such an officer in other
employment in th €ity if possible. Tenure provided by this section shall
apply only to full-time officers in the City service and shall not apply to
part-time officers. If, after a hearing, the officer is reinstated, he shall
be paid for time lops resulting from suspension.
SECTION 15. RETIREMENT FUNDS. All Police Officers shall be
enrolled in the Public Employees Retirement Association and Social Security
as required by State Law. Any other benefits for retirement or pension shall
be determined by the Council resolution.
' SECTION 16. Members of the Lino Lakes Police Department, other
than the Police Chief, may be given a rank or designation in the order of
Captain, Lieutenant, Sergeant, Corporal. and Patrolman. The order of Command
shall flow from the Police Chief downward in such order as listed, each
member being responsible to his superior officer. Such ranks and the rules
of qualification for any of such positions Mall be as established by the
City Council.
SECTION 17. The Lino Lakes Police Department shall keep a daily
record of all such Police Department activity within the City of Lino Lakes,
as prescribed by the City Council, which record shall be open to the members
of the City Council, City Clerk, and City Attorney, only.
SECTION 18. A badge, complete uniform and such other insignia or
evidence of identification and equipment, including firearms, as the Police
Chief may prescribe and authorize, shall be issued to the members of the
Lino Lakes Police Department, with approval of the City Council and at the
e,:pense of the City of Lino Lakes. All such City property issued to any
sach member shall be returned, in good condition, to the City, forthwith,
upon termination of employment and each such member shall be responsible for
and liable for each such item and the proper care thereof while same is in his
possession.
SECTION 19. No person not a valid member of the Lino Lakes Police
8apartment shall:
1. Wear, carry or display an identification card, badge, cap, or
insignia or uniform of the Lino Lakes Police Department or
hold any item out to be such.
2. In any manner represent himself to be connected with the Lino
Lakes Police Department.
SECTION 20. The badge and cap assigned may be worn only while a
member of the Lino Lakes Police Department is on actual duty as assigned.
SECTION 21. Whoever in any manner violates or fails to comply with
any of the terms of this Ordinance shall be punished by a fine of not more
than $300.00 or be imprisioned for not more than 90 days, or both, together
with the costs of presecution in either case.
SECTION 22. If any section, subsection, sentence, clause or
phrase of this Ordinance is, for any reason, held to be invalid, such
decision shall not affect the validity of the remaining portions of the Ordinance.
SECTION 23. Changes and Revisions of this Ordinance can be done
by Council REsolution.
SECTION 24. This Ordinance shall be effective upon adoption and
publication as provided by law.
